    This paper uses Stoic theory of language to gain more insight into Roman lawyer Proculus’s legal opinions on the meaning and understanding of ambiguous testaments, wills and dowries. After summarizing Stoic theory of language, the paper discusses its reception in Roman jurisprudence and situates Proculus in a Stoic legal/philosophical context. The meat of the article lies in the re-examination of Proculus’s legal opinions on ambiguities in light of Stoic theory of language, through: (1) the analysis of a case demonstrating that Proculus’s embeddedness in Stoic doctrine went beyond his technical competence in propositional syllogisms, going into the territory of Stoic physical materialism and, (2) the investigation of four cases that reveal how his approach to problems of ambiguity in unilateral legal acts converges with the Stoic conception of the parallelism between speech and thought.

    The Dutch approach of religious matters is still characterized by an approach that fits in the 19th century, not in the 21st. This approach considers religion as a private matter without taking into account the cultural dimension of religion. Such an approach is not keeping the pace of the development of religion in a post-secular world and it loses sight of the modern debate on religion elsewhere in Europe. In particular it tends to ignore the cultural value of Christianity by pointing at the deconfessionalization. The article focuses on the role the Christian narrative has in making visible the issue of power.

    Politics and law are not in essence about knowledge, good sense and learning, but about wisdom. Good legislation requires wisdom and the wise judge is also the ideal when it comes to good adjudication. But what is wisdom actually and who is the sage? To answer these questions, this article departs from the views of the Stoa (of Seneca especially) which has been of fundamental significance for the development of law and which still continues to influence it. It shows how the philosophical views of the Stoics included an objective view of law and cultivated a subjective impassibility and apathy that were associated with steadfastness or constancy. Stoic wisdom was (and still is): virtuous obedience to the objective laws of nature. In modern Stoics like Spinoza and Justus Lipsius we find these same elements. But in modern times Stoicism is wrapped in the veil of a Christian vision of life, which (as such) serves as a seductive legitimation of its principles. In this guise Stoicism has been of enormous significance in the history of Christianity. However, their historical relationship is based on a major misunderstanding. In fact, Stoicism is Christianity’s most extreme alternative, as Erasmus already pointed out. For the Stoic sage a theoretical and practical wisdom applies that is not (in any way) in accordance with the courageous foolishness of Christianity. It is through the prism of this foolishness that we come to appreciate that the eternal Stoic attitude is odious when it comes to law and politics. Stoicism is a recurring crisis phenomenon: a cultural sickness, for which the wisdom of Christianity still offers a very effective medicine.

    This paper discusses three approaches that can be helpful in the area of comparative rights jurisprudence, oriented in reference to three different kinds of studies that are possible in that area. To a large extent the methods for a comparative legal research depend on the research question and the goal of the researcher. First, a comparative law study may focus on the sociocultural context that led to the elaboration of differences or similarities in the protection of rights. Second, a comparative law approach can be a normative enterprise. It can focus on engaging in a philosophical analysis enlightened by the differences or similarities in the regulation of rights, in order to propose concrete solutions for the regulation of a right. Third, a comparative law approach can combine both elements of the two previously mentioned approaches. The paper discusses the challenges that the researcher faces in her attempt to use these methodologies and how these challenges can be overcome. The law as a normative discipline has its own constraints of justifiability. If what motivates a comparative law study is the search for principles of justice the researcher needs to persuade that her methodological approach serves her aim.

    De aansprakelijkheidsregeling voor gebruikers van ongeschikte medische hulpzaken volgens artikel 6:77 BW heeft geleid tot rechtsonzekerheid en discussie. Om nieuwe inzichten te verkrijgen is het interessant om een rechtsvergelijking te maken met twee nabijgelegen landen die voor wat betreft het rechtssysteem en de juridisch-culturele ontwikkeling op Nederland lijken. In deze bijdrage is daarom onderzocht wie in Frankrijk en Duitsland door patiënten kunnen worden aangesproken, wat daar de tendensen in zijn en op welke manier het Nederlandse recht daar inspiratie aan kan ontlenen.

    The American Legal Realism movement, which originated in the beginning of the twentieth century and was active until the Fifties, can be seen as one of the founders of current Empirical Legal Studies because of the importance it attached to social scientific knowledge on behavior of – for instance – judges and others involved in the judiciary. The author sketches several characteristics of Legal Realism at that time. Exploring their range of thought he also examines whether Legal Realism’s studies can be seen as a research program. The recent emergence of New Legal Realism in the US and elsewhere leads to the question what characterizes this (re)new(al) movement. Finally it is argued that American Legal Realism especially contributed to scientific progress by posing new questions, changing focus and by stressing the importance of empirical evidence.

    In a neoliberal age governments, NGOs, food producers and retailers all state that the food system can be governed via consumer choice aka voting with your fork. This makes the retail food label an important space for contests between different actors who each seek to govern the food system according to their own interests and priorities. The paper argues that this makes it crucial to ‘backwards map’ the regulatory governance networks behind the governance claims staked on food labels. The paper uses the example of the contested meaning of ‘free-range’ claims on animal products in Australia to propose and illustrate a methodology for this backwards mapping.

    This paper explores the hypothesis that the process of rupture in Brazilian graffiti writer’s subculture resulting in different groups - pichadores, pixadores and grafiteiros - took place in two different, though complementary, stages. The first stage is the commodification of graffiti by successive media campaigns and its penal control by the state. The second stage - which may be considered as a side effect of the first one - consists of the emergence of a new transgressive pixação movement. Instead of merely writing or tagging their signatures and messages on the walls of the city, they claim the freedom of usage of the urban space and contest the importance that property has in the late modernity context.

    The political far right French Vichy-regime or French State (1940-1944) criminalized freemasonry as a dangerous secret society using several state owned measures. In the tradition of the secret Jewish-Masonic conspiracy theory a legal framework was established to criminalize and ban freemasonry, to dissolve the lodges and to remove individual freemasons from command positions. Intellectuals, former freemasons, public and private police and intelligence agencies helped the regime to establish an anti-Masonic documentation, exhibition and movie (Forces occultes) in order to show the French population the danger of freemasonry. A specialized police force (Service des sociétés secrètes) identified 60.000 freemasons, the names of 18.000 were published and 3.000 lost their jobs. 989 were brought to the extermination camps and 545 were shot immediately by private militias.

    In this article I reconstruct the contribution of some central Hellenistic political thinkers to a theory of human rights. Starting point is the traditional Stoic conception of the law of nature as a power in which only perfect human beings actively participate. In the 2nd century BC the Stoic Panaetius adjusted this traditional high-minded theory by also allowing for a lower level of human excellence. This second-rate human excellence can be achieved just by following ‘proper functions’, which are derived from ordinary human nature and can be laid down in rules. From here, it was only a small, yet decisive step – presumably to be attributed to one of Cicero’s teachers – to discard the highest level of human perfection altogether. This step, I argue, paved the way for an understanding of the rules of natural law in terms of human rights.
