    Traditionally, the mayor has an important role as a citizen’s father and as a maintainer of public order. In the context of the so-called ‘undermining’ criminality, the mayor has been increasingly empowered with new legal instruments to combat undermining criminality. Some mayors see themselves as a sheriff. However, in the Dutch Municipal Act, the mayor only has a task of maintaining the public order. How does this task relate to combating undermining criminality? What is the role of the mayor in the combat of undermining criminality? Nowadays, there is no legal basis in the Dutch Municipal Act to equip the mayor with crime-fighting duties. This article proposes to equip the mayor with a legal duty as a crime fighter.

Upperdogs Versus Underdogs

    In the Netherlands, mayors are entitled to close public and non-public premises if drug-related activities are being conducted there. Using data from the case law of Dutch lower courts, published between 2008 and 2016, this article examines the relative success of different types of litigants, and the influence of case characteristics on drug-related closure cases. We build on Galanter’s framework of ‘repeat players’ and ‘one-shotters’, to argue that a mayor is the stronger party and is therefore more likely to win in court. We categorise mayors as ‘upperdogs’, and the opposing litigants as ‘underdogs’. Moreover, we distinguish stronger mayors from weaker ones, based on the population size of their municipality. Similarly, we distinguish the stronger underdogs from the weaker ones. Businesses and organisations are classified as stronger parties, relative to individuals, who are classified as weaker parties. In line with our hypothesis, we find that mayors win in the vast majority of cases. However, contrary to our presumptions, we find that mayors have a significantly lower chance of winning a case if they litigate against weak underdogs. When controlling for particular case characteristics, such as the type of drugs and invoked defences, our findings offer evidence that case characteristics are consequential for the resolution of drug-related closure cases in the Netherlands.

    This contribution reports on a delimited part of a larger, exploratory study, the main question of which was: How do aldermen perceive threats, what are their behavioral intentions and what is the influence of threats on the process and the outcome of decision-making? This question was answered with the help of Q methodology, semi structured interviews and case studies. This article discusses the results of the case studies and semi structured interviews on the impact of threats on decision-making. In two of the investigated cases (N=3) there are indications that the threats affect the decision-making process. The first case involves risk-avoiding behavior. In the second case there is a stronger conviction and hardening of opinions. There are no indications that threats affect the outcome of the decision-making process. The political administrative system that we have in the Netherlands is able to counteract improper influence. This is due to various elements in the system such as the boldness and the results-focused attitude of civil service (case 1) and the mayor and aldermen (case 2 and 3) and the design of the rules and procedures (case 1, 2 and 3).

Toepassing van het Voorontwerp op de Smallsteps-zaak leidt er volgens de auteurs toe dat de ontslagen Estro-werknemers slechter af zijn onder het Voorontwerp. De auteurs benoemen diverse (arbeidsrechtelijke) bezwaren die kleven aan het Voorontwerp en constateren dat het Voorontwerp op diverse plaatsen (mogelijk) in strijd is met Richtlijn 2001/23/EG. De auteurs geven een aantal aanbevelingen om het Voorontwerp vanuit het werknemersperspectief te verbeteren.

    Forensic psychiatric treatment plays a mayor role in keeping society safe. However, the expectations about what can be achieved with forensic treatment do not seem to be realistic. This complicates the chances of a successful re-socialization. It is foreseen that the number of patients will increase significantly in the upcoming years.
    More effective treatment programs and instruments for risk assessment are needed. For this, the causal relationship between psychopathology and delinquency must be better understood. This requires more criminological research.

    Based on a retrospective analysis of six large scale and fatal fires in the Netherlands, an improvement in terms of meeting the needs of victims can be seen. A comparison of the legal settlement of these fires shows mayor differences in the fulfilling of different aspects of social justice that are identified in social psychology. Two victim needs commonly associated with retributive justice – financial compensation and a thorough, neutral investigation into the causes of the disaster – were fulfilled to a higher degree after the most recent fires than after those that occurred decades ago. The legal settlement after the New Year’s fire in Volendam (2001) appears – at least on paper – to have been more just from the victim’s point of view than the ones after the other incidents. Empirical research into the experienced social justice after the New Year’s fire can be valuable to assess the factors that can lead to a just settlement after disasters.

    Several authors fear that the expansion of Dutch mayors’ executive powers in the field of safety and security will harm their position as non-partisan and consensus-oriented leaders. Empirical research into how mayors use their powers, however, is still rare. From a leadership perspective, the current article analyzes how mayors in the region of South East Brabant in Netherlands use their administrative power to close homes involved in drug-related crime. Drawing on Fischer’s framework of discursive practices, we analyze mayors’ considerations in terms of the argumentation they provide for closing homes. Our analysis, which draws on interviews and document analysis, covers 27 cases from the police region of South-East Brabant and includes 120 considerations. Our findings indicate that mayors vindicate home closures mostly through policy-derived technical and situational argumentations. Vindications that aspire a particular societal effect, such as the reduction of criminal activity, or ideological motivations are rarer, which is indicative of a non-decisive leadership style. In addition, mayors mostly respect the local closure policies. As such, they show very little decisive and individualistic leadership. And, to the extent that they deviate from agreed-upon regional policies, their motivation is to be able to take into account unique local circumstances. In the use of their administrative powers mayors, thus, show mostly situational and adaptive leadership, which, rather than as visionaries, positions them as caretakers. The leadership style of Dutch mayor in the use of this administrative power is, thus, much more in accordance with their traditional bridging-and-bonding leadership style than some authors suspect. Some of the limitations of our study are that we have analyzed closure decisions from one region only and that real-life decisions are susceptible to contextual influences. At the same time, our study provides a rare insight into real-world mayoral leadership in the Netherlands in the field of safety and security.

    According to article 13b of the Dutch Drug Act, the mayor is authorized to close homes and buildings in case of violation of this act. The closure of these homes and buildings is considered as an administrative sanction with no punitive aim. However, in certain cases it is possible that the application of this sanction could to be considered as a criminal charge. If so, this might have consequences for a possible criminal prosecution, because of the concept that no legal action can be instituted twice for the same cause (ne bis in idem-principle). This could lead to the situation that the Dutch Public Prosecution Service might lose its right to prosecute. In the combat of ‘undermining criminality’ this would be a major upset.

    The operational leader, the ‘gold commander’, fulfils a crucial function in crisis- and disaster management in the Netherlands. He is held responsible for the total coordination of all collaborating emergency services and supports/advises the Mayor, the Commander in Chief. Unfortunately, this function has never been very effective in practise, as shown by many evaluations. From a scientific point of view, it is easy to understand why the operational leader cannot be effective in the Dutch crisis management organisation. The operational leader has no authorities and has been seated in an emergency operation centre far from the Mayor. This article examines why this issue has not been solved, despite 30 years of studying and adjusting the Dutch crisis management organisation.

    Following a crisis, questions are often raised about how this crisis could have happened and whether someone is to be blamed for the crisis or its bad management. The blame game can become fierce as actors try to avoid, shift or mitigate blame in order to stay in office. In 2014, a festival took place in Haaksbergen where a monster truck drove into the audience, killing three people and injuring many others. Not enough safety measures had been taken to prevent the tragedy. Many actors were to blame for that, including the local authority which had granted the permit. Other actors blamed for the events were the mayor, the monster truck driver, and the organization organizing the festival. In the end, the mayor of Haaksbergen resigned. Instead of becoming more accommodative in his response as his blame levels increased, the mayor continued to be quite defensive, stating that the permit would be granted again – even with today’s knowledge. As one council member stated it, one cannot defend something which cannot be defended.

    The maxim ‘law in books and law in action’ relays an implicit dichotomy, and though the constitutive nature of law is nowadays commonly professed, the reflex remains to use law in books as an autonomous starting point. Law however, it is argued in this article, has a storyline that commences before its institutional formalisation. Law as ‘a continuous process of becoming’ encompasses both law in books and law in action, and law in action encompasses timelines both before and after the formal coming about of law. To fully understand law, it is necessary to understand the entire storyline of law. Qualitative studies in law and society are well equipped to offer valuable insights on the facets of law outside the books. The insights are not additional to doctrinal understanding, but part and parcel of it. To illustrate this, an ethnographic case study of local bylaws regulating an ethnically diverse public space of everyday life is expanded upon. The case study is used to demonstrate the insights qualitative data yields with regard to the dynamics in which law comes about, and how these dynamics continue for law in action after law has made the books. This particular case study moreover exemplifies how law is one of many truths in the context in which it operates, and how formalised law is reflective of the power constellations that have brought it forth.

    Under Article 13b (1) of the Dutch Opium Act, the mayor is authorized to impose an order under administrative coercion when drugs are sold, delivered, supplied or present in houses or premises This much-discussed article, also cited as the ‘Damocles Law’, gives the mayor the power to close drug shelters even before the suspect’s guilt has been established in legal proceedings. It is not necessary to show that the interests of public policy are at stake. Moreover, the means of defense against the closure are very limited. The author argues that the current application of Article 13b is exclusively punitive in nature, whereby in case of criminal prosecution, there is also a violation of the ne bis in idem principle.

    This contribution assesses the consensus-based analysis and reasoning of the European Court of Human Rights in recent judgments concerning equal marriage rights and compares it to the Court’s past jurisprudence on European consensus and the margin of appreciation awarded to Member States regarding the issue of equal marriage rights. The contribution aims to analyse whether there is a parallel to be seen between the rapid global trend of legalisation of same-sex marriage and the development or evolution of the case law of the ECtHR on the same topic. Furthermore, it demonstrates that the Court’s consensus-based analysis is problematic for several reasons and provides possible alternative approaches to the balancing of the Court between, on the one hand, protecting rights of minorities (in this case same-sex couples invoking equal marriage rights) under the European Convention on Human Rights and, on the other hand, maintaining its credibility, authority and legitimacy towards Member States that might disapprove of the evolving case law in the context of same-sex relationships. It also offers insights as to the future of European consensus in the context of equal marriage rights and ends with some concluding remarks.

    The employer had summarily dismissed the director of the company, on the basis that it had the right to protect its reputation and business interests against the criticisms she made in the media. What it failed to take into account was that she was simply responding to earlier criticisms by the employer in the media of her leadership. The expectation that the employee should not respond in the media would overstretch the employees’ duty of loyalty, contrary to Article 10 of the Convention – whereby the right to freedom of expression would protect against unreasonable demands of loyalty by the employer. On the facts, what the employee did was legitimate and within her right to freedom of expression.

Access_open Legal Constraints on the Indeterminate Control of ‘Dangerous’ Sex Offenders in the Community: The Dutch Perspective

    In the Netherlands, the legal possibilities for post-custodial supervision have been extended considerably in recent years. A currently passed law aims to further increase these possibilities specifically for dangerous (sex) offenders. This law consists of three separate parts that may all result in life-long supervision. In the first two parts, the supervision is embedded in the conditional release after either a prison sentence or the safety measure ‘ter beschikking stelling’ (TBS). This paper focuses on the third part of the law, which introduces an independent supervisory safety measure as a preventive continuation of both a prison sentence and the TBS measure. Inevitably, this new independent sanction raises questions about legitimacy and necessity, on which this paper reflects from a human rights perspective. Against the background of the existing Dutch penal law system, the content of the law is thoroughly assessed in view of the legal framework of the Council of Europe and the legal principles of proportionality and less restrictive means. In the end, we conclude that the supervisory safety measure is not legitimate nor necessary (yet). Apart from the current lack of (empirical evidence of) necessity, we state that there is a real possibility of an infringement of Article 5(4) ECHR and Article 7 ECHR, a lack of legitimising supervision ‘gaps’ in the existing penal law system, and finally a lack of clear legal criteria. Regardless of the potential severity of violent (sex) offenses, to simply justify this supervisory safety measure on the basis of ‘better safe than sorry’ is not enough.

    The French state council ruled that the mayor of Villeneuve-Loubet did not have the right to ban burkinis. The court found that the anti-burkini decrees were “a serious and manifestly illegal attack on fundamental freedoms”, including the right to move around in public and the freedom of conscience. The judges stated that local authorities could only restrict individual liberties if there was a “proven risk” to public order. It ruled that a proven public order risk had not been demonstrated.

De burgemeester als crisismanager

Implicaties van de decentralisatie van jeugdzorg voor leiderschapsstijlen tijdens crises

    Dutch mayors are confronted with various crises differing from a deadly incident with a monster truck to societal unrest due to convicted sex offenders returning to local society. This article presents the results of a research about the role of the mayor in so-called ‘youth crises’. The ‘big decentralization operation’ of January 1, 2015 resulted in new tasks and responsibilities for local governments regarding youth care. This research focuses on the implications of this decentralization for the leadership style of the mayor when a youth related crisis causes societal unrest. The way in which mayors deal with such a crisis was studied by means of in-depth interviews and a vignette study before and after the decentralization. This research concludes that the leadership style of the mayor did not change after the decentralization. Mayors consistently show two dominant leadership styles when managing a youth crisis: ‘First Civilian’ and ‘Peer Governor.’ As a ‘First Civilian’ the mayor’s crisis management actions focuses primarily on the community and the affected family. The style ‘Peer Governor’ is all about gathering relevant information and consultation with various partners, such as youth care organizations and aldermen. More interestingly, the results show that decentralization of youth care redefines the relationship between the local alderman responsible for youth care and the mayor as a crisis manager safeguarding local order and public safety. This relationship is currently under construction and could grow either competitive or fruitful.
