De bestuurlijke, strafrechtelijke en integrale aanpak van georganiseerde misdaad maken overuren maakt. Aan actie van de zijde van het huidige kabinet en aandacht in de verkiezingsprogramma’s is op dit terrein geen gebrek. Enorme plannen voor versterking van de aanpak van ondermijning zagen het afgelopen jaar het licht. Maar is de focus goed? De auteurs gaan na wat er kan worden geleerd uit criminologisch onderzoek naar ondermijnende drugscriminaliteit.

In 1981, PROCES published its first article on the criminal justice system in a pluriform or multicultural society. That article turned out to be the first of many articles on so-called cultural offences, like honour related violence and female genital mutilation, and the ways in which the criminal justice system could and should respond to these offences. This article reviews the various articles written on these topics for the past forty years and tries to finds an answer why it was that authors choose PROCES to publish their articles.

In 2012 is de tolkenvergoeding voor zorgaanbieders afgeschaft. Tegelijkertijd wordt er steeds meer verwacht dat zorgverleners en patiënten samen beslissen over medische behandelingen. Dit artikel gaat in op de informatieplicht van de zorgverlener, wanneer er een tolk moet worden ingeschakeld en hoe het afschaffen van de tolkenvergoeding zich verhoudt tot deze informatieplicht.

The aim of the present research was to gain insight into the topic of ‘task-related rule-breaking behavior’ (TRB) among Dutch police officers. TRB is a more refined alternative for the concept of noble cause corruption and has been defined as: police officers breaking rules or formal agreements for the purpose of acting in a manner that contributes to the lawful police task. Qualitative research has been conducted within one of the ten regional police forces in the Netherlands. Results show that TRB appears to be a relatively common phenomenon during policework. Behaviors are categorized in sixteen categories and five overarching outlines. In addition, attention is given to several important factors that could be related to TRB being distinguishable between police officers’ individual responsibility and organizational factors. To handle TRB, it is recommended to pay attention to the police officers’ approach of judging and rationalizing their own behavior, their level of knowledge, and social skills. Furthermore, organizational structure (i.e., spam of control) and police leadership may, among other factors, play an important role in encouraging TRB. Especially the way supervisors deal with police officers’ professional autonomy needs specific attention in order to reduce TRB. Autonomy needs guidance in the form of clear orders followed by feedback and coaching. Also, an active form of ethical leadership is needed. An action framework is presented that could be helpful to supervisors to judge and thereby reduce forms of TRB.

Dat kan op grond van de Wmo 2015. Maar niet iedereen wordt opgevangen en deel van hen die wel opvang krijgt, wordt na verloop van tijd weer uit de opvang gezet. Zonder huis, thuis of dak boven hun hoofd. Toch vinden gemeenten dat deze mensen ‘zelfredzaam’ zijn. In dit artikel gaan wij in op de vraag wat gemeenten op grond van de Wmo 2015 moet doen en hoe de rechtspraak luidt. Of gemeenten buiten de Wmo ook ingevolge internationale verdragen tot een vorm van opvang zijn verplicht, valt buiten het bestek van dit artikel.

To control the COVID-19 outbreak Dutch government opted for a so-called intelligent lockdown. The virus as well as the lockdown caused significant personal and societal damage. It also created, however, a unique natural experiment. How did the forced stay in affect the crime levels? This article presents empirical data on crime trends during the lockdown. Initially, the general crime level decreased sharply. However, the general crime level quickly returned to pre-lockdown levels. Different types of crime displayed divergent trends, e.g. property crimes decreased sharply whereas online crime rates increased considerably. These trends fit rather well with an opportunity theoretical approach regarding crime.

Arbeidsmigratie is in de EU een belangrijk en actueel onderwerp. Enerzijds, omdat steeds meer landen in de EU te kennen geven dat ze voor het op peil houden van het arbeidspotentieel hun toevlucht moeten nemen tot het aantrekken van arbeidsmigranten van buiten de EU. Anderzijds blijkt dat er regelmatig sprake is van uitbuiting van deze arbeidsmigranten. In EU-wetgeving in het algemeen en de regulering van migratie van onderdanen van derde landen (derdelanders) naar de EU in het bijzonder wordt aandacht besteed aan de kwetsbare positie van derdelanders en een eerlijke behandeling. Het doel van migratiewetgeving is echter met name ook het beheersen van migratie, het bestrijden van illegale migratie en het stimuleren van economische ontwikkeling. Deze verschillende doelen kunnen met elkaar botsen. In dit artikel wordt onderzocht wat de invloed is van de EU-migratiewetgeving op de uitbuiting van arbeidsmigranten.

In het kader van ontwrichtende criminaliteit ontstaat steeds meer aandacht voor de gebruikerskant. Zo ook voor de harddrugsgebruiker, die een ontwrichtende invloed op de samenleving heeft. Dit artikel beantwoordt daarom de vraag of strafbaarstelling van harddrugsgebruik legitiem en rechtvaardig is. Teneinde deze vraag te beantwoorden wordt getoetst aan de criteria voor strafbaarstelling en worden de argumenten die ten grondslag liggen aan de strafbaarstelling van de prostituant die misbruik maakt van prostituees die slachtoffer zijn van mensenhandel ter inspiratie gebruikt.

The Financial Action Task Force reported that money launderers may operate in professional money laundering networks. Whether such money laundering networks operate in the Netherlands is unclear. In this article the authors therefore explore whether professional money launderers collaborate in network structures and the business-like manner in which they offer their services. Business-like refers to their involvement in multiple cases, the amount of repeat customers, and excludes family relations. The research is based on Dutch police registrations of 236 professional money launderers. Our results suggest that professional money laundering networks are indeed active in the Netherlands and that money launderers in these networks offer their services in a business-like manner to a varying extent. An important caveat to the current findings is that the criminal cases analyzed predominantly pertain drug-related offenses, leaving the existence and professionalism of money laundering networks in other types of crime, like large-scale fraud, a question open for future research.

The aim of this study was to investigate the scale and network structure of prostitution in the northern provinces of the Netherlands. This study tries to answer three research questions – using a social network analysis – about (1) the size of the prostitution network, (2) the formation of subgroups, and (3) key positions within the networks. The findings show that approximately two thirds of the researched prostitution networks is still unregistered, while there are indications that the outcome of the estimate is in line with the actual situation. Furthermore, results show that prostitutes have a tendency to form subgroups on the basis of the same nationality, which indicates that homophily plays a role in the formation of subgroups. The identification of the actors who occupy key positions in the network were based on the key player problem (KPP). A striking finding was that organizers of prostitution (such as pimps) did not have a central position in the networks. These findings provide insight into the way in which prostitution is registered, and provide points of departure for interventions to disrupt the network or, on the contrary, to strengthen it.

Criminology has traditionally focused on urban areas where crime visibly concentrates. However, since the 1990s, attention for ‘rural criminology’ has steadily increased. First, rural areas are confronted with partly different and less visible crime problems, such as environmental crimes. Second, public actors such as enforcement and other agencies are less present and ‘available’ in rural areas, and people on average trust the government less to provide support when necessary. This chronicle presents an overview of international and Dutch research in the context of rural criminology. The paper addresses cultural differences between urban and rural areas, high-volume crimes, gender-related violence, alcohol and drug abuse, environmental crime, and enforcement in rural areas.

This article seeks to provide an introduction to art theft today. It is divided into sections that look at the context in which art is stolen, definitions of key terms, an explanation as to why the field is understudied and under-reported, and a brief history of the phenomenon. It also contains sidelines on actual developments like the theft of a Van Gogh painting from the Singer Laren Museum in the Netherlands as well as on the drop of art theft since the start of the Corona pandemic.

The focus of this article is on the role that football agents play in the world of professional football. Their role has also been associated with criminal activities such as money laundering, tax evasion, corruption and the exploitation of under-age players. The article pays attention to recent developments in the world of football and the shady business practices in relation to the transfer of football players. Moreover, the article addresses the self-image of football agents and raises the question whether they should take more responsibility themselves in containing fraud and money laundering in the world of football.

Internationally the term ‘violence against women’ has been coined. In the Netherlands is referred to ‘violence in relations of dependency’. GREVIO has critiqued Dutch government for their ‘gender neutral’ approach towards intimate violence, amongst other things by using the term ‘violence in relations of dependency’ instead of ‘violence against women’. This contribution offers a critical analysis of GREVIO’s point of view regarding Dutch policies on domestic violence.

Two major shifts in the Dutch policy have changed how social professionals work for migrants. These two refer to the change from a multicultural in an assimilation policy and a participative society where people are more dependent on their network or resilience for dealing with their needs. Based on our exploratory interviews with eight professionals and a focus group of six participants with a non-western cultural background we conclude that what migrants expect from social professionals and what they can offer do not match. It is due to contrasting views and cultural differences. This has a negative impact on their participation.

This article is a summary of the recently published study of Defence for Children - ECPAT: Sentencing of Sexual Exploitation of Minors: an analysis. The aim of the research was to provide insight into the penalties imposed in 2015-2019 in cases involving the sexual exploitation (human trafficking) of child victims. Another aim was to gain a better understanding of how the sentence was determined. A total of 145 convictions were analysed. This article first describes (the reason for) the research. Subsequently, the crime of human trafficking is briefly discussed. The findings of the analysis are then presented in a summarized version. Finally, the conclusion and recommendations follow.
