Pro-cycling’s doping pentiti

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2020
Trefwoorden doping, cycling, cultural criminology, crime facilitative system, organisational crime
Auteurs Dr. mr. Roland Moerland en Giulio Soana
SamenvattingAuteursinformatie

Throughout the last decade several cyclists have published memoirs in which they account for their doping use. In previous literature such autobiographical accounts have been characterized as attempts of fallen sports stars to sanitize their spoiled public image. In contrast, the analysis in this article will show that the accounts are of relevance when it comes to understanding the problem of doping in professional cycling. Their accounts break the omertà regarding doping, providing insights about the motivation and opportunity structures behind doping and how such structures are endemic to the system of professional cycling.

De ‘criminele sponsor’ van het lokale amateurvoetbal

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2020
Trefwoorden georganiseerde misdaad, organisatiecriminaliteit, voetbal, witwassen, filantropie
Auteurs Professor Toine Spapens
SamenvattingAuteursinformatie

The social role of criminals in local communities has so far received relatively little systematic academic attention. This applies more specifically to their involvement in philanthropic activities. This paper describes and analyses the role of dubious sponsors particularly in Dutch amateur football. Although it is difficult to estimate the scope of the problem, results indicate that criminal sponsorship is not incidental. It mainly concerns corporate criminals, persons involved in drug crimes and outlaw motorcycle gangs. The main goal is to enhance their public image. In most cases, their involvement in crimes or regulatory offenses is difficult to assess without a doubt, which complicates preventative measures. Our analysis shows several interacting factors which increase clubs’ vulnerability to criminal infiltration: setting overambitious sportive goals; dependence on volunteers and a lack of formal integrity policies and internal compliance mechanisms; financial problems; and external pressures associated with the club’s role as the ‘pride’ of the city, the village or the neighbourhood.

Trefwoorden football agents, fraud, money laundering, regulation, self-image
Auteurs Prof. dr. Hans Nelen
SamenvattingAuteursinformatie

The focus of this article is on the role that football agents play in the world of professional football. Their role has also been associated with criminal activities such as money laundering, tax evasion, corruption and the exploitation of under-age players. The article pays attention to recent developments in the world of football and the shady business practices in relation to the transfer of football players. Moreover, the article addresses the self-image of football agents and raises the question whether they should take more responsibility themselves in containing fraud and money laundering in the world of football.

Tijdschrift PROCES, Aflevering 5 2020
Trefwoorden sport, delinquency, desistance, probation, prison
Auteurs Dr. Lianne Kleijer-Kool, Dr. Jacqueline Bosker en Mr. Moniek Zuurbier
SamenvattingAuteursinformatie

The contribution of sport to reintegrating offenders receives limited attention, both in science and in the practice of probation and the prison system. From the perspective of desistance, this literature study concluded that sport can contribute to the development of individual capital, social capital and an alternative identity. However, the effect of sport is not necessarily positive. There are risks of negative influence or the reinforcement of problem behaviour. In counselling offenders, sport should be combined with other interventions to reduce recidivism. A personalized approach is required, based on the risk-need-responsivity model.

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2020
Trefwoorden defaunation, corona, wildlife trade, excess, ecological interaction
Auteurs Dr. Daan van Uhm
SamenvattingAuteursinformatie

The overexploitation of nature has led to anthropogenic defaunation, which results in complex socioeconomic, political and ecological consequences. Influenced by the economic growth of modernization and the interconnectedness of globalization, zoonotic diseases emerge as incalculable side effects of defaunation. By rejecting anthropocentric worldviews, this article critically examines anthropogenic defaunation and the causes and consequences of the coronavirus pandemic from a green criminological perspective.

Janine Janssen
SamenvattingAuteursinformatie

Little is known about (former) partners of 1%motorcycle club members. Social professionals working with victims of domestic violence in shelters have regular encounters with these mostly female (ex-)partners. In this exploratory contribution we wonder what is known about domestic violence amongst people with (ex-)partners of 1%motorcycle club members and the consequences of the involvement of a motorcycle club for tackling this violence. Based on thirteen semi-structured interviews with social professionals working in a shelter, external professionals and (ex-)partners, the link between domestic violence and membership of a motorcycle club could not be verified. What this research does show is that safety is the number one priority in working with these (ex-)partners. Furthermore, it shows how complex it is to assess the seriousness of potential threat coming from these 1%motorcyle clubs. Further research on domestic violence in environments associated with organised crime and the cooperation between the judiciary system and social professionals is needed to improve safety and wellbeing for this specific group.

In this article, the authors draw on a netnographic study conducted between May and July 2019 on phishing on Telegram Messenger. The results indicate that Telegram, just like cryptomarkets and online forums, seems to function as a criminal marketplace. In the groups analyzed the authors see users who both offer and are looking for specific goods and services related to the crime script of phishing. Furthermore, the information on Telegram contains specific modi operandi that are offering comprehensive and step-by-step guides to successfully complete specific financial cybercrimes. Therefore, based on this explorative study the authors argue that Telegram can be seen as a digital offender convergence setting.

‘Private enforcement’ van nalatigheid bij financieel-economische criminaliteit

Tijdschrift Tijdschrift voor Bijzonder Strafrecht & Handhaving, Aflevering 3 2020

Auteurs F.J. Erkens FFE MEWI LLM
SamenvattingAuteursinformatie

Tijdschrift PROCES, Aflevering 2 2020
Trefwoorden Georganiseerde criminaliteit Organized crime, Ondermijning Drugs, Datascience Data science, Voorspellende indicatoren Indicators
Auteurs Dr. Patricia Prüfer en Prof. dr. Emile Kolthoff
SamenvattingAuteursinformatie

Increasing digitization and datafication lead to an increasingly important role of data in our society and to changes in the way institutions work and decisions are made. Although it can lead to changes in the type of crime (e.g. cybercrime), datafication also facilitates shifts from visible and registered crime to crime that has not (yet) been measured and registered, like manifestations of organized crime. Analyzing so-called big data can help to recognize new forms of crime, predict risk factors, and decrease the dark number of these forms of crime.
In this study, we illustrate which indicators determine the stage of an industrial area regarding the occurrence of organized crime. Our supervised machine learning analysis shows that a number of indicators actually have predictive value for the degree of organized crime. These indicators could be used in the future to distinguish which industrial areas run an increased risk of organized and subversive crime.

Bezoek in Nederlandse gevangenissen

De stand van zaken

Tijdschrift PROCES, Aflevering 2 2020
Trefwoorden Bezoek Visitation, Detentie Imprisonment, Leefklimaat Prison climate, Detentie-ervaringen prison experiences
Auteurs Maria Berghuis MSc, Dr. Hanneke Palmen en Prof. dr. Paul Nieuwbeerta
SamenvattingAuteursinformatie

Prison visitation is important for protecting against social isolation during imprisonment. It is also essential for maintaining contacts that are important for life in prison and after release. It is therefore not surprising that both nationally and internationally important policy measures and scientific research have been undertaken on the topic. Nationally, however, limited scientific research is available regarding how many, how often and from whom prisoners receive visits, how visits are experienced and the possible effects of visitation, thus leaving many questions unanswered. Meanwhile, in the past ten years great changes have been made to visitation in Dutch prison policy and practice. Given these recent developments, both scientists and practitioners could benefit from an overview of the current state of affairs of visitation. This article aims to bridge the gap between research, policy and practice by summarizing findings from the Life in Custody study. This study includes a description of how visitation is organized legally, at the policy level and in practice, a thorough review of prior research on visitation and an analysis of the most recent national data on the prevalence and frequency of visitation, while considering important differences between prisoners and prisons.

Access_open Juvenile Justice in the Caribbean Netherlands: Important considerations from a Children’s Rights Perspective

Tijdschrift Boom Strafblad, Aflevering 1 2020
Trefwoorden UNICEF Situation Analysis, Caribbean Netherlands, Children’s Rights, Juvenile Justice
Auteurs L. (La-Toya) Charles MSc.
SamenvattingAuteursinformatie

The Dutch Government intends to implement a Juvenile Justice Law for the Caribbean Netherlands. This article addresses this development and gives some important considerations from a children’s rights perspective; particularly, the rights of children while in the juvenile justice system and the Government’s obligation to prevent children from entering into the system. The discussion hinges on the findings of UNICEF The Netherlands’ recently published Situation Analysis on the Rights of Children and Adolescents in the Caribbean Netherlands, focusing on child vulnerabilities that may eventually lead to criminality and recommendations regarding necessary provisions, collaboration between ministries and public entities, and the availability of data to monitor the effectiveness of government policy.

From the securitisation of migration to the criminalisation of solidarity towards migrants

The shrinking space for NGOs and volunteers in the Mediterranean Sea

Tijdschrift Crimmigratie & Recht, Aflevering 1 2020
Trefwoorden migration, securitisation, solidarity, growing pattern of criminalisation
Auteurs Fleur Boixiere
SamenvattingAuteursinformatie

In recent years, migration has been at the centre of European debates and the number of migrants trying to cross the Mediterranean remains alarming. To this day, hundreds of people continue to risk their lives crossing the Mediterranean on small boats in order to flee conflict zones, persecution or extreme poverty. However, due to the lack of legal alternatives, migrants engage in dangerous journeys and find themselves helpless in the hands of smugglers. This article will address the growing pattern of criminalisation of migration and humanitarian assistance throughout Europe and consider the extent to which national, European and international anti-smuggling laws affect the work of civil society actors.

Auteurs Jonas Stuurman, Emile Kolthoff, Joost van den Tillaart e.a.
SamenvattingAuteursinformatie

This contribution reports about a research in a medium-sized municipality on the possibilities of giving municipalities an instrument to determine at the earliest possible stage which neighborhoods are at (increased) risk of exposure to organized crime and its consequences. We are searching for indicators to measure that exposure to give direction to preventive measures. Our focus is on the erosion of structures and foundations of society as a result of activities of organized crime, eventually resulting in the infringement of the rule of law. It is therefore not about the phenomenon of organized crime itself, but about its effects on society. This requires clarification and measurability of the concept. In this first exploration, we focus on the following five manifestations of the effect of organized crime: The emergence of a subculture: not recognizing government authority; the emergence of takeover of power in the neighborhood; the emergence of vulnerable groups of citizens; the creation of the image: crime pays off; and the emergence of unfair competition.

Access_open Havens en georganiseerde criminaliteit: een historische bespiegeling

Tijdschrift Justitiële verkenningen, Aflevering 5 2019
Trefwoorden international harbors, organized crime, history, smuggling, Rotterdam
Auteurs prof. dr. Cyrille Fijnaut
SamenvattingAuteursinformatie

The structural vulnerability of the port of Rotterdam to organized crime is dealt with in this article from a broader, historical perspective. Using examples from ports in Italy and the United States, among others, the author shows how at the end of the last century local criminal groups managed to gain a dominant position in the handling of good flows. The author discusses various research reports that have been published over the years on the import of drugs into the port of Rotterdam and other European ports. Drug traffickers turn out to respond very flexible to stricter controls by simply moving to alternative ports or opting for transferring drug loads to small fast boats in open water. The author emphasizes that ports should not be studied as isolated transition points, but must be considered as nodes in networks that extend far inland and abroad. This is the only way to see the broader strategic and tactical options for stopping or reducing drug trafficking. In addition, attention must be paid to the problem of corruption among port workers, police and customs officers.

Transitcriminaliteit en logistieke knooppunten in Nederland

Tijdschrift Justitiële verkenningen, Aflevering 5 2019
Trefwoorden Drug trafficking, airports, seaports, security checks, corruption
Auteurs Renushka Madarie MSc en Dr. Edwin Kruisbergen
SamenvattingAuteursinformatie

The Netherlands functions as an important source and transit country for international organized drug trafficking. This is in part due to its large logistical nodes in the world economy, like the airport and the seaport. Based on in-depth analyses of sixteen cases of the Dutch Organized Crime Monitor, this article explores how drug traffickers operate at logistical nodes, in particular airports. The results demonstrate that organized crime groups deploy mainly three types of tactics to traffic drugs, namely defying, avoiding, and neutralizing security checks. Occupational embeddedness is manifested through several job-related factors. Autonomy, mobility, and the similarity between legitimate duties and criminal activities facilitate discrete engagement in organized crime activities during work time. Port employees are also attractive to organized crime groups because of their job-related social capital and knowledge.

Trefwoorden public private partnerships, Rotterdam harbor, security, drugs, crime
Auteurs Dr. Lieselot Bisschop, Dr. Robby Roks, Prof.dr. Richard Staring e.a.
SamenvattingAuteursinformatie

This article focuses on the challenges associated with public-private partnerships in tackling drug crime in the port of Rotterdam. The authors identified the actors involved in the fight against drug crime and, more generally, security in the port. The authors show how these various actors view the subject of drug crime (so-called mentalities), what they set as objectives (finalities) and how they try to achieve these objectives. Subsequently the various aspects of the interactions between these actors are being analyzed. The article is empirically based on 76 interviews with public and private actors in the port of Rotterdam, that were conducted in the period from January 2018 to February 2019, and an analysis of literature, news items, government reports and other documents.

Auteurs Prof. dr. mr. Arjan Blokland
SamenvattingAuteursinformatie

In our 2017 report “Profielen van outlaw bikers and outlawbiker clubs” we concluded, “Dutch members of outlaw motorcycle gangs disproportionally frequently have a history criminal justice contacts”. The attorney representing the Hells Angels in the civil law suit filed by the Dutch public prosecutor requesting a civil ban of the Hells Angels, after consulting an expert methodologist, challenged this conclusion due to the possibility of type 2 and type 1 errors in constructing our sample from a police gang database. Here we calculate the proportion of convicted Hells Angels members under different levels of potential bias resulting from these errors. We find that a realistic estimate of the proportion of convicted individuals among the Dutch Hells Angels membership is between 58-96%, which, at a minimum, is roughly twice that in an age-matched population of male motorcyclists who are not members of an outlaw motorcycle club.

Access_open Criminaliteit en macht: een inleiding

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2019
Trefwoorden crimes of the powerful, white collar crime, hate crime, eco crime, ‘lawful but awful’
Auteurs Prof. dr. René van Swaaningen
SamenvattingAuteursinformatie

Criminologists have by and large sought to explain crime by the deficiencies people may have. It took till the 1970s until the idea that crime can also be caused by structural power inequalities got an actual name in criminology: crimes of the powerful. Starting with the works of Willem Bonger and Edward Ross in the early 20th century, the author analyses how critical criminologists like Frank Pearce introduced the term ‘crimes of the powerful’ in the 1970s and how this concept was subsequently applied to gender- and racial inequalities, state crime, corruption et cetera, whilst pointing at the topical relevance of using a lens of ‘crimes of the powerful’ as a sensitising concept to analyse present-day problems, ranging from sexual abuse in the Roman Catholic church to the banking sector or indeed the expropriation of indigenous lands in the Amazon by soy-farmers and timber traders.
