Long before the coming of the Bill of Rights in written Constitutions, the common law has had the greatest regard for the personal liberty of the individual. In order to safeguard that liberty, the remedy of habeas corpus was always available to persons deprived of their liberty unlawfully. This ancient writ has been incorporated into the modern Constitution as a fundamental right and enforceable as other rights protected by virtue of their entrenchment in those Constitutions. This article aims to bring together the various understanding of habeas corpus at common law and the principles governing the writ in common law jurisdictions. The discussion is approached through a twelve-point construct thus providing a brief conspectus of the subject matter, such that one could have a better understanding of the subject as applied in most common law jurisdictions. |

In the Netherlands, immigration detention is classified under administrative law. More precisely: it is a form of administrative coercion. But immigration detention is also deprivation of liberty, or a habeas corpus measure. This makes it the most far-reaching form of administrative coercion you can think of. The regime and house rules of immigration detention differ just a little from those of criminal deprivation of liberty. The draft bill on the Return and Detention Act provides some improvements. For asylum seekers that cause nuisance, there is the Enforcement and Supervision Location, where the foreign national is given an area restriction and must remain within the municipal boundaries. Due to the liberty restrictions, immigration detention should always be the last resort. |

Qualitative research in an immigration detention center in the Netherlands shows that detained unauthorized migrants consider the entry procedure in Immigration Centre Rotterdam procedurally just. These migrants are generally positive on the fairness of the entry procedure as their safety and welfare are guaranteed and existing procedural justice criteria are respected. However, they believe that immigration detention in itself is illegitimate and that they do not deserve to be detained. This shows that the focus on procedures and interactions is insufficient to understand the perceived legitimacy of immigration detention if shared values and consent with the legal basis of immigration detention are lacking. |

The article presents the status quo of the law of retrial in Germany and gives an overview of the law and practice of the latter in favour of the convicted and to the disadvantage of the defendant. Particularly, the formal and material prerequisites for a successful petition to retry the criminal case are subject to a detailed presentation and evaluation. Because no official statistics are kept regarding successful retrial processes in Germany, the actual number of judicial errors is primarily the subject of more or less well-founded estimates by legal practitioners and journalists. However, there are a few newer empirical studies devoted to different facets of the subject. These studies will be discussed in this article in order to outline the state of empirical research on the legal reality of the retrial procedure. Against this background, the article will ultimately highlight currently discussed reforms and subject these to a critical evaluation as well. The aim of the recent reform efforts is to add a ground for retrial to the disadvantage of the defendant for cases in which new facts or evidence indicate that the acquitted person was guilty. After detailed discussion, the proposal in question is rejected, inter alia for constitutional reasons. |

States apply different material conditions to attract or restrict residence of certain types of migrants. But states can also make use of time as an instrument to design more welcoming or more restrictive policies. States can apply faster application procedures for desired migrants. Furthermore, time can be used in a more favourable way to attract desired migrants in regard to duration of residence, access to a form of permanent residence and protection against loss of residence. This contribution makes an analysis of how time is used as an instrument in shaping migration policy by the European Union (EU) legislator in the context of making migration more or less attractive. This analysis shows that two groups are treated more favourably in regard to the use of time in several aspects: EU citizens and economic- and knowledge-related third-country nationals. However, when it comes to the acquisition of permanent residence after a certain period of time, the welcoming policy towards economic- and knowledge-related migrants is no longer obvious. |

Hesdy is used to set an example, and since it takes more than seven years to reach a verdict, the impact on his private life and his career as a fighter is large. The study is based on participant observation and 33 interviews, twenty of which with the protagonist. |

The contribution of sport to reintegrating offenders receives limited attention, both in science and in the practice of probation and the prison system. From the perspective of desistance, this literature study concluded that sport can contribute to the development of individual capital, social capital and an alternative identity. However, the effect of sport is not necessarily positive. There are risks of negative influence or the reinforcement of problem behaviour. In counselling offenders, sport should be combined with other interventions to reduce recidivism. A personalized approach is required, based on the risk-need-responsivity model. |

Why and how mediated contact between victims and offenders (and members from their networks) leads to positive outcomes, remains a difficult question to answer. Not surprisingly therefore, this topic has been the focus of attention of multiple articles in the past twenty years of this journal. In this contribution, the inspiring article of Borbala Fellegi (2008), titled ‘Explaining the impact of restorative justice. The “4-way interaction” of morality, neutralisation, shame and bonds’ is celebrated. Fellegi presents a theoretical framework in which the added value of restorative, mediated victim-offender meetings for the re-integration of offenders is outlined compared to other judicial responses to crime. Central to her argument is that the mediation process affects in particular the four criminogenic factors mentioned in the title. In this contribution two innovative, working mechanisms of the mediation process that she proposes, are highlighted. First, the preparation phase in which the neutral mediator initiates and facilitates discussion of the crime and its consequences for the victim(s) with the offender. Fellegi proposes that this mechanism can (start to) lift the criminogenic factor moral reasoning of the offender. Second, the restorative focus of the encounter itself between the victim and offender, in which both parties can express how they were affected, express their emotions (such as shame feelings of the offender) and discuss jointly how restoration and reparation might be achieved. This should reduce the criminogenic factor neutralisation, increase moral reasoning, and might contribute to integrative social bonds between the parties and their networks. Thus, Fellegi’s work has made innovative suggestions about the working mechanisms of victim-offender mediation – these suggestions offer useful hypotheses that can be tested empirically. |

In toenemende mate wordt in het penitentiair beleid niet alleen de doelmatigheid, maar ook de eigen verantwoordelijkheid van de gedetineerde vooropgesteld. Dit laatste geschiedt dan vanuit de neoliberale responsabiliseringsgedachte dat het gevangeniswezen zich nog slechts hoeft in te spannen om de gedetineerde zelf in staat te stellen zich op zijn terugkeer in de samenleving voor te bereiden, mits en zolang hij dat zelf tenminste wil, zich daarvoor inzet en daar ook zijn verantwoordelijkheid voor neemt. Deze bijdrage bespreekt enkele voorbeelden van de doorgevoerde en aangekondigde veranderingen in het penitentiair recht en betoogt dat deze wijzigingen al met al een forse achteruitgang van de rechtspositie van en rechtszekerheid voor gedetineerden met zich brengen. |

Young people’s delinquent behavior remains a social problem of concern to parents, local residents, teachers, police officers and administrators. With respect to effective interventions, the dominant focus is on ‘what works’. Relatively little is known about ‘who works’. In this study, based on a survey of 679 vmbo-pupils, it was investigated to what extent receiving ‘sternness with love’ from a professional may contribute to mitigating delinquency. For this research, unique graphically supported measuring instruments were developed that enable participants of the target group – including those who suffer from mild intellectual disabilities – to independently fill out the questionnaire. The results based on regression analyses suggest that there is no support for the supposed contribution of the interaction between sternness and love or of the three-way interaction between delinquent friends, sternness and love in explaining the variance of delinquent behavior. The results further show that having delinquent friends is related to participants’ delinquency. The results of these analyses also suggest that the relevant professional’s approach with ‘sternness’ or with ‘love’ moderates the relationship between delinquent friends and committing theft. |

This article presents findings from a longitudinal study of 81 young recidivists examined over fifteen years. By the age of 25, 50 percent had desisted for at least three years. 60 percent had had no new police contacts during the last two years. Four stages could be distinguished in the desistance process. Apart from a small number of explicit persisters, all of the young adults did consciously consider whether the benefits of their criminal activities outweighed the disadvantages. With just a few exceptions, the decision to quit was not motivated by an altruistic goal, nor by extreme fear, but mainly motivated by the feeling of being too old for criminal life and by striving for a pleasant self-esteem. It is concluded that when young adult recidivists give up crime, this must be seen as an extreme and extremely late form of maturation. |

In each youth justice system, several age limits exist that indicate what type of reaction can and may be connected to the degree of responsibility that a person can already bear. Civil liability, criminal responsibility and criminal majority are examples of concepts on which age limits are based, but whose definition and impact is not always clear. Especially as far as the minimum age of criminal responsibility (MACR) is concerned, confusion exists in legal doctrine. This is apparent from the fact that international comparison tables often show different MACRs for the same country. Moreover, the international literature often seems to define youth justice systems by means of a lower and upper limit, whereas such a dual distinction is too basic to comprehend the complex multilayer nature of the systems. This contribution therefore maps out and conceptually clarifies the different interpretations and consequences of the several age limits that exist within youth justice systems. To that extent, the age limits of six countries are analysed: Argentina, Austria, Belgium, the Netherlands, New Zealand and Northern Ireland. This legal comparison ultimately leads to a proposal to establish a coherent conceptual framework on age limits in youth justice. |

Rehabilitation of hospitalized offenders is a stepwise process ideally achieved through four consecutive types of leave: supervised, unsupervised, extra-institutional and a probational leave. However, in reality this sequence may often be deviated from. The current study was undertaken to examine the most common deviations and the relationship with how the treatment ended (e.g. positive/negative). File information of 422 offenders previously admitted to a high-secure forensic hospital was used. Deviations from the standard sequence are relatively common. Probational leave is often missing, and one in ten sequences contains a suspension of leave. The relevance for forensic and legal professionals is discussed. |

This article outlines two points of criticism related to Christopher Marshall’s discussion of a relational justice of care. First, addressing the needs of the parties involved in a criminal justice case finds its appropriate place in the post-trial stage. In the pre-trial and trial stages, protecting the legal rights and equal treatment of suspects should take priority over caring for suspects. Secondly, if the outcome of the restorative encounter in the pre-trial stages has a bearing on the verdict of the judge, the encounter may risk to lose its authenticity. The offender may have reason to believe that a socially appropriate performance will be rewarded with less punishment. |
