Prisoners often encounter multiple barriers when returning to society, resulting in higher risks of recidivism. To overcome these barriers, prison-based and community-based professionals assist with preparation for release. Prison-based professionals, such as the case manager and mentor, screen and monitor the problems regarding work and income, housing, healthcare, financial debts and valid identification. Community-based professionals, such as municipal officials, parole officers, healthcare professionals and volunteers, can provide additional and specialized help. First, this research discusses the current policy of the Dutch Custodial Institutions Agency (DJI) and the role of different types of professionals. Second, it presents a nationwide picture of the extent to which prisoners report contact with prison-based and community-based professionals, and to what degree prisoners appreciate this contact. The results are specified for various types of regimes and time served and are based on 4308 prisoner surveys of the Dutch Prison Visitation Study (DPVS), part of the Life in Custody Study (LIC-study). It turns out that most prisoners seem to be in close contact with prison-based professionals and that prisoners positively value this contact. However, contact with community-based professionals is limited and prisoners are somewhat dissatisfied about their contact with parole officers and municipal officials. Furthermore, the amount of contact differs across various types of regimes and time served. In particular, individuals who recently entered prison report less contact. To conclude, policy implications will be discussed. |

The authors show that this discussion has been settled by introducing a specific knowledge base for probation work. They outline a number of important developments in recent decades: the focus on risk and the enforced framework, and the great influence of new technology. Nevertheless, an important basis for probation remains unchanged: the quality of the contact between probation officer and client. |

De Covid-19-crisis heeft veel inzicht gegeven in nut en noodzaak van het strafrecht. ‘Opeens’ bleek wat echt nodig was en wat niet. De auteurs houden een pleidooi voor minder vrijheidsbeneming. Werkstraffen en reclasseringstoezichten helpen vaak veel beter om mensen weer op het rechte pad te krijgen, en te houden. Ook mediation in strafrecht zou een prominentere plaats moeten krijgen. Tenslotte stellen de auteurs dat de samenwerking tussen partijen beter kan. Er is nog teveel landjepik. |

Vervolgens worden wetsvoorstellen besproken, gevolgd door een korte reflectie op deze ontwikkelingen in het licht van het Internationale Verdrag inzake de Rechten van het Kind. |

Young people’s delinquent behavior remains a social problem of concern to parents, local residents, teachers, police officers and administrators. With respect to effective interventions, the dominant focus is on ‘what works’. Relatively little is known about ‘who works’. In this study, based on a survey of 679 vmbo-pupils, it was investigated to what extent receiving ‘sternness with love’ from a professional may contribute to mitigating delinquency. For this research, unique graphically supported measuring instruments were developed that enable participants of the target group – including those who suffer from mild intellectual disabilities – to independently fill out the questionnaire. The results based on regression analyses suggest that there is no support for the supposed contribution of the interaction between sternness and love or of the three-way interaction between delinquent friends, sternness and love in explaining the variance of delinquent behavior. The results further show that having delinquent friends is related to participants’ delinquency. The results of these analyses also suggest that the relevant professional’s approach with ‘sternness’ or with ‘love’ moderates the relationship between delinquent friends and committing theft. |

The relationship between debts and delinquency is still unclear and knowledge about the prevalence and scope of debts among delinquents, which is needed to systematically explore this relationship, is lacking. The present study contains a systematic and scoping literature review on this relationship and analyzed data from risk assessment and client files (N = 250) from the Dutch probation service. Results show that debt and crime are strongly related and that debts among probation clients are highly prevalent and complex and underline the importance of inquiring more knowledge about debts as a potential risk factor for relapse during supervision. |

In order to improve the effectiveness of offender supervision many studies have been conducted into risk factors for delinquency. Evidence was found that debts and crime are interrelated. However, understanding of potential underlying risk factors in this relationship is limited. Results of an analysis of client files (N=250) show that debts among probation clients are highly prevalent and problems with respect to education, work and mental and physical health seem to be important underlying factors in the relationship between debts and crime. In addition, interviews were conducted with both probation workers (N=33) and clients (N=16) to get insight into the possibilities to adequately support clients with regard to debts in order to stimulate successful resocialization. Results underline the importance of paying attention to possible underlying factors to effectively supervise clients. |

In addition, it is also important to investigate what the legislation and initiatives yield. |

This contribution provides an overview of the legal and criminological research into the decision following the determination of a supervisor that the conditions of a freedom-restricting sanction are not met. It is an important decision, on the one hand because it can result in a more severe sanction than was initially imposed, on the other hand because a decision that is perceived as unfair can influence the extent to which suspects and convicts are willing to comply with conditions, and recidivism. Yet little research has been conducted into this decision. The legal safeguards with which it is accompanied are lagging behind those of the original sentencing decision. Undeserved according to penitentiary experts. The scarce empirical research shows that decision-making involves many different layers and that the actors involved have different goals, ranging from deterrence and emphasizing the credibility of the system to the successful completion of the sanction. Even in countries where regulations have been tightened considerably, the discretionary power of direct supervisors, such as employees of the working project or therapists, is still large. This raises the question to what extent the final decision maker (usually a judge) still has sufficient room to make an independent decision. |

Joint reflection of practitioners and clients appears beneficiary for the effectiveness of their working alliance in, for instance, psychotherapy. This study aims to find out whether a similar beneficiary effect is experienced by practitioners and clients in probation supervision, a mandated setting. Over thirty dyads of Dutch probation officers and probationers participated into structured joint reflection, using the working alliance monitor, specifically designed for this purpose. The majority of probation officers reported the reflection as useful. Probationers reported a more mixed experience. Probationers with an intellectual disability more often needed help to understand the working alliance monitor. |

Structured assessment of the risk of repeated offending has become common practice in the judicial system. However, much less attention has been paid to the way of communicating about the results of these risk assessments to the court or forensic settings. Research shows that the way of communicating about risks of relapse may affect decision-making by judges. In this article, these research results will be summarized and the different approaches to risk communication are discussed. Finally, recommendations are provided for clear communication about risk assessment results. |

In this article the development of a restorative justice probation practice is discussed from the perspective of the restorative justice principle of the inclusive community and the contribution of probation volunteers to the reintegration of (ex-)offenders through specific restorative justice intervention strategies. It is shown that in penal policy of the past decades the penal welfare-model and the aim of reintegration of ex-offenders has been overshadowed by a more utilitarian, punitive and management logic of criminal justice. As a result, the reintegration and social inclusion of ex-offenders has become a rather neglected area and, in the current liberal-democratic state, offenders face social conditions in which it is very hard to turn their life around. In addition it is suggested that both in mainstream and in restorative justice interventions, achievement of the goal of reintegration is often problematic or absent. Moreover, this lack of opportunities for connection may undermine and reduce the effects of interventions, including those with a restorative justice approach. Probation services that use specific restorative justice intervention strategies guided by both professionals and probation volunteers might contribute to a more active, inclusive role of the community and society in the reintegration of ex-offenders. |

The last years victim awareness has received special attention in the Dutch probation service. Three goals are central: respecting the rights and interests of the victim, mapping and increasing victim awareness of the probation client, and working towards the possibilities for recovery. Based on discussions with probation officers, this contribution sketches a picture of how this takes shape in practice. Experience shows that good results are achieved, but that more training and attention to the subject is needed to give it a full place in the probation work. |

How can technological tools contribute to supervising and reintegrating offenders in society? Globally, technological tools for supervision are broken down into so-called first generation (GPS tracking) and second generation (smartphone and sensor technology). An overview is given of what is globally known about the effectiveness and assumed mechanisms of action of first-generation technical tools. Then it is explored what added value second-generation technical aids can have and to which working mechanisms they could connect. Smartphone and sensor technology have the potential to contribute to the rehabilitation functions of the supervision, inter alia because they offer possibilities for more personalized supervision and for the combination of supervision and treatment. Although initiatives have been started in this regard and research is ongoing, hardly anything is known yet about the effectiveness of these new technological applications. The reliability and safety of IT, as well as ethical and legal aspects also require attention. |

Little is known about how ex-prisoners’ parole supervision experiences relate to desistance. The aim of this article therefore is to gain insight into the nature of release conditions and parole supervision of ex-prisoners and parolees’ perceptions of their supervision related to the desistance process. A total of 23 Dutch parolees were interviewed in depth at three waves starting in prison up to one year after their release, and the 69 interviews were combined with their parole files containing information about conditions, violations and sanctions. Parole files revealed the practice of highly engaged parole officers, who worked with parolees to strengthen factors known to foster desistance. However, the interviews showed that most parolees found their parole experience predominantly surveillance-oriented and not very helpful for desistance. Parole was experienced as most beneficial when parole officers used their discretionary power to adjust conditions creating ‘space’ for trial-and-error. |

This article presents and critically discusses a new Recommendation on restorative justice (CM/Rec(2018)8) that was adopted on 3 October 2018 by the Committee of Ministers of the Council of Europe. This new regulation builds on the previous Recommendation No. R(99)19 on mediation in penal matters and recommends the governments of the 47 member States of the Council of Europe the adopt and implement the principles of restorative justice as described in the Appendix of the new Recommendation. These guidelines apply to national authorities and national agencies in general, and to judges, public prosecutors, police, prisons, probation, juvenile justice agencies, victim support services and restorative justice services in particular. The article presents the origins of the Recommendation, its contents and its meaning for restorative justice developments in Europe and beyond. |
