In eleven experiments in Dutch prisons case managers, probation officers and municipality-counselors work together to realize sustainable, integral, continuous reintegration trajectories for detainees. Results show that physical presence of the probation officers in prison improved quick and regular consultation with case managers and other professionals in prison, availability of more and broader information about the detainee, and better preparation for life after prison. Facilitators who supported working and learning together contributed to the co-creation of a new way in organizing the reintegration process in prison. This kind of co-creation requires manpower and resources. |

In this article a framework is provided for the design and implementation of exit programmes used in prisons and by probation services. These programmes are targeted at violent extremist (ex-)offenders and are used for the purpose of deradicalisation or disengagement and support the successful reintegration of (ex-)offenders back into society. Based on a review of scientific and practice-oriented literature six categories of standards and practices are described. An exit programme needs to be tailored to the context in which it is used and to the risks and needs of the individual. In addition to various other aspects, earlier attention for reintegration and the active involvement of an (ex-)offender’s social environment are crucial in an exit progamme. |

The Arnhem Court of Appeal has examined whether an employee was reasonably able to take leave, applying the ECJ’s Max Planck and Kreuziger judgments. According to the Court, the employer did not violate its obligation to inform the employee regarding the lapse of the right to paid annual leave. The Court stated that the employee was reasonably able to take leave, despite being incapacitated for work due to sickness. The Court ruled that the employee was not entitled to an allowance in lieu of untaken paid annual leave, as the right to such leave had lapsed. |

Dutch prisons are not exempt from incidents. Despite the negative impact of violence on the safety of inmates and the chances of successful reintegration, not much is known about the prevalence of victimization in Dutch prisons and the characteristics of victims. Additionally, previous research has pointed out the overlap between victim status and offender status. In this contribution, the authors will discuss the prevalence of self-reported victimization among Dutch inmates and the characteristics of victims and victim-offenders. Data from 3,485 participants from the Life in Custody Study are used for this purpose. |

The main conclusion of the article is that contemporary forms of naming & shaming come closer to humiliation and public lynching, rather than redemption and self-reflection. |

Naming-and-shaming campaigns, in which civil society groups publicly call upon corporations to end harmful behavior via social media, are a powerful mechanism for social control of corporations. This article investigates naming and shaming in modern, global markets through a case study of Shell - one of the most stigmatized corporations of our time. First, the perspective of organizational sociology is used to answer the question why Shell is receiving such significant attention. Next, the article addresses how shaming manifests itself in global markets. The example of Shell illustrates reintegrative shaming, aiming to end harmful activities, as well as stigmatizing shaming that undermines a corporation’s license to operate. |

#MeToo is a social movement that started on social media and spread from the US all over the world in 2017. The social movement behind #MeToo is characterised by publicly naming and shaming those who exhibit everyday misconduct in the workplace. This is done by spreading naming and shaming stories via Twitter messages. A question that arises here is whether naming and shaming is a suitable and successful tool for a political movement that aims to bring about social change with regard to sexual violence. Has #MeToo changed the social perspective on sexual violence and social norms of behaviour for sexual encounters? To answer these questions, first a historical sketch of the feminist movements against sexual violence will be provided. What is characteristic of these movements and what are possible parallels with the #MeToo movement? From a feminist perspective, are there any dilemmas that a judicial response to sexual violence entails? In order to provide background to these insights, the characteristics of the #MeToo movement, and the associated dilemmas surrounding naming and shaming, will be discussed next. Finally, it will be discussed if #MeToo has led to social changes. |

Crime victims have gained a stronger position in all phases of the criminal procedure, including the post-sentencing phase. It is in this phase specifically that victims’ needs and interests relating to acknowledgement interplay with the offenders’ needs and interests relating to resocialisation. In the Netherlands, offenders who suffer from a mental disorder at the time of the offence limiting their criminal accountability and pose a significant safety threat, can be given a TBS order. This means that they are placed in a forensic psychiatric hospital to prevent further crimes and receive treatment aimed at resocialisation. As resocialisation requires the offender to return to society, contact with the victim might be a necessary step. This article focuses on victim-offender contact during the execution of this TBS order, and looks at risks and opportunities of victim-offender contact in this context, given the particular offender population. Offenders are divided into three groups: those with primarily psychotic disorders, those suffering from personality disorders and those with comorbidity, especially substance abuse disorders. The TBS population is atypical compared to offenders without a mental disorder. Their disorders can heighten the risks of unsuccessful or even counterproductive victim-offender contact. Yet, carefully executed victim-offender contact which includes thorough preparation, managing expectations and choosing the right type of contact can contribute to both successful resocialisation as well as victim acknowledgement. |

This essay is a scientific reflection on Leuven Restorative City (LRC). The cities, which present themselves as ‘restorative cities’, aim to ensure that restoration continues to nestle in the capillaries of our society. The article argues that realizing the LRC-promise requires restorative thinking through the meso-level of local public life. This involves reference to a number of notions that can be traced back to Ancient Greek thought in Athens, in which the intellectual virtue of phronesis – practical wisdom in a social and political context – is central. Citizens are seen as allies in the solution of social issues. LRC contributes to this through its focus on ‘turning conflict into opportunities’. Restorative justice wisdom is more widely applicable in society. However, the LRC process can sometimes be erratic and unpredictable. The article points to the possible alternation of good and bad periods, and puts forward the expectation that the development of restorative practices in Leuven can be understood as cascades. In these cascades, the course of the diffusion of restorative practices is presented in terms of successive waves of learning experiences and knowledge sharing. |

Prisoners often encounter multiple barriers when returning to society, resulting in higher risks of recidivism. To overcome these barriers, prison-based and community-based professionals assist with preparation for release. Prison-based professionals, such as the case manager and mentor, screen and monitor the problems regarding work and income, housing, healthcare, financial debts and valid identification. Community-based professionals, such as municipal officials, parole officers, healthcare professionals and volunteers, can provide additional and specialized help. First, this research discusses the current policy of the Dutch Custodial Institutions Agency (DJI) and the role of different types of professionals. Second, it presents a nationwide picture of the extent to which prisoners report contact with prison-based and community-based professionals, and to what degree prisoners appreciate this contact. The results are specified for various types of regimes and time served and are based on 4308 prisoner surveys of the Dutch Prison Visitation Study (DPVS), part of the Life in Custody Study (LIC-study). It turns out that most prisoners seem to be in close contact with prison-based professionals and that prisoners positively value this contact. However, contact with community-based professionals is limited and prisoners are somewhat dissatisfied about their contact with parole officers and municipal officials. Furthermore, the amount of contact differs across various types of regimes and time served. In particular, individuals who recently entered prison report less contact. To conclude, policy implications will be discussed. |

Terrorism can only be brought to an end if Islam and the Muslim community are enlisted as allies in combating it. Underlying militant jihadism is a violent interpretation of Islam which can best be challenged with the assistance of Islam and the Muslim community. Since the effects of the current state-led approach are questionable, while its criminal law component is close to exceeding the limits set by the rule of law and turns Muslims into a suspect community, it is important to test by way of a pilot whether an approach based on Islam can reap more promising results. |

The article presents the status quo of the law of retrial in Germany and gives an overview of the law and practice of the latter in favour of the convicted and to the disadvantage of the defendant. Particularly, the formal and material prerequisites for a successful petition to retry the criminal case are subject to a detailed presentation and evaluation. Because no official statistics are kept regarding successful retrial processes in Germany, the actual number of judicial errors is primarily the subject of more or less well-founded estimates by legal practitioners and journalists. However, there are a few newer empirical studies devoted to different facets of the subject. These studies will be discussed in this article in order to outline the state of empirical research on the legal reality of the retrial procedure. Against this background, the article will ultimately highlight currently discussed reforms and subject these to a critical evaluation as well. The aim of the recent reform efforts is to add a ground for retrial to the disadvantage of the defendant for cases in which new facts or evidence indicate that the acquitted person was guilty. After detailed discussion, the proposal in question is rejected, inter alia for constitutional reasons. |
