Samenvatting

    The Greek Supreme Court, in a case about the transfer of a business and the obligation on the transferee to continue employing the transferred employees, underlined the importance of a thorough and genuine control on all factors to be taken into consideration in order to conclude on the existence of a transfer of undertaking or not: the business transferred must retain an autonomous economic identity, in the sense that the functional link between the different factors transferred is retained, thus allowing the new entity to use them in order to exercise an economic activity identical or similar to the previous one.

    The Court of the Astana International Financial Center is a new dispute resolution initiative meant to attract investors in much the same way as it has been done in the case of the courts and arbitration mechanisms of similar financial centers in the Persian Gulf. This paper examines such initiatives from a comparative perspective, focusing on their Private International Law aspects such as jurisdiction, applicable law and recognition and enforcement of judgments and arbitration awards. The paper concludes that their success, especially in the case of the younger courts, will depend on the ability to build harmonious relationships with the domestic courts of each host country.

    Exile and migration are once more central issues in the contemporary European predicament. This short article intends to discuss these questions elaborating on the ideas of two Spanish authors, a novelist, Max Aub, and a philosopher, María Zambrano, both marked by the tragic events of civil war and forced expatriation. Exile and migration in their existential perspective are meant as a prologue to the vindication of citizenship.

    According to German law, every employee has the right to object to the transfer of their employment relationship to the transferee in the case of a transfer of business. However, the right to object is not unlimited. The Federal Labour Court (Bundesarbeitsgericht (‘BAG’)) held that an employee who had worked for the transferee for seven years had lost this right if they had been informed about the transfer.

    While media coverage supports citizens in exercising their democratic rights, developments in the media have turned organizations into glass houses. In this article we investigate what media attention and subsequent public reactions after incidents mean for social professionals who work with the so-called ‘hard-to- reach’. We draw on a practical example, literature and interviews. Media attention turns out to affect the public image of organizations and professionals and consecutively alters the long term public judgment. This results in professionals feeling powerless, unrecognized and pressurized. Professionals adopt different strategies to deal with the effects of media attention: resignation, defensiveness, caution and organizational blame.

    Following a crisis, questions are often raised about how this crisis could have happened and whether someone is to be blamed for the crisis or its bad management. The blame game can become fierce as actors try to avoid, shift or mitigate blame in order to stay in office. In 2014, a festival took place in Haaksbergen where a monster truck drove into the audience, killing three people and injuring many others. Not enough safety measures had been taken to prevent the tragedy. Many actors were to blame for that, including the local authority which had granted the permit. Other actors blamed for the events were the mayor, the monster truck driver, and the organization organizing the festival. In the end, the mayor of Haaksbergen resigned. Instead of becoming more accommodative in his response as his blame levels increased, the mayor continued to be quite defensive, stating that the permit would be granted again – even with today’s knowledge. As one council member stated it, one cannot defend something which cannot be defended.

    In 2017, the ECJ delivered its judgment in the Socha case (C-149/16). This judgment, about the Collective Redundancy Directive (98/59/EC), highlights the contradictions between the Directive and Polish law and demonstrates some of consequences such a judgment can lead to.

    Drones en drone-gerelateerde cybertechnologieën nemen een vlucht in het veiligheidsdomein in de vorm van toepassingen door het leger, de politie, brandweer, private beveiligingsbedrijven, en ook deurwaarders, agrariërs en burgerinitiatieven. Drones werden in eerste instantie ontwikkeld voor militaire doeleinden. Hun aanpassingsvermogen als universele platforms voor beeldregistratie en goederenvervoer leidt tot hoge verwachtingen rond toepassing in het civiele domein. Dit artikel onderzoekt de ethische aspecten van “dual use” van drones en gerelateerde technologieën. Verschillende dimensies van dual use worden verkend: de technologisch ontwikkeling, maar ook de ontwikkeling van wet- en regelgeving in Amerika en Europa. Voor het Nederlandse veiligheidsdomein is relevant dat dit artikel bijdraagt aan het signaleren van de noodzaak om de ontwikkeling en toepassing van drones in breder perspectief te bezien. Drones en hun toepassingen maken deel uit van de internationale markt van militaire organisaties en van veiligheidsorganisaties in het publieke en private domein. Bovendien maken ze veelal deel uit van geïntegreerde systemen en van wereldwijde platforms voor consumentenelektronica. Dit artikel is een van de resultaten uit het door NWO gefinancierde project 'Responsible Design of Drones and Drone Services: Towards an Ethical and Juridical Tool For Drone Design and Risk Assessment' (Project no. 313-99-318). Het project was gericht op het ontwikkelen van een instrument voor ontwikkeling en gebruik van dronetoepassingen uitgaande van methoden als Responsible Research & Innovation (RRI) en Value Sensitive Design (VSD).

    Van onafhankelijke toezichthouders wordt verwacht dat zij verantwoording afleggen. De gedachte is dat hoe onafhankelijker zij zijn, hoe meer verantwoording ze moeten afleggen om balans te houden in het systeem van checks and balances. Toezichthouders leggen via verschillende partijen verantwoording af, maar ook over een veelheid aan criteria. Is de toezichthouder binnen zijn wettelijke mandaat gebleven? Hoe heeft hij de aan hem ter beschikking staande middelen aangewend? Vooral in het financieel toezicht hebben zich op deze terreinen de laatste jaren ontwikkelingen voorgedaan. Deze ontwikkelingen roepen vragen op ten aanzien van de verantwoording door de toezichthouder. In dit artikel worden deze ontwikkelingen vanuit een juridisch perspectief bekeken en in relatie gezet tot het vertrouwen van het publiek in de toezichthouder.

    Under Irish law, an employee claiming compensation for constructive dismissal bears a high burden of proof. Failure to exhaust the employer’s grievance procedure before bringing such a claim to court is generally a recipe for failure. However, a CEO who brought such a claim without first going through the grievance procedure was recently awarded record compensation of € 1.25 million.
