    This article discusses the key methodological shortcomings of experimental regulations and regulatory sandboxes. I argue that the poor design and implementation of these experimental legal regimes have both methodological and legal implications. The deficient design of experimental regulations and regulatory sandboxes can have three adverse effects: First, the internal validity of experimental legal regimes is limited because it is unclear whether the verified results are the direct result of the experimental intervention or other circumstances. The limited external validity of experimental legal regimes impedes the generalizability of the experiment. Second, experimental legal regimes that are not scientifically sound make a limited contribution to the advancement of evidence-based lawmaking and the rationalization of regulation. Third, methodological deficiencies may result in the violation of legal principles which require that experimental regulations follow objective, transparent, and predictable standards. I contribute to existing comparative public law and law and methods literature with an interdisciplinary framework which can help improve the design of experimental regulations and regulatory sandboxes. I draw on social science literature on the methods of field experiments to offer novel methodological insights for a more transparent and objective design of experimental regulations and regulatory sandboxes.

    Long before the coming of the Bill of Rights in written Constitutions, the common law has had the greatest regard for the personal liberty of the individual. In order to safeguard that liberty, the remedy of habeas corpus was always available to persons deprived of their liberty unlawfully. This ancient writ has been incorporated into the modern Constitution as a fundamental right and enforceable as other rights protected by virtue of their entrenchment in those Constitutions. This article aims to bring together the various understanding of habeas corpus at common law and the principles governing the writ in common law jurisdictions. The discussion is approached through a twelve-point construct thus providing a brief conspectus of the subject matter, such that one could have a better understanding of the subject as applied in most common law jurisdictions.

    This article presents an interdisciplinary comparison of British and German legal arguments concerning the justification of the use of force against the Islamic State in Iraq and Syria (ISIS). It is situated in the broader framework of research on strategic culture and the use of international law as a tool for justifying state behaviour. Thus, a gap in political science research is analysed: addressing legal arguments as essentially political in their usage. The present work questions whether differing strategic cultures will lead to a different use of legal arguments. International legal theory and content analysis are combined to sort arguments into the categories of instrumentalism, formalism and natural law. To do so, a data set consisting of all speeches with regard to the fight against ISIS made in both parliaments until the end of 2018 is analysed. It is shown that Germany and the UK, despite their varying strategic cultures, rely on similar legal justifications to a surprisingly large extent.

    The interpretive techniques applied by the European Court of Human Rights are instrumental in filling the vaguely formulated rights-provisions with progressive content, and their use provoked widespread criticism. The article argues that despite the scarcity of explicit references to the Vienna Convention on the Law of Treaties, all the ECtHR’s methods and doctrines of interpretation have basis in the VCLT, and the ECtHR has not developed a competing framework. The Vienna rules are flexible enough to accommodate the interpretive rules developed in the ECHR jurisprudence, although effectiveness and evolutive interpretation is favoured – due to the unique nature of Convention – over the more traditional means of interpretation, such as textualism. Applying the VCLT as a normative framework offers unique ways of reconceptualising some of the much-contested means of interpretation in order to increase the legitimacy of the ECtHR.

    Legal professionals working in city and municipal government face changes in expectations about their roles within the organisation. Where in the past they mostly took on the reactive and detached role of guardians of legal quality, these days they are expected to take a more flexible, solution-oriented and cooperative stance. How do these legal professionals handle this shift? How far do they go in adapting and which factors play a role? Based on three different positions within the organisation I describe this process, focusing in particular on their perception of their professional roles, and their willingness to change. I conclude with some critical comments on the changing expectations from legal professionals.

    This special issue focuses on the role concept, which has largely fallen out of use in sociology, but which seems ideally suited to analyze the circumstances in which legal professionals work nowadays. Their occupations are often surrounded by constitutional guarantees and professional standards, but at the same time in full swing due to policy reforms referred to as New Public Management and Socially Effective Judiciary (Maatschappelijk Effectieve Rechtspraak). This combination of relative role stability and rapid change can ensure that the predictability and desirability of the interpretation attributed to professional roles become subject of discussion and reflection. The way the role concept is used in this special issue is deliberately decoupled from the much-criticized structural functionalism with which it is often associated. The fact that this sociological perspective has lost much of its sway since the 1960s, because of its conservative character, makes it easier to give dynamics, ambiguity, conflict and resistance a prominent place in contemporary analyzes in which the role concept is central. The authors in this special issue examine whether the role fulfillment by professionals working in the legal field is actually subject of discussion and reflection and how this dynamic manifests itself.
