Predictive policing is the use of historical crime and other data in complex statistical models to predict where and when there is a high risk of new crime events. These predictions can then be used to direct police patrols proactively. Despite the increasing use and commercialisation of predictive policing worldwide, academic research into the methodological and operational dimensions of predictive policing is relatively limited. Since 2015 we have researched and tested several predictive crime models methodologically and operationally, based on police and other (big) data sources in several Belgian police districts. In this article, we summarise the results of six years of empirical research into predictive policing and look to the future of predictive policing research and practice. |

In times of crisis, we witness exceptional expressions of solidarity. Why does solidarity spring in times of crisis when it wanes in normal times? An inquiry into what may explain the differences between the expression of solidarity in crisis vs. normalcy provides, as I will argue in this article, important insights into the conditions and nature of solidarity. Solidarity requires, I will contend, an egalitarian ethos and state action within and beyond the state. It is neither a momentary political ideal, nor an exclusionary one, which depends for its sustainment on formal, legal, structures. Transient, sectarian, and informal conceptions of solidarity unduly curtail the demands of solidarity by restricting its reach to times of crisis, to in-group recipients, and to the social rather than the legal sphere. The article concludes by discussing some aspects of the dynamics of solidarity and its inherent risks that the analysis of the exceptionality of solidarity helps bring into focus. |

The success of investigative genetic genealogy (IGG) in the US hasn’t gone unnoticed in Europe. After US police announced worldwide that the Golden State Killer had been identified with the application of IGG, the Swedish police and judiciary applied the same method to solve a double murder that had remained unsolved for sixteen years. How did this method come about? A young woman unfamiliar with her real name, age, parents, and origins came up with the idea that private genealogical DNA databases that allow customers to trace their distant relatives could also be used to discover her identity. Since then, in the US many cold cases have been solved with the help of these databases and also the identity of many unidentified human remains has been traced. Questions concerning this new method of investigation arise, to which the beginning of an answer is given here. What does the method entail? Is it allowed to use this method in the Netherlands as well? |

Schools are tasked with helping children to become socially competent(er), both in the on- and offline world. If conflicts occur, schools find out how they can tackle this behaviour and prevent it in the future. Schools cover various tracks here. More and more schools have understood that they can actively involve children and young people in their preventive and problem-solving approach. They integrate methodologies and programmes that give children and young people the opportunity to take responsibility when a conflict occurs. Some of these methods and programmes are looked at more closely in this article. The article concludes with a future-oriented dream that responds to some current educational needs. |

There is a pressing need to develop a research methodology for studying judicial opinions that goes beyond both dogmatic analyzes and the established positions developed within philosophy of law and legal theory (e.g. the hermeneutic and argumentative approaches). One possible way is to adopt or modify methodologies developed within empirically oriented social sciences. Most social science textbooks devoted to methodology of empirical research deal with case studies. So far, this research framework developed within the social sciences has not been applied directly to judicial opinions, though they have been used for some empirical legal research studies. Even et first sight, case study research would appear to have potential for use with judicial opinions. The aim of the paper is to answer the question, how and to what extent can case study methodology developed within the social sciences be fruitfully used to examine judicial opinions? The general answer is undoubtedly positive (case studies can bring new, non-trivial threads to the research methodology on judicial opinions), though with many serious and far-reaching reservations. |

This PhD project uses a mixed method design to study perceived procedural justice among defendants in Dutch single-judge criminal cases. To find out whether defendants are concerned with perceived procedural justice and to get a better grasp on the concept, the first empirical project reviewed here is an interview study among defendants conducted in 2017. In this study, defendants were interviewed after their court hearings about perceived procedural justice during their court hearings. The second empirical project, which started in January 2019, zooms in on experiences of defendants with a non-western migration background. Using a questionnaire, I examine whether and how perceived everyday discrimination affects defendants’ perceptions of and reactions to procedural justice during their court hearings. I am currently designing a third empirical study, which entails a scenario experiment among people with a non-western migration background. I plan to manipulate the level of perceived procedural justice during a hypothetical court hearing to examine its influence on, for instance, people’s trust in judges, and again assess whether people’s reactions to perceived procedural justice differ depending on their levels of perceived everyday discrimination. At the end of my dissertation, I plan to connect the empirical findings to the legal domain by assessing possible normative implications. |

Around 36.000 men enter Dutch prisons every year. Nearly half of them are father. Imprisonment is destructive to father involvement. Many prisoners involuntary fail to stay connected with their family and are unable to reconnect with family after release. However, father involvement protects fragile families, children and fathers themselves from collateral consequences of imprisonment and even reduces recidivism. One of the first Dutch initiatives for fathers in prison came from voluntary organization Exodus. Since 2014, they run an 8-week workshop on fatherhood in a number of Dutch penal institutions. Fathers work on the restoration or reconstruction of their relationship with their children and parenting partners. In this article, we review participating fathers’ perceptions of the workshop and the changes in their attitude towards fatherhood. |

Legal doctrinal scholarship engages with the problems of legal practice: it systematizes, comments on, evaluates and debates what goes on in law. These activities do not occur in a vacuum: they are embedded in scholarly traditions and theories. This paper discusses the role of the theoretical frameworks used in legal research and has two related aims. First, it aims to provide some practical conceptualizations and guidelines regarding theoretical and normative frameworks that are useful to understand and conduct legal research. Second, it aims to investigate the relationships between different kinds of normative frameworks and their relationship to empirical work. In the second part, an argument is made for a pragmatist understanding of the interplay between normative theorizing and empirical study. How do these work together in judgments about the state of the law? |

In Advies 2/13 oordeelt het Hof van Justitie dat het Ontwerpakkoord aangaande de toetreding van de Europese Unie tot het EVRM niet in overeenstemming is met de Verdragen. Het Hof van Justitie meent dat het Ontwerpakkoord op elf punten in strijd is met de autonomie en eigenheid van het Unierecht (de eenheid, voorrang en effectiviteit van het Unierecht) en de positie van het Hof van Justitie als ultieme rechter over de interpretatie van het Unierecht in gevaar brengt. Dit Advies werd ontvangen als een grote verrassing. Deze annotatie bespreekt het Advies en besluit dat het Hof van Justitie hiermee de toetreding zeer moeilijk zo niet onmogelijk maakt. |

This article puts forward the claim that private law, and especially contract and tort, is the area of law that most clearly shows how law depends on social interactions. Taking its cue from Lon Fuller, interactional law is presented as a form of law that depends on informal social practices. Using tort and contract cases, it is argued that this implies that law is in open connection to moral norms and values, and that law cannot be understood without taking into account people’s everyday reciprocal expectancies. |

The population of Central and East European immigrants in the Netherlands has increased following the eastward expansion of the European Union. Over the past years, a lot of media and political attention seems to focus on problems with crime and disorder relating to this immigrant group. This article describes a two-step study on this matter. First, by undertaking a media discourse analysis, we assess to what extent we can speak of a ‘hardened climate’ regarding Central and East Europeans in the Netherlands between 2007 and 2013. Second, we have conducted qualitative interviews with Central and East Europeans in the Netherlands, to explore their perceptions of the Dutch media and political discourse. The results show that this group is often connected with crime and disorder in the media, and that many of our respondents experience this negative framing. Dangers of this trend regarding feelings of discrimination, scapegoating, and self-fulfilling prophecies, are discussed. |

De Letselschade Raad heeft de Gedragscode Behandeling Letselschade (GBL) herzien. De auteur gaat in op het proces van de totstandkoming van de nieuwe versie van de GBL. Daarbij behandelt hij de ethische uitgangspunten die daaraan thans expliciet ten grondslag liggen. Door bij behandeling van letselschade in te gaan op het waarom achter een bepaalde beslissing zal de benadeelde beter kunnen begrijpen welke argumenten tot de beslissing hebben geleid. Daardoor is hij, los van andere elementen die maken dat hij serieus wordt genomen, bijvoorbeeld ook beter in staat om zijn eigen belangen te behartigen. Dat levert dus een bijdrage aan het herwinnen van de menselijke waardigheid dat hem door het ongeval is ontnomen. |

Steven Winter’s argument is premised on a sharp contrast of individualist and social revolutions. I elaborate my doubts about his argument on three accounts, involving feminist perspectives at various points. First, I take issue with Winter’s portrayal of liberal theory, redirecting the focus of his concern to economic libertarianism rather than liberalism, and arguing a more hospitable attitude to the Kantian pith in the theory of democracy. Secondly, I discuss his conceptualization of democracy, adding the conceptual distinction of civil society and public sphere. Thirdly, I question his normative notion of socially situated selves as having an intrinsic relation to social freedom. I moreover consult cultural history on the gendered symbolics of market and democracy to further problematize Winter’s take on either’s meaning for social freedom. |
