    Classic pragmatists like John Dewey entertained an encompassing notion of science. This pragmatic belief in the continuities between a scientific, ethical and cultural understanding of the world went into decline in the middle of the 20th century. To many mid-century American and English philosophers it suggested a simplistic faith that philosophy and science could address substantive questions about values, ethics and aesthetics in a rigorous way. This critique of classic pragmatism has lost some of its force in the last few decades with the rise of neo-pragmatism, but it still has a hold over disciplines like economics and law. In this article I argue that this criticism of pragmatism is rooted in a narrow conception of what science entails and what philosophy should encompass. I primarily focus on one facet: John Dewey’s work on art and aesthetics. I explain why grappling with the world aesthetically, according to Dewey, is closely related to dealing with it scientifically, for instance, through the poetic and aesthetic development of metaphors and concepts to come to terms with reality. This makes his theory of art relevant, I argue, not only to studying and understanding law, but also to teaching law.

    Narrative criminology focuses on stories. It initially contrasted itself with standard approaches to interviewing. The founders of narrative criminology proposed that we understand that what the persons we investigate are telling us, as acting discursively and not as factual descriptions of events or accurate representations of their perspective. This critique I compare to previous critique on interviewing to show their overlap. Next, I critique these critiques. Finally, I propose several ways through which narratives in interviews can be enriched.

    In the last decade neuropsychological insights have gained influence with regard to age boundaries in legal procedures, however, in Dutch civil law no such influence can be distinguished. Recently, voices have been raised to improve children’s legal position in civil law: to reflect upon the minimum age limit of twelve years for children to be invited to be heard in court and the need for children to have a stronger procedural position.
    In this article, first the current legal position of children in Dutch law and practice will be analysed. Second, development of psychological constructs relevant for family law will be discussed in relation to underlying brain developmental processes and contextual effects. These constructs encompass cognitive capacity, autonomy, stress responsiveness and (peer) pressure.
    From the first part it becomes clear that in Dutch family law, there is a tortuous jungle of age limits, exceptions and limitations regarding children’s procedural rights. Until recently, the Dutch government has been reluctant to improve the child’s procedural position in family law. Over the last two years, however, there has been an inclination towards further reflecting on improvements to the child’s procedural rights, which, from a children’s rights perspective, is an important step forward. Relevant neuropsychological insights support improvements for a better realisation of the child’s right to be heard, such as hearing children younger than twelve years of age in civil court proceedings.

    In this introductory chapter we provide an overview of criminological research into intergenerational transmission of criminal behaviour that currently is, and has been, conducted both internationally and in the Netherlands. The most important findings of these studies are also discussed. Next, possible explanations are discussed for intergenerational transmission of crime in general, and more particularly for families that are involved in more serious and organized crime. Moreover, possible ways in which intergenerational transmission of crime can be prevented are discussed. Finally, we give some directions for future research on this topic and will introduce the contributions to this special issue.

Andreas Hofmann is a post-doctoral researcher at Freie Universität Berlin. He has held previous positions as lecturer at the University of Cologne and post-doctoral fellow at the Centre for European Research (CERGU), University of Gothenburg.

    This article introduces the concepts of play and playfulness within the context of legal-philosophical education. I argue that integrating play and playfulness in legal education engages students and prepares them for dealing with the perpetual uncertainty of late modernity that they will face as future legal professionals. This article therefore aims to outline the first contours of a useful concept of play and playfulness in legal education. Drawing on the work of leading play-theorists Huizinga, Caillois, Lieberman and Csikszentmihalyi, play within legal education can be described as a (1) partly voluntary activity that (2) enables achievement of learning goals, (3) is consciously separate from everyday life by rules and/or make believe, (4) has its own boundaries in time and space, (5) entails possibility, tension and uncertainty and (6) promotes the formation of social grouping. Playfulness is a lighthearted state of mind associated with curiosity, creativity, spontaneity and humor. Being playful also entails being able to cope with uncertainty. The integration of these concepts of play and playfulness in courses on jurisprudence will be illustrated by the detailed description of three play and playful activities integrated in the course ‘Introduction to Legal Philosophy’ at the Vrije Universiteit Amsterdam.

Emotions and Explanation in Cultural Criminology

    Cultural Criminology (CC) is one of the most recent and exciting developments in criminological theory. Its main argument is that mainstream criminological theories provide inadequate explanations of crime due to epistemological and theoretical flaws. CC’s alternative involves assuming a phenomenological and interpretative approach that focuses on the cultural and emotional components of crime. In this article I shall argue that although CC makes a valid demand for more realistic and complex explanations of crime, its own alternative needs to deal with two main challenges referred to its conceptualization of explanation and emotion. First, two problematic antagonisms should be avoided: understanding vs. causal explanation; and universal nomothetic explanations as opposed to ideographic descriptions. Considering recent developments in philosophy of social science, particularly the ‘social mechanisms approach’, CC should focus on explaining retrospectively through identification of specific causal mechanisms rejecting universal and predictive pretensions. Second, although cultural criminologists rightly question the emotionless character of criminological explanations, they lack an articulated alternative conceptualization of emotions to explain crime. A more refined concept needs to be elaborated in dialogue with recent advances in social sciences.

    Indigenous claims have challenged a number of orthodoxies within state legal systems, one of them being the kinds of proof that can be admissible. In Canada, the focus has been on the admissibility and weight of oral traditions and histories. However, these novel forms are usually taken as alternative means of proving a set of facts that are not in themselves “cultural”, for example, the occupation by a group of people of an area of land that constitutes Aboriginal title. On this view, maps are a neutral technology for representing culturally different interests within those areas. Through Indigenous land use studies, claimants have been able to deploy the powerful symbolic capital of cartography to challenge dominant assumptions about “empty” land and the kinds of uses to which it can be put. There is a risk, though, that Indigenous understandings of land are captured or misrepresented by this technology, and that what appears neutral is in fact deeply implicated in the colonial project and occidental ideas of property. This paper will explore the possibilities for an alternative cartography suggested by digital technologies, by Indigenous artists, and by maps beyond the visual order.

    This paper discusses three approaches that can be helpful in the area of comparative rights jurisprudence, oriented in reference to three different kinds of studies that are possible in that area. To a large extent the methods for a comparative legal research depend on the research question and the goal of the researcher. First, a comparative law study may focus on the sociocultural context that led to the elaboration of differences or similarities in the protection of rights. Second, a comparative law approach can be a normative enterprise. It can focus on engaging in a philosophical analysis enlightened by the differences or similarities in the regulation of rights, in order to propose concrete solutions for the regulation of a right. Third, a comparative law approach can combine both elements of the two previously mentioned approaches. The paper discusses the challenges that the researcher faces in her attempt to use these methodologies and how these challenges can be overcome. The law as a normative discipline has its own constraints of justifiability. If what motivates a comparative law study is the search for principles of justice the researcher needs to persuade that her methodological approach serves her aim.

    Hoewel al decennia onderzoek wordt gedaan naar media-effecten op ‘de’ politiek, is de aandacht voor de invloed van de media op wetgeving bescheiden. In deze bijdrage staat dit effect van media-aandacht op de parlementaire behandeling van wetsvoorstellen centraal. Uit drie gevalsstudies blijkt dat die aandacht weliswaar een rol speelt, maar dat het effect op de substantiële uitkomst van het wetgevingsproces verwaarloosbaar is. Media-aandacht heeft een zogenoemd klemtooneffect: het legt de nadruk op een onderwerp, argument of actor, en wordt primair als retorisch instrument gebruikt. Wetgevingsprocessen blijken niet immuun voor mediaberichtgeving, maar worden er zeker niet door gedomineerd.

    In his thought-provoking article, Rainer Forst develops a discourse-theoretical approach to the justification of basic rights, and argues that it is superior to interest-based and autonomy-based views. I cast doubt on the superiority of the discourse-theoretical approach. I suggest that, on reflection, the approach suffers from the same difficulties that Forst believes undermine rival views. My discussion raises broader questions about what desiderata a good justification of basic rights should satisfy.

Laura Valentini is associate professor of Political Science at the London School of Economics and Political Science.

    This article examines the main assumptions and theoretical underpinnings of case study method in legal studies. It considers the importance of research design, including the crucial roles of the academic literature review, the research question and the use of rival theories to develop hypotheses and the practice of identifying the observable implications of those hypotheses. It considers the selection of data sources and modes of analysis to allow for valid analytical inferences to be drawn in respect of them. In doing so it considers, in brief, the importance of case study selection and variations such as single or multi case approaches. Finally it provides thoughts about the strengths and weaknesses associated with undertaking socio-legal and comparative legal research via a case study method, addressing frequent stumbling blocks encountered by legal researchers, as well as ways to militate them. It is written with those new to the method in mind.

    This article describes the European research project ALTERNATIVE, which studies the possible implementation of restorative justice approaches in intercultural conflicts. Besides theoretical research into concepts such as justice, security, conflict (transformation) and restorative justice, action-research was implemented in four diverse intercultural settings (Austria, Hungary, Serbia and Northern Ireland). In order to compare those settings, an innovative comparative research method was developed through which the various realities are ‘thickly described’ within evaluation grids. The article describes the different aspects of the research and reflects upon the question whether a more broad understanding of restorative justice, surpassing the judicial sector and aspects, is emerging.

    Pragmatism has become an established academic topic focused on an accepted canon of works and a number of seminal authors. There is something ironic about this fixation of the Pragmatist tradition. An anticipation of transience and embrace of adaptability runs through many of the classic works of Pragmatism. Nevertheless, there seems to be a tendency to fixate Pragmatism and freeze it in its classic iterations, especially with respect to its philosophy of scientific inquiry. The article seeks to retrieve the dynamics and adaptability the classical Pragmatists built into their notion of scientific inquiry. It seeks to illustrate the need for such flexibility with recent developments in the field of economics. When the financial crisis struck in 2007-2008, this involved more than the insolvency of a number of large banks. The crisis, at the very least, also involved the bankruptcy of a dominant economic model. It raised questions about the rationality of markets and the widespread faith in soft-touch regulation. It cast doubt on decades of neo-classical economic dogma that counseled small government, privatisation, and free markets. Neo-classical economics did not float free from other concerns. It informed notions about the role of the state, the limits of public policy, and the scope of democratic decision-making. Indeed, faith in rational, self-correcting markets affected debates in disparate disciplines like law, political science, philosophy, ethics, and history in many non-trivial ways. Hence, the financial crisis is also a crisis of scientific research.

    How best to account for moral quality in adjudication? This article proposes a six-pack of judicial virtues as part of a truly virtue-centred approach to adjudication. These virtues are presented as both constitutive and indispensible for realizing moral quality in adjudication. In addition, it will be argued that in order to honour the inherent relational dimension of adjudication a judge should not only possess these judicial virtues to a sufficient degree, he should also have the attitude of a civic friend. The Aristotelian concept of civic friendship will be proposed as an important complement to a virtue-ethical approach to adjudication.

    There is a distinct place for legal doctrinal methods in legal-interdisciplinary research methodologies, but there is value to be had in expounding that place – in developing a deeper understanding, for instance, of what legal doctrinal analysis has to offer, wherein lies its limitations, and how it could work in concert with methods and theories from disciplinary areas other than law. This article offers such perspectives, based on experiences with an ‘advanced’ legal-interdisciplinary methodology, which facilitates a long-term study of the growing body of practice generated by citizen-driven, independent accountability mechanisms (IAMs) that are institutionally affiliated with multilateral development banks. The article demonstrates how legal doctrinal methods have contributed towards the design and development of a multipurpose IAM-practice database. This database constitutes the analytical platform of the research project and also facilitates the integration of various types of research questions, methods and theories.

    The paper offers an argument for a conception of legal pluralism, which has some substantive upshots and at least partly alleviates that legal pluralism may regress to rampant relativism. In particular, I will argue that law in its pluralist conception is inextricably linked to the requirement of public justification. This is not by way of appealing to any transcendental normative ideals but as a matter of entailment of the very practice of law. But, perhaps to the disappointment of many, this procedural requirement is the only practical consequence of the concept of law. For thicker, substantive limits to what law can do and for ways in which legal pluralism may be reduced in real contexts one will have to turn to the actual circumstances furnishing the law with content and a different kind of thinking about the law.

    Order in Security. A Dynamic Perspective (Schuilenburg 2012) is a theoretical and empirical study of self-organizing processes of change taking place within what the author calls ‘security assemblages’. In this review, the study is favorably evaluated as a form of empirical philosophy and praised for usefully introducing French philosophy into the field of security studies. In terms of empirical sociological research, however, the study is more critically reviewed as offering little insight into the perceptions, emotions, interpretations and meanings that actors assign to their conduct in this field.
