A comparative law analysis of no-fault comprehensive compensation funds: international best practice & contemporary applications

    Compensation funds in different jurisdictions have varying functions and objectives to remedy loss. This doctoral research addresses the significant knowledge gap in relation to no-fault comprehensive compensation funds. These are a single publicly-managed structure that provides a wide, compulsory and complete replacement for tort remedies.
    The research identifies the hallmarks of these funds’ successful establishment, administration, operation and further development. This includes analysis of the functional harms covered, compensation quantum and funding. There is also a novel first principles analysis of the interaction between large funds and human rights law. These analyses inform concrete recommendations for the legislative improvement of existing funds, new funds, and the framework’s application to contemporary liability problems.

    The ports of Rotterdam and Antwerp are among the main European ports of entry for the import and further distribution of cocaine. Earlier research underlines the interchangeability of these ports regarding the criminal networks trafficking cocaine into Europe. In this contribution, the interchange­ability of these European sea ports regarding cocaine trafficking is questioned. Based on empirical research, and applying the routine activity approach, the Port of Rotterdam and the Port of Antwerp are compared with respect to their physical characteristics, the potential, motivated offenders, as well as the existing public and private security measures.

    Op 29 januari 2020 vernietigde het Gerecht (Hof van Justitie) een bevel van het Europees Parlement als werkgever waarbij een aantal tolken en conferentietolken werd opgeëist. Het bevel kwam tot stand om het hoofd te bieden aan een staking. Het is de eerste maal dat het Hof van Justitie uitdrukkelijk erkent dat EU-ambtenaren een recht te staken hebben. Het arrest illustreert dat beperkingen van in het Handvest van de grondrechten van de Europese Unie gewaarborgde grondrechten bij wet moeten zijn voorzien. Dit veronderstelt dat een duidelijke en voldoende nauwkeurige juridische grondslag moet bestaan. Deze bijdrage werpt licht op het weinig gekende stelsel van collectieve arbeidsverhoudingen binnen de Europese instellingen.

    This article focuses on the posting of workers in the aviation industry. The main problem is that it is not clear in which situations the Posting of Workers Directive should be applied to aircrew (i.e. cabin crew and pilots). The aviation sector is characterised by a very mobile workforce in which it is possible for employees to provide services from different countries in a very short timeframe. This makes it, to a certain extent, easier for employers to choose the applicable social legislation, which can lead to detrimental working conditions for their aircrew. This article looks into how the Posting of Workers Directive can prevent some air carriers from unilaterally determining the applicable social legislation and makes some suggestions to end unfair social competition in the sector. This article is based on a research report which the authors drafted in 2019 with funding from the European Commission (hereafter the ‘Report’)

    De komst van volledig zelfrijdende of autonome auto’s doet vele juridische vragen rijzen doordat zelfrijdende auto’s geen bestuurder hebben. Deze vragen rijzen onder meer ten aanzien van de toepassing van bepalingen van het RVV 1990 en de WVW 1994 die de bestuurder als normadressaat hebben. Daarnaast komen aspecten van cybersecurity aan bod in dit artikel. Er wordt in deze bijdrage onder meer een voorstel tot wijziging van artikel 6 WVW 1994 gedaan, om zo te voorzien in een bestuurderloze toekomst.

    In former times, citizens themselves were responsible for ensuring and protecting their own safety. Over the years, this responsibility largely shifted to the government, partly due to the establishment of an institutionalized police force. In recent years, citizens have increasingly reestablishing themselves in domain of social security. Citizens are engaged in tasks that are traditionally seen as primarily the responsibility of the police, such as law enforcement, criminal investigation and immediate in case of emergencies.
    Technology can be considered as one of the major driving forces behind this increasing contribution of citizens in the field of security. Technology makes it possible to quickly find and share information and enhances people’s ability to deal with cognitively complex tasks. In a certain way, technology democratizes police work by making the skills and tools available for every citizen.
    In this article we will discuss the value of a specific form of technological support for citizens in their search for missing persons: the missing persons app ‘Sarea’. The Netherlands has a high number of missing persons and in many incidents citizens start searching themselves. Often, this citizen initiatives are uncoordinated. Therefore, an app has been developed by the police to help citizens start and coordinate their own searches for a missing person.

    The increasing volume of waste generated globally is one of the most prominent environmental issues we face today. Companies responsible for the treatment or disposal of waste are therefore among the key actors in fostering a sustainable future. Yet the waste industry has often been characterised as a criminogenic one, causing environmental harm which disproportionately impacts the world’s most vulnerable regions and populations. In this article, we illustrate how companies operating in global supply chains exploit legal and enforcement asymmetries and market complexities to trade waste with countries where facilities for environmentally sound treatment and disposal of waste are lacking. We draw on two contemporary cases of corporate misconduct in the Global South by companies with operating headquarters in the Global North: Seatrade and Probo Koala. We compare these cases building on theories about corporate and environmental crime and its enforcement. This explorative comparative analysis aims to identify the key drivers and dynamics of illegal waste dumping, while also exploring innovative ways to make the waste sector more environmentally responsible and prevent the future externalisation of environmental harm.

A Case Study on the Role of Consumers in Energy Transition

    As our economies continue to focus on growth, competition and maximisation of consumer choice, the global increase in consumption takes vast environmental and social costs and cause irreversible harm to our climate and environment. The urgency of reducing human footprint and to diminish one of the root causes of a declining climate and environment is irrefutable. In the shift that globally has to take place, a decentralised energy system relying on more distributed generation, energy storage and a more active involvement of consumers form a crucial component of renewable energy solutions. The move from a highly centralised to a more decentralised power system involves an increasing amount of small-scale (intermittent) generation from renewable energy which is located closer to the point of final consumption. In order to steer consumption towards sustainability national governments and supranational organisations have adopted policies and corresponding legislation that address individual consumers as rational and active choice-makers who make socially responsible choices when they receive the ‘right’ amount of information. By relying on insights from modern consumption theories with contributions from sociology, this article questions the effectiveness and legitimacy of these ‘consumer-centred’ policies and laws. First, the article argues that the single focus on individual consumer behaviour as a rational and utility maximising market actor fails to take into account the complexity of consumption, which is fundamentally influenced by social norms and its broader institutional setting. Although consumers are willing to consume more sustainably, they are often ‘locked in by circumstances’ and unable to engage in more sustainable consumption practices even if they want to. Second, by relying on evidence from sociological studies the article argues that individual consumers are not the most salient actors in support of sustainable consumption. Even though the urgency of the energy transition and the critical role consumers play in (un)sustainable energy consumption is acknowledged in both the EU and its Member States, their laws and policies remain grounded on goals of economic growth with competitive economies, the sovereignty of consumer choice and wealth maximisation, instead of aiming at slower economic growth or even degrowth, reducing overall resource use and consumption levels and introducing radically different ways of consumption.
    Third, the role of law is underlined as a social institution both as a constraint on the autonomous acts of consumption, dictating the normative frameworks within which the role of consumer is defined, and as a facilitator which consumers might also employ, in order to determine for themselves particular normative parameters within which consumption can occur.
    The Netherlands, which serves as a case study in this article, has reached important milestones in its energy transition policy since 2013. Still, it remains strongly focused on economic rationality and market competitiveness. Even though various models of consumer participation exist and local consumer energy initiatives are flourishing and are recognised as key actors in the energy transition, they remain embedded in institutional, structural and behavioural settings where consumers still face challenging sociocultural barriers to sustainable practices.
    In light of these legal, political and social complexity of energy transition, the article offers a critical analysis of the current Dutch law in its broader legal context of EU law in order to answer the question what the role of (energy) law is in steering consumers towards sustainable energy consumption.

Patronen in regelovertreding in de chemische industrie

    Unlike criminal career research into the criminal behavior of natural persons, longitudinal research into rule violations by corporations is still scant. The few available studies are mostly limited to US corporations, and suffer from either a small sample size or a short follow-up period, limiting the generalizability of their findings. The present study uses longitudinal data on rule violating behavior of 494 Dutch chemical corporations derived from yearly inspections (N=4.367) of the relevant safety and environmental agencies between 2006 and 2017. The study aims to gain insight in the patterning of rule violations by Dutch chemical corporations, and the extent to which these patterns are associated with sector and corporate characteristics. The results show that rule violation is common among Dutch chemical corporations. A small minority of chronically violating corporations however, is responsible for a disproportional share of all observed rule violations. Using group-based trajectory modelling (GBTM) we distinguish several longitudinal patterns of rule violations in our data. Available sector and corporation characteristics are only weakly associated with the patterns of rule violations identified.

    This article provides an overview of the developments about the armed on-board protection of Dutch vessels under Dutch law. The Dutch position has changed over the years. In 2011, the starting point was that private security companies (PSCs) are not to be allowed. It was expected that adequate protection of Dutch vessels could be provided by vessel protection detachments (VPDs). Although not considered as an absolute statutory bar, the state monopoly on force was considered the main argument against PSCs. After optimising the use of VPDs and given the development in other countries, the approach changed into a ‘VPS, unless …’-approach. Under the new Protection of Merchant Shipping Act that is expected to come into force in the second half of 2019, PSCs can be employed only if no VPS is available. This article gives an overview of the argumentation in this change of view over the years. It also explores the headlines, criteria and procedures of the new law and some other topics, including the position of the master under the upcoming law. In line with the other country reports, it enables the comparative study in the last article of this special issue.

    The power to regulate on-board protection of merchant vessels lies with the flag state. However, the national models of regulation are not developed in a unilateral vacuum. In fact, the whole concept of flag state jurisdiction and legislative power has to be understood and exercised on the national level in close relation with the general regime of the international law of the sea. The aim of the article is therefore two-fold: first, it aims to provide a background for the country reports in this special issue by giving a brief insight into the problem of piracy in the twenty-first century and the international approaches towards this problem. Here the article also provides an insight into the legal background by presenting the concept of piracy in the law of the sea and connected law enforcement powers. Thus, this part of the article provides the overall context in which the discussions concerning on-board protection and the development of national regulations have occurred. Second, the article analyses the issue of on-board protection from the perspective of the legal framework in international law, as well as relevant international soft-law instruments, influencing the development on the national level. On-board protection of vessels as such is not regulated in the international law; however, international law provides a form of general legal setting, in which flags states navigate. Thus, this article aims to draw a picture of the international context in which flags states develop their specific legal approach.

    The sharp increase of piracy attacks in the last two decades was followed by a parallel increase of demand in the maritime security sector. A plenty of flag States around the world have started to authorize the deployment of armed security guards, either military or private, aboard commercial ships. In 2011, Italy also introduced the possibility of embarking armed security services to protect Italian flagged ships sailing in dangerous international waters. Like the other flag States’ legal systems, the newly adopted Italian legislation aims to preserve the domestic shipping industry which was particularly disrupted by modern-day pirates. On the other hand, the doubling of approaches of the Italian legal and regulatory framework, initially privileging military personnel and then opting for the private solution, took the author to investigate the main relevant features of the Italian model of regulation and to analyze the recent developments of the domestic legal practice on counterpiracy armed security services, focusing on the role that customary and treaty obligations of international law played for the realization at national level of on-board armed protection of Italian ships. The use of lethal force at sea and the relationship between the shipmaster and the security guards will receive specific attention in this article.

    This article examines the legal issues pertaining to the use of civilian armed guards on board Danish-flagged ships for protection against piracy. The Danish model of regulation is interesting for several reasons. Firstly, the Danish Government was among the first European flag States to allow and formalise their use in a commercial setting. Secondly, the distribution of assignments between public authorities and private actors stands out as very pragmatic, as ship owners and contracting private security companies are empowered with competences which are traditionally considered as public administrative powers. Thirdly, the lex specialis framework governing the authorisation and use of force in self-defence is non-exhaustive, thus referring to lex generalis regulation, which does not take the special circumstances surrounding the use of armed guards into consideration. As a derived effect the private actors involved rely heavily on soft law and industry self-regulation instrument to complement the international and national legal framework.

    The maxim ‘law in books and law in action’ relays an implicit dichotomy, and though the constitutive nature of law is nowadays commonly professed, the reflex remains to use law in books as an autonomous starting point. Law however, it is argued in this article, has a storyline that commences before its institutional formalisation. Law as ‘a continuous process of becoming’ encompasses both law in books and law in action, and law in action encompasses timelines both before and after the formal coming about of law. To fully understand law, it is necessary to understand the entire storyline of law. Qualitative studies in law and society are well equipped to offer valuable insights on the facets of law outside the books. The insights are not additional to doctrinal understanding, but part and parcel of it. To illustrate this, an ethnographic case study of local bylaws regulating an ethnically diverse public space of everyday life is expanded upon. The case study is used to demonstrate the insights qualitative data yields with regard to the dynamics in which law comes about, and how these dynamics continue for law in action after law has made the books. This particular case study moreover exemplifies how law is one of many truths in the context in which it operates, and how formalised law is reflective of the power constellations that have brought it forth.

    Drones en drone-gerelateerde cybertechnologieën nemen een vlucht in het veiligheidsdomein in de vorm van toepassingen door het leger, de politie, brandweer, private beveiligingsbedrijven, en ook deurwaarders, agrariërs en burgerinitiatieven. Drones werden in eerste instantie ontwikkeld voor militaire doeleinden. Hun aanpassingsvermogen als universele platforms voor beeldregistratie en goederenvervoer leidt tot hoge verwachtingen rond toepassing in het civiele domein. Dit artikel onderzoekt de ethische aspecten van “dual use” van drones en gerelateerde technologieën. Verschillende dimensies van dual use worden verkend: de technologisch ontwikkeling, maar ook de ontwikkeling van wet- en regelgeving in Amerika en Europa. Voor het Nederlandse veiligheidsdomein is relevant dat dit artikel bijdraagt aan het signaleren van de noodzaak om de ontwikkeling en toepassing van drones in breder perspectief te bezien. Drones en hun toepassingen maken deel uit van de internationale markt van militaire organisaties en van veiligheidsorganisaties in het publieke en private domein. Bovendien maken ze veelal deel uit van geïntegreerde systemen en van wereldwijde platforms voor consumentenelektronica. Dit artikel is een van de resultaten uit het door NWO gefinancierde project 'Responsible Design of Drones and Drone Services: Towards an Ethical and Juridical Tool For Drone Design and Risk Assessment' (Project no. 313-99-318). Het project was gericht op het ontwikkelen van een instrument voor ontwikkeling en gebruik van dronetoepassingen uitgaande van methoden als Responsible Research & Innovation (RRI) en Value Sensitive Design (VSD).

    De invoering van de zelfrijdende auto lijkt nog maar een kwestie van jaren. Van automatisering van de rijtaak wordt veel verwacht in termen van verbetering van de verkeersveiligheid, rijcomfort en doorstroming. Maar de techniek brengt ook nieuwe risico’s en daaruit voortvloeiende aansprakelijkheidsvragen mee. Een van die vragen betreft de potentiële aansprakelijkheid van de producent. In deze bijdrage bespreekt de auteur de op de Europese richtlijn gebaseerde aansprakelijkheidsregeling van afdeling 6.3.3 BW.
