Wrongful convictions and miscarriages of justice, their reasons and effects, only rarely become the subject of academic debate in Poland. This article aims at filling this gap and providing a discussion on the current challenges of mechanisms available in Polish law focused on the verification of final judgments based on innocence claims. While there are two procedures designed to move such judgment: cassation and the reopening of criminal proceedings, only the latter aims at the verification of new facts and evidence, and this work remains focused exactly on that issue. The article begins with a case study of the famous Komenda case, which resulted in a successful innocence claim, serving as a good, though rare, example of reopening a case and acquitting the convict immediately and allows for discussing the reasons that commonly stand behind wrongful convictions in Poland. Furthermore, the article examines the innocence claim grounds as regulated in the Polish criminal procedure and their interpretation under the current case law. It also presents the procedure concerning the revision of the case. The work additionally provides the analysis of the use of innocence claim in practice, feeding on the statistical data and explaining tendencies in application for revision of a case. It also presents the efforts of the Polish Ombudsman and NGOs to raise public awareness in that field. The final conclusions address the main challenges that the Polish system faces concerning innocence claims and indicates the direction in which the system should go. |

Those involved in a motor vehicle accident often have emotional needs that are not being met within the current framework of personal injury settlement. These needs include sharing one’s (side of the) story, getting in touch with the other person(s) involved and offering or receiving apologies. Following Nils Christie’s theory of ‘stolen’ conflicts, the fact that the people involved are often represented by lawyers or insurance companies is problematic because it alienates them from each other and it thwarts proper recovery. Incorporating restorative justice could offer a solution to this ‘theft’ of conflict, as it focuses on bringing all involved together to restore any of the harm done by concentrating on their needs. The central question to this dissertation is: how can restorative justice play a role in the sustainable resolution of conflicts after motor vehicle accidents so that the current insurance and liability system can better meet the immaterial needs of victims and perpetrators? Via several projects, the role of lawyers and insurance companies is studied. How beneficial or adversarial are their influences on victims and offenders? And can they incorporate restorative justice in their practice? The first publication is expected at the end of this year. |

According to the traditional view, the ultimate aim of the extraordinary review (recurso de revisión) provided in the Spanish justice system was to deal with wrongful criminal convictions and correct those serious miscarriages of justice which became apparent only after the judgment had become final. However, the 2015 reform called this traditional view into question by formally including two additional grounds for review that are not necessarily related to the correcting miscarriages or blatant mistakes in the assessment of the facts made by the sentencing court. This paper aims to give an overview of the extraordinary review in Spain. To that end it will first address the legal framework and its practical implementation, as well as present pitfalls and best practices. Finally, future trends and challenges will be identified in order to improve the protection of defendants who have suffered a wrongful conviction. |

This article adopts German philosopher Hans Vaihinger’s Philosophy of “as if” as a vehicle to sketch the main features of the emerging research domain of narrative victimology, as well as address some of its limitations. Vaihinger emphasizes the importance of useful untruths, i.e. things we know to be untrue, but nevertheless behave as if they are not, if that strengthens their use as instruments for us to find our way more easily in the world. This applies to our daily lives, but also to our societal institutions and the models and metaphors that underlie our approaches to (social) science. The paper argues that the narrative metaphor of the historical event is often more apt to enhance our understanding of victimological phenomena than that of the mechanism, which is the default metaphor of (social) science. The paper subsequently describes four areas of inquiry of narrative victimology: victimisation’s impact on (life) stories; narratives in the aftermath of victimization; narratives of victim’s experiences with justice processes and the coincidence and juxtaposition of the victims’ narrative with narratives of other significant parties. For all its merits however, the narrative metaphor is also a “useful untruth”, equipped with its own limitations, for instance the difficulty of language in describing first hand experiences of victims and the possibility that narrative structures will be imposed upon victim experiences. |

In each youth justice system, several age limits exist that indicate what type of reaction can and may be connected to the degree of responsibility that a person can already bear. Civil liability, criminal responsibility and criminal majority are examples of concepts on which age limits are based, but whose definition and impact is not always clear. Especially as far as the minimum age of criminal responsibility (MACR) is concerned, confusion exists in legal doctrine. This is apparent from the fact that international comparison tables often show different MACRs for the same country. Moreover, the international literature often seems to define youth justice systems by means of a lower and upper limit, whereas such a dual distinction is too basic to comprehend the complex multilayer nature of the systems. This contribution therefore maps out and conceptually clarifies the different interpretations and consequences of the several age limits that exist within youth justice systems. To that extent, the age limits of six countries are analysed: Argentina, Austria, Belgium, the Netherlands, New Zealand and Northern Ireland. This legal comparison ultimately leads to a proposal to establish a coherent conceptual framework on age limits in youth justice. |

In previous observational studies among operational police officers, some officers stated that if a victim is not willing to (officially) report a crime to the police, they are not able to police these cases. This rather cynical and fatalistic statement raises several questions. What do police officers mean when they say this? What do they actually do in those cases and why? In this paper we try to answer these questions based on explorative qualitative interviews with several police officers in two police teams in the Netherlands. The results show that even though police officers recognize these statements among their colleagues, they do not agree with them and in practice police officers show a lot of effort and involvement in these cases. In fact, police officers have several possible strategies available to deal with these cases. Which strategy they opt for depends on various pragmatic, organisational and moral considerations. |

In the Internet era, banking fraud has become a common way of stealing money. According to victim surveys, this offense has already led to significant numbers of victims. In this article, the authors focus on illegal bank account withdrawals, which are an indication of identity fraud. For this they use data on 636 victims who were surveyed in the LISS panel. Using the concept of ‘capability to act’, as used in the WRR report Why knowing what to do is not enough (2017), the authors model which type of victim takes action to get the stolen amount reimbursed and which type of victim succeeds in doing so. They expect that the less educated and people with low self-control more often refrain from contact with authorities (bank, police) and therefore more often receive no compensation and remain with higher residual damage. The results show that approximately four in five victims of unauthorized bank debits are fully compensated. For the group of victims for whom this is not the case – remaining with residual damage – most of the hypotheses are confirmed. |

In our daily decision-making processes, attitudes play an important role. An attitude is an evaluative judgement of a person, object or an issue on a scale of favorability. A large amount of research has been done on the role of attitudes in our daily decision-making processes. There is, however, a gap in empirical knowledge when it concerns the role of attitudes in the professional judicial decision-making process. It has been accepted that the professional judicial decision-making process has a subjective element, but this subjective element remains unexplained. Attitudes are inherently personal and subjective, and they can make our decision-making process easier. They can, however, also be the basis for biases and prejudices. Herein lies a potential risk, especially in the professional judicial decision-making process. If attitudes play a role in the decision-making process of judges there is a possibility that impartiality, one of the judiciary’s core professional values, might be unobtainable. To see whether attitudes play a role in the professional judicial decision-making process semi-structured interviews will be conducted among judges, who will also be asked to fill in a scenario survey. Hopefully the obtained data will lead to a start in filling this gap in empirical knowledge. |

Deze bijdrage bevat enkele krachtlijnen met betrekking tot de invulling van dit begrip. |
