    In this article a critical reflection upon age limits applied in the law is provided, in light of the tension that exists in international children’s rights law between the protection of children and the recognition of their evolving autonomy. The main research question that will be addressed is to what extent the use of (certain) age limits is justified under international children’s rights law. The complexity of applying open norms and theoretically underdeveloped concepts as laid down in the UN Convention on the Rights of the Child, related to the development and evolving capacities of children as rights holders, will be demonstrated. The UN Committee on the Rights of the Child struggles to provide comprehensive guidance to states regarding the manner in which the dynamic legal position of children should be applied in practice. The inconsistent application of age limits that govern the involvement of children in judicial procedures provides states leeway in granting children autonomy, potentially leading to the establishment of age limits based on inappropriate – practically, politically or ideologically motivated – grounds.

    This study describes how penal protection orders contribute to victim perceptions of safety, drawing upon data collected via a victim survey (n=101). Perceived victim safety is explored based on the factors of personal vulnerability, procedural justice, and experiences with compliance and enforcement. Results show that more than half of the victims in this study does not feel safer because of the protection order. The effects of the orders are even weaker for feelings of relaxation and feelings of anger about the situation. An increase in perceptions of control over the situation appears to be the most important predictor of an increase in feelings of safety and a decrease in feelings of anger, but is unrelated to an increase in feelings of relaxation. The effect of procedural justice differs per outcome measure. It is associated positively with increased feelings of safety, but negatively with decreased feelings of anger because of the protection order. The positive association with feelings of safety is partly indirect via personal vulnerability. Findings result in various suggestions for future research.

    What role do Dutch criminologists play in the – especially since the onset of the so-called migration crisis – heated national and international debates on the criminalization of migration and border mobility? This will be the central question in this publication. Based on an inventory of national and international peer-reviewed publications written by Dutch criminologists, the article will reflect upon Dutch criminologists’ public role. In addition, based on the observed ‘silences’ in the scholarly debates on the criminalization of migration and border mobility, three avenues for further criminological research will be identified.

    Whereas the starting point of victimisation is clearly marked by a co-occurence of harm and wrong, the end of victimhood is not as straightforward. What is more, because victimisation is a social construct, the label of ‘victim’ is established in social interaction, meaning that third party observers have a role in the understanding of the (limits of) victimisation. In this article, I suggest that third party observers may understand attempts at restorative justice, more specifically, an apology, as an indicator of recovery of the victim. If this is true, they may expect the victim to decrease emotional display that signals victimisation after receiving an apology. If the victim continues to display similar signals of victimisation, this may result in negative victim-oriented responses. In an exploratory repeated measures vignette study, I show that third party observers evaluate the victim less positively after the victim received an apology than before they received this apology. The results imply that in understanding the (limits of) victimhood, we should consider the dynamics between victim and offender but also a broader circle of third-party observers. This is also important for restorative justice.

    The Employment Appeal Tribunal (EAT) has clarified the grounds on which bad faith can be alleged in a victimisation claim under the Equality Act 2010 (‘EqA’). The EAT held that although motive in alleging victimisation could be relevant, the primary question is whether the employee acted honestly in giving the evidence or information, or in making the allegation. The concept of ‘bad faith’ is thus different in victimisation claims than whistleblowing claims.

    Whether and under which conditions restorative justice can be applied to cases of corporate violence is explored starting from the phenomenon of corporate violence, defined as acts committed by corporations in the course of their regular activities but with harmful consequences for people’s health. Specific characteristics of different types of corporate violence are presented, as well as victims’ needs, experiences and expectations. The applicability of restorative justice, but also the need of its rethinking, is discussed through an analysis of the role of its key actors and the concepts of participation and restoration.

    This article explores victimisation by corporate violence on the basis of case studies, interviews and focus groups with victims and professionals carried out in the European project Victims and Corporations. The typical characteristics of victimisation by corporate violence are described, as well as the harmful effects for victims and their social context. The problematic aspects of tackling corporate violence through criminal procedures lead to a first evaluation of the possible contribution of restorative processes to this field on the basis of interviews and a focus group with restorative justice professionals.

    Social engineering is the usage of social manipulation and psychological tricks to make the targets assist offenders in their attack. This paper aimed to discuss the success of social engineering attacks and interventions in an organisational setting. Three kinds of social engineering experiments were discussed, each using a different modality (i.e. face-to-face (f2f), email and telephone). In each experiment, the targets (i.e. participants) were persuaded to perform actions that contribute to their victimisation.
    A portion of the participants in both the f2f and telephone experiment received an intervention to reduce victimisation. The conclusion is that awareness raising about dangers, characteristics and countermeasures related to social engineering proved to have a significant positive effect on protecting the target. The results of these experiments allow practitioners to focus awareness campaigns to maximise their effectiveness.

    This study departs from the notion that current high-tech crime developments bring various new challenges for the rather anthropocentric, instrumental and dualistic theoretical repertoire of criminology. The article reflects on these challenges and proposes the alternative ‘cyborg crime’ perspective. This concept is the result of an explorative research on the theoretical potential of the actor-network theory (ANT) for cybercrime. The study concludes that ANT and the ensuing cyborg crime perspective enables to grasp certain dimensions of cybercrime more profoundly. ANT can move us (criminologists) beyond the classical novelty debate surrounding cybercrime and stimulate theoretical innovation.

    The Court of Appeal has overruled the recent Employment Appeal Tribunal (EAT) decision in Efobi – v – Royal Mail [2017] IRLR 956 (reported in EELC 2017/41), restoring the previous position that a claimant in a discrimination case has the initial burden of proof – which ‘shifts’ to the respondent to provide an explanation of why its conduct was non-discriminatory if a prima facie case is proven.
    The Court of Appeal disagreed with Mrs Justice Elisabeth Laing’s ruling in Efobi, that section136 of the Equality Act 2010 had made a substantial change to the law when it was introduced, on the basis that it could not be fair that a respondent should have to discharge the burden of proof without the claimant first showing that there is a case to be answered. Lord Singh ruled that it could not have been Parliament’s intention to remove this initial burden of proof when it enacted the Equality Act.

    The Employment Appeal Tribunal (EAT) has adopted a new approach to the burden of proof in discrimination cases. Up to now, the courts have held that the claimant must, in the first instance, prove sufficient facts from which (in the absence of any other explanation) an inference of discrimination can be drawn. Once the claimant has established these facts, the burden of proof shifts to the respondent to show that he or she did not breach the provisions of the Act. The EAT has now said that courts should consider all of the evidence (both the claimant’s and the respondent’s) when making its finding of facts, in order to determine whether or not a prima facie case of discrimination has been made out. It is then open to the respondent to demonstrate that there was no discrimination. This is an important development in how the burden of proof is dealt with in discrimination cases. It clarifies that it is not only the claimant’s evidence which will be scrutinised in determining whether the burden of proof has shifted, but also the respondent’s evidence (or lack thereof).

    The Employment Appeal Tribunal (‘EAT’) considers the Equality Act – and to some extent the Equal Treatment Directive – and gives guidance about harassment and victimisation claims as well as on principals’ liability for acts of their agents. In a decision that declines to expand the scope of harassment claims, the EAT has decided, in particular, that it is not enough for claimants alleging harassment to simply assert that they are disabled, without meeting the definition of disability or falling into another protected situation.

    The rationale behind refugee law is that people who fear persecution in their home country can seek and find a safe haven in another country. The situation in Eritrea with its national service and wide-spread human rights violations is reason why many Eritreans flee their country. A vast number of them want to apply for asylum in European countries. After a risky journey over the African continent where they face risks of kidnappings, trafficking for ransom, and situations of inhuman and degrading treatment, they reach Europe. Some of them continue their journey to the Netherlands. The central question in this article is whether or not their safety and well-being are at stake once they arrive in the Netherlands. Situations of involvement of and intimidation by the Eritrean regime in the Netherlands, diaspora tax that is forcibly collected, involvement of the Orthodox Church and indications of human trafficking have been reported in media and reports, by individuals and organisations. In this article the outcomes of a research on the concerns about the well-being of Eritrean asylum seekers in reception centres among employers of organisations responsible for their safety and well-being are presented and discussed. Data were collected and discussed during four focus group meetings with a total of 33 professionals. The concerns are divided in three groups: 1) Concerns about the capacities and possibilities to integrate in Dutch society, 2) Concerns about religion and rituals, and 3) Concerns about indications of human trafficking. These concerns are further elaborated based on which the conclusion is drawn that more tailored support and assistance is required for successful integration of Eritreans in Dutch society, their empowerment and resilience against threats and challenges in Dutch society.
