    A recent challenge to the constitutionality of the Irish Workplace Relations Commission (WRC) has failed. The applicant in the case at hand argued that the WRC was unconstitutional for two reasons: (a) that the WRC carries out the administration of justice in breach of the general constitutional rule that only the courts may administer justice; and (b) several of the statutory procedures of the WRC were so deficient that they failed to vindicate the applicant’s personal constitutional rights. The High Court of Ireland dismissed both arguments.

    In a decision with implications for unfair dismissal law generally, the UK’s Supreme Court (SC) ruled that it is not always necessary for a dismissing manager to know about whistleblowing disclosures made by an employee in order for that dismissal to be automatically unfair.

    This was a case alleging detrimental treatment for whistleblowing brought by an employee working outside the UK against two co-workers also working abroad in the same location. The Court of Appeal (CA) ruled that there was no jurisdiction for the Employment Tribunal (ET) to hear the claim in relation to personal liability of the co-workers because they were outside the scope of UK employment law. The CA’s judgment potentially has implications for other types of claim brought by UK employees posted abroad where similar personal liability provisions apply, such as discrimination and harassment.

    Following an appeal by Uber against the Employment Appeal Tribunal’s (EAT) finding last year, which was featured in EELC 2018/9, that drivers engaged by Uber are ‘workers’ rather than independent contractors (reported in EELC 2018-1), the Court of Appeal (CA) has now upheld the EAT’s decision. The CA also upheld the finding of the Employment Tribunal (ET), which was featured in EELC 2017/10, that drivers are working when they are signed into the Uber app and ready to work (reported in EECL 2017-1). Uber has approximately 40,000 drivers (and about 3.5 million users of its mobile phone application in London alone) and so this decision has potentially significant financial consequences for the company.

    Dit artikel bespreekt hoe het Huis voor Klokkenluiders zich verhoudt tot gelijkaardige instellingen in tien andere landen, gebaseerd op 21 interviews en de analyse van beleidsdocumenten en onderzoeksrapporten. Het onderzoek laat zien dat deze buitenlandse instellingen ook vaak door de overheid gefinancierd zijn, maar enkel gericht op klokkenluiders in de publieke sector. Onderzoek naar misstanden en benadeling van klokkenluiders wordt vaak door afzonderlijke instellingen gedaan om belangenverstrengeling te voorkomen, terwijl het Huis beide taken combineert. Verder valt op dat naast Nederland weinig landen overheidsfinanciering voorzien voor psychosociale hulp aan klokkenluiders. Advies en preventie zijn wel belangrijk in de meeste landen.

    The draft of the Dutch Whistleblower Protection Act that is currently discussed in Parliament can be regarded as an essential step forward in the protection of whistleblowers. However, it can be questioned if the Act will contribute in an optimal manner to the ideal of transparency and the fight against the abuse of power, which should be the main goal of the Act. The tasks and powers of the new House for Whistleblowers are rather unclear and they do not meet legal standards. The combination of advice and support to whistleblowers and independent research into major violations of integrity should be abolished.

    This article seeks to aid understanding of the ways in which different policy purposes, approaches and legal options can be combined in the design of better legislation, using Australia’s recently passed Public Interest Disclosure Act 2013. It provides a guide to key elements of the new legislation, as an example of legislative development taking place over a long period, informed by different trends. In particular, it is one of the first national laws to seek to integrate divergent approaches to the ‘anti-retaliation’ model of whistleblower protection, including its place in the employment law system, it sets new standards for the role of ‘public whistleblowing’ in such a regime, and provides new responses on basic questions of coverage, including which individuals are able to gain the benefit of the legislation. This provides lessons as to how different legal approaches might be better integrated, in pursuit of a clearer understanding of the interface between whistleblowing and other integrity reforms.
