    De twee meest recent aangenomen ILO-instrumenten – Conventie 190 en Aanbeveling 206 – reguleren de aanpak van geweld en intimidatie in de context van werk. Het fundament van deze instrumenten is een ‘inclusive, integrated and gender-reponsive approach’ die middels de routes van preventie en bescherming, handhaving en genoegdoening en advies en scholing dient te worden geïmplementeerd. Conventie 190 hanteert een brede definitie van ‘geweld en intimidatie’ en is van toepassing op formele werknemers, maar ook op andere groepen ‘werkenden’. Maar wat is de inhoud en het belang van deze geïntegreerde aanpak, bezien in nationaal en internationaal perspectief? Hoe verhoudt de bescherming tegen geweld en intimidatie onder gelijkebehandelingswetgeving en arbeidsomstandighedenrecht zich tot elkaar en voldoet het Nederlands juridisch raamwerk aan de voorgestelde ‘integrated approach’? Alhoewel de Conventie als normatieve basis gelijke behandeling en non-discriminatie neemt, geeft zij uitdrukkelijk de opdracht aan ratificerende lidstaten om een geïntegreerde aanpak toe te passen, waarbij geweld en intimidatie niet slechts onder gelijkebehandelingswetgeving, maar tevens onder arbeidsomstandighedenrecht en strafrecht worden ondergebracht om zo lacunes in de juridische bescherming voor slachtoffers te voorkomen. Alhoewel de juridische infrastructuur voor deze ‘integrated approach’ in Nederland aanwezig lijkt, is er nog een aantal aandachtspunten aangaande een effectieve implementatie hiervan, met name in relatie tot criteria voor zorgvuldige klachtbehandeling, risicoanalyse en aanpak en de rol van de vertrouwenspersoon.

    Arbeidsmigratie is in de EU een belangrijk en actueel onderwerp. Enerzijds, omdat steeds meer landen in de EU te kennen geven dat ze voor het op peil houden van het arbeidspotentieel hun toevlucht moeten nemen tot het aantrekken van arbeidsmigranten van buiten de EU. Anderzijds blijkt dat er regelmatig sprake is van uitbuiting van deze arbeidsmigranten. In EU-wetgeving in het algemeen en de regulering van migratie van onderdanen van derde landen (derdelanders) naar de EU in het bijzonder wordt aandacht besteed aan de kwetsbare positie van derdelanders en een eerlijke behandeling. Het doel van migratiewetgeving is echter met name ook het beheersen van migratie, het bestrijden van illegale migratie en het stimuleren van economische ontwikkeling. Deze verschillende doelen kunnen met elkaar botsen. In dit artikel wordt onderzocht wat de invloed is van de EU-migratiewetgeving op de uitbuiting van arbeidsmigranten.

Access_open A Positive State Obligation to Counter Dehumanisation under International Human Rights Law

    International human rights law (IHRL) was established in the aftermath of the Second World War to prevent a reoccurrence of the atrocities committed in the name of fascism. Central to this aim was the recognition that out-groups are particularly vulnerable to rights violations committed by the in-group. Yet, it is increasingly apparent that out-groups are still subject to a wide range of rights violations, including those associated with mass atrocities. These rights violations are facilitated by the dehumanisation of the out-group by the in-group. Consequently, this article argues that the creation of IHRL treaties and corresponding monitoring mechanisms should be viewed as the first step towards protecting out-groups from human rights violations. By adopting the lens of dehumanisation, this article demonstrates that if IHRL is to achieve its purpose, IHRL monitoring mechanisms must recognise the connection between dehumanisation and rights violations and develop a positive State obligation to counter dehumanisation. The four treaties explored in this article, the European Convention on Human Rights, the International Covenant on Civil and Political Rights, the Framework Convention for the Protection of National Minorities and the International Convention on the Elimination of all forms of Racial Discrimination, all establish positive State obligations to prevent hate speech and to foster tolerant societies. These obligations should, in theory, allow IHRL monitoring mechanisms to address dehumanisation. However, their interpretation of the positive State obligation to foster tolerant societies does not go far enough to counter unconscious dehumanisation and requires more detailed elaboration.

    The entry into force of the United Nations Convention on the Rights of Persons with Disabilities (CRPD) pushed state obligations to counter prejudice and stereotypes concerning people with disabilities to the forefront of international human rights law. The CRPD is underpinned by a model of inclusive equality, which views disability as a social construct that results from the interaction between persons with impairments and barriers, including attitudinal barriers, that hinder their participation in society. The recognition dimension of inclusive equality, together with the CRPD’s provisions on awareness raising, mandates that states parties target prejudice and stereotypes about the capabilities and contributions of persons with disabilities to society. Certain human rights treaty bodies, including the Committee on the Rights of Persons with Disabilities and, to a much lesser extent, the Committee on the Elimination of Discrimination against Women, require states to eradicate harmful stereotypes and prejudice about people with disabilities in various forms of interpersonal relationships. This trend is also reflected, to a certain extent, in the jurisprudence of the European Court of Human Rights. This article assesses the extent to which the aforementioned human rights bodies have elaborated positive obligations requiring states to endeavour to change ‘hearts and minds’ about the inherent capabilities and contributions of people with disabilities. It analyses whether these bodies have struck the right balance in elaborating positive obligations to eliminate prejudice and stereotypes in interpersonal relationships. Furthermore, it highlights the convergences or divergences that are evident in the bodies’ approaches to those obligations.

Een positief criminologische visie op radicalisering

    The first part of this article presents three academic theories on radicalisation: Moghaddam’s staircase model of radicalisation, Galtung’s typology of violence (direct, structural and cultural violence), and Staub’s psycho-educative approach. The core of Staub’s approach is that in conflict periods, people can be psychologically manipulated through their own fears, insecurities and unresolved traumas. Therefore, psycho-education and the empowerment of people are highly necessary to stimulate citizens to function as active bystanders when they are confronted with wrongdoing. In the second part of this article some promising approaches are pres­en‍ted which might increase personal and social resilience. The role of narratives in understanding experiences and changing identities is discussed. Radio La Benevolencija in Rwanda uses the power of storytel­l‍ing to stimulate resilience among the population. In the concluding paragraph a two-pronged strategy on radicalization is presented. This positive criminological perspective aims to promote active bystandership, participation and resilience.

    A narrative review was conducted to develop more coherent awareness and knowledge regarding emotional experiences of qualitative researchers studying sensitive topics or vulnerable groups, as discussions about this topic are currently fragmented and scattered. Qualitative researchers experience many painful as well as enjoyable emotions, which can influence their personal, social and professional lives. These emotions are recurrently reported in relation to the unpredictability of qualitative research and the different roles of qualitative researchers. More structural and individual attention for emotional experiences of qualitative researchers is necessary, for instance, in academic (doctoral) training and general handbooks on qualitative research.

    A rapidly growing field of research and practice, restorative justice has primarily found its gravitational centre within the criminal justice system, as an alternative of dealing with the aftermath of crime. Less explored remains the application of restorative justice in complex, urban, or intercultural contexts, an application which raises a whole set of conceptual and practical challenges. This article is based on an action project which aimed to research conflict narratives in intercultural contexts and transform them through restorative praxis. Mostly used in educational, organizational, and health care settings, action research remains an underused but a highly interesting methodology for criminology and criminal justice research. Its alternative epistemology makes it particularly apt for scientific projects that aim both at investigating crime and justice related issues and at engendering change, either at the level of criminal justice or communities. Although action research has focused mostly on creating change at the level of practical knowledge, when conceived in a critical manner, action research aims not only at improving the work of practitioners, but also at assisting them to arrive at a critique of their social or work settings. Practice concerns at the same time problem setting or problem framing. By zooming into one of the case studies of the project, more specifically the social housing estates in Vienna, I focus in this article specifically on the tensions and dilemmas created by processes of engagement in a problematizing approach to the context and to practice. During these processes, together with other social actors, such as inhabitants and professionals, we named problems (in our case social conflicts) and framed the context in which we addressed them. I argue that participatory forms of inquiry, such as action research, should actively reframe rather than merely describe contexts and problems they work with.

    Working in the forensic social field is interesting and fulfilling and many professionals deliberately choose to do this work. However, it can also be a very demanding job. Experiencing aggressive incidents by forensic clients, continuous tensions in contact with clients and the confrontation with narratives about shocking events are specific characteristics of working in the forensic field that appeal to the resilience of professionals. This article discusses which characteristics of organisations, teams and individual professionals impact on resilience and how it can be enhanced.

    This article aims to deepen scholarly understanding of the Law and Society Movement (L&S) and thereby strengthen debates about the relation between Empirical Legal Studies (ELS) and L&S. The article departs from the observation that ELS, understood as an initiative that emerged in American law schools in the early 2000s, has been quite successful in generating more attention to the empirical study of law and legal institutions in law schools, both in- and outside the US. In the early years of its existence, L&S – another important site for the empirical study of law and legal institutions – also had its center of gravity inside the law schools. But over time, it shifted towards the social sciences. This article discusses how that happened, and more in general explains how L&S became ever more diverse in terms of substance, theory and methods.

    Both H.L.A. Hart and John Searle repeatedly refer to games in their work on the concept of law and the construction of social reality respectively. We can argue that this is not a coincidence, Hart’s analysis of law as a system of primary and secondary rules bears close resemblances to Searle’s analysis of social reality as a system of regulative and constitutive rules and the comparison to games leads to interesting insights about the ontology of law and legal epistemology. The present article explores both the institutional theory of law that can be devised on the basis of the work of Hart and Searle, the method of analytical philosophy they employ and the particular consequences that can be deduced for legal research from the resulting legal theory.

    This study investigates the effect of providing information about decision making on aggression of clients of the Dutch Employee Insurance Agency (UWV). The expectation is that providing adequate information leads to a decrease in aggression, because it influences feelings of informational justice and frustration. UWV-clients (N=1.415) participated in an experimental scenario study (adequate vs. limited information providing). Next to aggression, psychological, UWV and social demographic characteristics were measured. Compared to limited information, receiving adequate information results in lower aggression. Clients with more negative affect show more aggression, but receiving adequate information especially reduces aggression in these clients.

    Emergency responders are often sent to the front line and are often confronted with aggression and violence in interaction with citizens. According to previous studies, some professionals experience more workplace violence than others. In this article, the theoretical framework to study variations in workplace violence against emergency responders is described. According to criminal opportunity theories, which integrate the routine activity theory and lifestyle/exposure theory, victimisation is largely dependent on the lifestyle and routine activities of persons. Situational characteristics that could be related to workplace violence are organisational or task characteristics, such as having more contact with citizens or working at night. However, they do not provide insight in all aspects of influence, and their usefulness to reduce victimisation is limited. Therefore, it is important to consider the role of personal characteristics of the emergency responders that may be more or less ‘attractive’, which is elaborated upon by the victim precipitation theory. Psychological and behavioural characteristics of emergency responders may be relevant to reduce external workplace violence. The author argues that, despite the risk of being considered as blaming the victim, studying characteristics that might prevent victimisation is needed. Directions for future studies about workplace violence are discussed. These future studies should address a combination of victim and situation characteristics, use a longitudinal design and focus on emergency responders. In addition, differences between professions in relationships between characteristics and workplace violence should be explored.

    A decision issued by the Constitutional Court on 3 March 2016 upholds a High Court decision on whether evidence obtained through video surveillance at the work place without previously informing the employee or the works council of the recording infringes employees’ privacy. The existence of cameras in the workplace was only made known via a sticker on the shop window, but the Constitutional Court found that it provided sufficient information to employees. The Court found that, as there was a prior suspicion of theft by the employee, temporary recording of the cashier area was lawful and did not require prior consent. The judgment sets out the criteria to be used to determine a fair balance between the competing interests of employee privacy and the employer’s right to compliance.

    In order to understand why people can turn to violence to achieve political or societal changes, it is important to examine factors that can trigger a process of radicalization. In this article the authors outline such a model of trigger factors. In this model they specify trigger factors at the micro level (individual level), meso level (group level), and macro level (societal level). In addition, the authors argue that it is important to take into account personal characteristics, such as age, gender, and the type of motivation, behind a radicalization process. With respect to these types of motivation, the authors distinguish between sensation seekers, justice seekers, identity seekers, and meaning seekers. This model enables to discern triggers in the radicalization process of specific people in specific contexts.

    Throughout history people have committed theft, fraud and murder. However, the frequency and severity of crimes are not static, but varies across time and space. The ways in which people respond to crime also change over time: penalties such as banishment, corporal punishment and capital punishment were frequently imposed in early modern Europe, but do not exist here anymore. Our thinking about crime and crime control changed over time as well. In addition to so-called hard crimes such as theft and homicide, various kinds of conduct were – in some times and periods – labeled as criminal (adultery, fornication and blasphemy). In crime control, state formation resulted in the emergence and expansion and professionalization of police forces and judicial systems, which development was accompanied by increasing interactions and interplays between supranational governments, private crime fighters, and informal forms of social control. Criminologists study fluid phenomena which vary across time and space. This makes exchange of knowledge and research cooperation between historians and criminologists particularly fruitful, or as Paul Knepper put it: ‘From what has been done so far, one thing is clear enough: the most interesting criminology arises at the point that history and criminology meet’ (Knepper, 2013, 2081).

    In this article we examine which factors are correlated to the rehabilitation of prisoners. Central is the prisoners’ willingness during their imprisonment to work on a successful return in society. Assumptions derived from the theory were statistically tested with data from the Dutch Detainee Survey 2014; a large-scale study, in which prisoners held in all Dutch penitentiary institutions (N = 29) were surveyed (n = 2120). The results are in line with the theory and show that detainees are more positive about their (potential for) rehabilitation when they are more satisfied with a) the way they are treated by correctional officers (staff orientation); b) active deployment of the so-called Detention and Re-integration Plan; c) their daily program and activities, and; d) the experienced autonomy and personal decision-making. These outcomes offer fruitful perspectives on how the prison system can promote a successful return of prisoners in our society.
