    This article tells the story of University of Strathclyde Mediation Clinic through the eyes of its founder. Taking its first case in 2012, by the start of 2021 it will be providing a free mediation service in 16 of Scotland’s 39 sheriff courts, covering more than half the country’s population. Yet it started with no plan, no budget and a few volunteers. The article makes the case that mediation clinics, like mediation itself, call for improvisation, coining the term ‘pracademia’ to describe how such clinics straddle the two worlds of practice and theory.

Charlie Irvine has been working as a mediator since the early 1990s; he developed and runs the Mediation and Conflict Resolution masters programme at University of Strathclyde Law School, Glasgow. He is also Director of Strathclyde Mediation Clinic. His academic work is focused on mediation and justice, in particular the neglected justice reasoning of ordinary people.

Slovenia’s experience with mediation incentives

    Slovenia realized very early that mediation as a form of a more flexible, consumer-friendly and interest-driven procedure can also be utilised as an effective means of court backlog reduction. The court-annexed mediation model was launched in 2001 without any regulatory framework as a pilot project at the District Court of Ljubljana. As a consequence of the successful pilot project court-annexed mediation was introduced into every first-instance and second-instance court. The main incentives for the mediation model were that it was free of charge, i.e. the costs of mediation were included into the court budgets, that it was performed by judges trained as mediators and that attorneys were included into the process at a very early stage. Mediation has become widely accepted, as the voluntary uptake by the parties is quite high and referral to mediation by judges against the will of litigants is rather an exception.

    The two years FOMENTO project ‘Fostering Mediation in cross-border civil and succession matters’ aims to contribute to conflict prevention in cross-border succession matters. To reach a deeper understanding and impulses for a correct implementation of Directive 2008/52/EC (Mediation Directive) and of Regulation (EU) No. 650/2012 (Succession Regulation) the effects of both regulations have been analyzed in a research study. To this end, country reports about the implementation of the Succession Regulation and the Mediation Directive in six European countries (Austria, France, Germany, Italy, Poland and Sweden) have been assembled and 105 expert interviews with lawyers, notaries, judges and mediators have been conducted and analyzed.
    This article gives a general overview about the outcomes of the research study and focuses on the analysis of the expert interviews. The experts gave answers about the concrete advantages, challenges and suggestions for improving mediation in cross-border succession conflicts and the effects of the European Succession Regulation.

Judith Pfützenreuter is Member of EU-Project FOMENTO (Fostering mediation in cross-border civil and succession matters).

    This research aims to contribute to the development of an adequate handling of the complex, conflictual family situation that occurs during a parental abduction. The following research question is answered: to what extent can the methods of conflict resolution – in the Belgian context – be optimized so that the interests of the child are guaranteed, in the light of the theoretical insights provided by Glasl’s conflict theory? Attention is paid to the limited effectiveness of legal procedures on the one hand and the mediation on the other. The method of de-escalation, developed by Glasl, offers a useful diagnostic tool for the conflict counsellor. In addition, the metaphor of the ladder he uses is extremely valuable as a tool for gaining insight into the mechanisms of conflict-escalation. A clear theoretical framework for the judiciary in the interpretation of an escalated conflict can lead to a better understanding of the possibilities and limits of cooperation between ex-partners, which benefits the best interests of the child.

    More than sixty years after the adoption of the New York Convention, UNCITRAL finalised at its annual session, in July 2018, an instrument akin to the New York Convention in the area of mediation: the United Nations Convention on International Settlement Agreements Resulting from Mediation (‘the Singapore Convention on Mediation’ or ‘the Convention’), which was adopted by the United Nations General Assembly on 20 December 2018. In addition, UNCITRAL adopted the UNCITRAL Model Law on International Commercial Mediation and International Settlement Agreements Resulting from Mediation, (2018, amending the Model Law on International Commercial Conciliation (2002); ‘the revised Model Law’).
    This contribution gives an overview of these two texts and their drafting process, starting with an overview of the works done by UNCITRAL over the past decades in the field of international mediation.

Annie de Roo
Annie de Roo is associate professor of ADR and comparative law at Erasmus University Law School in Rotterdam, editor-in-chief of TMD, and vice chair of the exams committee of the Mediators Federation of the Netherlands MFN. She has published extensively on mediation and has inter alia been a Rapporteur three times for the European Commission on the use of mediation in employment disputes.

Rob Jagtenberg
Rob Jagtenberg is senior research fellow at Erasmus University and has published frequently on the relationship between public and private justice. He has been involved in research commissioned by the Worldbank, the Netherlands Council for the Judiciary, and various Dutch Ministries including the MoJ funded national project on court-connected mediation.

    ADR in Kenya is traceable to the pre-colonial era. Before colonial rule, African communities applied traditional justice systems in the resolution of disputes. Some of these traditional justice systems are what are formally called ADR. It is through the imposition of formal justice systems by the British that certain ADR mechanisms were recognised in Kenya. In recent times, ADR is one of the commonly used avenues in accessing justice in Kenya. ADR in Kenya is growing at an unprecedented rate courtesy of its recognition in law, inaccessibility of courts and tribunals, backlog of cases and increased commercial activities requiring the use of ADR processes. Consequently, there are efforts by government and the private sector aimed at promoting ADR in Kenya. These efforts suggest that the future of ADR in Kenya is promising. In this article, the authors discuss the growth, development and practice of ADR in Kenya highlighting some of the likely challenges and opportunities in its use.

    Colombia has been a territory with some social and political difficulties which have affected several dynamics of the community as well as the legal security in almost all levels of the Colombian society. The alternative dispute resolution mechanisms arise as a response for all the gaps that such circumstances produce in the country and as useful tools to solve numerous disputes in different fields. The Chamber of Commerce of Bogotá, through its Arbitration and Conciliation Center founded in 1983, is making a permanent bet to support the Colombian citizens’ coexistence in the schools, in the neighbourhoods, in the companies that provide jobs as well as benefits to the city and to the whole country. Clever strategies have been developed through the years with three purposes: change the culture about the alternative dispute resolution methods, provide confidence in using them and change the way the people manage their conflicts.


Rafael Bernal Gutiérrez
Rafael Bernal Gutiérrez is director of the Arbitration and Conciliation Center of the Chamber of Commerce of Bogotá. His expertise in ADR counts more than 30 years. He has participated in the construction of legal frameworks for ADR in different countries all across Latin America. He is lecturer in ADR topics in Colombia and as well internationally.

    Mediation is not very popular (yet) in the Dutch private sector. The author used his own network of business relations to investigate the motives not to choose mediation in solving business conflicts. Entrepreneurs and managers recognize mediation as a suitable method to solve personal conflicts like in family and community mediation. In business conflicts however, parties try not to get too personally involved and to keep feelings and emotions away from the negotiations. This investigation made clear that the timing of the conflict management process is a crucial factor in the unpopularity of mediation. The moment to choose a suitable method for dispute resolution is when the entrepreneur or manager failed to solve the dispute together with the other party. At this stage the competences of the mediator are competing with those of the entrepreneur/manager and therefore the choice for mediation is not very likely. This can only be changed by the introduction of dispute consultancy earlier in the process. Also the promotion of the traditional values and benefits of mediation does not seem to match the desires of most of the entrepreneurs and managers. Mediators might invest in pilots with companies to create opportunities for conflict consultancy and the introduction of a dispute analysis as early as possible in the process.

    After a brief analysis of concepts of culture, conflict and conflict resolution, this contribution discusses how mediation and its practices are perceived in different cultures and countries. It appears that mediation is one of the most common forms of conflict resolution applied across a diverse range of cultures. In this respect, the author raises the question whether this also implies that there is a shared understanding of what mediation is or should be.

    In 2008, Ruud Lubbers led a mediation process to resolve the conflicts which had arisen between two Dutch campaigning organisations, various Indian non-governmental organisations (NGOs) and labour unions, two Dutch internet providers, an Indian clothing producer and a Dutch jeans brand. The mediation took place at the request of the disagreeing parties and the Dutch and Indian governments. The conflict related to corporate social responsibility (CSR) standards followed by the textile companies.In this contribution the effects of campaigning and litigating in issues concerning CSR will be examined. Limiting the analysis to CSR conflicts in the textile industry, the author will reflect on these new types of international conflicts in a globalising world and will share her view on appropriate ways to avoid them or, ultimately, to (re)mediate them if necessary.This contribution informs the reader about the events in India and the Netherlands which led to the escalation of the conflict. It provides an overview of the conflict resolution procedures and elaborates on the outcome of the ‘Lubbers Mediation’. The applicable legal and soft law labour standards are compared as well as the parties’ communication strategies. Lastly, this case is contrasted with other CSR conflicts in the textile industry, revealing a hidden conflict.
