    This article builds on two previous publications in this journal on the topic of the role of the parents of misbehaving children. We previously concluded that the family plays an important role in ending crime among young people. More recently, we sharpened that conclusion on the basis of long-term monitoring of a large group of young repeat offenders: they don’t stop because their parents say so. The role of the parents turned out to be much more fragile. This article aims to offer an extra insight into the complexity of the relationship between education and crime based on three recent cases.

    This article addresses the role of parents and girlfriends in the process of giving up crime. It presents findings from a longitudinal study of 81 young recidivists examined over 15 years. It concludes that parents played a pivotal role in this process, since the young men began to realize what misery they had caused them. However, these young men did not change their path in life because of their parents. We conclude even stronger than with the parents that it does not seem likely that a young recidivist would desist because of his girlfriend. Nevertheless, it would seem that both parents and a secure, lasting relationship could indeed have a positive influence in this process, particularly in the motivation to stick to a new path towards a more pro-social lifestyle once it has been set out on.

    This article tries to answer the question whether the right to due process, especially for minors receiving a public prosecutor’s penalty decision in the Netherlands is sufficiently guaranteed. To answer this question, formal legislature with respect to this topic, the concept of ‘due process’ as well as the actual legal guarantees for minors, have been explored. In juvenile criminal law, contrary to adult criminal law, the pedagogic aspect plays an important role. The pedagogic point of view is also taken into account. A recent report by the Attorney General of the Dutch Supreme Court showed undoubtedly that after six years of experience, the processes surrounding the instrument of the public prosecutor’s penalty decision are far from being executed flawlessly. Both from a judicial perspective as well as a pedagogic perspective, this is a serious problem. The most important procedural aspects that require substantial improvement are related to determining guilt, attorney accessibility and the presence of parents.

    Restorative Justice could have a more extensive implementation within criminal justice if there was more restorative practice within probation work. This may also lead to more restorative mediation. This article is based on practice-based research on what is known about restorative practices within probation and how contextual therapy, developed by the Hungarian-American psychiatrist Ivan Böszörményi-Nagy, can contribute to this. The main conclusion is that contextual therapy can offer a currently non-existent framework that is needed to be able to work with restorative practices within probation. This article describes how contextual approaches can be useful for probation officers.

    When a person commits a severe crime in the Netherlands, for which he cannot be (fully) held responsible because of a mental disorder, a judge may impose a hospital order in a secured psychiatric institution. To make this possible, behavioural experts have to assess whether the suspect suffered from a mental disorder at the time of the crime. However, during this assessment a suspect has the right to remain silent. Since recent years the number of non-cooperating suspects is increasing. To solve this problem, the Secretary of State of Security and Justice has submitted a legislative proposal, which makes it possible to force health professionals to submit past medical records of the suspect to the behavioural experts for their assessment without his consent. This breaches the professional law of confidentiality. Following case law of the European Court of Human Rights, this can only be justified, if it complies with the principles of proportionality, subsidiarity and necessity. The legislative proposal does not comply with these principles, as alternatives are available. These are: improvement of the forensic psychiatric care, reduction of the duration of the treatment and extension of the behavioral research period.
