In 1932 the court room of the Juvenile Judge in Amsterdam was redesigned and this work was marked as 'spadework'. In 2021 in a joined project of law student and art students ‘Design of Justice’ a concept for a court room of the future is developed. Again 'spadework'? In this article the author reflects on this and other current developments in the field child-friendly justice in criminal youth cases. |

In 1985 the Second International Congress on (Prison) Abolitionism took place. The organizers wanted to denounce the formalistic-legal approach to crime and revise the criminal pretensions. The aim was to develop a non-repressive process of conflict regulation. This contribution addresses the question of whether or to what extent the development of restorative justice in recent decades is an extension of the abolitionist perspective. Among other things, the developments in punishment and restorative detention and restorative justice in The Netherlands are discussed. It is concluded that restorative justice in a broad sense- and the introduction of small-scale, tailor-made detention are a realistic, at this time appropriate continuation of the efforts to find solutions for resolving conflicts outside criminal law. |

This article is a summary of the recently published study of Defence for Children - ECPAT: Sentencing of Sexual Exploitation of Minors: an analysis. The aim of the research was to provide insight into the penalties imposed in 2015-2019 in cases involving the sexual exploitation (human trafficking) of child victims. Another aim was to gain a better understanding of how the sentence was determined. A total of 145 convictions were analysed. This article first describes (the reason for) the research. Subsequently, the crime of human trafficking is briefly discussed. The findings of the analysis are then presented in a summarized version. Finally, the conclusion and recommendations follow. |

However, not much attention is being paid on the role and position of the victim in the Dutch administrative procedure. This article explores the scope of what is called ‘Administrative victimology’. Administrative victimology is an empirical science that deals with the position and legal role of the victim in the administrative procedure. It is expected that this ‘new’ type of victimology will become more important in the years to come. |

In 2014, the Dutch government abolished its ban on blasphemy, which had laid dormant in its criminal code for decades. Similar laws have been abolished in nine other jurisdictions in the West since an international campaign to this end started in 2015. This article first describes the tension between blasphemy laws and the freedom of expression. It then examines the Dutch position on blasphemy in its international context. This article argues against bans on blasphemy and specifically against a potential reintroduction of a de facto ban on blasphemy in the Netherlands. Moreover, it argues in favour of applying political pressure to abolish bans on blasphemy around the world as well as giving diplomatic support to those affected by these laws. |

Prison visitation is important for protecting against social isolation during imprisonment. It is also essential for maintaining contacts that are important for life in prison and after release. It is therefore not surprising that both nationally and internationally important policy measures and scientific research have been undertaken on the topic. Nationally, however, limited scientific research is available regarding how many, how often and from whom prisoners receive visits, how visits are experienced and the possible effects of visitation, thus leaving many questions unanswered. Meanwhile, in the past ten years great changes have been made to visitation in Dutch prison policy and practice. Given these recent developments, both scientists and practitioners could benefit from an overview of the current state of affairs of visitation. This article aims to bridge the gap between research, policy and practice by summarizing findings from the Life in Custody study. This study includes a description of how visitation is organized legally, at the policy level and in practice, a thorough review of prior research on visitation and an analysis of the most recent national data on the prevalence and frequency of visitation, while considering important differences between prisoners and prisons. |

The Dutch police has noticed that in cases of honour-based violence often people are involved that might suffer from some form of trauma. Over the last years the police has dealt with cases from, for example, refugees that have fled from with war infected regions. Next to that, the road to the north of Europe was also involved with serious safety issues. Therefore the police works together with specialists in the treatment of trauma. In this article some frequently encountered misunderstandings about trauma are described, illustrated with cases of honour-based violence. The first misunderstanding is that all trauma is PTSS; the second is that PTSD explains all the mis happenings in an individual’s life; the third misunderstanding is that EMDR is the effective treatment for all sorts of trauma. |

Teen sexting is an increasingly common phenomenon. It is doubtful whether primary teen sexting – when minors take sexually pictures of themselves and share these voluntarily with peers – should fall within the scope of the Dutch offence description of child pornography. The German Penal Code contains an exception clause for primary teen sexting, whilst the Dutch Penal Code does not. In this article is argued, through comparative law research, that the Netherlands should also adopt an exception clause. This way not only the right of the child to protection against sexual abuse and exploitation, but also the right of the child to sexual development is safeguarded sufficiently. |

The matter for this research is the request from the municipality of Eindhoven to map youth nuisance in the city of Eindhoven and to find explanations for differences between neighborhoods in order to provide policy makers with guidance. Quantitative and qualitative methods tested the social disorganization theory. Factors that may explain youth nuisance are a high degree of ethnic heterogeneity, low neighborhood participation and a high level of physical deterioration. In addition, youngsters who have unstructured leisure time prefer a place to hang out where there is no social control. Policy makers can use these insights to design their neighborhoods. |

This is the case, for example, when domestic violence occurs in circles that are also involved in organized crime. In theory it is possible that the professionals involved work together, but it is also not impossible that they will get into each other’s waters because they have a different vision of the problem to be tackled and, of course, also have to fulfill other roles and tasks based on their positions. A professional must be able to handle complex situations of this kind. |

This study provides an in-depth analysis of the resilience of criminal investigators in the Netherlands. Observational studies within three criminal investigation teams and 45 interviews with investigators and team leaders revealed that confrontations with human suffering, decision-making, and dirty and physically demanding circumstances at the crime scene can sometimes be (very) challenging. However, investigators have relatively little difficulty with the strain resulting from the operational stressors to which they are exposed during investigations. They know how to apply different coping strategies to reduce stress. However, this does not apply to organisational stressors. The way in which their work is organised regularly causes tension, dissatisfaction and frustration. The research highlights that investigators suffer more from these organisational stressors than from the stressors that can be associated with criminal investigations. Attention should therefore be focused on strengthening their ‘internal resilience’, the article makes a number of recommendations to support this. |

Violence in the name of honour has an ancient ring to it. But honour codes tend to be very flexible: cyber-space has given a new dimension to honour-related violence. Images and messages that are perceived as violations of honour also pass through social media. Unfortunately these stings on the good name of the family are quite difficult to remove. In this contribution is explained how violations of honour occur on the internet. Next to that will be described how currently in the Netherlands criminal law especially regarding vice is being adapted in order to deal with phenomena like sexting and sextortion. What are the consequences of these changes for dealing with modern forms of the violation of family honour? |

Neuroscience teaches us that we can obtain information about the brain by the use of neuro tests. An example of a neuro test is the concealed information test (CIT). This test examines whether a suspect recognizes specific details of a criminal offence. Afterwards experts can conclude whether the suspect has knowledge of a criminal offence, which only a perpetrator can know. This way a CIT contributes by the detection and adjudication of criminal offences. In recent decades, the interest in neuro tests such as the CIT has increased, also at the Ministry of Justice and Security. Based on the existing literature, both advantages and disadvantages of the CIT are discussed in this article. |

The proposal is to replace the conditional suspension of remand detention for both adults and juveniles with a new modality of provisional restraint. This contribution deals with the punitive aspects of the Dutch ‘Educational Measure Behaviour and traffic’ rehabilitation course (EMG), thereby using the criminal charge concept (article 6 ECHR) and the alcohol interlock case law as indicators for the level of punitivity. As of 2009, Dutch drivers whom (repeatedly) commit traffic violations may be subjected to an EMG. Failing this course can cause a driver to have his or her driving licence suspended. The Dutch Driving Test Organization (CBR) lacks the possibility to take any individual circumstances into account. The question then arises as to whether the EMG may have a disproportionate impact in certain cases. It is argued that the imposition of the EMG predominantly qualifies as a criminal charge, requiring an extension of the current regime of legal protection. It is furthermore argued that the dominant position of the police officer who makes an EMG report should be reconsidered. |

By the end of 2020, the European Public Prosecutor’s Office (EPPO) will be operational. The EPPO will be tasked with investigating, prosecuting and bringing to judgement criminal offences against the EU budget. The substantive competence of the EPPO could in the future be extended to terrorism and other serious cross-border crimes. This article will first describe the background, structure and competences of the future EPPO. Then the procedural guarantees will be discussed and the problem of ‘forum shopping for evidence’. This problem entails that the choice in which Member State to conduct an investigative measure could be made on the basis of the less stringent rules in that Member State regarding, for example, the right to privacy. The article will end with a proposal on how to prevent forum shopping for evidence. |
