Auteurs Dr. Lieselot Bisschop, Dr. Robby Roks, Prof.dr. Richard Staring e.a.
SamenvattingAuteursinformatie

This article focuses on the challenges associated with public-private partnerships in tackling drug crime in the port of Rotterdam. The authors identified the actors involved in the fight against drug crime and, more generally, security in the port. The authors show how these various actors view the subject of drug crime (so-called mentalities), what they set as objectives (finalities) and how they try to achieve these objectives. Subsequently the various aspects of the interactions between these actors are being analyzed. The article is empirically based on 76 interviews with public and private actors in the port of Rotterdam, that were conducted in the period from January 2018 to February 2019, and an analysis of literature, news items, government reports and other documents.

Tijdschrift Justitiële verkenningen, Aflevering 3 2019
Trefwoorden penal law system, supervision, political debate, responsibility, personal autonomy
Auteurs Prof. dr. mr. Jeroen ten Voorde
SamenvattingAuteursinformatie

Dutch legal scholars have expressed their concern over an increase in (the relevance of) supervision as part of the criminal sanction system. They endorse the need for a more fundamental research on the nature and position of supervision within the Dutch criminal sanction system. This article discusses some fundamental issues: the meaning of autonomy and the position of the autonomous person as an object of supervision, the possible consequences of supervision for and the various purposes of supervision within the criminal sanction system.

Controle of begeleiding? Ervaringen met reclasseringstoezicht tijdens de voorwaardelijke invrijheidstelling

Tijdschrift Justitiële verkenningen, Aflevering 3 2019
Trefwoorden parole, desistance, supervision, Re-entry, risk management
Auteurs Jennifer Doekhie MSc, Dr. Esther van Ginneken, Dr. Anja Dirkzwager e.a.
SamenvattingAuteursinformatie

Little is known about how ex-prisoners’ parole supervision experiences relate to desistance. The aim of this article therefore is to gain insight into the nature of release conditions and parole supervision of ex-prisoners and parolees’ perceptions of their supervision related to the desistance process. A total of 23 Dutch parolees were interviewed in depth at three waves starting in prison up to one year after their release, and the 69 interviews were combined with their parole files containing information about conditions, violations and sanctions. Parole files revealed the practice of highly engaged parole officers, who worked with parolees to strengthen factors known to foster desistance. However, the interviews showed that most parolees found their parole experience predominantly surveillance-oriented and not very helpful for desistance. Parole was experienced as most beneficial when parole officers used their discretionary power to adjust conditions creating ‘space’ for trial-and-error.

Georganiseerde kinderpornonetwerken op het darkweb

Tijdschrift Justitiële verkenningen, Aflevering 5 2018
Trefwoorden child pornography, Dark Web, organized crime
Auteurs Madeleine van der Bruggen MSc
SamenvattingAuteursinformatie

The emergence of Dark Web child pornography forums and their availability to large offender communities has enabled a professional form of child pornography distribution as well as an increased exchange of criminal and social capital. Offenders have access to a new platform in which strong ties and long-lasting relationships with co-offenders are formed. Moreover they could be classified as organized crime, because child pornography Dark Web forums are characterized by a hierarchical order, a clear role division and illegal power structures that regulate the illegal activities. The implications from a law enforcement as well as from scientific perspective are discussed.

Over undercoverbevoegdheden op internet

Tijdschrift Justitiële verkenningen, Aflevering 5 2018
Trefwoorden undercover operations, investigative powers, infiltration, Internet, jurisdiction
Auteurs Mr.dr. Jan-Jaap Oerlemans
SamenvattingAuteursinformatie

This article investigates which online undercover investigative methods are applied in practice and how they fit in the Dutch legal framework. In particular, the three special investigative powers of a pseudo purchase, systematic information gathering and infiltration are examined. Investigative powers cannot be applied unilaterally (across state borders). When law enforcement officials cannot reasonably determine the location of the suspect, the online unilateral application of undercover investigative powers is allowed. However, there is still a risk that diplomatic tensions arise with the involved state. States should agree in treaties under which circumstances cross-border online undercover operations are allowed.

Een analyse van de Wet computercriminaliteit III

Tijdschrift Justitiële verkenningen, Aflevering 5 2018
Trefwoorden cybercrime, Dutch Cybercrime Act, hacking, investigative powers, privacy
Auteurs Mr. dr. ir. Bart Custers
SamenvattingAuteursinformatie

In 2018 the Dutch parliament accepted new cybercrime legislation (the Cybercrime III Act) that creates several new online criminal offences and gives law enforcement agencies new investigative powers on the Internet. This article describes the background of Dutch cybercrime legislation and the contents of the Cybercrime III Act. The newly introduced cybercrimes are discussed as well as the new investigative competences. Particularly the legitimacy and the necessity of the investigative power of the police to hack computer systems of suspects may significantly interfere with the right to privacy.

SamenvattingAuteursinformatie

Worldwide, the digitalization of society is proceeding rapidly and this brings new forms of crime. The threats arising from different types of cybercrime are real and constantly evolving, as the internet with its anonymity and borderless reach, provides new opportunities for criminal activities. This article describes some results from an international empirical study aimed to gather more insight on the link between cybercrime and organized crime as well as on the question whether cybercrime is organized. It shows how cybercriminals cooperate with each other and what this organization structure looks like.

Auteurs Mr. Maartje Schaap
SamenvattingAuteursinformatie

Under Article 13b (1) of the Dutch Opium Act, the mayor is authorized to impose an order under administrative coercion when drugs are sold, delivered, supplied or present in houses or premises This much-discussed article, also cited as the ‘Damocles Law’, gives the mayor the power to close drug shelters even before the suspect’s guilt has been established in legal proceedings. It is not necessary to show that the interests of public policy are at stake. Moreover, the means of defense against the closure are very limited. The author argues that the current application of Article 13b is exclusively punitive in nature, whereby in case of criminal prosecution, there is also a violation of the ne bis in idem principle.

Trefwoorden youth courts, restorative justice, active citizenship, schools, community
Auteurs Drs. Gert Jan Slump en Prof. dr. Jessica Asscher
SamenvattingAuteursinformatie

This article describes the backgrounds, the development and first findings on youth courts in the Netherlands. A Dutch version of the USA youth courts was developed and piloted in 4 Amsterdam schools. Cases referred are small (partly illegal) incidents committed in the school environment. The Dutch youth court practice is described against the background of transformational change in society and the development of restorative justice and (peer oriented) development of citizenship. Although the model is still in development and schools are somewhat reluctant to deliver and refer cases, practice is growing.

Auteurs Dr. mr. Marc Schuilenburg
SamenvattingAuteursinformatie

In this article the author reports on an ethnographic research conducted on the Collective Shopping Ban, a measure taken in the Netherlands in an effort to make shopkeepers co-responsible for maintaining safety and security. By describing the practice of the Collective Shopping Ban in The Hague, he investigates how the involved shopkeepers are dealing with offenses like theft, nuisance, intimidation, and vandalism. The author describes the sociological background of banning orders and what the banning of people means in terms of purification of public space.

Crimmigratie en het uitzetten van strafrechtelijk veroordeelde vreemdelingen

Tijdschrift Justitiële verkenningen, Aflevering 2 2018
Trefwoorden crimmigration, bordered penality, migration, banishment, bifurcation
Auteurs Jelmer Brouwer MSc E.MA
SamenvattingAuteursinformatie

This article analyses to what extent current responses to crime committed by immigrants can be seen as a modern version of the classical practice of banishment. To that end it analyses three recent policy developments directed at criminally convicted immigration. The analysis shows that during the last ten years there has been a sharp increase in the number of immigrants losing their residence permit following a criminal conviction. Moreover, punishment aimed at criminally convicted immigrants without a legal right to stay is increasingly aimed at permanent exclusion through the practice of deportation. Drawing on the theoretical notions of crimmigration and bordered penality, it is therefore argued that criminally convicted immigrants increasingly see themselves confronted with punishment practices that are the modern equivalent of the classical practice of banishment. This raises important questions about where we should draw the line between insiders and outsiders.

Auteurs Mr. dr. drs. Benny van der Vorm
SamenvattingAuteursinformatie

There are different types of banning orders (criminal, administrative and private banning orders) and also various procedures for imposing these orders. According to the case law of the European Court of Human Rights (EctHR) it is unlikely that the private banning orders can be labelled as a criminal charge. The nature of the private banning orders is not punitive. These orders are to be regarded as recovery sanctions. However, applying the ‘Engel criteria’ will lead to the conclusion that some criminal banning orders are to be considered as a criminal charge. Accumulation between criminal and private law banning orders might be troublesome, but it is possible. It is recommended that the Public Prosecution Service is cautious when it comes to demanding a criminal banning order, when a private banning order has already been imposed.

Ruim baan? Uitsluiting en zelfuitsluiting van de arbeidsmarkt

Tijdschrift Justitiële verkenningen, Aflevering 2 2018
Trefwoorden criminal records, screening, young adults, labor market, self-exclusion
Auteurs Dr. mr. Elina van ’t Zand-Kurtovic
SamenvattingAuteursinformatie

In the Netherlands, the number of criminal record screenings performed each year skyrocketed to more than one million. Yet, empirical evidence on its effects has been largely absent. In this article the author addresses parts of the findings of her PhD research, which aimed to fill this gap, by providing a subjective perspective of how having a criminal record impacts the process of re-entry into society, particularly into the labor market, for young adults. It is based on the lived experiences of 31 young adults having a criminal record who were followed during their process of reintegration into the labor market. The vivid, real-life stories of young adults’ strategies of dealing with the stigma of a criminal record, and how this subsequently influences their position in the labor market, highlight the counterproductive effects of increasingly widespread criminal record screening. They provide evidence that many young adults adopt self-exclusion as a strategy for avoiding rejection and exclusion.

Metaforen in de Nederlandse inlichtingengeschiedenis

Tijdschrift Justitiële verkenningen, Aflevering 1 2018
Auteurs Dr. Constant Hijzen
SamenvattingAuteursinformatie

Since intelligence and espionage are so secret by nature, discussing it proves to be rather difficult. Debates about intelligence therefore tend to be fought with metaphors. Using Johnson’s and Lakoff’s idea that metaphors provide conceptual frameworks and thus have real-world effects, as well as Butler’s idea of performative power, this article has explored the most widely used metaphors in Dutch intelligence history. The Dutch security services have been depicted, in a wide variety of images, broadly as remnants of the past (ruins or ‘anachronisms’), as spies on wooden shoes, as a stowaway of democracy, and as a state within the state. Since the civil servants and politicians almost always felt the need to respond to these metaphors, by providing explanation, nuance, and facts – or by introducing a competing metaphor – it is argued that these metaphors have real-world effects, showing how the security service was positioned in politics and society.

De invloed van verhoormethoden op de inhoud van verklaringen

Tijdschrift Justitiële verkenningen, Aflevering 6 2017
Trefwoorden interrogation methods and techniques, suspect and witness, (borderline) intellectual disability, false confessions, false statements
Auteurs P.R. Kranendonk MSc
SamenvattingAuteursinformatie

The main goal of an interrogation is to elicit truthful information about the involvement of a suspect or witness in a criminal act. Some interrogation methods and techniques are useful for extracting information from otherwise unwilling suspects, but they can also elicit false confessions or statements from innocent (and vulnerable) suspects and witnesses. Multiple studies show that a large proportion of false confessions are made by suspects with an intellectual disability. Intellectual disabilities are often difficult to recognize, because of an individual’s streetwise behavior. This vulnerable group is extremely sensitive to suggestibility, compliance and acquiescence. Some interrogation methods and techniques used by the police can have a severe influence on these features and therefore on the reliability of statements. Given the overrepresentation of people with an intellectual disability in the Dutch criminal justice system, it is of great importance to prevent unwanted risks in the interrogation.

Begaafdheid en crimineel gedrag

Tijdschrift Justitiële verkenningen, Aflevering 6 2017
Trefwoorden IQ-crime relationship, high IQ offenders, white-collar crime, criminological research, self-reporting
Auteurs Dr. J.C. Oleson
SamenvattingAuteursinformatie

Criminologists generally regard below-average intelligence as a robust correlate of delinquency and crime. In this article the author argues that the negative association between IQ and crime could be explained at least in part by a lack of research access to gifted adults who possess wealth, power and privileges. Asking these adults about other types of offending (e.g. white-collar crimes) than usual in self-report studies might uncover a positive relationship between IQ and prevalence rates, in accordance with the results of the exploratory study underlying this article. As a consequence different conclusions about the linkages between intelligence and crime might have to be drawn.

LVB-jongeren in de ZSM-procedure

Over kwetsbaarheid en recidiverisico

Tijdschrift Justitiële verkenningen, Aflevering 6 2017
Trefwoorden intellectual disability, recognition, criminal court, ZSM method, recidivism
Auteurs Drs. M. Teeuwen
SamenvattingAuteursinformatie

In recent years, there are signs that young people with a (mild) intellectual disability are overrepresented in the criminal justice system. It turns out that especially a large majority of the repeated offenders have an intellectual disability. Therefore it would be relevant to know whether and when an intellectual disability is recognized by professionals in the criminal procedure. What is the impact of not recognizing the specific disability on the offender in the criminal justice procedure and on recidivism? The author focuses on a rather new accelerated out-of-court settlement of criminal cases, the so-called ZSM method. She concludes that the high speed of this procedure increases the vulnerability of suspects with a (mild) intellectual disability, especially because the various professionals involved in this procedure seem to lack substantial awareness of the problem. This situation increases the risk of false confessions and witnessing and might also contribute to recidivism.

Op de grens van ideeën en daden. Over de vervolging van het voorbereiden van liquidaties

Een interview met OvJ Koos Plooij en advocaat Christian Flokstra

Tijdschrift Justitiële verkenningen, Aflevering 5 2017
Trefwoorden contract killings, acts of preparation, article 46 Dutch Penal Code, public prosecution, criminal defense
Auteurs Mr. drs. M.P.C. Scheepmaker
SamenvattingAuteursinformatie

In this interview the Dutch prosecutor Koos Plooij discusses with criminal lawyer Christian Flokstra on the intention of the Public Prosecution Office to adapt article 46 of the Dutch Penal Law (Sr) in such a way that the burden of proof necessary for a sentence on contract killing is lowered. Plooij argues that many suspects who were clearly up to a very serious deed, have received a relatively low punishment because it was too difficult to prove that they were preparing a contract killing – and were not simply trying to intimidate their target or for instance take this person as a hostage. For the judge it is essential to establish which crime was being prepared, since the latter are completely different crimes and the punishment is much lower compared to the punishment for murder. Flokstra replies by stressing that the limitations of the current article 46 Sr exist to assure that people are not punished for things they didn’t do or were not planning to do. He argues that the prosecution should accept that sometimes there’s just not enough proof to convince the judge that the suspect was preparing a contract killing. A sentence for arms possession or participation in a criminal organization could be an alternative in such cases. Both men agree that the current maximum punishments for these crimes are too low.

De verschuiving van illegale drugsmarkten van Nederland naar België

Perceptie of realiteit?

Tijdschrift Justitiële verkenningen, Aflevering 2 2017
Trefwoorden drug policy, drug markets, Displacement, the Netherlands, Belgium
Auteurs Dr. F. De Middeleer en Dr. B. De Ruyver
SamenvattingAuteursinformatie

Recent figures indicate that certain drug markets, or at least parts of it, shift from the Netherlands to Belgium. However, it is still unclear whether it is a displacement of some parts of the illicit drug markets or whether it should be seen as a diversification of certain parts of some illicit drug markets in terms of spreading of risks and taking profit of new opportunities. In this respect, this article contributes to an ongoing research (DISMARK) by providing an overview of drug policy measures most recently taken by the Netherlands, from a Belgian point of view, and by trying to link these developments to drug-related trends in Belgium. It is clear that both countries will have to invest in a common approach of their common drug problems. However, it is not yet possible to draw any profound conclusions on the actual displacement of illicit drug markets.

Drugsafval in Brabant

Tijdschrift Justitiële verkenningen, Aflevering 2 2017
Trefwoorden synthetic drug waste, synthetic drugs, organized crime, environmental crime, criminal networks
Auteurs Drs. Y.M.M. Schoenmakers en S.L. Mehlbaum MSc
SamenvattingAuteursinformatie

Synthetic drug waste dumpings are a growing concern in the Netherlands, particularly in the southern region. During the production process of ecstasy (MDMA) and speed (amphetamine), large quantities of chemical residue are released, that the illegal manufacturers need to get rid of. According to police statistics the chemical waste is mostly dumped in barrels in rural areas, and recovered as such by authorities. However, an unknown quantity of synthetic drug waste is also directly being discharged into sewer, soil or natural surface waters. The phenomenon embodies environmental crime as well as organized crime. From the viewpoint of environmental crime, both ecological and social harm are evident. The article also illustrates the operations of serious organized crime groups behind the scenes.
