    Since the beginning of 2020 mediation in penal cases (mediation in strafzaken) has officially become the preferred intervention for victim-offender mediation in the criminal procedure in the Netherlands. Although mediation in general has a sound theoretical framework, the methodological elaboration appears pluriform and somewhat limited. In practice mediators in penal cases operate conform their own personal and professional standards and preferences, apparently without tailor made methodology. This article describes the current methodological directions such as transformative or narrative mediation and seeks for useful references. As a part of restorative practice, mediation in penal cases seems to remain secluded from insights and methodology developed in the domain of restorative justice practices. Educational institutes providing trainings for mediators barely refer to this theoretical framework. Besides a methodological reconnaissance this article offers a fundamental comparison of mediation styles and interventions, but is above all an incentive to further methodological research and development.

    This article discusses the concepts of society and community involvement as they appeared in the articles of the Dutch-Flemish Tijdschrift voor Herstelrecht (Journal of Restorative Justice) during last 20 years. It shows how the journal from its very beginning adopted a strong focus on criminal justice reform, although restorative practices within the community occupied a considerable space in the consecutive volumes as well. Studies on restorative justice programmes in Belgium and The Netherlands, such as victim-offender mediation and family-group conferences, revealed a predominant orientation on interpersonal relationships stressing the role of the community of care. In the same sense, also community mediation and other community oriented restorative practices focus on the personal well-being of people and the improvement of personal and social relationships. Hence, both theory and practice face two important challenges in developing restorative justice: (1) which role to give to a larger community and how to operationalize its involvement, and (2) how to deal with underlying causes of crime and social-structural injustices? Referring to European action-research projects and to conceptual models developed outside Europe, a case is made for designing restorative justice methodologies and programmes involving civil society in a more encompassing way and linking micro to macro societal levels. Developing strategic alliances with new social movements could be the way forward.

    Why and how mediated contact between victims and offenders (and members from their networks) leads to positive outcomes, remains a difficult question to answer. Not surprisingly therefore, this topic has been the focus of attention of multiple articles in the past twenty years of this journal. In this contribution, the inspiring article of Borbala Fellegi (2008), titled ‘Explaining the impact of restorative justice. The “4-way interaction” of morality, neutralisation, shame and bonds’ is celebrated. Fellegi presents a theoretical framework in which the added value of restorative, mediated victim-offender meetings for the re-integration of offenders is outlined compared to other judicial responses to crime. Central to her argument is that the mediation process affects in particular the four criminogenic factors mentioned in the title. In this contribution two innovative, working mechanisms of the mediation process that she proposes, are highlighted. First, the preparation phase in which the neutral mediator initiates and facilitates discussion of the crime and its consequences for the victim(s) with the offender. Fellegi proposes that this mechanism can (start to) lift the criminogenic factor moral reasoning of the offender. Second, the restorative focus of the encounter itself between the victim and offender, in which both parties can express how they were affected, express their emotions (such as shame feelings of the offender) and discuss jointly how restoration and reparation might be achieved. This should reduce the criminogenic factor neutralisation, increase moral reasoning, and might contribute to integrative social bonds between the parties and their networks. Thus, Fellegi’s work has made innovative suggestions about the working mechanisms of victim-offender mediation – these suggestions offer useful hypotheses that can be tested empirically.

    As an approach to law and justice, restorative justice focuses squarely on addressing human needs; it acknowledges the equal dignity of all parties, irrespective of their role in the harmful act; it accepts responsibilities for addressing the disadvantages or inequities that crime has bequeathed to victims and that often have contributed to offending on the part of the perpetrator; and it derives its creative potential from the shared vulnerability and reciprocal exchange of concern that occurs through respectful face-to-face encounter. Therefore restorative justice constitutes a relational justice of care.

    This paper examines moral injury, in relation to recovery from this kind of psychic damage and to restorative justice. In recent research the concept is developed in distinction from the psychiatric diagnosis PTSD. Whereas PTSD is rooted in anxiety, as it occurs during or after life-threatening situations, people suffering from moral injury are disruptively affected by guilt and shame, in the slipstream of which they may be tormented by remorse, self-loathing, anger and self-disgust – with symptoms similar to PTSD. Unlike PTSD, however, the risk of moral injury is part of ordinary life. It may happen to anyone. Therefore, this paper takes an ‘existential’ perspective by relating moral injury to the fundamental human condition of relationality. Moral injury is interpreted as the disturbance of the responsibility, the confidence and the security that fundamentally sustain the human relationships to the world, to each other, and to oneself. One way of recovering from moral injury is through empathy, primarily performed by caregivers or chaplains who guide the morally injured, and consequently accomplished by the injured themselves, in a narrative way.

    This article outlines two points of criticism related to Christopher Marshall’s discussion of a relational justice of care. First, addressing the needs of the parties involved in a criminal justice case finds its appropriate place in the post-trial stage. In the pre-trial and trial stages, protecting the legal rights and equal treatment of suspects should take priority over caring for suspects. Secondly, if the outcome of the restorative encounter in the pre-trial stages has a bearing on the verdict of the judge, the encounter may risk to lose its authenticity. The offender may have reason to believe that a socially appropriate performance will be rewarded with less punishment.

    The first part of this article presents three academic theories on radicalisation: Moghaddam’s staircase model of radicalisation, Galtung’s typology of violence (direct, structural and cultural violence), and Staub’s psycho-educative approach. The core of Staub’s approach is that in conflict periods, people can be psychologically manipulated through their own fears, insecurities and unresolved traumas. Therefore, psycho-education and the empowerment of people are highly necessary to stimulate citizens to function as active bystanders when they are confronted with wrongdoing. In the second part of this article some promising approaches are pres­en‍ted which might increase personal and social resilience. The role of narratives in understanding experiences and changing identities is discussed. Radio La Benevolencija in Rwanda uses the power of storytel­l‍ing to stimulate resilience among the population. In the concluding paragraph a two-pronged strategy on radicalization is presented. This positive criminological perspective aims to promote active bystandership, participation and resilience.

    This contribution seeks to bring together three themes in a descriptive and exploratory manner: (a) community service orders, (b) traffic offences and (c) restorative justice; the Dutch situation is central. To this end, the Dutch legal regulation regarding community service orders is first explained. Attention is also paid to existing empirical research on the effectiveness of community service orders in terms of reduction of recidivism (section 2). Furthermore, the sanctioning of traffic offences is discussed as well as the consequences for this of the current bill that seeks to sharpen criminal liability for serious traffic offences (section 3). Subsequently, it is examined which restorative justice provisions or modalities are available and how restorative community service orders are and can be designed (section 4). Finally, I describe my ideal when it comes to the sanctioning of traffic offences in the form of a continuum in which a special role is reserved for restorative community service orders (section 5). The contribution ends with a conclusion (section 6).

    The authors discuss reparations, with particular attention to programs launched to do justice to the victims of the Holocaust. While focusing on the compensation scheme of the Dutch Railways to the victims of the transports during the Second World War, they examine in which respects the suffering and victimization of some victim groups are not or insufficiently recognized. They compare the establishment of the compensation scheme and the procedure for repayment with findings from victimological research into the recognition of victimization and reparation, including the symbolic value of compensation, recognition of suffering, inclusion and exclusion of stakeholders, and victim participation. The analysis concludes with a few considerations about how secondary victimization could have been prevented.

    In the past twenty-five years, a lot of attention is paid to a more victim-aware and restorative justice focused policy in prisons in Belgium and The Netherlands, striving for a restorative culture and climate in the institutions (among prisoners and staff) and for more restorative practices like victim-awareness programs and mediation. The focus is primarily on the prison structure and culture, striving to create a more restorative prison culture and climate in the institutions. In this article we argue for a shift from this system-focused pursuit of ‘estorative detention’ to the restorative reintegration of prisoners at the individual level, and by this supporting their desistance from crime. We present a conceptual framework for restorative reintegration in and outside prison as a strengths-based approach, with attention to the structural and individual elements that supports their desistance from crime.

    This article presents and critically discusses a new Recommendation on restorative justice (CM/Rec(2018)8) that was adopted on 3 October 2018 by the Committee of Ministers of the Council of Europe. This new regulation builds on the previous Recommendation No. R(99)19 on mediation in penal matters and recommends the governments of the 47 member States of the Council of Europe the adopt and implement the principles of restorative justice as described in the Appendix of the new Recommendation. These guidelines apply to national authorities and national agencies in general, and to judges, public prosecutors, police, prisons, probation, juvenile justice agencies, victim support services and restorative justice services in particular. The article presents the origins of the Recommendation, its contents and its meaning for restorative justice developments in Europe and beyond.

    How does the police deal with conflict resolution and (referrals to) mediation? Is this perceived as relevant within the new national police organization? This article elaborates on work processes within the National Police, including ZSM-settlements, the punitive aspects of police culture and the impoverishment of neighborhood-oriented police work. It is concluded that there is little room within the police for responsive approaches to crime and social unsafety. However, there are still police professionals who question ‘assembly line’-processing of criminal cases, support restorative justice strategies and try to improve the citizen-empowerment in neighbourhoods.

    In a recent research study entitled Encountering ‘The Other’: Victim Offender Dialogue in Serious Crime the impact and outcomes for victims/survivors of meeting with the prisoner participants who had caused them harm were examined. In the vast majority of those cases, organised within the context of the Victim Offender Mediation Program (VOMP), forgiveness was offered by victims and received by offenders. This research, utilizing a qualitative multiple case study method, examined twenty-five randomly selected cases referred for victim/offender mediation over a 10-year period, in which victims/survivors, following a period of preparation, had participated in at least one day-long dialogue with their offenders facilitated by trained personnel. This article addresses only one of the research questions posited in this study, namely, the ways in which apology and forgiveness played a part in those dialogues and in the experience of the participants following their mutual encounters. It is argued that granting forgiveness can have great power in its effects when experienced by the participants.

    This article explores victimisation by corporate violence on the basis of case studies, interviews and focus groups with victims and professionals carried out in the European project Victims and Corporations. The typical characteristics of victimisation by corporate violence are described, as well as the harmful effects for victims and their social context. The problematic aspects of tackling corporate violence through criminal procedures lead to a first evaluation of the possible contribution of restorative processes to this field on the basis of interviews and a focus group with restorative justice professionals.

    The apologies offered by young offenders in restorative justice conferences are often of poor quality. In this article the difficulties that accompany the offering of excuses are discussed. Offenders sometimes lack the language skills to pronounce an adequate apology, are anxious or insecure or believe that they have not been treated fairly. The mediation setting itself also has effects: sometimes perpetrators feel intimidated and feel compelled to say something that resembles an excuse. A related problem is that the perceptions about the sincerity of the apology can vary considerably. This perception-mismatch also occurs among victims: what one victim considers sincere is ‘fake’ for another. Many people
    – also advocates of restorative justice – trust that the offender will offer a sincere apology, without realizing that this is not self-evident in a thorny confrontation setting. This article aims to temper this sincerity-expectation.

    The Halt-intervention is an extra-judicial intervention for young people who have committed a minor offense. This article zooms in on the results of a literature review concerning the efficacy of offering an apology, one of the core elements of the Halt-intervention. Offering an apology leads to more insight into the consequences of their behavior and it increases the sense of moral norms. Shame and guilt play a crucial role in this process. The effect of the excuse can be increased by good mediation between perpetrator and victim, good preparation of the conversation, and the drafting of a contract. These instructions can also be applied when offering an apology in other interventions.

    This article presents some of the results of a study in which 25 adult men were interviewed who took part in restorative mediation in the French speaking part of Belgium and were desisting from crime. Their narratives were used to find out whether participation in restorative justice influenced positively their journey towards desistance; if so, which factors in restorative mediation supported this change process and how these factors had been helpful. The results suggest that restorative mediation has the potential to contribute to desistance in a humble, but significant way. Core aspects of mediation supported mostly already started desistance processes and they were helpful in a mainly cognitive way. The authors propose to further investigate the specific and helpful ‘presence’ of mediators and to reflect upon the apparent absence in restorative mediation of practical follow-up support towards desistance.

    Restorative justice has evolved from an unknown concept towards a model that is considered world-wide when it comes to changes in the penal and youth justice sector. The restorative model expands towards handling conflicts in other areas, such as neighbourhoods, business, welfare issues, family matters and behavioural problems in schools. This article deals with the latter. Restorative practices are based upon an open and respectful dialogue, which presupposes certain attitudes and capacities. The article looks into possible risks, but especially the chances restorative practices in schools can offer for socially vulnerable youth.

    This article describes the context of this thematic issue on restorative practices in schools. In 2016, KU Leuven performed an explorative research named “Field Glasses”. The research dealt with similarities and differences between restorative justice in the penal context on the one hand, and the domains of community building, adult education and schools on the other hand (Deboeck e.a., 2017). Literature has been studied and actors of both practice and policy-making have been interviewed. This article describes some of the main findings with regard to restorative practices and schools.

Inge Vanfraechem werkte jaren aan het Leuvens Instituut voor Criminologie (KU Leuven) als senior onderzoeker in de domeinen van herstelrecht en victimologie. Nu is zij actief als consultant (Libra) en nog steeds verbonden aan LINC als affiliated researcher. Ze is redacteur van dit blad.

    This article describes some victim-related research results of both an action research into the Flemish practice of conferencing, as well as the results of a European comparative research on victim-offender mediation. Through these results, we examine what victims think of restorative justice and why they choose (not) to participate. This way, we aim to fill a certain gap in restorative justice literature especially when it comes to non-participating victims (Van Camp & Wemmers, 2016), a group which remains hard to interview.
