    The aim of the present research was to gain insight into the topic of ‘task-related rule-breaking behavior’ (TRB) among Dutch police officers. TRB is a more refined alternative for the concept of noble cause corruption and has been defined as: police officers breaking rules or formal agreements for the purpose of acting in a manner that contributes to the lawful police task. Qualitative research has been conducted within one of the ten regional police forces in the Netherlands. Results show that TRB appears to be a relatively common phenomenon during policework. Behaviors are categorized in sixteen categories and five overarching outlines. In addition, attention is given to several important factors that could be related to TRB being distinguishable between police officers’ individual responsibility and organizational factors. To handle TRB, it is recommended to pay attention to the police officers’ approach of judging and rationalizing their own behavior, their level of knowledge, and social skills. Furthermore, organizational structure (i.e., spam of control) and police leadership may, among other factors, play an important role in encouraging TRB. Especially the way supervisors deal with police officers’ professional autonomy needs specific attention in order to reduce TRB. Autonomy needs guidance in the form of clear orders followed by feedback and coaching. Also, an active form of ethical leadership is needed. An action framework is presented that could be helpful to supervisors to judge and thereby reduce forms of TRB.

    Citizens investigating crimes themselves is a growing trend, because of democratization of information (e.g. social media), tools (e.g. apps) and knowledge (e.g. explanimations on YouTube). More and more citizens do their own research as modern Sherlocks. The police has to handle these trends in line with participant wishes and the law, but does not yet have concrete tools to do so. This article explores how the police participate in contemporary citizen criminal investigations, including the difficulties and benefits experienced. The obtained insights of the presented research serve as guidance, which can help police officers understand how to participate with citizens who have started, or want to start, a criminal investigation. The presented model explains how police can use it to better guide and stimulate, but also stop or protect citizens in their investigative activities. An app with professional guidance was piloted in four police units to participate with citizens that do their own research and learn from expectations and experiences. Citizens need guidance, but more importantly expect a certain degree of reciprocity in collaborating with police in criminal investigations.

    In former times, citizens themselves were responsible for ensuring and protecting their own safety. Over the years, this responsibility largely shifted to the government, partly due to the establishment of an institutionalized police force. In recent years, citizens have increasingly reestablishing themselves in domain of social security. Citizens are engaged in tasks that are traditionally seen as primarily the responsibility of the police, such as law enforcement, criminal investigation and immediate in case of emergencies.
    Technology can be considered as one of the major driving forces behind this increasing contribution of citizens in the field of security. Technology makes it possible to quickly find and share information and enhances people’s ability to deal with cognitively complex tasks. In a certain way, technology democratizes police work by making the skills and tools available for every citizen.
    In this article we will discuss the value of a specific form of technological support for citizens in their search for missing persons: the missing persons app ‘Sarea’. The Netherlands has a high number of missing persons and in many incidents citizens start searching themselves. Often, this citizen initiatives are uncoordinated. Therefore, an app has been developed by the police to help citizens start and coordinate their own searches for a missing person.

    Over the years, the use of data and digital technology in neighbourhood watch groups for prevention and detection of crime and citizens initiatives to enhance public safety has increased due to social and technological changes of citizen participation in coproduction of safety and digitization of economy and society. This causes a transition towards a new technology regime, a shift from a ‘closed’ information and communication technology regime owned by governmental organizations towards (inter)national ‘open’ platforms, which in turn challenges the current policy regime. This transition creates new societal expectations and challenges, often with contrasting dynamics. For instance, citizens are becoming the so-called ‘eyes and ears’ for government in prevention and detection of crime in neighbourhoods, while professionals are increasingly expected to coproduce safety with citizens through new forms of prevention and detection. With the rise of data and digital technology such as platforms and applications citizens are increasingly enabled to take the lead and initiate collaboration and organize new forms of prevention and surveillance in their own neighbourhoods.
    Both in literature as in public policy practice, neighbourhood prevention and crime detection in general is addressed. However, less attention is spent on the role and impact of data and digital technology. We propose this is an issue because the emerging digital technology regime requires a new conceptual view wherein citizen initiatives are no longer perceived as merely instrumental to government interventions, but are understood as coproducers of public safety in their neighbourhoods, as part of a broader societal shift in which citizens are enabled by digital technology to organize their own data environments. Based on the introduction of digital coproduction, we illustrate four case examples to explain which opportunities for safety professionals and local governments arise to create a policy regime that suits the emerging digital technology regime.

    Undermining has become a buzz-word in Dutch politics and security governance. On national and local level there is great concern about the disappearing lines between the legal and illegal world, which affects the democratic order and rule of law in the Netherlands. Hence, everything possible should be done in order to combat the creeping threat of undermining. However, what is undermining actually? And why has the concept become so popular now? In this contribution, the authors will consider those and other relevant key questions about the rise and effect of the undermining concept to provide more conceptual clarity. By critically reflecting on undermining as a speech act, that is ‘underminization’ (cf. securitization), and based on empirical research, the authors suggest that there are two discourses at work that hinder the effectivity of the concept: one is specifically focused on the drugs industry with its illegal activities and one broadens the concept into unlawful and undesired developments that interfere with societal stability. The authors conclude that the concept of undermining may mobilize at policy level, yet seems to paralyze at operational level.

    This contribution reports about a research in a medium-sized municipality on the possibilities of giving municipalities an instrument to determine at the earliest possible stage which neighborhoods are at (increased) risk of exposure to organized crime and its consequences. We are searching for indicators to measure that exposure to give direction to preventive measures. Our focus is on the erosion of structures and foundations of society as a result of activities of organized crime, eventually resulting in the infringement of the rule of law. It is therefore not about the phenomenon of organized crime itself, but about its effects on society. This requires clarification and measurability of the concept. In this first exploration, we focus on the following five manifestations of the effect of organized crime: The emergence of a subculture: not recognizing government authority; the emergence of takeover of power in the neighborhood; the emergence of vulnerable groups of citizens; the creation of the image: crime pays off; and the emergence of unfair competition.

    The promises of Big Data, predictive policing and artificial intelligence hold a key position in the public debate for quite some time now. Optimists tell that it is possible to predict where criminal events will occur before they take place. This would implicate a major shift towards a crime and insecurity preventive society, feeding on our cultural longing for a secure future. Therefore we give algorithms and deep learning access to more and more aspects of our lives. But how realistic and desirable is the application of Big Data techniques in the area of security?
    In this article we put focus on the research question ‘In which way can Big Data and predictive policing support good governance of security?’, that has led our study. By exploring the central concepts, the processes behind them and their results in the domain of public security, we conclude that there are only rather disappointing results from the application of these techniques: crime and insecurity have not dropped when the police and other organizations turned to Big Data techniques. Instead, many negative side effects occurred. We search for explanations in six central academic critiques on the application of these techniques in the area of security.
    We have found several ways to guaranty principles of good governance in the application of Big Data techniques, but these require a firm paradigm shift on Big Data in general. The heuristics of security professionals should not be overshadowed by technological promises: the professional should always be in the loop, must understand the way predictions come into existence and must be able to correct flaws and bugs of (semi-)automated decisions. We conclude that safeguarding public security must remain human work in which Big Data techniques can assist.

    Until recently, Dutch merchant ships could not rely on privately contracted maritime security staff to protect themselves against pirates. On the one hand, the argument prevailed that the State had to retain the monopoly on the use of force and, on the other hand, one also feared for the escalation of violence or international incidents. Nowadays, however, more and more European countries allow for the use of privately contracted armed security personnel on board merchant ships. As a result, the Dutch Parliament has adopted a bill containing rules for the use of armed private security guards on board Dutch maritime merchant ships (Law to Protect Merchant Shipping 2019 (published in the Dutch official Gazette on June 7th, 2019)).
    The author addresses the question whether because of the new law a level playing field will emerge with the Merchant Navies from the neighboring Flag States of Belgium, the United Kingdom, Spain and Denmark, presenting a comparative analysis of their domestic legislation.
    The Dutch law clearly regulates the use of force and the master has the final responsibility for everything that happens under his authority. In principle, the security guards may only apply violence as the master has determined that it is necessary. Innovative is that there is a reporting obligation whereby every incident should be reported with images and sound recordings. It seems, however, that the law is especially made to protect and secure and not necessarily to provide a solution for situations in which pirates come on board.
    It is clear that the intention of the legislator is to leave the monopoly on the use of force in the hands of the State. However, the adoption of this law to protect merchant shipping could constitute a first step in enabling the use of force by other actors than the State, which in itself is groundbreaking. Before being able to go on this road, there are still countless political (mainly related to the sovereignty of a State) and legal challenges (mainly concerning the use of force and respect for human rights) to be addressed.

    In the Netherlands, over the past 25 years mayors have had an increasing number of formal powers, based on administrative law, to fight against crime and disorder. Now, the Dutch mayors have the power to impose a restraining order, to close houses in case of drugs and/or drugs trade, or to decline a request for a permit when it might be used for illegal activities.
    To implement these measures, the local government is highly dependent on (information provided by) the police. At this moment we do not have much information about this cooperation between local government and the police in the management of crime and disorder. This paper is based on an empirical study concerning this issue. It shows that the inter-organizational cooperation between local government and the police may differ strongly, however this cooperation still often depends on central factors and circumstances. An important factor is the (growing) distance between the police and local government in regard to the local approach of problems of crime and disorder. A significant number of local police officers concentrates mainly on the maintenance of law and order by criminal law enforcement instead of the implementation of administrative measures. As a result, local government is often unsatisfied about the contribution of the police. For example, the quality of the information provided by the police is often perceived as insufficient. In some cases local governments try to diminish the degree of interdependency with the police and to strengthen their own position in the local safety domain.

    This contribution reports on a delimited part of a larger, exploratory study, the main question of which was: How do aldermen perceive threats, what are their behavioral intentions and what is the influence of threats on the process and the outcome of decision-making? This question was answered with the help of Q-methodology, semi-structured interviews and case studies. This article discusses the results of the Q-methodology and the semi-structured interviews. The case studies will be reported separately later on. Through the Q-methodology three patterns in perception were found in dealing with threats: ‘combative and decisive’, ‘vulnerable and thoughtful’ and ‘down-to-earth and accepting’. The interviews show that it usually concerns instrumental threats that are deliberately used to influence decision making, which usually take place in the private sphere and vary from verbal aggression to physical violence. Most threats come from individuals, but some come from groups, in some cases there is a relationship with criminals. In the cases reviewed, the consequences in the private sphere are far-reaching, there are indications for the influence on public functioning (from hardening to great caution). There is almost always a report, a fuss in the media can affect the authority of the official.

    Drones en drone-gerelateerde cybertechnologieën nemen een vlucht in het veiligheidsdomein in de vorm van toepassingen door het leger, de politie, brandweer, private beveiligingsbedrijven, en ook deurwaarders, agrariërs en burgerinitiatieven. Drones werden in eerste instantie ontwikkeld voor militaire doeleinden. Hun aanpassingsvermogen als universele platforms voor beeldregistratie en goederenvervoer leidt tot hoge verwachtingen rond toepassing in het civiele domein. Dit artikel onderzoekt de ethische aspecten van “dual use” van drones en gerelateerde technologieën. Verschillende dimensies van dual use worden verkend: de technologisch ontwikkeling, maar ook de ontwikkeling van wet- en regelgeving in Amerika en Europa. Voor het Nederlandse veiligheidsdomein is relevant dat dit artikel bijdraagt aan het signaleren van de noodzaak om de ontwikkeling en toepassing van drones in breder perspectief te bezien. Drones en hun toepassingen maken deel uit van de internationale markt van militaire organisaties en van veiligheidsorganisaties in het publieke en private domein. Bovendien maken ze veelal deel uit van geïntegreerde systemen en van wereldwijde platforms voor consumentenelektronica. Dit artikel is een van de resultaten uit het door NWO gefinancierde project 'Responsible Design of Drones and Drone Services: Towards an Ethical and Juridical Tool For Drone Design and Risk Assessment' (Project no. 313-99-318). Het project was gericht op het ontwikkelen van een instrument voor ontwikkeling en gebruik van dronetoepassingen uitgaande van methoden als Responsible Research & Innovation (RRI) en Value Sensitive Design (VSD).

Persoonlijkheidskenmerken van e-fraudeslachtoffers

    With the digitization of society, perpetrators gained new tools to commit crimes. Online fraud, also referred to as e-fraud, is one of the most common types of cybercrime. The present study focusses on two types of e-fraud: phishing and online consumer fraud. Although e-fraud always contains a digital component, the human is the weakest link in such crimes. Perpetrators deceive their victims to acquire sensitive data or to conclude a fraudulent sale, which makes victims unwillingly participate in the offence. However, not every person adheres to such fraudulent schemes. This raises the question what makes some people comply with these schemes and thus become a victim of cybercrime, while others do not. In this study, the differences between personality traits of e-fraud victims and the Dutch population were investigated. Personality traits influence the way people process information and react to situations, which also applies when people are confronted with e-fraud. Data were collected through an online survey, in which 224 e-fraud victims participated. The outcomes of the survey were compared with norm groups representative for the Dutch population. E-fraud victims, compared to the Dutch population, scored higher on extraversion, altruism and conscientiousness, and lower on neuroticism. Based on the findings, recommendations have been made for the development of targeted preventive measures against e-fraud.

De digitale schandpaal: opsporingsberichtgeving in een gedigitaliseerde samenleving

    In the context of criminal investigations police and prosecution can appeal to the public for information to further their case. This decision cannot be taken lightly and requires a balancing exercise between the rights of the suspect (and other people involved), specifically the right to privacy, the interest of criminal investigations, such as the identification of the suspect or witnesses, and public pressure to fight crime.
    In the current digital society, the prosecutor can choose between a wide range of (new) media and modes of communication to ask for information. Next to wanted notices on paper posters and broadcasts on television, appeals for information are published on websites, social media platforms, apps and digital screens. Citizens can modify and share these appeals and they can comment on them. This necessitates careful consideration by the prosecutor on whether and how to appeal for information. After all, these appeals could lead to DIY-policing or online vigilantism (digilantism), leading to infringements on the right to privacy and even possibly to misidentification of suspects.
    This article contributes to the continuing debate. We describe the legal framework the prosecution has to take into account in such cases. The importance of a considered decision is illustrated by three cases in which judicial authorities appealed to the public for help in the criminal investigations, resulting in massive (media) attention and consequently affecting the eventual criminal case against the defendants. In two of these cases the prosecutorial decision to involve the public’s help resulted in a violation of the defendants’ rights to privacy and consequently had to be remedied by the court. Both cases led to social, legal and political debate about the balance between privacy and crime control.

    In this article the following question is answered. What is the modus operandi of human smugglers that smuggle Syrian migrants to the Netherlands in de period 2014-2016? Content analysis of police and Royal Marechaussee files, interviews with experts and Syrian migrants and literature research has revealed that: Syrian migrants in first instance use the South-Eastern route overseas from Turkey to Greece, for which they pay 1200-4000 euro to a smuggler, depending on the quality of the boat. From Greece some travel over land on the Balkan route. Several means of transportation are used on this route, with smugglers asking prices ranging from tens to hundreds of euros. Also they travel large parts on their own. Others are smuggled by airplane, for which they need (false) documentation. Smuggling by plane tends to be successful when departing from a small airfield, when made a detour through visa-free countries and/or a good quality (false) travel document. Prices range from 2.000 to 14.000 euros. Migrants mostly pay cash through irregular ‘banks’, a third party that plays an important facilitating role within several smuggling networks. These networks consist of several cells, with in these cells leaders and ‘employees’ and are located on migration routes and ‘hubs’ like Istanbul, Athens and Milan. The South-Eastern route is mostly in hands of Turkish criminal networks, and the continuation of the journey by airplane or through Milan over land is in hands of Syrian Dutch smugglers, the Balkan route seems to be mainly operated by individual smugglers. Within these smuggling networks the most important roles are: the recruiter, who is responsible for making contact with migrants on migration hubs or social media. The organizer/leader who coordinates activities along the smuggling route and calls employees to account. And finally the driver. Responsible for transporting the migrants and instructing them. Based on these findings several recommendations were made that can be found in this article or full research rapport.

    This article reports on a conceptual model that provides insight into the relationship between Twitter use by community policing officers and citizens’ safety perceptions. The model has been tested using data from a relatively large-scale survey study and these results are supporting the model. Furthermore, a small impact of Twitter use has been found on feelings of safety and judgments about the police. To confirm these findings, further research on a larger scale is necessary. To find out more about the exact positive and negative effects of Twitter use by community policing officers, a more experimental design is required.

    In police practice and science, police culture is often seen as having a significant influence on the behavior of police officers. With his article Police (canteen) subculture, Waddington challenged this perspective in 1999. He argued that the expressive talk in the canteen is an area of action that is separated from the behavior on the street. This led to a discussion in the police literature about how to interpret the relation between police culture and police behavior. In this article this discussion is enriched with new empirical research. This research resulted in 22 patterns that police officers use to make sense of their environment in order to act in that environment. A distinction is made in three environments: organization (canteen), street (surveillance) and situation (encounter with citizens). The distinction in different environments for sensemaking helps to re-interpret the relation between police culture and police behavior and shows that police culture and police behavior are related in rather complex ways. Police culture influences the behavior on the streets through the cultural knowledge they share in the canteen, and which they use to make sense of concrete situations in which they have to act. At the same time, the point made by Waddington seems also true. The patterns of interaction between police officers have also a function in affirming their worldview and beliefs, regardless of their behavior on the streets. His perspective is just to one dimensional. A multidimensional view on the relation between police culture and police behavior is preferable if we want to understand the relation between police culture and police behavior.

    This article scrutinizes the forces that are at play during the work of police officers in the Netherlands in order to unravel how they shape and give meaning to police officers’ workaday practice. By doing so, we contribute to scholarly debates in the fields of criminology and public administration and give a new impulse to the Dutch debate on policy culture. Using insights from the literatures on police culture, policing, police morality and police styles as theoretical background, an empirical study was conducted using fifteen focus groups with a total of 83 police officers working at street-level as main method of data collection. After analyzing the transcripts through an iterative coding process, four main forces that influence police officers’ workaday practice emerged from the data, partly confirming and partly expanding existing research: 1) environment and public; 2) group culture; 3) organization and its supervisors; and 4) personal factors. However, by acquiring a deeper understanding of these forces in relation to each other and to their workaday practice, police officers’ ‘moral resilience’ will increase: it will help them to act well-considered, strengthening their ability to explain the logic of their actions.

    Community oriented policing (COP) can be seen as a co-production between citizens and police (and other stakeholders) in increasing public safety. There is a broad range of projects to cooperate with citizens. We ordered these projects along two dimensions: level of co-production (informing/consulting, advising and co-creation) and domain (prevention, law and order, investigation and quality of life). Today, most initiatives are at the lowest rungs (informing and consulting), but social media provide new possibilities to involve citizens in a more direct and fast way. The effects of the various projects are mostly limited to psycho-social factors like experienced safety, feelings of control and legitimacy. However recent studies show that these factors may have an indirect effect on crime rate. Furthermore, as reducing crime rate was not the only goal for introducing COP effect studies should not be limited to crime rate but incorporate a broad range of indicators.

    In this article we examine which factors are correlated to the rehabilitation of prisoners. Central is the prisoners’ willingness during their imprisonment to work on a successful return in society. Assumptions derived from the theory were statistically tested with data from the Dutch Detainee Survey 2014; a large-scale study, in which prisoners held in all Dutch penitentiary institutions (N = 29) were surveyed (n = 2120). The results are in line with the theory and show that detainees are more positive about their (potential for) rehabilitation when they are more satisfied with a) the way they are treated by correctional officers (staff orientation); b) active deployment of the so-called Detention and Re-integration Plan; c) their daily program and activities, and; d) the experienced autonomy and personal decision-making. These outcomes offer fruitful perspectives on how the prison system can promote a successful return of prisoners in our society.

    The concept of positive security appears more and more often in academic and public discussions. It presents a normative agenda for a non-repressive approach of security. In the article, it is claimed that the concept and its implications lack fundamental clarity. First of all, it is illustrated that the meaning of positive security primarily develops on the renouncement of negative security. Second, a historical comparison between the discipline of international relations and criminology discloses that different meanings have been assigned to positive security that seem at times at odds with each other. These frictions substantiate the view that it is problematic to accept positive security as an unequivocal recipe for change. Finally, the consequences of the disseminated structure of meaning are discussed in relation to the ambition of reform that positive security represents. For example, advocates of positive security do not seem eager to commit themselves to very clear normative views. This makes it difficult to really pin down what the suggested changes underlying positive security, are truly implying. Moreover, positive security invites us to extend the horizon of security politics to include various kinds of positive needs and values. But doesn’t this take us back to the initial criticism that the reach of the security concept has extended too much, covering virtually every aspect of life?
