    There is an intimate link between good conduct by judges and the rule of law. The quintessence of their role is that judges shape a trustworthy and fair legal system from case to case. Ethical trading is not carved in granite, and judges must determine their course on different levels. First, it concerns personal conduct and requires integrity and reliability. On the second level, the challenge is to achieve proper adjudication by conducting a fair trial in accordance with professional standards. Third, judges exercise discretion, in which normative considerations run the risk of becoming political. They should act independently as one of the players in the trias politica. A triptych of past cases illustrate moral dilemmas judges may encounter in their profession. Calibrating the ethical compass is not an abstract or academic exercise. A dialogue at the micro (internal), meso (deliberation in chambers) and macro levels (court in constitutional framework) could be incorporated in the legal reasoning as a didactic framework to make future judges aware of their ethical challenges.

    Legal ethics may be taught indirectly, given resistance to ethics as a separate and presumably merely subjective subject. This may be done by stressing the importance of facts (as the vast majority of legal issues relate to contested facts), of professional role consciousness and of the importance of formal and informal respect for all concerned. This indirect approach is best integrated into the whole of the legal curriculum, in moot practices and legal clinics offering perceptions of the administration of legal justice from receiving ends as well. Basic knowledge of forensic sciences, argumentation and rhetoric may do good here as well. Teachers of law are to set an example in their professional (and general) conduct.

    This article aims to contribute to the public debate on the consequences and risks of the spreading of DNA data related to direct-to-consumer (DTC) genetic testing. Market developments drive DTC companies to find new business models. As a result of mergers and acquisitions and of the developments of new products and services, DNA data are often used differently than what they were originally collected for. Since DTC DNA data are not protected as well as health-related data generally are, it is hard to keep track of these data. This is partly due to legal and ethical issues such as unclarity of who owns DNA and problems with informed consent. Risks are identified with regards to privacy, information security, the right not to know, (un)equal opportunities, and national security. The author calls for an investment in knowledge and awareness in order to allow for a fair balance between opportunity and risk of DTC DNA products and services.

    The article offers a reflection on how applications of computer technology (including data analytics) are and may be taught to (future) lawyers and what are the benefits and limitations of the different approaches. There is a growing sense among legal professionals and law teachers that the technological changes in the practice of law are likely to promote the kind of knowledge and skills that law graduates often do not possess today. Teaching computer technology can be done in various ways and at various depths, and those different ways and levels have different cost and benefit considerations. The article discusses four models of teaching technology: (1) teaching basic technological literacy, (2) more advanced but general technology teaching, (3) teaching computer programming and quantitative methods and (4) teaching a particular aspect of technology – other than programming (e.g. cybersecurity). I suggest that there are strong reasons for all current and future lawyers to acquire proficiency in effective uses of office and legal research software and standard means of online communication and basic cybersecurity. This can be combined with teaching of numerical and informational literacy. I also claim that advanced technology topics, like computer programming, should be taught only to the extent that this is justified by the direct need for such skills and knowledge in students’ future careers, which I predict to be true for only a minority of current lawyers and law students.

    De twee meest recent aangenomen ILO-instrumenten – Conventie 190 en Aanbeveling 206 – reguleren de aanpak van geweld en intimidatie in de context van werk. Het fundament van deze instrumenten is een ‘inclusive, integrated and gender-reponsive approach’ die middels de routes van preventie en bescherming, handhaving en genoegdoening en advies en scholing dient te worden geïmplementeerd. Conventie 190 hanteert een brede definitie van ‘geweld en intimidatie’ en is van toepassing op formele werknemers, maar ook op andere groepen ‘werkenden’. Maar wat is de inhoud en het belang van deze geïntegreerde aanpak, bezien in nationaal en internationaal perspectief? Hoe verhoudt de bescherming tegen geweld en intimidatie onder gelijkebehandelingswetgeving en arbeidsomstandighedenrecht zich tot elkaar en voldoet het Nederlands juridisch raamwerk aan de voorgestelde ‘integrated approach’? Alhoewel de Conventie als normatieve basis gelijke behandeling en non-discriminatie neemt, geeft zij uitdrukkelijk de opdracht aan ratificerende lidstaten om een geïntegreerde aanpak toe te passen, waarbij geweld en intimidatie niet slechts onder gelijkebehandelingswetgeving, maar tevens onder arbeidsomstandighedenrecht en strafrecht worden ondergebracht om zo lacunes in de juridische bescherming voor slachtoffers te voorkomen. Alhoewel de juridische infrastructuur voor deze ‘integrated approach’ in Nederland aanwezig lijkt, is er nog een aantal aandachtspunten aangaande een effectieve implementatie hiervan, met name in relatie tot criteria voor zorgvuldige klachtbehandeling, risicoanalyse en aanpak en de rol van de vertrouwenspersoon.

    Long before the coming of the Bill of Rights in written Constitutions, the common law has had the greatest regard for the personal liberty of the individual. In order to safeguard that liberty, the remedy of habeas corpus was always available to persons deprived of their liberty unlawfully. This ancient writ has been incorporated into the modern Constitution as a fundamental right and enforceable as other rights protected by virtue of their entrenchment in those Constitutions. This article aims to bring together the various understanding of habeas corpus at common law and the principles governing the writ in common law jurisdictions. The discussion is approached through a twelve-point construct thus providing a brief conspectus of the subject matter, such that one could have a better understanding of the subject as applied in most common law jurisdictions.

    This article focuses on the posting of workers in the aviation industry. The main problem is that it is not clear in which situations the Posting of Workers Directive should be applied to aircrew (i.e. cabin crew and pilots). The aviation sector is characterised by a very mobile workforce in which it is possible for employees to provide services from different countries in a very short timeframe. This makes it, to a certain extent, easier for employers to choose the applicable social legislation, which can lead to detrimental working conditions for their aircrew. This article looks into how the Posting of Workers Directive can prevent some air carriers from unilaterally determining the applicable social legislation and makes some suggestions to end unfair social competition in the sector. This article is based on a research report which the authors drafted in 2019 with funding from the European Commission (hereafter the ‘Report’)

    The Financial Action Task Force reported that money launderers may operate in professional money laundering networks. Whether such money laundering networks operate in the Netherlands is unclear. In this article the authors therefore explore whether professional money launderers collaborate in network structures and the business-like manner in which they offer their services. Business-like refers to their involvement in multiple cases, the amount of repeat customers, and excludes family relations. The research is based on Dutch police registrations of 236 professional money launderers. Our results suggest that professional money laundering networks are indeed active in the Netherlands and that money launderers in these networks offer their services in a business-like manner to a varying extent. An important caveat to the current findings is that the criminal cases analyzed predominantly pertain drug-related offenses, leaving the existence and professionalism of money laundering networks in other types of crime, like large-scale fraud, a question open for future research.

    Phase 5 of a mediation process aims at the participants’ reaching an agreement that is complete, fair, feasible and enforceable. Its legal nature is primarily dependent on the wishes of the parties. It can comprise legally non-binding statements, agreements on the parameters of future contracts, and even legally binding declarations of intent concerning contested claims.
    It can be considered a settlement contract if it contractually settles a conflict between parties, or contractually determines an uncertain legal relationship by dint of mutual relenting. Depending on the circumstances, it may also be classified as a precontract, a procedural agreement, a contract of remission, or a contract sui generis.
    German law does not provide a special order of enforcement for mediation settlements. Though such an order (section 796d ZPO) was part of one of the drafts for the German Mediation Act and its accompanying changes of the law, it was abandoned during the legislative procedure. An agreement can be enforced based on: a settlement in court, an arbitral settlement, a lawyers’ settlement, a recorded instrument, or an arbitral verdict.

    A question that has preoccupied sociolegal scholars for ages is whether law can change ‘hearts and minds’. This article explores whether non-discrimination law can create social change, and, more particularly, whether it can change attitudes and beliefs as well as external behaviour. The first part examines how sociolegal scholars have theorised about the possibility and desirability of using law as an instrument of social change. The second part discusses the findings of empirical research on the social working of various types of non-discrimination law. What conclusions can be drawn about the ability of non-discrimination law to create social change? What factors influence this ability? And can non-discrimination law change people’s hearts and minds as well as their behaviour? The research literature does not provide an unequivocal answer to the latter question. However, the overall picture emerging from the sociolegal literature is that law is generally more likely to bring about changes in external behaviour and that it can influence attitudes and beliefs only indirectly, by altering the situations in which attitudes and opinions are formed.

    The entry into force of the United Nations Convention on the Rights of Persons with Disabilities (CRPD) pushed state obligations to counter prejudice and stereotypes concerning people with disabilities to the forefront of international human rights law. The CRPD is underpinned by a model of inclusive equality, which views disability as a social construct that results from the interaction between persons with impairments and barriers, including attitudinal barriers, that hinder their participation in society. The recognition dimension of inclusive equality, together with the CRPD’s provisions on awareness raising, mandates that states parties target prejudice and stereotypes about the capabilities and contributions of persons with disabilities to society. Certain human rights treaty bodies, including the Committee on the Rights of Persons with Disabilities and, to a much lesser extent, the Committee on the Elimination of Discrimination against Women, require states to eradicate harmful stereotypes and prejudice about people with disabilities in various forms of interpersonal relationships. This trend is also reflected, to a certain extent, in the jurisprudence of the European Court of Human Rights. This article assesses the extent to which the aforementioned human rights bodies have elaborated positive obligations requiring states to endeavour to change ‘hearts and minds’ about the inherent capabilities and contributions of people with disabilities. It analyses whether these bodies have struck the right balance in elaborating positive obligations to eliminate prejudice and stereotypes in interpersonal relationships. Furthermore, it highlights the convergences or divergences that are evident in the bodies’ approaches to those obligations.

    In this article, we focus on how the education system can be used to promote equality in the context of changing people’s hearts and minds – values, morals and mindsets. The duties contained in the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 (‘Equality Act’) bind private and public schools, educators, learners, governing bodies and the state. The Equality Act calls on the state and all persons to promote substantive equality, but the relevant sections in the Equality Act have not been given effect yet, and are therefore currently not enforceable. We set out how the duty to promote equality should be concretised in the Equality Act to inter alia use the education system to promote equality in schools; in other words, how should an enforceable duty to promote equality in schools be fashioned in terms of the Equality Act. Should the relevant sections relating to the promotion of equality come into effect in their current form, enforcement of the promotion of equality will take the form of obliging schools to draft action plans and submit these to the South African Human Rights Commission. We deem this approach inadequate and therefore propose certain amendments to the Equality Act to allow for a more sensible monitoring of schools’ duty to promote equality. We explain how the duty to promote equality should then play out practically in the classroom to facilitate a change in learners’ hearts and minds.

    Sexually transgressive behavior occurs in all sections of society, including sports. That includes behavior from making sexual comments to rape. A risk factor is the culture that can prevail in sports, also known as a disruptive culture. There is normalization of deviant behavior. The top sport culture is particularly vulnerable to unacceptable behavior. In this article we will consider the phenomenon of grooming by the coach – the conscious and movement that induce the minor to engage in sexual contact. Within top sport, the opportunity for (sexually) transgressive behavior will be the determining factor. While grooming in recreational or recreational sport is often by isolating (vulnerable) children from the group, grooming can occur in top sport because of the intensity of the relationship, which is in any case of a more closed nature and can be strengthened by the strong performance-oriented top sport culture. In both cases, an alert, open environment is necessary to create a safe sports climate.

    Few legal theorists today would argue that the domain of law exists in isolation from other normative spheres governing society, notably from the domain of ‘politics’. Nevertheless, the implicit norm that judges should not act ‘politically’ remains influential and widespread in the debates surrounding controversial court cases. This article aims to square these two observations. Taking the Miller v. Secretary of State and Urgenda cases as illustrative case studies, the article demonstrates that what it means for judges to adjudicate cases ‘apolitically’ is itself a matter of controversy. In reflecting on their own constitutional role, courts are forced to take a stance on substantive questions of political philosophy. Nevertheless, that does not mean that the ‘norm of judicial apoliticality’ should therefore be rejected. The norm’s coherence lies in its intersocial function: its role in declaring certain modes of judicial interpretation and intervention legitimate (‘legal’/‘judicial’) or illegitimate (‘political’).

    This article tells the story of University of Strathclyde Mediation Clinic through the eyes of its founder. Taking its first case in 2012, by the start of 2021 it will be providing a free mediation service in 16 of Scotland’s 39 sheriff courts, covering more than half the country’s population. Yet it started with no plan, no budget and a few volunteers. The article makes the case that mediation clinics, like mediation itself, call for improvisation, coining the term ‘pracademia’ to describe how such clinics straddle the two worlds of practice and theory.

    As mediators we should be aware of our biases. We cannot avoid them, although we need integrity and impartiality while helping people communicate and negotiate in their search for conflict resolution. The mediator’s job is delicate and important, as we ‘play’ with people and their underlying interests, emotions and identity. That is also the case in business mediation, where it all seems to be just professional and some feel emotions are to be avoided.
    Mediators need much intrapersonal work to stay balanced and to manage their own biases. In this article a 5 step Managing Biases Process (5MBP) is suggested.
    To do this honestly and seriously, and to keep growing, we need a ‘sparring partner”. Such mediator buddy contributes to our checks and balances, and better guarantees the integrity of the mediator.

    In this article the authors describe briefly the legal aspects of liquidation of an estate and the alternative way of mediation. Besides that they investigate what should better be done before the estate will be liquidated. It turns out that also in that case the facilitation of mediation is a wise choice.
