Special issue on Education in (Professional) Legal Ethics, Emanuel van Dongen & Jet Tigchelaar (eds.)

Tijdschrift Law and Method, juni 2021
Auteurs Emanuel van Dongen en Jet Tigchelaar
SamenvattingAuteursinformatie

The legal position of persons with intellectual disabilities under the Dutch Care and Compulsion Act (Wzd) in light of Article 12 of the Convention on the Rights of Persons with Disabilities (CRPD)

Tijdschrift Family & Law, juni 2021
Trefwoorden dicrimination, guardianship, incapacitated adults, legal (in)capacity
Auteurs F. Schuthof LLM
SamenvattingAuteursinformatie

In the Netherlands, the use of involuntary treatment in the mental health care sector is governed by the Dutch Care and Compulsion Act (Wzd). This study examines the legal position of persons with intellectual disabilities under this Act. The Wzd is analyzed in light of the human rights standards of Article 12 of the Convention on the Rights of Persons with Disabilities (CRPD). The findings of this study show that the Wzd does not meet the standards of Article 12 in several cases. The Wzd does not recognize the legal capacity of persons with intellectual disabilities, it continues to allow for substituted decision-making and support measures are not complemented by adequate safeguards. From a theoretical point of view, an imbalance between the protection of and the respect for the autonomy of persons with intellectual disabilities can be observed. This article formulates several recommendations in order to restore this balance.

Or: The desirability of introducing simple adoption as an option for long-term foster children in The Netherlands

Tijdschrift Family & Law, juni 2021
Trefwoorden Adoption, foster care, guardianship, parental responsibility, supervision orders for minors
Auteurs mr. dr. M.J. Vonk en dr. G.C.A.M. Ruitenberg
SamenvattingAuteursinformatie

In this article you will be introduced to Martha. Martha will turn eighteen in a couple of weeks and is afraid of losing her foster family when she becomes an adult (I). You will be taken on a journey through the Dutch child protection system and recent research on the desirability of forging an additional legal instrument, such as the introduction of simple adoption, for children like Martha and her two families. The following questions will be answered: How do children like Martha end up in a foster family (II)? Who is responsible or who makes decisions about Martha’s care and future and what problems may occur? Five possible situations in long-term foster care will be discussed in this context on the basis of current law and research (III). Would simple adoption (eenvoudige adoptie) solve some of the problems discussed in the earlier section and thus be a feasible and desirable option for long-term foster children and their foster parents (IV)? At the end of this journey you will be invited to take a brief glance into the future in the hope that Martha’s voice will be heard (V).
    ---

Access_open What does it mean to be ‘illiberal’?

Tijdschrift Netherlands Journal of Legal Philosophy, Aflevering 1 2021
Trefwoorden Liberalism, Illiberalism, Illiberal practices, Extremism, Discrimination
Auteurs Bouke de Vries
SamenvattingAuteursinformatie

‘Illiberal’ is an adjective that is commonly used by scholars. For example, they might speak of ‘illiberal cultures’, ‘illiberal groups’, ‘illiberal states’, ‘illiberal democracies’, ‘illiberal beliefs’, and ‘illiberal practices’. Yet despite its widespread usage, no in-depth discussions exist of exactly what it means for someone or something to be illiberal, or might mean. This article fills this lacuna by providing a conceptual analysis of the term ‘illiberal practices’, which I argue is basic in that other bearers of the property of being illiberal can be understood by reference to it. Specifically, I identify five ways in which a practice can be illiberal based on the different ways in which this term is employed within both scholarly and political discourses. The main value of this disaggregation lies in the fact that it helps to prevent confusions that arise when people use the adjective ‘illiberal’ in different ways, as is not uncommon.

Tijdschrift PROCES, Aflevering 3 2021
Trefwoorden ontuchtige handelingen, seksuele autonomie minderjarigen, Legaliteit
Auteurs Dr. Renée Kool en Dr. Lydia Dalhuisen
SamenvattingAuteursinformatie

A revision of the Dutch vice law is to be expected, amongst others with regard to sex between minors. The current standard requires such contacts to be in violation with the social view, indicating that the minor’s perspective is subdue to the majority opinion. Applying the legal standard of ‘indeceny’ (‘ontuchtig’), the judiciary are left with room for interpretation. In order to grant minors more sexual autonomy and to further legality, the legislator wants to change the criterion, opting for the standard of ‘other than in an equal relationship’. This begs the question whether this will solve the interpretive issues that flow from such open criteria. In order to predict whether the standard of ‘other than in an equal relationship’ will contribute to clarify the issues of legality, the jurisprudence with regard to the standard of ‘indecency’ was analyzed in order to learn which variables are applied by the magistracy.

Dispute settlement among the Nigerian Igbo in Antwerp

Tijdschrift Recht der Werkelijkheid, Aflevering 1 2021
Trefwoorden Legal pluralism, Dispute settlement, Igbo, Antwerp
Auteurs Filip Reyntjens
SamenvattingAuteursinformatie

This is a case study in ‘new legal pluralism’ which is interested in the operation of plural legal orders in countries of the global North. It considers the way in which the Nigerian Igbo living in Antwerp, Belgium settle their disputes. It first presents the Antwerp Igbo’s organisation in a Union possessing a constitution with precise legal stipulations. It then finds that the Igbo take the law with them from their home region into a diasporic community. Next it looks into the concrete organisation of dispute settlement and presents five cases as exemplars. It then discusses the advantages and drawbacks of applying Igbo law and justice, the issue of women’s rights, and the plurality and flexibility of the system. The conclusion underscores the fact that legal pluralism is a universal empirical reality.

Access_open Teaching Technology to (Future) Lawyers

Tijdschrift Erasmus Law Review, Aflevering 1 2021
Trefwoorden legal education, law and technology, legal analytics, technology education, technological literacy
Auteurs Mikołaj Barczentewicz
SamenvattingAuteursinformatie

The article offers a reflection on how applications of computer technology (including data analytics) are and may be taught to (future) lawyers and what are the benefits and limitations of the different approaches. There is a growing sense among legal professionals and law teachers that the technological changes in the practice of law are likely to promote the kind of knowledge and skills that law graduates often do not possess today. Teaching computer technology can be done in various ways and at various depths, and those different ways and levels have different cost and benefit considerations. The article discusses four models of teaching technology: (1) teaching basic technological literacy, (2) more advanced but general technology teaching, (3) teaching computer programming and quantitative methods and (4) teaching a particular aspect of technology – other than programming (e.g. cybersecurity). I suggest that there are strong reasons for all current and future lawyers to acquire proficiency in effective uses of office and legal research software and standard means of online communication and basic cybersecurity. This can be combined with teaching of numerical and informational literacy. I also claim that advanced technology topics, like computer programming, should be taught only to the extent that this is justified by the direct need for such skills and knowledge in students’ future careers, which I predict to be true for only a minority of current lawyers and law students.

What makes a sex crime?

A fair label for image-based sexual abuse

Tijdschrift Boom Strafblad, Aflevering 2 2021
Trefwoorden Image-based sexual abuse, Revenge porn, Wraakporno, Fair labelling, Sexual autonomy
Auteurs M.L.R. (Marthe) Goudsmit LL.M. M.A
SamenvattingAuteursinformatie

This article considers why image-based sexual abuse (‘ibsa’) should be classified as a sexual offence. The article briefly considers harmfulness, and then moves to discuss the principle of fair labelling. Classification of offences should be informed by the wrongdoing they address. A conceptual analysis of sexual offences shows that sexual wrongs warrant labelling as sexual offences. The infringement of the right to sexual autonomy in ibsa means the nature of the wrong is sexual. Ibsa should be a sex crime.

Access_open Big Data Ethics: A Life Cycle Perspective

Tijdschrift Erasmus Law Review, Aflevering 1 2021
Trefwoorden big data, big data analysis, data life cycle, ethics, AI
Auteurs Simon Vydra, Andrei Poama, Sarah Giest e.a.
SamenvattingAuteursinformatie

The adoption of big data analysis in the legal domain is a recent but growing trend that highlights ethical concerns not just with big data analysis, as such, but also with its deployment in the legal domain. This article systematically analyses five big data use cases from the legal domain utilising a pluralistic and pragmatic mode of ethical reasoning. In each case we analyse what happens with data from its creation to its eventual archival or deletion, for which we utilise the concept of ‘data life cycle’. Despite the exploratory nature of this article and some limitations of our approach, the systematic summary we deliver depicts the five cases in detail, reinforces the idea that ethically significant issues exist across the entire big data life cycle, and facilitates understanding of how various ethical considerations interact with one another throughout the big data life cycle. Furthermore, owing to its pragmatic and pluralist nature, the approach is potentially useful for practitioners aiming to interrogate big data use cases.

Tijdschrift Law and Method, april 2021
Trefwoorden legal education, pragmatism, symbolic interactionism, sociology of space
Auteurs Karolina Kocemba
SamenvattingAuteursinformatie

The article deals with the possibility of socializing law students through space. It first indicates which features of space affect the possibility of influencing interactions and identity. It then discusses how we can use symbolic interactionism to study interactions and socialization in spaces of law faculties. Then, on the basis of the interviews conducted with law faculty students about their space perception, it shows how to research student socialization through space and how far-reaching its effects can be.

Bounding Border Checks

A Comparative Approach to Crimmigration, Race, and Policing at the US Internal Border

Tijdschrift Crimmigratie & Recht, Aflevering 1 2021
Trefwoorden Border checks, US International Border, US Border Patrol, Schengen area
Auteurs David Hamburger
SamenvattingAuteursinformatie

Crimmigration – the hybridization of criminal law and migration policy – is a transatlantic phenomenon. Despite this growing recognition, however, academic attention has thus far tended to focus more on discrete cases than on the similarities across regional contexts. In considering internal checkpoint stops conducted by US Border Patrol within the context of ongoing debates about racial profiling and policing of the internal border in the Schengen area, this article aims to provide a comparative lens by which to assess the questions at the heart of the current European discussion. An examination of both the jurisprudence and practice of the US internal border, this comparison suggests, offers a cautionary tale for European attempts to balance the fight against cross-border crime with the principles of human rights and the promise of a Europe free of internal frontiers.

A machine without an engine: why deportation would hardly find its place in the Italian judicial system

Tijdschrift Crimmigratie & Recht, Aflevering 1 2021
Trefwoorden deportation, convicted foreign nationals, crimmigration, judicial decision-making
Auteurs Eleonora Di Molfetta
SamenvattingAuteursinformatie

In the last decades, many Western countries have embraced an exclusionary stance towards non-members by increasingly relying on deportation. An important target of ‘crimmigration’ practices is represented by convicted foreign nationals, who are subject to deportation after serving their sentence. In Italy, trial judges can issue a deportation order towards convicted foreign nationals considered socially dangerous. This article examines whether and how deportation has found its space in judicial settings. Drawing on data collected in the court of Turin, this article sheds light on how structural and cultural traits of the Italian judicial system make deportation ‘a machine without an engine’.

The Crimmigration Trend in the Netherlands: Some Critical Reflections

Tijdschrift Crimmigratie & Recht, Aflevering 1 2021
Trefwoorden crimmigration, immigration control, irregular migrants, the Netherlands, crimmigration critique
Auteurs Richard Staring en Ruben Timmerman
SamenvattingAuteursinformatie

Over the past decade, the concept of crimmigration has dominated legal and criminological understanding of contemporary immigration control. Drawing on the Netherlands as case study, this article provides a critical reflection on ‘crimmigration’ as both a policy trend and a scholarly trend. We argue that much of the existing scholarship has presented a one-dimensional understanding of crimmigration as a unilateral process singularly trending towards increasing punitiveness, securitization and exclusion. We examine a number of concrete examples illustrating the need for a more complex understanding that incorporates an analysis of the full range of actors and (counter)processes within the field of crimmigration.

Access_open Art, Science and the Poetry of Justice – Pragmatist Aesthetics and Its Importance for Law and Legal Education

Special Issue on Pragmatism and Legal Education Sanne Taekema & Thomas Riesthuis (eds.)

Tijdschrift Law and Method, maart 2021
Trefwoorden legal research, legal education, epistemology, law, science and art
Auteurs Wouter de Been
SamenvattingAuteursinformatie

Classic pragmatists like John Dewey entertained an encompassing notion of science. This pragmatic belief in the continuities between a scientific, ethical and cultural understanding of the world went into decline in the middle of the 20th century. To many mid-century American and English philosophers it suggested a simplistic faith that philosophy and science could address substantive questions about values, ethics and aesthetics in a rigorous way. This critique of classic pragmatism has lost some of its force in the last few decades with the rise of neo-pragmatism, but it still has a hold over disciplines like economics and law. In this article I argue that this criticism of pragmatism is rooted in a narrow conception of what science entails and what philosophy should encompass. I primarily focus on one facet: John Dewey’s work on art and aesthetics. I explain why grappling with the world aesthetically, according to Dewey, is closely related to dealing with it scientifically, for instance, through the poetic and aesthetic development of metaphors and concepts to come to terms with reality. This makes his theory of art relevant, I argue, not only to studying and understanding law, but also to teaching law.

Wouter de Been
Wouter de Been is a legal theorist who has written widely on pragmatism and legal realism. I would like to thank the reviewers for their comments. Their critical commentary made this a much better article. Any remaining shortcomings are of course my own. I dedicate this article to the memory of Willem Witteveen, who always saw the art in law.

Reimagining Liberalism Regarding Disability and Public Health

Tijdschrift Netherlands Journal of Legal Philosophy, Aflevering 1 2021
Trefwoorden Vulerability Theory, Liberalism, Convention on the Rights of Persons with Disabilities (CRPD), Public Health, Capabilities Approach
Auteurs Erwin Dijkstra
SamenvattingAuteursinformatie

The public health systems of liberal states systematically fail to meet the goals and obligations of the Convention on the Rights of Persons with Disabilities, which aims to facilitate full societal participation and independent life choices by all impaired persons, as well as the unburdening of their private caretakers. This failure does not stem from a lack of money or effort by governments and other societal institutions, but flaws in the anatomy of these systems. As these systems confine institutional assistance to the needs of persons with certain delineated disabilities, they neglect the needs of other persons, whose disabilities do not fit this mould. The responsibility for the latter group thus falls to their immediate social circle. These private caretakers are in turn seldom supported. To remedy this situation, I will present the alternative paradigm of vulnerability theory as the possible foundation for a more inclusive approach to public health.
