    This article discusses the importance of reflection for prison staff. Their work is both physical and emotionally incriminating. That increases risk on turnover, burn-out, psychosomatic diseases and negative experiences with prisoners. To render all challenges in their work it’s important to build up resiliency. One of the means to stimulate resilience is organized reflection. It is described how guided by experts, reflecting on own experiences can contribute to resilience of prison employees and strengthen their learning capacity. That is done by literature study and a description of experiences with organized reflection in PI Vught.

    In the Netherlands there is a tendency to make use of the methodology of conferencing circles in case of domestic violence and abuse. The 2009 evaluation showed positive results and since then the approach has been improved, giving way to an increase of requests coming from justice (related) authorities. The underlying approach and caveats are discussed, portraying Eigen Kracht-conferences as an adequate means to unravel the complex phenemenon of domestic violence and abuse, calling upon significant others.

    The article is an ethnographical study of Rotterdam’s experience with a program called ‘Community Governs’ (Buurt Bestuurt). Community Governs, a Dutch version of the Chicago Alternative Policing Strategy (CAPS), is a community-based program which goal is to solve neighbourhood crime and disorder problems. Community commitment and involvement are a main component of this program. The article emphasizes the effects that this program had on three levels of trust (performances, intentions and skills) of the residents in police officers and municipal service agencies as partners in the fight against crime and disorder. The results indicate that a ‘positive exercise’ of liberty through political participation of civilians is difficult to realise in poor, inner city, neighbourhoods.

    Research into radicalization and terrorism assumes that violent individuals have political or religious intentions and motivations. However, what ‘political or religious motivations’ exactly are changes through time. A rigorous conceptual demarcation of ‘radicalization’ and ‘terrorism’ runs the risk of overlooking societal and political changes leading to a variety of violent outbursts that may have more in common than assumed at forehand. Hans Magnus Enzensberger’s concept of ‘the radical loser’ is used as an example of a broader conceptualization that can function as a category enabling interconnected and interdisciplinary research into different manifestations of violence, both in their differences and their similarities. Whether or not terrorists, school shooters and violent lone actors are fundamentally different categories should be a topic of academic enquiry instead of being taken for granted.

    Over the last decades the number of people who have been detained on the suspicion of terrorism has significantly grown. This has resulted in an increased scholarly interest in the topic of prisons and terrorism. However, the main focus of academic research has been the period of incarceration. Especially the question whether terrorists should be isolated from other prisoners has received considerable scientific attention. What happens after their release still remains opaque. In this article some preliminary insights will be shared on particular aspects of the societal reintegration of former suspected terrorist detainees. It presents some of the obstacles, dilemmas and opportunities. These insights where obtained through semi-structured interviews with both professionals and former detainees with a jihadist background.

    This contribution contains a response to the article of Vincent Geeraets included in this issue. Following the structure of Geeraets’ article this reflection consists of two parts: 1. Stories that deal with the origin of criminal law and restorative justice and 2. The perspective of the offender as someone who harms himself in the views of Duff and Claessen. In this contribution these parts are connected through the concepts ‘dialectics’ (ad 1) and ‘mysticism’ (ad 2) – i.e. concepts in which ‘Western’ respectively ‘Eastern’ Enlightenment seem to intertwine.

Jacques Claessen is als universitair docent straf(proces)recht verbonden aan de vakgroep Strafrecht & Criminologie, Faculteit der Rechtsgeleerdheid, Universiteit Maastricht. In 2010 verscheen zijn dissertatie Misdaad en straf. Een herbezinning op het strafrecht vanuit mystiek perspectief (Nijmegen: Wolf Legal Publisher). Zijn interessegebieden zijn sanctierecht, herstelrecht en de strafrechtelijke positie van het slachtoffer. Claessen is redacteur van de Nieuwsbrief Strafrecht en het Tijdschrift voor Herstelrecht. Voorts is hij rechter-plaatsvervanger bij de Rechtbank Limburg. Hij is winnaar van de Bianchi Herstelrechtprijs 2012.

    Adherents to restorative justice are to be commended for systematically questioning whether the manner in which criminal law is currently organised is a good thing. The debate about criminal justice and restorative justice is therefore an important one. It is also a debate which is occasionally marred by a reliance on ideology. In this article, a number of ideological claims are identified and discussed. First, both adherents to criminal law and supporters of restorative justice invoke an ‘origin story’ to defend their view. The origin story of criminal law consists of the idea that without criminal law the world would be a chaos, i.e. the world would resemble the state of nature as depicted by Hobbes. In contrast: the origin story of restorative justice revolves around the idea that without central authority people tend to resolve their conflicts harmoniously. I argue that neither types of origin story can withstand scrutiny. Secondly, in both the context of criminal law (e.g. Antony Duff) and restorative justice (e.g. Jacques Claessen), it is claimed that an individual by violating the rules harms himself as a person. The point of punishment (criminal justice) respectively reparation (restorative justice) therefore is to enable the offender to restore himself and to once again take up his role of citizen. I argue that the claim of self-harm may be based on a primitive worldview. Moreover, I show that this claim can be used to describe criminal law respectively restorative justice in terms that are too harmonious. In this way we lose sight of the coercion and violence that is involved in both contexts.

    Based on a literature research and program evaluation of the practice of Victim in Focus (Slachtoffer in Beeld) in 2013, two issues are addressed: What are the possible effects of victim offender mediation? Which active mechanisms will cause or contribute to these effects? The authors describe the current context and developments in The Netherlands concerning restorative justice and then describe the effects and possible active mechanisms such as satisfaction, diminishing fear, anger and shame, information and consent, procedural justice, reduction of recidivism, compliance. In a synthesis of active mechanisms they present four domains or mediating factors: from incomprehension to comprehension (cognitive restoration); from unease to ease (emotional restoration); from injustice to justice (moral restoration); from powerless to powerful feelings (restoration of control). The victim offender mediation as a ritual has an impact or is supposed to have an impact on these four domains for both victims and offenders. Within the four domains four activities or interactions within victim offender mediation are presented: creating understanding through inter-subjectivity; expression of fear, trauma and shame; doing justice by excuses/apologies and restorative actions; regaining self control. Further research is needed to validate the model and to get more insight in essential or primary and secondary aspects in the explanation of the impacts of victim offender mediation.

Gert Jan Slump is criminoloog, sociaal-maatschappelijk ondernemer en consultant, adviseur en trainer. In 2010 was hij medeoprichter van de Stichting Restorative Justice Nederland en sindsdien ontwikkelt hij samen met organisaties en professionals binnen het netwerk rond herstelrecht en herstelgericht werken in Nederland allerlei projecten op dit terrein. Hij is een veelgevraagd spreker op dit terrein. Gert Jan is ook actief op het terrein van professionaliseringsvraagstukken, onder meer binnen de jeugdzorg.

    Herman Bianchi, who passed away on the 30th of December 2015, has been a true ‘significant other’ for cultural criminologists. This article is a ‘criminological Verstehen’ of Bianchi’s work. His general attitude towards criminology is characterised by a mix of academic analysis, emotional outrage and incongruities. In order to understand this, his contributions to criminology are linked to biographical notes and to the mixed reactions he got on his work. Bianchi played an important role in the establishment of criminology as an autonomous academic discipline, yet he was very critical of this ‘discipline of shame’ because it has always served the exclusion of the most vulnerable members of society. He has been one of the frontmen of critical criminology, but he was not a Marxist. His concern for the despised other is related to his eternal fear, as a gay man in a ‘closet with a revolving door’, of new waves of discrimination against gays, and his rigorous abolitionism to his experience as a prisoner in a Nazi-concentration camp in 1944. Bianchi’s historical interest led him at the end of his career in the 1980s to support the emergence of strong historical criminol­ogy, but his utilitarian use of historical studies, also resulted in some clashes with professional historians.
