Both in punishment theory and sentencing practices, the subjective sentence severity is an important yet neglected area of research. This paper aims to explain differences between inmates in their subjective severity of imprisonment and to contemplate these against the background of important sentencing goals and sentencing principles. Two models commonly used to explain adjustment to prison life were applied: the import and deprivation model. Data from the Prison Project, collected among Dutch inmates staying in pretrial detention, reveal that both import and deprivation characteristics are related to the subjective severity of imprisonment. No support is found for a moderation effect of personality. |

Sentencing research focusing solely on unsuspended imprisonment does no justice to the practice of sentencing, where many other punishment types are imposed – often conjunctly. To investigate to what extent this imprisonment bias might have caused incomplete and thereby biased findings, we compare the effects of offender characteristics for imprisonment to those for other sanction types, as well as to a model combining sanction types. Findings suggest that the effects of offender characteristics differ per sanction type. When combinations of sanction types are taken into account, some offender characteristics do no longer have mitigating or aggravating effects, or the effects even inverted. Hence, future sentencing research should aim to include all sentences imposed. |

In the Netherlands penal interventions aimed at the reduction of recidivism are progressively executed according to the ‘what works’ approach, a research tradition that tries to articulate the conditions under which penal interventions can be effective in preventing offenders to relapse into crime. The ideas on ‘what works’ originate from international studies, but what about the Dutch research itself? Which interventions have proved to be successful in the Netherlands and which have had adverse results? The WODC has carried out a meta-analysis of all relevant studies that have been published in the Netherlands and the Dutch-speaking part of Belgium since the early seventies of the previous century. 141 evaluations were identified, 83 of which contained some sort of comparison with a control group. Results indicate that programmes aimed at adult offenders were more successful than interventions for youth and young adults. Programmes based on the idea of rehabilitation appeared to have been more successful than sanctions based on deterrence. |

Based on qualitative research within Chinese restaurants in the Netherlands, the authors describe and discuss (informal) labour relations among Chinese restaurant owners and their illegal Chinese workers. It is argued that a too one-sided emphasis on interpreting these labour relations in terms of ‘labour exploitation’ reduces employers to offenders and employees to victims. Such a judicial perspective hinders a clear view on the causes of underlying themes as illegal labour and illegal stay. The authors discuss how restaurant owners and employees operate in a ‘moral economy’ in which a demand for cheap products and flexible, motivated, cheap, and capable labour interacts with culturally shared expectations on justice and reciprocity and influences labour relations. |

Annually hundreds of victims make use of their right to speak in court. Victims often expect this will result in more punitive sentences. According to judges this is unlikely. This experiment among law students examines the influence of victim impact statements (VIS) on the sentencing outcome. Furthermore the effect of how the statement is delivered is examined. Is there a difference between the VIS as document in the case file and one delivered by the victim in court? Does it matter if the victim still has visible injuries? Study findings indicate that neither the presence of a VIS, nor the mode of delivery and visible injuries affect sentence length. |

In the Netherlands, not much research has been done on the ways that Dutch women experience and try to survive a detention abroad. The research, on which this article is based, did focus on Dutch female prisoners abroad, using an ethnographic research method. This study looks at the ways Dutch mulas experience their prison term in Peru and focuses on their strategies of survival. The ways these women react upon their detention can be traced back to existing literature on the importation theory and deprivation theory. Also it became apparent that various coping strategies are used to survive their Peruvian imprisonment. These coping strategies proof to be related to the life experiences of the women (importation theory) and the experienced prison environment (deprivation theory). |

Much of developmental and life course criminological research addresses either the onset and escalation of antisocial behavior in childhood and adolescence, or the desistance from crime during the adult years. Far less attention has been paid to the years in which adolescents first make the transition to adulthood. Over the last 50 years due to increased educational demands this transition period has become prolonged and increasingly deinstitutionalized, resulting in a new life stage denoted as the emerging adult period. This introductory paper describes the ways in which this newly formed life stage between ages 18 and 28 is relevant for criminology, questions our knowledge on criminal career development during this period and explores new research avenues that may contribute to a full-fledged criminology of the emerging adulthood. |

This explorative ethnographic study in a Dutch prison focuses on the way inmates with drug problems experience their incarceration, and how that influences their identity as ‘addict’. Respondents describe incarceration as a loss of control over their lives, while their drug problems are characterised by losing control as well. Therefore regaining control in order to overcome their drug problems renders more difficult during incarceration. It is argued that resistance strategies of detainees can give them a sense of control in a short-term perspective. This sense of control could be important for the possibility of changing identity from addict to non-addict during incarceration. |

The Netherlands pursues an active policy of excluding and prosecuting potential perpetrators of international crimes. In recent years hundreds of people have been excluded from taking part in the asylum procedure. Bringing cases to court, however, has proven to be very difficult in practice. Most excluded persons reside illegally in the Netherlands or elsewhere in Europe. A good overview of the grounds upon which persons have been excluded and with what types of crimes they are associated is currently lacking. The Netherlands – actually the international community as a whole – still struggles with a number of legal and ethical issues. International law, for example, does not provide an adequate solution for some convicted excluded asylum seekers after their release. |

This study focuses on the effect of having a first child on parents’ criminal behaviour. First we examine whether after accounting for stable between person differences, such a parenthood-effect still exists. Next we examine whether this effect differs for men and women, having a child in or outside of wedlock or having a child at a young or average age. This study is based on the individual criminal careers of 3,527 men en 339 women. A fixed effects model was used to control for selection into parenthood and crime. Results show that criminal behaviour declines after having a first child among men, but that having a first child has no effect on women’s criminal behaviour. The independent effect of having a child is larger among unmarried men than married men. When men have their first child at a young age, however, their participation in crime increases. |

Employment and crime are commonly assumed to be negatively correlated. Those employed are less likely to commit crimes, and conversely, those who have a criminal record are less likely to become employed. Criminological research has provided strong empirical and theoretical support for the link between employment and crime, but also suggests that a complex set of mechanisms may be at play. Additionally, studies show that employment can also increase the risk of criminal behaviour. In the introduction of this special issue, three causal relationships in the work-crime nexus will be discussed: employment causing crime, employment preventing crime, and crime blocking future employment. |

A period of labor market absence decreases the chance to get a job. Previous research showed that labor market positions of both incarcerated and temporarily unemployed people are worse after compared to before the (forced) time out of the labor market. It remains uncertain which mechanisms cause the negative association between labor market absence and employment outcomes. In this paper we investigate whether incarceration affects the time to employment differently than regular unemployment. Using an unique quasi-experimental design we conduct event history analyses in order to estimate to what extent job opportunities differ for a group of ex-prisoners (N=1,790) and a group of unemployed future prisoners (N=266). The results show that ex-prisoners find a job more quickly than unemployed future prisoners. Possibly, training, aftercare and the prison experience (deterrence) have a positive effect in the period right after release. |

Over 700 students judged fictitious descriptions of court cases, in which the gender of the offender was systematically varied, as well as a number of aspects pertinent to theories that explain disparities in sentencing between females and males. The results show that females indeed received shorter sentences than males, and that this difference could be attributed to the fact that male student-judges gave women shorter sentences and differential sentencing for violent crimes. We found mixed support for the chivalry as well as for the perceptual shorthand theory. More research is needed, in more realistic settings, to explain gender differences in sentencing. |

Gender, in criminological research, often refers to women. Although ‘masculinities’ and crime have been intertwined internationally for more than two decades, this isn’t so for Dutch research. Based on this international critique, this article introduces the masculinities approach in Dutch penology. Prisons are generally considered as hypermasculine settings (Toch, 1998), but this hypothesis is seldom explored within a gender framework. Nevertheless, ‘doing masculinity’ is an important coping strategy for male prisoners (Jewkes, 2005). This gap is tackled on two levels: (1) the conceptualization of ‘hegemonic masculinity’ and (2) a critical, masculinity-oriented analysis of the existing knowledge on prison life, prison culture and prison hierarchy. It aims to tackle prison masculinity stereotypes, since traditional penal insights aren’t necessarily valid from a gender point of view (Evans & Wallace, 2008). Therefore, we conclude by analyzing the value of masculinity studies for penology. |

Since the last years there is extensive ongoing debate in Belgium about jury trials at the Assize Court. These trials are an example of direct participation of citizens in the criminal justice system. Hence this jury has obtained a special position in the Belgian administration of justice. Jury deliberations behind closed doors and the isolation of jury members from the outside world contribute to the fascination for this legal phenomenon. The element of secrecy also explains why there is so little empirical research on the jury’s functioning and the jurors’ experiences during the process. By means of interviews with former jury members, we studied the influence of lay participation in a jury trial on their views and confidence in jury decision making. We found that a positive evaluation of participation in a jury may strengthen their involvement with and trust in jury decision making. However, our research also reveals that jury trials may lead to some unacceptable deficits in the proceedings and outcome of the process. These results are contextualised in the broader debate about the jury and the demand for reform of the assize court proceedings. |

In the Netherlands, the number of cocaine traffickers arrested at Schiphol International Airport peaked in 2003. In May 2003, sentencing guidelines regarding cocaine traffickers were redefined into a smaller number of categories (wider quantity ranges, less specified offender categories) with lower sentences than before. New guidelines allowed criminal courts more flexibility, and judges were expected to sentence cocaine traffickers more often than before in accordance with guidelines. All cases, at all four applicable criminal courts, against cocaine traffickers that had been arrested at Schiphol in 2003 were analyzed (877 simple court and 994 full court cases). In between 30 and 40 percent of cases sentences were not according to the guidelines (mostly lower), and even more frequently than before the new guidelines had been introduced. Experience as a judge (number of years) was not associated with keeping up with guidelines, but male judges sentenced suspects more often than female judges in discordance with guidelines (and consequently below guidelines). In line with American literature, personal characteristics of suspects appeared strong predictors of the extent judges conformed to sentencing guidelines. Female offenders were twice as often as male offenders sentenced lower than the guidelines. The same result was found for offenders born or living in the Netherlands, versus migrants and offenders living abroad. |

Marriage is considered to be an important life-course event that can lead to desistance from a criminal career. However, desistance is far less obvious when offenders marry criminal partners. The aim of this study is to investigate what impact a spouse’s criminal career at the time of marriage has on persistence in crime. To analyze the relationship between marriage, spousal criminality, and criminal offending, we use a unique longitudinal dataset: the Criminal Career and Life-course Study. This is the first study that contains longitudinal data on the criminal careers of both offenders and their partners. Results show that the frequency of criminal conviction is lower if men marry non-criminal spouses. However, if men marry criminal spouses, their conviction rate does not differ from those who remain single. For women, on the other hand, marriage is related to lower conviction frequencies no matter the spouse’s criminal history. |

This research aimed to describe the remigration of Bulgarian women who had been exploited in prostitution in the Netherlands. The difficulties they encountered during their attempt to reintegrate in their environment of origin was one of the main points of interest. Files of Bulgarian women registered as victims have been analyzed in both the Netherlands and in Bulgaria. Interviews were held with current Bulgarian sex workers, former victims of trafficking and several professionals involved in the wellbeing of these women. In many cases remigration turned out to be a temporary situation as many women returned to the Netherlands later on. Partly for that reason it appeared difficult to keep track of their situation after they (initially) came back to Bulgaria. Many women encounter the very problems that contributed to the situation of trafficking in the first place. This makes it difficult to change their marginal position: prostitution remains a well paid option if the circumstances that have led to their exploitation in prostitution remain the same. This does not necessarily lead to repeated victimization, but at least to only a limited difference that reintegration programs can make. |

The political and media discourses in the Netherlands focus on the migration background of the youth responsible (mainly Moroccan juveniles) whereas in England and Wales the possible influence of discrimination is stressed. The analysis of the two discourses reveals that although the problems in the two countries are in essence comparable, very different discourses have developed. |

Starting a decade ago, police authorities in Western Europe have been dealing with (South)Eastern European gangs coming over to Western Europe. These gangs commit a large number of property crimes and are characterised by their high level of mobility. Yet, this raises questions as to how their mobility has to be interpreted: is it temporary, making them criminal tourists, or are there any migration mechanisms involved? This article is based on interviews with offenders charged with selling criminal goods (i.e. fencing). Fencing activities appear to take place either in Western Europe or in the countries of origin. Alongside these activities, their centre of social activity appears to be located in either one of them as well. This heterogeneity indicates there is little added value in combating the Eastern European crime gangs, because different offender types with a different background are involved. |
