    Spiritual care is connected with one’s identity and is linked to the religious or worldview background of the detainee. The spiritual caregiver’s religious or worldview serves the question of care. This care does not have any ‘care targets’; the basic characteristics for this care are availability and presence. The positive effect of his or her efforts on the well-being of the detainee and his contribution to a humanitarian penal system, resocialization in general, and maintenance of order have already been proven. Despite the legal protection spiritual care cannot escape the discussion on the role of religion and worldview in a strongly secularized society. This article suggests that spiritual care weathers this questioning.

    The Netherlands pursues an active policy of excluding and prosecuting potential perpetrators of international crimes. In recent years hundreds of people have been excluded from taking part in the asylum procedure. Bringing cases to court, however, has proven to be very difficult in practice. Most excluded persons reside illegally in the Netherlands or elsewhere in Europe. A good overview of the grounds upon which persons have been excluded and with what types of crimes they are associated is currently lacking. The Netherlands – actually the international community as a whole – still struggles with a number of legal and ethical issues. International law, for example, does not provide an adequate solution for some convicted excluded asylum seekers after their release.

    Little is known about children when the mothers are imprisoned. Especially in the Netherlands, hardly any empirical research has been conducted regarding the whereabouts and psychological well-being of children with incarcerated mothers. We visited and collected data from four female prisons. Via the mothers’ consent we contacted the children and their caregivers. First, we conducted a semi-structured interview about the wellbeing of the child during the separation through detention of mother and child. Second, we asked mothers and caregivers to complete checklists of behavioral problems. The caretaking situation turned out to be diverse. Generally, the children experienced both internalizing and externalizing behavioural problems and specific problems associated with the detention of their mothers. The well-being of the children seems to be partially related with the incarceration of the mother. However, it also turned out that quite a few risk factors such as a broken home and neglect is present for the child being raised. Results are discussed as well as some recommendations for future research.
