    Counterfeiting is a major worldwide crime problem and one with demonstrable links to organized criminality. The production and distribution of fake plant protection products is no exception, the proliferation of such products within the European Union owing much to the abuse of parallel trading arrangements and the high profit, low risk opportunity it presents to organized crime groups. It is also a particularly insidious crime; these chemicals are untested and unapproved for use and they pose a serious economic, environmental and human health threat. Of particular concern is the potential for residues from illegal pesticides to persist in harvested crops to then be found in foodstuffs. It is argued that this should be regarded as a food crime.

    This essay describes the most important recent events in the field of American drugs legislation covering the liberalization of cannabis policies in several states as well as the reduction of penalties for the possession of crack at the federal level. These developments are situated in a broader context of a complicated and big country with plenty of room for extreme moral views and a very punitive justice policy that targets Blacks and Latino’s much more than the white middle class. The disproportionate impact of the punitive drugs legislation is an important driving force behind the trend towards liberalization, next to the high costs of maintaining an overcrowded prison system.

    The Advice Centre for Whistleblowers in the Netherlands (het Adviespunt Klokkenluiders) opened on 1 October 2012 and offers independent and confidential advice to (potential) whistleblowers. Even though the Advice Centre opened only recently, this article gives an overview of the findings of the Advice Centre up-to-date, because of its relevance for the public debate on whistleblowers. The article inter alia mentions the number of whistleblowers that needed advice from the Advice Centre, the sectors where they work(ed), the types of wrongdoing involved in the cases and it describes the questions and dilemmas of whistleblowers who approached the Advice Centre. The article also points out how the Advice Centre could help persons with raising their concern about possible wrongdoing or malpractice in the workplace.

    This article seeks to aid understanding of the ways in which different policy purposes, approaches and legal options can be combined in the design of better legislation, using Australia’s recently passed Public Interest Disclosure Act 2013. It provides a guide to key elements of the new legislation, as an example of legislative development taking place over a long period, informed by different trends. In particular, it is one of the first national laws to seek to integrate divergent approaches to the ‘anti-retaliation’ model of whistleblower protection, including its place in the employment law system, it sets new standards for the role of ‘public whistleblowing’ in such a regime, and provides new responses on basic questions of coverage, including which individuals are able to gain the benefit of the legislation. This provides lessons as to how different legal approaches might be better integrated, in pursuit of a clearer understanding of the interface between whistleblowing and other integrity reforms.

    The period of austerity which most of Europe is now experiencing is for the first time impacting on law and orders services, particularly the police service. This article gives an overview of the debate in England and Wales on the decision of the Coalition government to cut 20% to police spending and police numbers. An important instrument to reach this goal is the private outsourcing of tasks performed in the back office. The author discusses the public views on the performance and reliability of private security companies. Also the high rise of public police expenses are discussed against the background of declining crime levels.

    As a contribution to literature drawing together green criminology and studies of organized and corporate crime, this paper provides a case study of crimes and public health harms linked to the Naples garbage disposal crisis. The context is the inability of modern consumer society to cope with the problem of mass production of waste. In turn this leads to opportunities for both legal and criminal entrepreneurs to offer services that promise but fail to ‘dispose’ of the problem. The analysis draws upon environmental law and classic studies of organised crime.

    Intimate partner violence (IPV) changed from a private problem to a public concern over the last decades. It has become subject of various discourses in different domains. In the social sciences the gender-based discriminatory nature of IPV is contested by some researchers who claim a gender equality in IPV. They call for a gender-neutral approach to IPV as a family problem, de-contextualized from gender-based inequalities. In the Netherlands this degendering is reflected in current policy discourse. However, in the international legal human rights domain, IPV is unequivocally considered to be an issue that affects women disproportionately as a form of women's discrimination that is the result of unequal power relations. Both international binding human rights law and recent ruling of the ECHR impose binding duties to acknowledge this. This article addresses the paradox that is reflected in these two positions and how to get beyond it.

    Many public prosecutors see a link between domestic violence and violence in the public sphere. In the beginning of this century the fight against domestic violence was integrated into the national security policy of The Netherlands. The growing attention for domestic violence combined with better registration has led to an enormous grow of criminal justice cases of domestic violence. The article analyses the public prosecution policy towards domestic violence. Nowadays even without a report suspects can be brought to trial if the charges can be proved. On the one hand the public prosecution aims to lay down a standard, on the other hand perpetrators are confronted with a set of conditions forcing them to accept professional help in order to bring about a change in their behaviour and prevent recidivism. In this way an effective use of criminal justice could contribute to a reduction of domestic violence and crime in general.

    Intervention teams are among the most discussed tools in the current process of securitisation. Their integrated approach takes into account all underlying causes of insecurity and quality of life. For a more effective approach authorities and organisations have to cooperate and let go of their mutual boundaries. But can the participants put aside their differences in perspectives and policies? This article discusses the goal of ‘ontkokering’ (‘decompartalisation’), this was done through a study of the practices of intervention team SIP in Amsterdam. On basis of thirteen interviews and observations the authors argue that there are three main mechanisms or ‘molar barriers’, which conserve the old structures in the integrated approach of the intervention team: ‘methodical robustness’, ‘institutional robustness’ and ‘financial robustness’.

    There is currently no legal base for financial supervision and crisis management at the European level. Powers are nationally based. This article develops the financial trilemma, which states that a stable financial system, an integrated financial system and national financial autonomy are incompatible. Any two of the three objectives can be combined, but not all three; one has to give. Assuming that a stable financial system is desirable, this article explores the trade-off between national financial autonomy and financial integration in Europe. Policymakers face a clear choice. If they want to preserve the benefits of the single market for financial services (financial integration), financial supervision and crisis management have to be based on a European footing. This article stresses that a strong legal base is needed for such European arrangements. Voluntary cooperation does not work in a crisis, as national governments tend to follow their national interests. The alternative to European arrangements is preserving the current national powers. This article predicts that banking will then become national: each country has its own national banks.

    In this essay the author looks back at ten years of rule of law foreign assistance in Afghanistan. She first surveys the elements that make Afghanistan particularly challenging as a development. This is followed by a brief outline of foreign donor-assisted efforts at rule of law reform in the last decade. The features of law and legal systems in Afghanistan that are salient for would-be foreign reformers are analyzed. The concept of judicial independence serves as example of well-intentioned rule of law interventions that have not fared well in this complex environment. The author argues that better prepared international advisors with a better grasp of legal history and comparative law may have produced stronger outcomes. Ultimately, however, a pre-post-conflict setting constrains conventional rule of law programs in important ways and calls for more realism about what can be achieved, within what time frame and with what degree of sustainability.

    This article presents a short historical introduction of the Dutch radical movement in the 1840s. What kind of people were these radical-democrats? Where did they come from? And what did they want? Moreover, this case study shows how government framed these radicals, and what actions were taken against them. It becomes clear, that from a historical perspective the continuity and similarities between the 1840s and the present are at least as remarkable as the differences.

    In this article the authors try to analyze the prerequisites and critical factors for the successful implementation of a nodal orientation in law enforcement. Their analysis is based on an exploration of the exemplary case of the Dutch national airport Schiphol, one of the most important multi nodal and infrastructural nodes in the Netherlands, where transport by air, road and rail and streams of people and goods intersect. The authors reject naive instrumentalism that sometimes comes along with the nodal orientation. They discuss the possibilities and limitations of high tech, the stipulation of nodal security governance and the dilemma's with regard to the privacy of citizens. They advocate a balance between the need for safety and personal freedom, based on a dialogue in politics and in broader society, and more accountability in the application of high tech detection equipment.

    This paper advances a ‘nodal governance’ perspective, which understands the delivery of security as being accomplished through the thinking and practices of various ‘nodes’ or entities characterized by ways of thinking about problems and influencing events. In this light, policing should be understood sociologically as involving the activities of state and non-state entities (e.g. corporations and well-resourced communities) as well as the public police. The authors argue that it is essential for police to recognize the nodal world within which they live and to locate themselves within ‘nodal assemblages’ for the delivery of security. As illustrations, the paper discusses two practical projects devoted to exploring nodal security governance arrangements in the country contexts of South Africa and Australia. The authors add that the question of what precisely nodal policing can or should look like in concrete terms is an empirical matter to be resolved within site-specific contexts.

    In March 2008 the Minister of Agriculture, Nature and Food Quality put forward a bill on animal welfare and animal health to the Dutch Parliament. In this bill five acts on kept animals are integrated. The authors discuss whether the integration is a goal in itself or means to an end. In their view the choice of legislation involved in the integration is not a logical one, and it is questionable whether this integration is necessary at all. Furthermore, the bill in its present form is not an adequate instrument to attain the policy goals in the field of animal welfare and animal health.
