    Giuseppe De Palo and Romina Canessa give a description of the recent publication of a study conducted for the European Parliament on Mediation, ‘Rebooting the Mediation Directive: Assessing the Limited Impact of its Implementation and Proposing Measures to Increase the Number of Mediations in the EU’, has contributed to the ongoing debate about effective mediation policy. The Study concluded that despite an increase in mediation awareness and the proven benefits it can have, mediation still remains largely unused as a method of dispute resolution.

Huub Sprangers
Ir. H.F.A. Sprangers (1949) is oud-ondernemer. Hij was tussen 1999 en 2005 voorzitter van de Vereniging Bouwmediators.nl en haar rechtsvoorganger NMI Groep Bouw. Daarnaast was hij rond de eeuwwisseling actief voor de Regio NMI Mediators Haaglanden, voor wie hij een samenwerking met de Kamer van Koophandel realiseerde, en in dezelfde periode grondlegger, medeoprichter en vervolgens eerste voorzitter van de Nederlandse Mediatorsvereniging (NMv; 2000-2008). Hij is sinds 2008 erevoorzitter van de NMv en zat van 2002 tot juli 2011 namens de NMv in het bestuur van het Nederlands Mediation Instituut (NMI). Van 2005 tot medio 2011 was hij voorzitter/coördinator van het Centraal Mediators Beraad, een informele samenwerking tussen NIP sectie mediation (psychologen), NMv, NVvMA (advocaten), vFAS (familierecht) en VMSN (notarissen).     Mediation is not very popular (yet) in the Dutch private sector. The author used his own network of business relations to investigate the motives not to choose mediation in solving business conflicts. Entrepreneurs and managers recognize mediation as a suitable method to solve personal conflicts like in family and community mediation. In business conflicts however, parties try not to get too personally involved and to keep feelings and emotions away from the negotiations. This investigation made clear that the timing of the conflict management process is a crucial factor in the unpopularity of mediation. The moment to choose a suitable method for dispute resolution is when the entrepreneur or manager failed to solve the dispute together with the other party. At this stage the competences of the mediator are competing with those of the entrepreneur/manager and therefore the choice for mediation is not very likely. This can only be changed by the introduction of dispute consultancy earlier in the process. Also the promotion of the traditional values and benefits of mediation does not seem to match the desires of most of the entrepreneurs and managers. Mediators might invest in pilots with companies to create opportunities for conflict consultancy and the introduction of a dispute analysis as early as possible in the process.

    Alternative Dispute Resolution (ADR) and Online Dispute Resolution (ODR) are on the rise in Europe and different Member States. In May 2013, the European Parliament and Council adopted an ADR Directive (n 2013/11) and ODR Regulation (n 524/2013) that will bring major changes in the European and national ADR landscapes. Both instruments are analyzed in this article. On the other hand, attention is also paid to the Belgian ODR-platform Belmed, that was created in 2011 and facilitates Belgian consumers to make an online ADR application. Finally, a plea is made for the exchange of data between ODR-platforms and national regulators, as a means to detect mass cases.

    Employee resistance to change is a key factor to turnaround failure. Interim managers who support companies in financial distress, mediate between employees, management, shareholders, bank, and other stakeholders in order to solve organisational conflicts. This article explores the internal social dynamic aspects of a turnaround. It develops a theoretical framework on the role of trust, emotion and communication, and its affect on reducing internal resistance, and describes the outcomes of an exploratory research study. Findings confirm that employee motivation to make a reorganisation a success significantly impacts upon turnaround success. Resistance can be reduced by an open communication climate, offering a new perspective, attention to emotions, managing by walking around, and ‘practicing what you preach’. More research is necessary to generalize the findings and to better understand success and failure factors.

    Providing access to justice is a major challenge for any judicial system. Canada has gone to great lengths to meet this challenge over the past thirty years, in part by developing alternative dispute resolution methods. Unfortunately, results have been mixed. Canadian society is currently preparing to renew its vision of access to justice and the contribution of dispute resolution methods in meeting that challenge. What lessons can we learn from Canada’s experience? What are the new directions and initiatives for access to justice? Our paper suggests that the Canadian experience can make two contributions to the access to justice debate. First, we suggest that the notion is evolving in the legal community from an institutional perspective to a contextual vision of access to justice. Second, we point out an evolution of alternative or appropriate dispute resolution methods toward a participatory justice movement. Our paper proposes a new Canadian perspective on access to justice and dispute resolution methods.

    On 1 January 2013 the new Mediation Rules of CEPANI (the Belgian Center for Arbitration and Mediation) entered into force. The 2013 CEPANI Mediation Rules replace the 2005 version of the CEPANI Mediation Rules and also the 2010 version of the CEPANI ICT (Information and Communication Technology) Mediation Rules. The 2013 Rules contain provisions on the introduction of the mediation, the appointment of the mediator, the mediation protocol to be established at the beginning of the mediation process, the conduct of the mediation, the confidentiality, the end of the mediation and its costs. The authors comment on these various provisions of the CEPANI Mediation Rules and explain thereby also the relevant provisions of the Belgian Mediation Law contained in Chapter VII of the Belgian Judicial Code.

    Construction contracts are particularly prone to the emergence of disputes. In Belgium, construction disputes have traditionally been referred to State Courts. In recent years however, there has been a growing interest in Alternative Dispute Resolution (ADR), which has gradually affected the Belgian construction sector. There are now several institutions dedicated solely to providing arbitration and ADR services to the construction industry.Beside the Centre belge de l’arbitrage et de la mediation, three institutions are specialized in the settlement of construction and real estate disputes: the Chambre de Conciliation, d’Arbitrage et de Médiation en matière immobilière, the Commission de conciliation construction and the Centre Scientifique et Technique de la Construction. These institutions offer fast and cost-effective ways of settling disputes, which are often more suitable than judicial proceedings

    From an international point of view the double hybrid nature of ‘med-arb’ – imagined as a ‘guarantee’ for a ‘prompt’ resolution of business disputes – is out on a limb. The contractually planned transition from a failed mediation towards the ascertainment of procedural fairness in the subsequent arbitration under the guidance of the same Neutral poses indeed delicate questions.Not more than two – by the way federally ruled – countries – the USA and Australia – have endeavored – in some of their States – to tackle the problems related to confidentiality which determine the viability of ‘med-arb’ (beside the basic behavioral problem of negotiating with the assistance of a Neutral who unexpectedly may become your arbitrator). The validity of the – domestic – solutions devised in the USA and Australia is subject to caution in the light of the 1958 New York Convention on the recognition and enforcement of foreign arbitral awards.

    The goal of this article is to examine key problems of training standards for mediators in Russia and to identify possible solutions that may address these issues. In considering the question of mediation training in the context of mediation development in Russia, one can distinguish two periods: (1) before the enactment of the Law on mediation, or the period of private initiatives, and (2) after this Law entered into force, which can be entitled as the period of governmental regulation.During the first period, there were no special legal regulations and thus, private institutions had been offering their own diverse and numerous mediation training programs. The situation has changed due to the active force of the Federal Law on mediation by implementing provisions that require creation of a special unified training program for professional mediators and approval by the Government of the Russian Federation. This program was adopted on 14 February 2011. The approach of the Russian legislature to the establishment of a consistent educational standard for Russian mediators can be considered as the implementation of the woldwide shift toward standards unification. However, the Law itself contains some contradictions, and also contains a number of provisions that cast serious doubts upon the success of this effort.

    The article is intended to give a view (shared by many) on how arbitrators could or maybe even should react when faced with misdeeds in an ongoing arbitration proceeding. The misdeeds meant in this article concern forgery and false witness testimonies that may fraudulently influence judgements. Not covered are questions related to illicit contracts (i.e. contracts induced by bribery or corruption).
    The author contrasts the different views of an arbitrator’s role as either as a private dispute settler or as a person deriving his or her function also from the state as a guarantor of arbitration as a means to settle disputes. She comes to the conclusion that in the end, public policy consideration should overrule party autonomy and that, contrary to the current practice, tribunals faced with misdeeds during an arbitration should not hesitate to address this issue in the award.

    Arbitration cases involving EC competition law may create difficulties for arbitrators with regard to their attitude towards the EU organs. The article discusses aspects of this relationship. The article specifically evaluates the (non-)application in arbitration of the regime for EC Commission’s relationship with member states’ courts as well as the EC Commission’s role as a third party in arbitrations. The article then analyses circumstances of the possible co-operation of arbitrators with the EC Commission and the conditions for its smooth running. The article subsequently looks at the effects of the Commission’s decisions on arbitration as well as the effects of the arbitral awards on the Commission. The article considers the lack of a relationship between arbitrators and the European Court of Justice in light of the Court’s jurisprudence, and the relevance of the Court’s jurisprudence for particular arbitrations.

    In this article it is argued that bankruptcy courts really can help in preventing distressed companies to become bankrupt. However, the use of judicial reorganization procedures (moratoria) should then be abolished. By nature judicial reorganization instruments invoke polarization of debtors and creditors in fact making the (financial) problems of distressed companies worse. A new system for reorganization and dispute settlement should be introduced, at least in the Netherlands, in which insolvency judges act as mediators in confidential negotiation sessions between companies and their creditors. These negotiations should take place at an early stage of the insolvency process, in to be established (neutral) ‘Turnaround Chambers’ of district courts, and should be accompanied by a holistic business turnaround process taking place at the company at stake. By introducing this alternative system the dramatic failure rate of current judicial reorganization procedures (between 73%-95% in the Netherlands) can and will be reduced dramatically.

    In this contribution an overview is given of the most recent developments with regard to commercial dispute management and its legal context, in particular in the Netherlands. Firstly, a focus is put on the importance of integral conflict management on the basis of ADR/EDR from the perspective of risk management and cost control. Secondly, recent developments with regard to effective dispute resolution, in particular in government policy, ADR/EDR and in the legal context are discussed. The judicial and the extrajudicial system offer conflict parties various possibilities to effective and efficient dispute resolution. Further, special attention is paid to mediation clauses in commercial contracts. With regard to the European Directive of 21 May 2008 on mediation in civil and commercial matters, Directive 2008/52/EC, its consequences to the Dutch legal system and its importance for commercial dispute resolution management are discussed.

    In TMD 2009-2 the article ‘Case study: the international CSR conflict and mediation. Supply-chain responsibility: western customers and the Indian textile industry’ was published. In this article, Tineke Lambooy describes the ins and outs of the multiparty dispute between G-Star, in origin a Dutch company, the Indian-Italian Fibres & Fabrics, the employees of Fibre & Fabrics International, the governments involved and a number of non-governmental organisations striving for good labour relations and labour conditions. Lambooy’s article resulted in four reactions that are published in this article.
