Samenvatting

    In February 2012 the Dutch student team took part in the 7th ICC International Commercial Mediation Competition. In their report they describe some of their experiences inter alia with the different negotiation styles practiced by the (other) student teams, particularly how a chosen style of negotiation may have a positive or negative impact on the mediation process. This was an important insight for a possibly new generation of mediators.

    Arbitration cases involving EC competition law may create difficulties for arbitrators with regard to their attitude towards the EU organs. The article discusses aspects of this relationship. The article specifically evaluates the (non-)application in arbitration of the regime for EC Commission’s relationship with member states’ courts as well as the EC Commission’s role as a third party in arbitrations. The article then analyses circumstances of the possible co-operation of arbitrators with the EC Commission and the conditions for its smooth running. The article subsequently looks at the effects of the Commission’s decisions on arbitration as well as the effects of the arbitral awards on the Commission. The article considers the lack of a relationship between arbitrators and the European Court of Justice in light of the Court’s jurisprudence, and the relevance of the Court’s jurisprudence for particular arbitrations.

    After having explained what the function and role of a quantity surveyor is, the author describes his first acquaintance with mediation in the construction industry. One of his major observations is that ‘we quantity surveyors have been mediating long before mediation was a twinkle in the eyes of the legal fraternity’.


Stuart Ness
Stuart Ness, is a chartered quantity surveyor with extensive experience in international construction claims case management and dispute resolution. He is also an accredited mediator under the auspices of the Chartered Institute of Arbitrators, London, and is the founding chairman of the Netherlands chapter of the Institute.
