Uitgaansgeweld en de morele setting van het uitgaan in Amsterdam

    Nightlife violence is gaining increasing attention and is a substantial part of all violent incidents. In this article we explore the assumption that going out in metropolitan clubs and bars creates a specific moral setting, where the aim is to let yourself go. The main question in this article is to what extent the moral setting of going out contributes to nightlife related violence. We explored this issue by analyzing the case of Amsterdam, in particular the two famous squares, Leidseplein and Rembrandtplein, and de Wallen (red light district). With regard to the moral setting we distinguish between physical, social, professional and normative aspects of the moral setting. Each of these aspects has been described in academic literature as potentially contributing to violence. On that basis a checklist has been developed that was used for observations in nightlife venues that are known for either a high or low disproportionate amount of violent incidents. By comparing the two categories we were able to identify elements of the moral setting which, supported by the literature, can be expected to contribute to the prevalence of nightlife violence. Elements which we discovered that occur more frequently in venues where many incidents occur are visitor density, the loudness of the music, the presence of smokers, the overall comfort, the opportunity to dance, the presence of drunken visitors and their degree of intoxication, overtly sexually charged behavior, opportunities for the staff to observe, security at the exit, the number of bouncers, and whether visitors were searched or not before they entered the venue. Whether situations actually developed into violent conflict depended on one of three possible causes, namely miscommunication, conflict with authority or unsolicited advances. Policymakers can use these insights in order to try to manipulate violence stimulating factors.

    Safety authorities in The Netherlands have the obligation to develop so-called risk-profiles. Risk profiles are probability-consequences schemes of all kinds of hazards (ranging from earth quakes to transportation and from floodings to fires in high rise buildings). To develop such schemes, various data sources could be useful. In this paper, we describe an approach to make use of existing database to reveal ‘new’ kinds of transportation-related risks. To this end, we combined publicly available public and private databases related to: hazardous materials transportation and Natura 2000 areas; congested areas and large scale public events; hazardous materials transportation and multi-functional areas.
    Our approach makes clear that combination of existing databases has great potential for the safety authorities to develop their risk profiles, do their business intelligence and creating steering dash-boards for their own budget allocations.

    In England & Wales the coalition-government has opted for a localisation of the police service. The government dissociates itself from the New Labour policy of centrally-imposed targets, aims to reconnect the police and the people, and carries out a radical democratic renewal: since 2012 citizens have the possibility to choose their own Police and Crime Commissioner (PCC) in their region. This new administrator is reigning over police chiefs and is responsible for the management of security policies in the region. That is the main reason why the English police reform diverges fundamentally from developments in other European countries in which centralizing tendencies prevail. The question is whether the radical changes in England & Wales have a beneficial impact on the local embedment of the police. Are citizens more willing to commit themselves with the local police? In the first part of this paper we examine which developments have taken place in the English police, what the localisation-agenda has achieved so far, and which problems it faces. In the second part we discuss the question which lessons can be learned from the English renewals. Would it be a good idea to introduce PCC’s in the Netherlands? Is democratization the best way to strengthen community involvement? How to stimulate local accountability?

    This is an ethnographic evaluation study on a train the trainer programme (Diamant) for the prevention of political radicalisation among young Muslims in the Netherlands. Especially the training of independent judgement on moral issues looks promising to overcome cultural disorientation. Its preventive power for radicalisation is unclear since there were no radicals among the participants of the training.

    In 2011 we executed a quantitative and qualitative research on the extent of discrimination, polarisation and radicalisation in a region in the Netherlands. The results are representative for The Netherlands. The research shows that there is breeding ground for radicalization, in particular Muslim youths. The outcome also provides insights in relevant avenues for public policy. Over the past years, several inventories have been made of public policy that aims to counter radicalisation. Most of the interventions listed do not conjure with the interventions we propose on the basis of our research, such as awareness raising for practitioners, prevention of and education about discrimination, focus on neighbourhood grievances and nuisances caused by specific ethnic groups and the negative tone of the public debate regarding Islam and the multicultural society. If measures to counter radicalization are even evaluated, they tend to focus on the process and effectiveness of the intervention, but they do not answer the question if that is actually also the right intervention. We therefore propose not only to focus on doing things right, but also to ask the question if we are doing the right things. We suggest not only measuring effectiveness, but also measuring impact.

    Halt is a Dutch organization for enforcement of alternative punishment given tot juveniles and prevention activities, like for example advisory services and educational programmes. In the context of the Government action programme Polarization and Radicalization – a programme to reduce the chances of people to become a radical or even a terrorist − the Halt offices in Limburg in cooperation with the KPC Group developed an education kit of six lessons meant for juveniles (primary school and secondary education). The lessons are given by Halt fellow workers and the teacher of the class is there for give them support and to observe the lessons. This project is qualitatively evaluated and the conclusion is as follows. The reason for the project is not located in a problem of radicalization, the final target group is more restricted than intended and in the implementation the words radicalization and polarization may not be used. Is it then a good educational package? Yes, say different Halt employees, but not for the problem raised, because that problem is not identified by them.

    In this article a longitudinal effect study is described of resilience training Diamant. The training focuses in particular on adolescents with a dual identity who do not have work, are not enrolled in an education, feel unfairly treated (relatively deprived), have low self-esteem, and are at risk of social isolation. The training can be considered as a method to prevent development of criminal behaviour and possibly radicalisation. Certified trainers work with small groups of 10 to 15 adolescents to increase their resilience and help them finding their place in society. The present research focused on the following questions: (1) Does this training have a positive effect on self-esteem among the participants? (2) Does social isolation decrease as a consequence of the training? (3) Does the training reduce feelings of relative deprivation and help participants better deal with conflicts? Participants were interviewed before and halfway the training and directly after completing the training. A follow-up measurement three months after the end of the training examined effects on the longer term. In total 44 semi-structured interviews were held. Interviews were written out and coded using a two-step procedure: In the first step two researchers independently coded each interview. Second, when necessary, changes in the coding scheme were made. Then each interview was coded separately by the two researchers and disagreements were discussed until full agreement was reached. The results show that Diamant has a positive effect on self-esteem of participants. Also, participants overall showed an increase in connectedness to society. Third, Diamant reduced feelings of relative deprivation and participants indicated they could better deal with conflicts. Based on these results it is concluded that Diamant is effective in regard to its goals which were evaluated in this study. Limitations of the research and possibilities for future studies are discussed.

    Preventive interventions against terrorist attacks can be justified on legal and moral grounds. The Dutch broad-based approach against terrorism also addresses radicalizations processes. It is, however, hard to justify why a government in a liberal democracy should be allowed to intervene in processes of radicalization where danger to society is not obvious. A reason to justify intervention is when a (former) radical asks for help. Theories based on the ideas of Kant and Rawls also allow for intervention if an individual’s autonomy is diminished because he is member of a sect or under the spell of a charismatic leader. Other interventions with regard to (prevention of) radicalization cannot be justified by deontological theories such as Kant’s and Rawls’. Virtue ethics or teleology would, however, allow interventions but only if they are geared towards helping the individual in their quest to the good life. This justification allows for interventions that are, for example, focused on supporting individuals to critically reflect, reason and discuss about the good life and a just society. Based on the teleological justification constraints can be derived for preventive interventions with regard to radicalization or even deradicalisation. Notice that individuals cannot be forced to join these programs because there is no legal basis.

    A regional risk profile (RRP) is a systematic ordering – by likelihood and impact seriousness – of identified hazards and threats in one of the Netherlands’ 25 safety regions. Since 2010, RRPs follow the Dutch National Risk Assessment (NRA) as a basis for prioritising regional safety capacities. In Europe, RRPs are proliferating, and the corresponding risk-assessment approach is further spreading internationally. The methodology comprises risk identification, scenario development, multi-criteria impact evaluation, expert likelihood estimation, a two-dimensional risk diagram and an analysis and prioritisation of safety capabilities. A compact overview and discussion is provided of the 25 published RRPs for the Netherlands, each covering between 9 and 40 hazards and threats, along with their most and least worrying risk scenarios. It appears that for many regions pandemic disease, electricity black-out and major flooding are most worrying, while transport accident, industry fire and disturbance of water supply are (relatively) least worrying. Also, in different regions similar risk scenarios (e.g., pandemic disease and electricity black-out) are assessed rather differently, both by likelihood and by impact seriousness. Apparent weaknesses of the RRP (and the NRA) approach so far are, among other: lack of stakeholder involvement, rigid multi-criteria impact evaluation, hybrid methods for likelihood estimation, forced comparison of disparate risk scenarios, and unclear decision rules for risk acceptance. Independent review and validation of major RRP components is recommended for strengthening overall results as a reliable basis for regional safety policies. The ‘new risk thinking’ is considered in view of the long-problematic standard-setting approach about Individual Risk and Group Risk in the framework of Dutch external-safety policies. The RRP approach may be called ambitious and much-demanding. External validation and closer cooperation between safety policy-makers and scientists seem desirable.

    This article examines the safety perception of citizen participants in neighbourhood watches. Two questions are central: to what extent is it correct to assume that participation increases feelings of safety, and what is the role of measuring safety perceptions in local safety policy? In-depth interviews with 21 participants in The Hague show that participation changes perceptions of safety both positively and negatively, which is related to contacts with other residents, the information they receive about safety and crime problems, and experienced effectiveness in solving problems. Participation seems to result rather in a more nuanced perception of safety. The article ends with a discussion on the value of a detailed insight into the perception of safety for local safety policies.

    In an attempt to reduce re-offending rates in the Netherlands, the Dutch government has developed the Prevention of Recidivism program, which started in 2002. The current study aims to describe the content of this program, and aims to give an overview of the state of the art concerning the execution and effectiveness of the program. Results show that the number of detainees taking part in the program is fairly limited. Moreover, in many cases, correctional interventions are not part of the imposed rehabilitation program. An extensive literature study shows that the execution of the Prevention of Recidivism program and various correctional intervention show a number of implementation problems, which probably hamper the program’s effectiveness. However, further research is necessary to assess if the Prevention of Recidivism program successfully lowers recidivism rates amongst program participants.

    On a yearly basis between 4.000 and 4.500 underage suspects in Flanders accept the offer of Restorative Justice. A many cited definition of Restorative Justice has been developed by Lode Walgrave: ‘Restorative Justice is every action that is primarily oriented toward doing justice by repairing the harm that has been caused by the crime’.
    Commissioned by the Flemish Minister of Welfare, Public Health and Family an evaluation of Restorative Justice for minors was conducted by Bureau Beke. In the article the authors reflect on Restorative Justice in Flanders and describe the most important findings of their research. The process of Restorative Justice, the satisfaction of the parties involved and its results are considered. The authors offer organizations several suggestions related to developing established procedures and practices. Furthermore results show that suspects and victims are satisfied with Restorative Justice, which yields several benefits for the parties involved: Reparation for victims and learning effects and reduced contacts with counseling agencies for suspects. An important overall conclusion is that face-to-face contact between victim and suspects is beneficial for the mediation process and subsequently repairing the harm.

    The theme of governing anti-social behaviour and incivilities in the public space became more important on the policy and research agenda over the last twenty years. This article describes the law on incivilities in Belgium, namely the ‘administrative communal sanctions’ (GAS). This law is studied in a broader context of contemporary crime control and its organizing patterns. The development of the politics of behaviour can be explained by different characteristics of the period referred to as the late modernity. In the dissertation ‘A culture of control?’ (Devroe 2012) we studied the application and the concrete strategies behind the governance of incivilities on a national and on a city level. The incivility law broadened the competences of the Mayor and the city council especially in the completion of anti social behaviour and public disorder problems in his/her municipality. Instead of being dealt with on a traditional judicial way by the police magistrate, the Mayor can, by this law; himself lay on fines until maximum 250 euro. We mention ‘city republics’ as this punitive sanction became a locally assigned matter, which means that one municipality differs from another in their ‘incivility policy’. Due to the split up of competences of the Belgian state arrangements of 1988, each municipality finds itself framed in different political and organisational executive realities. In this view, Mayors can be called ‘presidents’ of their own municipality, keeping and controlling the process of tackling incivilities as their main responsibility and determining what behaviour had to be controlled and punished and what behaviour can be considered as normal decent behaviour in the public space. Problems of creating a ‘culture of control’, creating inequality for the poor, the beggars and the socially ‘unwanted’ can arise, especially in big cities.

    During the last decade the phenomenon of citizen watches has become a common and meaningful element in citizen participation that aims to improve local public safety. Citizen watches make a great case for examining the tension between the need for the Dutch government to maintain control over local safety issues and the strivings of citizens to contribute to local solutions in a more or less autonomous way. This paper examines the question to what extent citizen watches can contribute to the governance of local safety in a meaningful way. The Dutch government has been appealing strongly for more citizen involvement in public matters for some time, but is unclear about how municipalities and the police should respond to active citizens. The paper describes two different ways in which citizens can realize such an involvement i.e. either in a predominantly top-down fashion, in which the municipality and the police take a strongly directive approach towards citizen watches or in a more bottom-up oriented way, in which citizen watches are well embedded in local systems of informal social control. The paper argues and explains that both approaches have advantages as well as disadvantages regarding the way they support new forms of governance and cooperation between citizens and the state. It suggests that formal authorities can contribute to the self-reliance and collective efficacy of neighbourhood residents with regard to local public safety if they make a better effort of combining the pros of both approaches.

    Contemporary scholarly literature is full of references to the crisis of the criminal justice system. The general public seems to increasingly lose confidence in the criminal justice system and its actors. In this article we look into the potential manners in which restorative justice practices can enhance the legitimacy of the criminal justice system. Our analysis is based on the observation that by actively engaging victims and defendants in the resolution of their conflict, restorative practices seem to accommodate a necessary condition of procedural fairness. Since research on procedural justice and legitimacy in turn suggests that the legitimacy of the criminal justice system is based largely upon its perceived procedural fairness, we investigate whether participation in restorative practices improves perceptions of the legitimacy of the criminal justice system. To that end we describe the results of a qualitative study on the experiences of victims and defendants who participated in victim-offender mediation in Belgium. Relating their experiences to the antecedents of procedural justice as described in the literature, we find that restorative practices in different ways enhance perceptions of procedural fairness. Yet these perceptions do not necessarily reflect on the criminal justice system. Our analysis suggests that the degree to which the perceptions of procedural fairness resulting from participation in a restorative practice influence an individual’s perceptions of the legitimacy of the criminal justice system depends on whether the restorative practice is seen as an integral part of the criminal proceedings. We found, for example, that this is more likely to be the case if the judge at trial formally acknowledges the parties’ participation in mediation. We conclude that more research on the degree to which people perceive the restorative practice to be a part of the criminal proceedings is needed in order to further flesh out this issue.

    Police officers sometimes use creative ways in deploying their authorities when they deal with obstacles that hinder the pursuit for higher organizational goals or the common interest. By doing this, the boundaries of legislative rules might be stretched or even exceeded. This article reports the findings of a Dutch case study within the police into this phenomenon, which the authors described as the ‘creative use of authorities’. By means of observations and interviews within the researched police forces 57 cases were described and analyzed. The cases enabled a first categorization of distinctive forms of creative use of authorities with 4 essential core elements, that is: abstain from use, abuse, improper use and selective use of authorities.

    In this article, the concept of ‘loverboys’ is discussed and characteristics and needs of victims are described. The term ‘loverboy’ refers to a person who uses a specific method of human trafficking of mostly girls and young women. The methods involve recruitment and grooming of the girl by contacting and seducing her by means of (the promise of) a romantic relationship, with the aim of exploiting the victim sexually and financially or use her as a drug mule or otherwise. The loverboy concept is not a new phenomenon, but the traditional image of a loverboy as a charming young man operating on his own is outmoded. Victims of loverboys form a broad and diverse group, but share certain characteristics that make them vulnerable, such as attachment issues, traumatic (sexual) events in their childhood and, to a lesser extent, intellectual disability. More insight is needed in the underlying mechanisms of repeated victimization − a serious issue with loverboy victims − and how this can be prevented. Regarding loverboy victims as a specific type of national human trafficking or youth prostitution instead of isolating it as a new phenomenon, is a first step in accomplishing this.

    This article attempts to interpret and critically discuss the concept of incapacitation as a motive in the response to crime. Research shows that incapacitation – disabling or hindering people to commit offences – increasingly presents an important motive in the response to crime. This tendency is explored by several researchers in a new book titled Incapacitation: Trends and New Perspectives (Ashgate 2012). This tendency presents itself by the expansion of various modes of and grounds for detention, but also in the increase of other kinds of incapacitative measures, as well as in the fact that also administrative measures outside criminal law increasingly contain incapacitative elements. This tendency towards incapacitation of possible (re-)offenders can also be witnessed in contemporary politics. Examples discussed here are the intensive application of preventive custody, disqualifications, restraining orders accompanied by electronic monitoring, as well as administrative measures aimed at refusing certificates of good conduct or permits for specific commercial activities. It is argued that incapacitation often is not a proportionate and effective approach against crime. It appears to obscure the perspective on possibly more effective attempts to secure future behavior.

    In the Netherlands ‘Safety Houses’ have been established, in which partner organizations in the field of criminal justice, crime prevention, law enforcement, public administration and social services collaborate in order to reduce crime and recidivism, and to increase public safety. This article examines why some Safety Houses are better in achieving these goals than others. The effectiveness of 39 Safety Houses is analyzed by means of QCA (qualitative comparative analysis). Results show two different paths leading to effective outcomes. Effective Safety Houses have been in existence for at least three years, show a high degree of stability and a centrally integrated collaboration structure. In addition, they either have considerable resources at their disposal or have been set up with a network administrative organization, where a neutral coordinator governs the network.

    By pointing to the immense use of Twitter by citizens during crises, communication experts argue that governments should participate more actively on Twitter during crises. Until now, however, little empirical research has been conducted to validate this claim. This article aims at validating this claim and putting forward building blocks for an evidence-based vision on the use of Twitter by governments during flash crises, i.e. large-scale incidents that occur unexpectedly and immediately. The authors analysed 52.806 tweets sent by citizens and governments during a large-scale industrial fire in Moerdijk (2011). They looked at the content of the tweets and sorted them into fourteen categories. The results show that most of the tweets sent by citizens contained no new or relevant information for governments. In addition, the tweets sent by governments were totally ‘snowed under’ in the huge stream of tweets from citizens. Consequently, the tweets sent by governments were very little re-tweeted by Twitter users. The authors conclude that the Moerdijk case does not show a need for a more proactive role of governments on Twitter.
