Uitgaansgeweld en de morele setting van het uitgaan in Amsterdam

    Nightlife violence is gaining increasing attention and is a substantial part of all violent incidents. In this article we explore the assumption that going out in metropolitan clubs and bars creates a specific moral setting, where the aim is to let yourself go. The main question in this article is to what extent the moral setting of going out contributes to nightlife related violence. We explored this issue by analyzing the case of Amsterdam, in particular the two famous squares, Leidseplein and Rembrandtplein, and de Wallen (red light district). With regard to the moral setting we distinguish between physical, social, professional and normative aspects of the moral setting. Each of these aspects has been described in academic literature as potentially contributing to violence. On that basis a checklist has been developed that was used for observations in nightlife venues that are known for either a high or low disproportionate amount of violent incidents. By comparing the two categories we were able to identify elements of the moral setting which, supported by the literature, can be expected to contribute to the prevalence of nightlife violence. Elements which we discovered that occur more frequently in venues where many incidents occur are visitor density, the loudness of the music, the presence of smokers, the overall comfort, the opportunity to dance, the presence of drunken visitors and their degree of intoxication, overtly sexually charged behavior, opportunities for the staff to observe, security at the exit, the number of bouncers, and whether visitors were searched or not before they entered the venue. Whether situations actually developed into violent conflict depended on one of three possible causes, namely miscommunication, conflict with authority or unsolicited advances. Policymakers can use these insights in order to try to manipulate violence stimulating factors.

    Preventive interventions against terrorist attacks can be justified on legal and moral grounds. The Dutch broad-based approach against terrorism also addresses radicalizations processes. It is, however, hard to justify why a government in a liberal democracy should be allowed to intervene in processes of radicalization where danger to society is not obvious. A reason to justify intervention is when a (former) radical asks for help. Theories based on the ideas of Kant and Rawls also allow for intervention if an individual’s autonomy is diminished because he is member of a sect or under the spell of a charismatic leader. Other interventions with regard to (prevention of) radicalization cannot be justified by deontological theories such as Kant’s and Rawls’. Virtue ethics or teleology would, however, allow interventions but only if they are geared towards helping the individual in their quest to the good life. This justification allows for interventions that are, for example, focused on supporting individuals to critically reflect, reason and discuss about the good life and a just society. Based on the teleological justification constraints can be derived for preventive interventions with regard to radicalization or even deradicalisation. Notice that individuals cannot be forced to join these programs because there is no legal basis.

    On a yearly basis between 4.000 and 4.500 underage suspects in Flanders accept the offer of Restorative Justice. A many cited definition of Restorative Justice has been developed by Lode Walgrave: ‘Restorative Justice is every action that is primarily oriented toward doing justice by repairing the harm that has been caused by the crime’.
    Commissioned by the Flemish Minister of Welfare, Public Health and Family an evaluation of Restorative Justice for minors was conducted by Bureau Beke. In the article the authors reflect on Restorative Justice in Flanders and describe the most important findings of their research. The process of Restorative Justice, the satisfaction of the parties involved and its results are considered. The authors offer organizations several suggestions related to developing established procedures and practices. Furthermore results show that suspects and victims are satisfied with Restorative Justice, which yields several benefits for the parties involved: Reparation for victims and learning effects and reduced contacts with counseling agencies for suspects. An important overall conclusion is that face-to-face contact between victim and suspects is beneficial for the mediation process and subsequently repairing the harm.

    The theme of governing anti-social behaviour and incivilities in the public space became more important on the policy and research agenda over the last twenty years. This article describes the law on incivilities in Belgium, namely the ‘administrative communal sanctions’ (GAS). This law is studied in a broader context of contemporary crime control and its organizing patterns. The development of the politics of behaviour can be explained by different characteristics of the period referred to as the late modernity. In the dissertation ‘A culture of control?’ (Devroe 2012) we studied the application and the concrete strategies behind the governance of incivilities on a national and on a city level. The incivility law broadened the competences of the Mayor and the city council especially in the completion of anti social behaviour and public disorder problems in his/her municipality. Instead of being dealt with on a traditional judicial way by the police magistrate, the Mayor can, by this law; himself lay on fines until maximum 250 euro. We mention ‘city republics’ as this punitive sanction became a locally assigned matter, which means that one municipality differs from another in their ‘incivility policy’. Due to the split up of competences of the Belgian state arrangements of 1988, each municipality finds itself framed in different political and organisational executive realities. In this view, Mayors can be called ‘presidents’ of their own municipality, keeping and controlling the process of tackling incivilities as their main responsibility and determining what behaviour had to be controlled and punished and what behaviour can be considered as normal decent behaviour in the public space. Problems of creating a ‘culture of control’, creating inequality for the poor, the beggars and the socially ‘unwanted’ can arise, especially in big cities.

    Graffiti has been linked in empirical studies to disorder, fear of crime, avoidance behavior, vandalism and delinquency. In most of those studies, graffiti is treated as an abstract and uniform concept: no distinctions are made between one graffiti or another. Policies based on this assumption hold a zero tolerance approach, meaning all graffiti is deemed undesirable and is or should be removed. This has been criticized by several (theoretical) studies. On the other hand however, ethnographic studies present graffiti as a multifaceted phenomenon, serving as a means of communication, resistance and protest or as an art form. The current study investigates the assumption that graffiti is perceived as a homogeneous and undesirable environmental feature. This article examines whether graffiti is actually perceived uniformly by Dutch citizens, and if not how people distinguish between different graffiti; which types of graffiti are perceived as disorder and whether different types of people exist based on their attitudes towards graffiti. An extensive questionnaire was designed, based on a thorough analysis of the literature and empirical pilot studies. A nationally representative sample responded to general questions with respect to graffiti and judged eighteen specific examples of graffiti on a reliable scale that measured perceived disorder. Results indicate that people vary enormously in their ideas and attitudes. Also, not every graffiti is the same, meaning graffiti is not a homogeneous, uniform phenomenon. Both type of graffiti and the location on which the graffiti is situated relate to the degree of perceived disorder. For example, tags, small scribbles, were considered a public nuisance more than pieces, large colorful images. Also, graffiti on a house or car is perceived much more as disorder than graffiti in a skatepark. The diversity in views necessitates a normative

    People vary in their perceptions and opinions, and that seems to be the case for the way they perceive anti-social behavior too. Scientific literature concerning the fear of crime hypothesizes diversity in the public’s perception of anti-social behavior and crime. But this fear of crime research tradition has been criticized repeatedly for its conceptual and methodological arrears. The focus has particularly been narrowed to ‘fear’ of ‘crime’, being measured by surveys. So, it is not very surprising that there has not been a thorough empirical focus on the assumed diversity in the perception of crime and anti-social behavior. To fill in this gap, the main research question in this article is: which differences in the perception of anti-social behavior exist within contemporary Dutch society? Using Q-methodology, five different factors were found in the perception of anti-social behavior. These factors have been labeled respectively: ‘disaffected residents’, ‘untroubled liberals’, ‘anxious communitarians’, ‘concerned spectators’ and ‘non-averse professionals’. These factors showed the empirical reality of the assumed diversity in the public perception of anti-social behavior. In all of these factors, people seem to address crime and anti-social behavior to a decrease of social standards and values in Dutch society, instead of worrying about chances and consequences of personal victimization. This was even the case for people who signalized crime and anti-social behavior in their own neighborhood. What really stands out is that people strongly agreed about the unacceptability of crime and anti-social behavior. People seem to have an aversion against these rude types of behavior. Altogether this image does not comply to the mainstream image of a ‘crime fearing society’. People do not seem to fear crime, but they seem to be worried and agitated about the moral conditions of the Dutch society in a wider framework. This might be a more reassuring illustration than a ‘crime fearing society’, but this proposition needs further and additional quantitative assessment.

    Human trafficking means exploitation; human smuggling is associated with illegal labour and a connection with exploitation is absent. Where a victim of human trafficking can appeal for legal protection, a smuggled migrant (illegally residing or with vulnerable legal status) overall has little rights because of the formal absence of the aspects of exploitation and coercion in human smuggling. In this article, the empirical analysis based on file analysis demonstrates that in several files of cases framed as human smuggling indications are found for exploitation of migrants, although this has not been recognised as such. Theoretically the authors tie this to the trend of crimmigration. Measures designed to combat human trafficking and smuggling are often concentrated on (criminal) law enforcement and criminal punishment, to the detriment of a human rights-based approach. The tension between immigration policy and the combat against human trafficking deserves more attention.

    Analysing large amounts of data goes to the heart of the challenges confronting intelligence and law enforcement professionals today. Increasingly, this involves Internet data that are ‘open source’ or ‘publicly available’. Projects such as the European FP7 VIRTUOSO aim at developing platforms for open-source intelligence by law enforcement and public security, which open up opportunities for large-scale, automated data gathering and analysis. However, the mere fact that data are publicly available does not imply an absence of restrictions to researching them. This paper investigates one area of legal constraints, namely Dutch criminal-procedure law in relation to open-source data gathering by the police. Which legal basis is there for this activity? And under what conditions can foreign open sources be investigated?
    After sketching the context of the VIRTUOSO project and legal constraints of open-source intelligence in general, this paper discusses provisions of the Dutch Police Act 1993 and the Code of Criminal Procedure to determine which is the correct legal basis for gathering data from openly accessible and semi-open sources. Next, cross-border gathering of data is discussed on the basis of article 32 of the Cybercrime Convention. The paper draws the conclusion that investigating open sources by the police will often go beyond what is allowed on the basis of the general task description of the police (art. 2 Police Act 1993); hence, an order from the Public Prosecutor for systematic observation or intelligence is required. Moreover, the tools used must meet the non-manipulability and auditing requirements of the Dutch Decree on Technical Devices in Criminal Procedure.

    On January 1, 2009 the Temporary Restraining Order Act entered into force allowing mayors to impose a ten-day restraining order on potential perpetrators of domestic violence. This restraining order, which may be extended to 28 days, prohibits the perpetrator from entering his or her house as well as from contacting the persons staying behind in the home (partner, children, or other members of the household). In order to impose a temporary restraining order, risk factors relating to the perpetrator, the incident, and the family have to be assessed using a domestic violence risk assessment tool (RiHG).The immediate cause to introduce the Act was to enable mayors to take action in situations that, before, would not have given police just cause to intervene because no offences had (yet) been committed. However, evaluations show that temporary restraining orders are mainly imposed in conjunction with criminal proceedings. Yet, researchers suggest that the temporary restraining order may be imposed as a truly preventive measure in a large amount of situations that until now have not been considered (for instance, situations that have not escalated into physical violence). This article examines whether such preventive restraining orders exist within a sample of imposed orders and if so, what characteristics they share.Results show that truly preventive restraining orders are extremely rare. Closer inspection of cases that according to the available risk assessment were not notably violent showed that most of these cases could not be regarded as cases of truly preventive restraining orders. The discussion of the article focuses on the implications of these results for the suggestion that a large number of situations could be suitable for imposing a preventive restraining order.

    Internal and external security are traditionally considered to be distinct concepts that allow police organizations and tasks to be differentiated from those of the military. Internal security is then viewed as oriented towards the maintenance of the order within a state and to be exercised against fellow citizens with a limited use of violence. External security deals with the protection of the territory and is exercised against foreign enemies, may include the use of excessive violence. In practice, however, the boundaries between these concepts and between police and military aims and tasks have become blurred. The extension of the security concept, a change in the nature of interventions on foreign territory and a shifting image of the enemy create an overlap between internal and external security issues and actors. This evolution seriously challenges the existing legal and normative frameworks that rely heavily on assumptions based on the distinction between internal and external security.

    This contribution focuses on ‘fear of crime’ research. Departing from the classic distinction between crime and victimization as objective threats, on the one hand, and fear of crime as a subjective and emotional interpretation of that threat, on the other hand, the research tradition is confronted with the so-called fear victimization paradox. This paradox emerges from the observation that fear of crime is greater among women and elderly people, while these groups actually are less at risk of becoming a crime victim. It has immersed the research tradition in a dominant debate on the rationality of the fear of crime, with two opposing paradigms: rationalist and symbolic.Whilst both the paradox and the different paradigms in the debate offer a view at the core of fear of crime research, and illustrate how similar empirical observations can lead to differing explanations, and policy implications for that matter, we argue that the fear victimization paradox and the rationality debate surrounding this paradox, has occupied the bulk of research on fear of crime with what is essentially a nonsensical and redundant debate.

    The Dutch aftercare for former prisoners is strongly developing. This article describes lessons from international experiences with aftercare for former prisoners in three areas of life: alcohol and drug problems, work and housing. Moreover, it discusses which lessons are especially relevant for the Dutch system. The analysis of the literature shows to what extent and under which conditions voluntary aftercare can affect reintegration and recidivism. Conclusions are that various aftercare programs do affect recidivism to some extent, but that the level of success differs substantially across programs and across subpopulations of former prisoners. Both programs that start during detention and continue after release and programs that combine multiple services (e.g. housing services and drug treatment) are most successful. Work programs have the strongest effects for older individuals. In all three areas of aftercare studied in this article, the strongest program effects were found for subpopulations with the highest risk of recidivism. The review also shows that communication between organizations and the integration of services are very important for the success of aftercare programs.

    Since the legalization of the prostitution sector, not only has the combating of human trafficking through criminal law been substantially fortified, but also the administrative approach to human trafficking in that sector. This integral approach of human trafficking, in which administrative and criminal law measures complement each other, is necessary to combat this harrowing type of crime. The criminal law-administrative approach offers good footholds for a more forceful reaction to human trafficking. Besides the preventive effect administrative measures can have as a complement to criminal law, administrative supervision can also be useful to obtain criminal law information. However, that brings several new dilemmas with it that are connected to the phenomenon of the blurring of spheres. Under certain circumstances, the blurring of spheres between a criminal law and an administrative approach can lead to an improper use of competencies. We conclude that in the manner in which the prostitution sector is currently supervised, the legal protection of the citizen against actions of the supervisor is inadequately guaranteed. That does not mean that information that is obtained through administrative supervision may no longer be used in criminal cases. It is to be recommended however that several changes be made to current practice, which may prevent the improper use of supervisory competencies in prostitution controls.

    In this contribution the current security debate in France is dissected as if it were a play in different acts. President Sarkozy, the political producer, has launched a public ‘schizophrenic’ discussion in which criminologists/sociologists act and quarrel on the edge of a knife. This debate can only be understood in reference to French criminological history, politics, structures and scientific particularities. The contents of this criminological theatre of war can enrich criminological discussion in the Netherlands and Belgium.

    Teenagers between twelve and eighteen years of age are protected by Dutch criminal law against sexual encounters that can be described as ‘voluntarily’. If teenagers are approached without force or approach a person themselves autonomously they are thus protected against such contact, but they could have played a sexual active role nevertheless. How do the alleged offenders in these criminal cases make contact and how are the punishable interactions possible considering the facilitative role of the victim? This paper will deal with the way the officials of the police and justice departments value sexual contacts with youngsters in a diverse range of settings. The crucial question is how the professionals dealing with the protection of youngsters and at the same time safeguarding the legal rights of offenders come to their juridical deliberation.

    The ‘Shortlist troublesome youth groups’ is a compact survey that enables police-officers to categorize problematic youth groups on a general level. The ‘shortlist’ results in three categories. The least troublesome groups are labelled ‘annoying’, the more serious groups are referred to as ‘disturbing’ and the most serious ones are called ‘criminal’ youth groups. As a quick scan, the shortlist tool has originally been developed in order to prevent criminalization of youth. It has now become a compulsorily used instrument for all 25 police services in the Netherlands. The shortlist is seen as the central starting point that should ultimately lead to the implementation of multidisciplinary interventions to tackle the specific problems that the youth groups cause.This article briefly discusses the highly subjective judgements of perceptions of disorder in society. Against this background this article describes the aim, the benefits and limits to the use of the shortlist. This analysis is based on fifteen years of experience with the annual listing of troublesome youth groups by means of the shortlist at the Haaglanden police service.This contribution concludes that the shortlist is a useful instrument that enables police officers to efficiently categorize problematic youth groups. Several changes by the Haaglanden police service with regard to the content as well as to the procedure further optimized the use of the shortlist. However, its global characteristic hampers evaluation of local safety interventions on the group. Also, comparisons of results between police services are not possible just like that. For those purposes (evaluations and comparisons) additional, i.e. more detailed information on the groups are to be gathered. The shortlist-methodology consists of further steps that include more in-depth analyses.Having said this, the shortlist is a valuable quick scan tool that enables professionals to swiftly categorize problematic youth groups.

    In this article we want to show how different actors (amongst whom residents, professional safety-functionaries and street youth) view the safety situation in Rotterdam’s problematic neighbourhood ‘the Old West’ in very different ways and start from very different parameters. We conclude that the one-dimensional image of an unsafe neighbourhood that emerges from the city’s official, quantitative measurement instrument, the so-called ‘Safety Index’ (Veiligheidsindex), does not do justice to the diversity of opinions and visions of the different actors in the neighbourhood and is thus unsuited as the political ‘compass’ for local safety policy it was intended for. This diversity comes much better to the surface in the qualitative, ethnographic research on which this article is based. Such research enables us first to better understand safety as a local phenomenon and secondly offers more concrete points of departure for policy.

    Changing public safety problems as well as an increasing societal demand for public safety made way for new policy approaches. During the 1990s, the so called ‘integral safety approach’ was introduced in the Netherlands. This approach manifested itself mainly on the municipal level where the mayor is being held responsible for managing public safety and order. The central question raised in this article is: what are the consequences of an integral approach to public safety problems for the mayor when managing local order and public safety? We will demonstrate that ‘integrality’ is no clear cut concept. Careful inspection of the concept learns that it has multiple meanings. Of these various meanings, especially the ambition to address public safety problems by means of ‘new alliances’ characterized the actual implementation of integral policies. However, working together within these new alliances uniting various more or less independent actors from both the public and private sector, seemed to be hampered by a lack of coordination and control. In that sense, the introduction of the integral approach had consequences for steering and control of public safety policies. These consequences have to be addressed, especially by the mayor who is accountable for local order and safety. The mayor had attributed to him – first in practice, soon by law as well – the role of director of public safety policy on the municipal level. However, as we will demonstrate in this article, the mayor lacks an important trait needed for effective directorship: decisive powers. Therefore the mayor is not able to realize effective cooperation between partners within the new alliances of the integral approach to public safety problems. As a potential solution, we will describe the characteristics of a ‘model of anticipation’ granting the mayor a certain level of decisive powers to be used as an ultimum remedium.

    This article explores the links between the concepts of security and community, questioning the conventional use and meaning of both. To begin with, it addresses the taken-for-grantedness of the thought that communities foster feelings of security, and that contemporary processes of migration, intensified worldwide communication, and ‘heterogeneization’ of habitats stimulate feelings of insecurity and nostalgia for ‘old-fashioned’ tight kinship. Subsequently, it criticizes the too lop-sided focus on insecurity in current debates, and asks attention for – community-based – positive feelings of security. In the next paragraphs, however, the problematic aspects of the idea of ‘community’ are discussed: its inadequacy in capturing current individualized ways-of-life, its exclusionary tendencies, its potentially exaggerated focus on social control, and its rejection of, and fear for, the outside world. Therefore, we assess the possibility to construe (‘strong’) community qualities in a situation of multiple, overlapping and porous populations of varied identity-relevance within overarching institutional arrangements of rule of law and of shared codes of conduct (as ‘weak’ ties). Finally, the argument is translated in suggestions for empirical research to be able to determine the fecundity of the ideas presented.

    Public safety governance has been characterised in many ways. Literature mentions traditional sanctions for purposes of repression, policy programs aiming for prevention, as well as cooperation of public, private and hybrid organizations in addressing public safety problems. Very recently, a so called culture of precaution, in which problems of public safety are to be addressed at a very early – premature – stage, would have entered the scene. This potential culture of precaution is topic of this article. The article aims to indicate the empirical manifestations of a culture of precaution, as mentioned in literature, in contemporary public safety governance. The central question is as follows: to what extent and in what way is contemporary public safety governance on municipality level characterised by the precautionary principle? Five municipalities within the police region of Utrecht, varying in size from 40.000 to 300.000 citizens, have been studied; Amersfoort, Bunschoten, Utrecht, Woerden and Zeist. In total 153 measures addressing problems of public safety have been analyzed for characteristics of precaution. In order to do so, a model has been developed which locates precaution next to traditional strategies for addressing public safety. It will be demonstrated that a culture of precaution is not empirically present in public safety governance on municipality level. However, contemporary public safety governance does appear to posses some minor characteristics of the precaution paradigm.
