    Preventive interventions against terrorist attacks can be justified on legal and moral grounds. The Dutch broad-based approach against terrorism also addresses radicalizations processes. It is, however, hard to justify why a government in a liberal democracy should be allowed to intervene in processes of radicalization where danger to society is not obvious. A reason to justify intervention is when a (former) radical asks for help. Theories based on the ideas of Kant and Rawls also allow for intervention if an individual’s autonomy is diminished because he is member of a sect or under the spell of a charismatic leader. Other interventions with regard to (prevention of) radicalization cannot be justified by deontological theories such as Kant’s and Rawls’. Virtue ethics or teleology would, however, allow interventions but only if they are geared towards helping the individual in their quest to the good life. This justification allows for interventions that are, for example, focused on supporting individuals to critically reflect, reason and discuss about the good life and a just society. Based on the teleological justification constraints can be derived for preventive interventions with regard to radicalization or even deradicalisation. Notice that individuals cannot be forced to join these programs because there is no legal basis.

    The theme of governing anti-social behaviour and incivilities in the public space became more important on the policy and research agenda over the last twenty years. This article describes the law on incivilities in Belgium, namely the ‘administrative communal sanctions’ (GAS). This law is studied in a broader context of contemporary crime control and its organizing patterns. The development of the politics of behaviour can be explained by different characteristics of the period referred to as the late modernity. In the dissertation ‘A culture of control?’ (Devroe 2012) we studied the application and the concrete strategies behind the governance of incivilities on a national and on a city level. The incivility law broadened the competences of the Mayor and the city council especially in the completion of anti social behaviour and public disorder problems in his/her municipality. Instead of being dealt with on a traditional judicial way by the police magistrate, the Mayor can, by this law; himself lay on fines until maximum 250 euro. We mention ‘city republics’ as this punitive sanction became a locally assigned matter, which means that one municipality differs from another in their ‘incivility policy’. Due to the split up of competences of the Belgian state arrangements of 1988, each municipality finds itself framed in different political and organisational executive realities. In this view, Mayors can be called ‘presidents’ of their own municipality, keeping and controlling the process of tackling incivilities as their main responsibility and determining what behaviour had to be controlled and punished and what behaviour can be considered as normal decent behaviour in the public space. Problems of creating a ‘culture of control’, creating inequality for the poor, the beggars and the socially ‘unwanted’ can arise, especially in big cities.

    During the last decade the phenomenon of citizen watches has become a common and meaningful element in citizen participation that aims to improve local public safety. Citizen watches make a great case for examining the tension between the need for the Dutch government to maintain control over local safety issues and the strivings of citizens to contribute to local solutions in a more or less autonomous way. This paper examines the question to what extent citizen watches can contribute to the governance of local safety in a meaningful way. The Dutch government has been appealing strongly for more citizen involvement in public matters for some time, but is unclear about how municipalities and the police should respond to active citizens. The paper describes two different ways in which citizens can realize such an involvement i.e. either in a predominantly top-down fashion, in which the municipality and the police take a strongly directive approach towards citizen watches or in a more bottom-up oriented way, in which citizen watches are well embedded in local systems of informal social control. The paper argues and explains that both approaches have advantages as well as disadvantages regarding the way they support new forms of governance and cooperation between citizens and the state. It suggests that formal authorities can contribute to the self-reliance and collective efficacy of neighbourhood residents with regard to local public safety if they make a better effort of combining the pros of both approaches.

Legitimiteit via procedurele rechtvaardigheid: kunnen herstelrechtelijke praktijken de maatschappelijke legitimiteit van het strafrecht verhogen?

    Contemporary scholarly literature is full of references to the crisis of the criminal justice system. The general public seems to increasingly lose confidence in the criminal justice system and its actors. In this article we look into the potential manners in which restorative justice practices can enhance the legitimacy of the criminal justice system. Our analysis is based on the observation that by actively engaging victims and defendants in the resolution of their conflict, restorative practices seem to accommodate a necessary condition of procedural fairness. Since research on procedural justice and legitimacy in turn suggests that the legitimacy of the criminal justice system is based largely upon its perceived procedural fairness, we investigate whether participation in restorative practices improves perceptions of the legitimacy of the criminal justice system. To that end we describe the results of a qualitative study on the experiences of victims and defendants who participated in victim-offender mediation in Belgium. Relating their experiences to the antecedents of procedural justice as described in the literature, we find that restorative practices in different ways enhance perceptions of procedural fairness. Yet these perceptions do not necessarily reflect on the criminal justice system. Our analysis suggests that the degree to which the perceptions of procedural fairness resulting from participation in a restorative practice influence an individual’s perceptions of the legitimacy of the criminal justice system depends on whether the restorative practice is seen as an integral part of the criminal proceedings. We found, for example, that this is more likely to be the case if the judge at trial formally acknowledges the parties’ participation in mediation. We conclude that more research on the degree to which people perceive the restorative practice to be a part of the criminal proceedings is needed in order to further flesh out this issue.

    This article attempts to interpret and critically discuss the concept of incapacitation as a motive in the response to crime. Research shows that incapacitation – disabling or hindering people to commit offences – increasingly presents an important motive in the response to crime. This tendency is explored by several researchers in a new book titled Incapacitation: Trends and New Perspectives (Ashgate 2012). This tendency presents itself by the expansion of various modes of and grounds for detention, but also in the increase of other kinds of incapacitative measures, as well as in the fact that also administrative measures outside criminal law increasingly contain incapacitative elements. This tendency towards incapacitation of possible (re-)offenders can also be witnessed in contemporary politics. Examples discussed here are the intensive application of preventive custody, disqualifications, restraining orders accompanied by electronic monitoring, as well as administrative measures aimed at refusing certificates of good conduct or permits for specific commercial activities. It is argued that incapacitation often is not a proportionate and effective approach against crime. It appears to obscure the perspective on possibly more effective attempts to secure future behavior.

    Graffiti has been linked in empirical studies to disorder, fear of crime, avoidance behavior, vandalism and delinquency. In most of those studies, graffiti is treated as an abstract and uniform concept: no distinctions are made between one graffiti or another. Policies based on this assumption hold a zero tolerance approach, meaning all graffiti is deemed undesirable and is or should be removed. This has been criticized by several (theoretical) studies. On the other hand however, ethnographic studies present graffiti as a multifaceted phenomenon, serving as a means of communication, resistance and protest or as an art form. The current study investigates the assumption that graffiti is perceived as a homogeneous and undesirable environmental feature. This article examines whether graffiti is actually perceived uniformly by Dutch citizens, and if not how people distinguish between different graffiti; which types of graffiti are perceived as disorder and whether different types of people exist based on their attitudes towards graffiti. An extensive questionnaire was designed, based on a thorough analysis of the literature and empirical pilot studies. A nationally representative sample responded to general questions with respect to graffiti and judged eighteen specific examples of graffiti on a reliable scale that measured perceived disorder. Results indicate that people vary enormously in their ideas and attitudes. Also, not every graffiti is the same, meaning graffiti is not a homogeneous, uniform phenomenon. Both type of graffiti and the location on which the graffiti is situated relate to the degree of perceived disorder. For example, tags, small scribbles, were considered a public nuisance more than pieces, large colorful images. Also, graffiti on a house or car is perceived much more as disorder than graffiti in a skatepark. The diversity in views necessitates a normative

    People vary in their perceptions and opinions, and that seems to be the case for the way they perceive anti-social behavior too. Scientific literature concerning the fear of crime hypothesizes diversity in the public’s perception of anti-social behavior and crime. But this fear of crime research tradition has been criticized repeatedly for its conceptual and methodological arrears. The focus has particularly been narrowed to ‘fear’ of ‘crime’, being measured by surveys. So, it is not very surprising that there has not been a thorough empirical focus on the assumed diversity in the perception of crime and anti-social behavior. To fill in this gap, the main research question in this article is: which differences in the perception of anti-social behavior exist within contemporary Dutch society? Using Q-methodology, five different factors were found in the perception of anti-social behavior. These factors have been labeled respectively: ‘disaffected residents’, ‘untroubled liberals’, ‘anxious communitarians’, ‘concerned spectators’ and ‘non-averse professionals’. These factors showed the empirical reality of the assumed diversity in the public perception of anti-social behavior. In all of these factors, people seem to address crime and anti-social behavior to a decrease of social standards and values in Dutch society, instead of worrying about chances and consequences of personal victimization. This was even the case for people who signalized crime and anti-social behavior in their own neighborhood. What really stands out is that people strongly agreed about the unacceptability of crime and anti-social behavior. People seem to have an aversion against these rude types of behavior. Altogether this image does not comply to the mainstream image of a ‘crime fearing society’. People do not seem to fear crime, but they seem to be worried and agitated about the moral conditions of the Dutch society in a wider framework. This might be a more reassuring illustration than a ‘crime fearing society’, but this proposition needs further and additional quantitative assessment.

    Human trafficking means exploitation; human smuggling is associated with illegal labour and a connection with exploitation is absent. Where a victim of human trafficking can appeal for legal protection, a smuggled migrant (illegally residing or with vulnerable legal status) overall has little rights because of the formal absence of the aspects of exploitation and coercion in human smuggling. In this article, the empirical analysis based on file analysis demonstrates that in several files of cases framed as human smuggling indications are found for exploitation of migrants, although this has not been recognised as such. Theoretically the authors tie this to the trend of crimmigration. Measures designed to combat human trafficking and smuggling are often concentrated on (criminal) law enforcement and criminal punishment, to the detriment of a human rights-based approach. The tension between immigration policy and the combat against human trafficking deserves more attention.

    In the Netherlands whistle-blowing regulations are still unbalanced and ineffective in the protection of whistle-blowers and the prevention of misconduct at work. This article focuses on the question how whistle-blowing behaviour is influenced by the type and severity of the wrongdoing. The study also examines to whom employees would report (internally and/or externally), if they would report anonymously, and why they would do that or not. As far as the authors know, this is one of the first studies on whistle-blowing behaviour that systematically investigates the characteristics of the wrongdoing by using vignettes. In a two by two design, two kinds of wrongdoing (safety problem or embezzlement) at two levels of severity are plotted against each other. When confronted with severe wrongdoing, respondents intend to blow the whistle more often (externally) than with mild wrongdoing. Of the four cases, the difference between mild and severe embezzlement is most pronounced. Internally, a difference is found between the vignettes in reporting anonymously. Most respondents prefer to report to their direct supervisor, especially when a mild safety problem occurs. With severe embezzlement however, respondents prefer to report to a confidential adviser within the company. Outside the company, reporting to one’s trade union is most popular. Nearly all respondents would only report externally after an internal report has not yielded any results, or they would not report outside the company at all. They often argue that it is an internal problem and that the company could be harmed if the wrongdoing would be disclosed. This argument is used in all vignettes. Anonymity is still considered important by the majority of the respondents. It is recommended in this article that policymakers specify whistle-blowing regulations that are adaptable to the specific characteristics of the wrongdoing and the reporting employee(s).

    Since November 2009, the regional police of Groningen facilitated their community officers with Twitter. According to the principles of community policing, they are enabled to shorten the distance between the police and citizens by giving them a direct connection. Such a connection should stimulate interaction, while at the same time it should make people feel more safe. In addition, Twitter also creates possibilities for the police to be transparent. Sharing of information should alter citizens’ perception towards the police.
    A comparison has been made, by using an online questionnaire, between followers and two kinds of non-followers. The effects of following twittering community officers have been demonstrated by using statistical analyses, taking into account relevant control variables. On the basis of these analyses it has been demonstrated that following a twittering community officer did not positively or negatively alter the perception of safety of their followers. However, an enhanced information position has made followers much more aware of local disorder and crime. Thanks to shared information about police actions to sustain and improve local safety and livability, followers’ perception of safety has not been altered negatively.
    Followers’ perception towards the police organization has been positively altered, thanks to the twittering community officers. Especially the sharing of information and involving citizens into local policing helps the police to alter the perception of citizens towards their organization. In addition, it has been shown that followers’ willingness to report has been improved. Thanks to the ease of use of Twitter and the shortened distance between the police and citizens, followers do frequently contact the police or a community officer to share some information, or to report some crime or disorder. However, it has been shown that Twitter should just be presented as complementary to existing ways to contact the police.

Identificatie van Nederlandse jongeren die risico lopen op internet

    This article describes the findings of a national representative survey on online victimization. The survey was conducted in the Netherlands in 2011 amongst youth aged 10 to 18. Purpose of this research is to identify various risk factors related to cyber bullying, online sexual activities and online financial crime (e.g. e-fraude and commercial deceit). More than 9 percent of the youths had negative experiences with cyber bullying, about 5 percent with e-fraude and over 11 percent with commercial deceit. Also unwanted online sexual solicitations (6%) and unwanted exposure to sexually explicit internet material (12%) occurred with some regularity.
    This research complements earlier research on youth victimization in two important respects. First, we paid explicit attention to determine whether the youngster experienced the online incident as negative, neutral or positive. Our strategy to address negative experiences ensures the identification of actual victims. Secondly, we made it possible to identify and compare risk factors on various types of online crime. Girls are more likely to be cyber bullied, to receive unwanted sexual solicitations and to be unwantedly exposed to online pornography, whilst boys are more at risk to be commercially deceived or scammed.
    Internet use and behaviour are significant risk factors to comprehend online victimization. Above average use of instant messaging and clicking on (advertising) hyperlinks without restraint, are important predictors for online victimization. Finally, online disinhibition - a loosening of social restrictions during interactions with others on the Internet - and low self-control, turn out to be significant risk factors.
    It is difficult to accept certain risks, especially when youth are involved. However, children have to learn themselves to assess risks, to deal with them and to learn from them. It is important youths built up resilience to adequately react on negative online incidents and to reduce online vulnerability.

    This article is based on a research in which we are looking for exemplary urban professionals who seem to be successful in pursuing the social goals they set together with their partners. In urban disadvantaged neighbourhoods, it is not always the standard procedure that gets things done. In the Netherlands decades of urban renewal in its various forms have not solved problems permanently. This does not mean that success is never attained. What seems to have helped in some cases is the presence of a type of practitioner who goes beyond standard procedure. These are professionals, as the ‘casting cop’ we introduce in this article, who do not give up and who are able to succeed where others have failed. Most likely these are experienced practitioners who learned how to cope. Most likely they are actors who inspire others.What we ask is how these practitioners in urban districts do their job in controversial, politically sensitive policy processes that might develop in unintended and surprising ways. In other words we have as a central question: through what ways of working and relating do exemplary urban practitioner (try to) get things done?The professionals we call exemplary are not always taking the common routes to realize their goals. They will not automatically follow the routines of problem solving and because of that they can make a difference. They are critical about mainstream practices and try to find solutions starting from the perspectives of citizens. When we talk about ‘ways of working and relating’ we refer to the qualities these professionals put to use in the planning and decision making processes of urban renewal. It has to do with personal qualities like attitude and experience, but also with strategic skills such as networking with policy partners. ‘Getting things done’ means solving problems or better stated exploiting opportunities. More broadly is their aim to transform what is called ‘urban problem districts’ into ‘livable neighborhoods’.

    A number of authors claim that the Dutch government is using the words safety and security more often and more broadly. In this article we show that this is partly true. By studying the usage of the word safety in the Dutch queen’s speeches, we see that especially from 1999 onwards the speeches do contain more references to safety and security issues. Moreover, more and more topics are defined as a safety and security issue. However, this same study shows that a decline in the use of the words safety and security can be discerned from 2006 onwards. Ideas to understand these fluctuations are presented at the end of the article.

    This contribution focuses on ‘fear of crime’ research. Departing from the classic distinction between crime and victimization as objective threats, on the one hand, and fear of crime as a subjective and emotional interpretation of that threat, on the other hand, the research tradition is confronted with the so-called fear victimization paradox. This paradox emerges from the observation that fear of crime is greater among women and elderly people, while these groups actually are less at risk of becoming a crime victim. It has immersed the research tradition in a dominant debate on the rationality of the fear of crime, with two opposing paradigms: rationalist and symbolic.Whilst both the paradox and the different paradigms in the debate offer a view at the core of fear of crime research, and illustrate how similar empirical observations can lead to differing explanations, and policy implications for that matter, we argue that the fear victimization paradox and the rationality debate surrounding this paradox, has occupied the bulk of research on fear of crime with what is essentially a nonsensical and redundant debate.

    This paper deals with the question of how a partly privatized security sector could be regulated. A central aim of this regulation should be the control of security as a public good. Three models of regulation are analyzed. The current practice of this regulation in the Netherlands shows a serious lack of effectiveness. One of our main conclusions is that neither the state nor the private sector is able to enforce this regulation on their own. However, it is assumed that the state should have a central and integrated regulatory role in this field, with more attention paid to the practical implementation of it, with the power and will to sanction private agencies if necessary. In addition managers of private security companies should adopt a role as public managers with a public moral duty. Regulation of security is faced with a double problematic, not only the horizontal fragmentation of the field, but also the vertical fragmentation, often resulting in a serious gap between managers and those in the field, both in the public and the private sector. This implies that the regulation should not only rest on the state and on self-regulation by the sector at management level, but also on the promotion of a practical ethic for security workers to steer and regulate their daily work.

    The author provides a discussion of the articles in this issue of the Tijdschrift voor Veiligheid (Journal on Security) on the occasion of its tenth anniversary. He notes that there is an increasing hybridising, subjectification and fragmentation in the security area. The increasing interweaving of security politics seems to apply least to a common approach in ‘social security and physical safety issues’ (crime control and disaster and crisis management), while exactly this was aimed for in so-called integral security politics. According to the author that is the case because of ‘the moral pin’, which plays a dominant role in crime, but not in safety issues. The entanglement of forms of security identified by the author has a normative basis – it comes from the social order of an increasingly complex society. For the future an ever greater responsibilisation can be expected, in which the perception of security becomes even more important than it is now already. Not a big orchestrated security policy, but jazzy structures will then determine the prospects.

    Since 2001, the Netherlands have broadened their array of antiterrorism legislation and policies. However, there is hardly any insight into the level of public support for them. This article assesses the Dutch public opinion on four measures that were recently made effective: enhanced possibilities for stop-and-search, broadening of possibilities for special investigative resources, increased obligations for identification, and body scans in airports. Two randomly selected, comparable groups were asked different questions about these issues: attitudes or willingness to pay. The results show that respondents have positive attitudes towards newly introduced antiterrorism measures, yet simultaneously, they have low willingness to pay. Both groups were also asked how they would allocate an imaginary fixed budget to various criminal justice policies and tax rebate. These results show similar relations for both attitudes and willingness to pay, suggesting they both measure the relative importance assigned to antiterrorism policies. A right political orientation predicts both positive attitudes and high willingness to pay. Furthermore, people with high income have higher willingness to pay. The results underline the necessity to pay attention to the subtleties underlying public opinion on crime control.

    The Dutch aftercare for former prisoners is strongly developing. This article describes lessons from international experiences with aftercare for former prisoners in three areas of life: alcohol and drug problems, work and housing. Moreover, it discusses which lessons are especially relevant for the Dutch system. The analysis of the literature shows to what extent and under which conditions voluntary aftercare can affect reintegration and recidivism. Conclusions are that various aftercare programs do affect recidivism to some extent, but that the level of success differs substantially across programs and across subpopulations of former prisoners. Both programs that start during detention and continue after release and programs that combine multiple services (e.g. housing services and drug treatment) are most successful. Work programs have the strongest effects for older individuals. In all three areas of aftercare studied in this article, the strongest program effects were found for subpopulations with the highest risk of recidivism. The review also shows that communication between organizations and the integration of services are very important for the success of aftercare programs.

President Sarkozy, the political producer, has launched a public ‘schizophrenic’ discussion in which criminologists/sociologists act and quarrel on the edge of a knife. This debate can only be understood in reference to French criminological history, politics, structures and scientific particularities. The contents of this criminological theatre of war can enrich criminological discussion in the Netherlands and Belgium.

    In this article we want to show how different actors (amongst whom residents, professional safety-functionaries and street youth) view the safety situation in Rotterdam’s problematic neighbourhood ‘the Old West’ in very different ways and start from very different parameters. We conclude that the one-dimensional image of an unsafe neighbourhood that emerges from the city’s official, quantitative measurement instrument, the so-called ‘Safety Index’ (Veiligheidsindex), does not do justice to the diversity of opinions and visions of the different actors in the neighbourhood and is thus unsuited as the political ‘compass’ for local safety policy it was intended for. This diversity comes much better to the surface in the qualitative, ethnographic research on which this article is based. Such research enables us first to better understand safety as a local phenomenon and secondly offers more concrete points of departure for policy.
