Access_open The Right to Have Rights as the Right to Asylum

Tijdschrift Netherlands Journal of Legal Philosophy, Aflevering 1 2014
Trefwoorden Arendt, asylum, refugeeship, right to have rights, statelessness de facto and de jure
Auteurs Nanda Oudejans
SamenvattingAuteursinformatie

This article argues that the right to have rights, as launched by Hannah Arendt, is relative to refugee displacement and hence translates as a right to asylum. It takes issue with the dominant view that the public/private divide is the locus classicus of the meaning of this primordial right. A different direction of thought is proposed, proceeding from Arendt’s recovery of the spatiality of law. The unencompassibility of place in matters of rights, freedom and equality brings this right into view as a claim at the behest of those who have lost a legal place of their own. This also helps us to gain better understanding of Arendt’s rebuttal of the sharp-edged distinction between refugees and stateless persons and to discover the defiant potential of the right to have rights to illuminate the refugee’s claim to asylum as a claim to an own place where protection can be enjoyed again.

Politie en wetenschap: waarom zij elkaar nodig hebben

Tijdschrift PROCES, Aflevering 3 2013
Trefwoorden Politie, Wetenschap, Onderzoek, Opsporing
Auteurs Annemieke Venderbosch
SamenvattingAuteursinformatie

The Research Programme Police and Science was launched in 1999 with a mission to contribute towards the development of scientific knowledge with respect to the organisation and performance of the police and to promote the actual application of relevant new knowledge and understanding of police and safety practice. In this article we explore the challenging balance between those two worlds of researchers and practitioners. Scientific research can contribute to new methods or instruments in police forces and new training programmes. Based on former experience the conditions are defined that are necessary for a professional en productive relationship.

Burgerschap en inburgering

Tijdschrift Recht der Werkelijkheid, Aflevering 1 2012
Trefwoorden citizenship, republicanism, communitarianism, naturalization policy

SamenvattingAuteursinformatie

Citizenship is a notoriously complex and an essentially contested concept which has been defined in many different ways. The only stable element in all these definitions seems to be that citizenship is primarily described in terms of the relationship between the political community and the citizen. This article aims to explain why citizenship is such a contested concept by showing that it is embedded in three very different normative traditions: the liberal conception of citizenship as a (legal) status, the republican conception of citizenship as an activity and the communitarian conception of citizenship as identity. Each approach emphasizes an important element of citizenship, but none of the three is comprehensive enough to provide a complete picture of what citizenship implies in contemporary constitutional democracies. At the same time they cannot simply be merged because they come from different normative traditions among themselves at odds with each other. This article starts by illustrating the three conceptions of citizenship on the basis of the underlying theoretical models: liberalism, republicanism and communitarianism. Section 3 discusses two mutual tensions between different conceptions of citizenship: first between the liberal and republican conception and then between the liberal and republican conception on the one hand and the communitarian conception on the other. In Section 4, this conceptual analysis is used to analyze a policy terrain that is explicitly embedded in the idea of citizenship, namely the integration of immigrants through naturalization policy. Section 5 concludes.

Slachtofferschap van online oplichting nader onderzocht

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 4 2010
Trefwoorden Online oplichting, Slachtofferschap, Slachtofferenquête, Lage zelfcontrole
Auteurs Johan van Wilsem
SamenvattingAuteursinformatie

Consumer fraud seems to be widespread, yet little research is devoted to understanding why certain social groups are more vulnerable to this type of victimization than others. The present paper deals with internet consumer fraud victimization, and uses an explanatory model that combines insights from self control theory and routine activity theory. The results from large-scale victimization survey data among the Dutch general population (N=6,201) reveal that people with low self-control run substantially higher victimization risk, as well as people performing ‘risky’ routine activities, such as online shopping and participation in online forums. Though a minority share of the self-control-victimization link is indirect – because people with low self-control are more involved in risk-enhancing routine activities – a large direct effect on internet fraud victimization remains. This suggests that, within similar situations, people with poor impulse control respond differently to deceptive online commercial offers.
