John Griffiths
John Griffiths is emeritus hoogleraar rechtssociologie aan de Rijksuniversiteit Groningen (1977-2005). Hij studeerde filosofie aan de University of California, Berkeley (B.A., 1962) en rechten aan de Yale Law School (LL.B, 1965). Hij werkte als ‘law clerk’ voor Justice Fortas van de US Supreme Court en werd daarna hoogleraar rechten aan de Yale Law School (1967-1970), Fulbright Professor aan de Faculty of Law van de University of Ghana (1970-1972), en hoogleraar rechten aan de New York University Law School (1973-1977). Onderzoeksthema’s: rechtspluralisme, geschilprocessen, en de sociale werking van recht. Sinds de jaren negentig heeft zijn empirisch onderzoek vooral betrekking gehad op problemen rondom de effectieve regulering van euthanasie en andere sociaal-problematische medische handelingen. Na zijn pensionering richt hij zich vooral op de theoretische grondslagen van de rechtssociologie.

    Professor Schauer covers many topics in this interview. On a general note, the interview covers themes pertaining to his experience in engaging with legal philosophy as a trained lawyer; his views on the present and the future of legal philosophy and how we shall cope with its development; his new book Thinking like a Lawyer; the role of legal philosophers in law and society; and some sincere suggestions to young legal philosophers. It also covers more specific topics, including discussions about his insistence on rule priority; differences between legal principles and rules; his opinion of legal positivism; and the pros and cons of analytical tools like spectrum, continuum and generality.
