Incidents involving persons with ‘confused behavior’ are an important and topical theme in Dutch society. The police are often the first to be involved in these incidents because they are the only public organization that has a 24/7 presence on the streets. In 2019, the police registered 96,000 reports of persons who showed confused behavior. It is therefore not surprising that the police have repeatedly drawn political-administrative attention to this situation and indicated that the limits have been reached. That raises the question of how police officers deal with a situation that has actually grown above their heads in daily practice. In this research, based on the theory of street-level bureaucracy introduced by Lipsky, it was investigated how police officers in The Hague use their discretion to cope with this difficult reality. |

In 2014, the Dutch government abolished its ban on blasphemy, which had laid dormant in its criminal code for decades. Similar laws have been abolished in nine other jurisdictions in the West since an international campaign to this end started in 2015. This article first describes the tension between blasphemy laws and the freedom of expression. It then examines the Dutch position on blasphemy in its international context. This article argues against bans on blasphemy and specifically against a potential reintroduction of a de facto ban on blasphemy in the Netherlands. Moreover, it argues in favour of applying political pressure to abolish bans on blasphemy around the world as well as giving diplomatic support to those affected by these laws. |

Restorative justice has developed into a recognized sanction or intervention in several countries. Literature shows that restorative justice is experienced as a procedural just approach by participants. Furthermore, a strong rejection of the behavior of the violators would reinforce reintegrative shaming in the process. Finally, stopping crime (desistance) could be achieved if the restorative justice approach would include reconstructing the self-image of the participants. This systematic literature review examines to what extent restorative justice contributes to compliant behavior by individuals and corporations. Although direct effects of restorative justice on compliance and recidivism fail to appear, procedural justice and reintegrative shame are positively affected. The results offer practical implementations and challenges for further research. |

Recently a project was started that aims to systematically describe and explain the developments in the Criminal Code for the period 1886 - 2017. This article presents the first results of this new project, called the Historical Criminal Code (HWvSr). An overview is given of the long-term developments in the structure – the ‘external’ structure – of the Second Book of the Criminal Code since 1886. The analyzes show that its scope has been substantially expanded over the last 130 years, but also that various articles and article parts have been deleted. The article describes the most important changes in terms of both quantity and content. |

There is casuistry, where on the one hand it is the turn of the professionals from the investigation, enforcement and prosecution and on the other hand the turn of the social workers from the social domain. This is the case, for example, when domestic violence occurs in circles that are also involved in organized crime. In theory it is possible that the professionals involved work together, but it is also not impossible that they will get into each other’s waters because they have a different vision of the problem to be tackled and, of course, also have to fulfill other roles and tasks based on their positions. A professional must be able to handle complex situations of this kind. |

Neuroscience teaches us that we can obtain information about the brain by the use of neuro tests. An example of a neuro test is the concealed information test (CIT). This test examines whether a suspect recognizes specific details of a criminal offence. Afterwards experts can conclude whether the suspect has knowledge of a criminal offence, which only a perpetrator can know. This way a CIT contributes by the detection and adjudication of criminal offences. In recent decades, the interest in neuro tests such as the CIT has increased, also at the Ministry of Justice and Security. Based on the existing literature, both advantages and disadvantages of the CIT are discussed in this article. |

This article merely outlines the methods of Teylingereind with respect to youth and young adult suspects who are difficult to examine, based on five cases. By collecting and combining data about this group from a range of different perspectives, better insight about the specific person was obtained in each of the cases as described. When it is possible to describe specific behavioural patterns, statements could be made about freedom of behavioural choices, danger of recidivism, and advice about the most appropriate legal framework. In this way, when there are serious concerns about the developmental course of youth and young adults who are not willing to cooperate in diagnostic research pro Justitia, clinical observation is of added value to the judge. |

In 2016 an independent review into a deadly ex-partner stalking case1xEenhoorn Commission. (2016). Conclusies en aanbevelingen: Onderzoeksrapport TweeSteden. identified a number of structural problems in the police’s approach to stalking cases. Police struggle to accurately and effectively assess and respond to stalking cases because of several reasons. Police often fail to identify stalking by focusing too much on single incidents, missing the pattern of behaviours that constitute stalking. Investigations also focus on the criminal offence of stalking, with police waiting to take action until a particular threshold is reached. There is a lack of knowledge about stalking in general and risk factors associated with stalking in particular, which means the victim’s safety can be at stake if adequate security measures are not taken. These findings led to the development of a new structured response to ex-partner stalking cases, which consists of an automated query, case screening and prioritisation with the SASH2xMcEwan, T. E., Strand, S., MacKenzie, R. D., & James, D. V. (2015). Screening Assessment for Stalking and Harassment (SASH)., case management together with partner agencies and improved training for police officers who are handling stalking cases. Three cases of sexual violence with two teenagers and one young woman as dead victims have put – besides the indescribable sufferings of themselves, their families, friends and acquaintances – a heavy burden on Dutch collective memories of the year 2017. Dutch society commiserated on a massive scale: volunteers helped searching, thousands united in silent marches and more than 400 thousand citizens signed an online petition that emotionally called for a firm revision of the ‘failing justice system’. In this article we explore the deeper social, personal and cultural elements that gave media messages their strong emotional impact in Dutch society. |

Persons who suffer from dementia could potentially commit serious crimes. By studying 22 casus of settlements in cases of serious crimes allegedly committed by a demented person, published on ‘rechtspraak.nl’, the mode of settlement in these cases was established and problems in that field were identified. The group of dementia sufferers proved to be heterogeneous which resulted in a great variety of settlements within the criminal proceedings. However, problems do occur and certain aspects of these problems are not resolvable within the current Dutch penal systems. Reflection on this issue is desirable, as the number of people who suffer from dementia will increase considerably in the near future. |

Reducing the number of suicides in prison has been highlighted as an international priority. To date, however, studies examining prison suicides in Belgium are lacking. Therefore, adopting a retrospective record-based approach, we sought to investigate all suicides occurring in the whole Belgian prison estate during a 17-year period. The results underline the need for suicide prevention among prisoners in Belgium, and echo prior findings that restrictive preventive measures should be combined with psychosocial interventions in order to address the causes of prisoners being suicidal. Such strategies are ideally embedded within a comprehensive suicide prevention policy on a national level. |

But in the impressive body of literature on both types of crime and as seen by specialists from the Dutch National Police, some indications can be found that there is a toxic relationship between the two forms of delinquency: human traffickers can call on the family-honour of their victims in order to blackmail them into prostitution and to keep them working in that field against their will. |

Amsterdam is a popular destination for tourists. The number of tourists visiting Amsterdam increases every year and is expected to hit 23 million by 2025. This article describes which implications increasing tourism has on security and crime in Amsterdam. It appears that increasing tourism has a negative effect on social cohesion and can be a serious threat to safety. Tourism also attracts crime. Tourists are far more likely to suffer from crimes than inhabitants of Amsterdam. In particular they become victims of crimes like pickpocketing, mugging and scams. Tourists are also often associated with drug- and alcohol-related incidents. Apart from being a victim, a tourist can also be a perpetrator of crime. Inhabitants of Amsterdam regularly complain about nuisance caused by tourists. Especially subletted apartments via Airbnb is a serious concern for residents of Amsterdam and local policymakers. |

This article focuses on the experiences that authors gained during a study trip to Japan. In general terms, the main features of Japanese criminal law are being observed. This system resembles the letter of Dutch criminal law, but in practice it appears to differ greatly. Among other things, attention is paid to the strong position of the prosecutor’s office, the high conviction rate, the limited contradictory nature of the criminal procedure, and the relative strong position of the victim. Subsequently, attention is given to some recent reforms, including the democratization of criminal law. Also, authors describe a visit to the Fuchu-prison. This article concludes with the question to what extent we could learn something from the Japanese practice in the Netherlands. |
