Ere wie ere toekomt

Een kritische analyse over de relatie tussen eer, geweld en gender

Tijdschrift PROCES, Aflevering 6 2014
Trefwoorden gender, eergerelateerd geweld, sociale uitsluiting

SamenvattingAuteursinformatie

Honour, violence and masculinity are closely linked in traditional criminology, and are combined with an ethnic profile of the offender. This article discusses the conclusion of these assumptions as ethnocentric, but also as a simplification of the gendered idea of honour. Beliefs about honour, which are reduced to the male gender, and understood as conductive to crime, disregard insights regarding violent females, and awareness about the significance of honour in marginalized groups. Furthermore, this contribution discusses the supplementary value of a critical gender perspective, for discussion in criminology about honour and crime.

When a person commits a severe crime in the Netherlands, for which he cannot be (fully) held responsible because of a mental disorder, a judge may impose a hospital order in a secured psychiatric institution. To make this possible, behavioural experts have to assess whether the suspect suffered from a mental disorder at the time of the crime. However, during this assessment a suspect has the right to remain silent. Since recent years the number of non-cooperating suspects is increasing. To solve this problem, the Secretary of State of Security and Justice has submitted a legislative proposal, which makes it possible to force health professionals to submit past medical records of the suspect to the behavioural experts for their assessment without his consent. This breaches the professional law of confidentiality. Following case law of the European Court of Human Rights, this can only be justified, if it complies with the principles of proportionality, subsidiarity and necessity. The legislative proposal does not comply with these principles, as alternatives are available. These are: improvement of the forensic psychiatric care, reduction of the duration of the treatment and extension of the behavioral research period.

Naar een vervanging van de unus-testisregel van artikel 342 lid 2 Sv

SamenvattingAuteursinformatie

The rule that a conviction cannot be based on the statement of just one witness, is codified in article 342 of the Dutch Criminal Procedural Code. The Supreme Court has recently demanded that such a statement finds sufficient support in other evidence and that sometimes the trial judge needs to specify why that statement is corroborated enough by other evidence. However, the Supreme Court has always given a very marginal meaning to this rule, by allowing convictions which basically are substantiated by only that one statement. The evidence supporting the story of the witness does not have to prove that the crime actually took place, nor that is indeed the defendant who has committed it. In this article, I propose the replacement of the rule with a well-founded motivated ruling of the trial judge on this subject.

Het politiewerk en gendergerelateerde selectiviteit

Processen van waarnemen, interpreteren, beoordelen en toeschrijven van gender

Tijdschrift PROCES, Aflevering 1 2014
Trefwoorden politie, gender, selectiviteit, criminaliteit
Auteurs Dr. Martina Althoff
SamenvattingAuteursinformatie

This article explores the ways in which the work of the police is influenced by ideas about gender. Even though there is a long tradition of doing research about selectivity of the control agencies of criminal law, criminology has hardly had any attention for this topic. The main purpose of this article is to find out the meaning of the theoretical concept of gender for the social control of crime by the police and to give some examples for illustration. First of all, the article takes into consideration any crucial aspects of the process of selectivity.
