When a person commits a severe crime in the Netherlands, for which he cannot be (fully) held responsible because of a mental disorder, a judge may impose a hospital order in a secured psychiatric institution. To make this possible, behavioural experts have to assess whether the suspect suffered from a mental disorder at the time of the crime. However, during this assessment a suspect has the right to remain silent. Since recent years the number of non-cooperating suspects is increasing. To solve this problem, the Secretary of State of Security and Justice has submitted a legislative proposal, which makes it possible to force health professionals to submit past medical records of the suspect to the behavioural experts for their assessment without his consent. This breaches the professional law of confidentiality. Following case law of the European Court of Human Rights, this can only be justified, if it complies with the principles of proportionality, subsidiarity and necessity. The legislative proposal does not comply with these principles, as alternatives are available. These are: improvement of the forensic psychiatric care, reduction of the duration of the treatment and extension of the behavioral research period.

Daar doen we het voor! Opbrengsten en effecten van verslavingsreclassering

Tijdschrift PROCES, Aflevering 4 2014
Trefwoorden rehabilitating institutions, result indicators, monitoring rehabilitation, drug-addicted offenders
Auteurs Drs. Corine Von Grumbkow en Drs. Ron Van Wonderen
SamenvattingAuteursinformatie

The SVG aims to improve its ability to show the social relevance of the work done by organizations for the rehabilitation and probation of drug-addicted offenders. As a first step the SVG asked the Verwey-Jonker Institute to develop a monitor which provides structurally insight into the returns of this work. The monitor couples data at the individual client level to relevant indicators. The monitor’s results are very promising. A year after they had come into contact with the rehabilitating institutions, clients committed significantly fewer criminal offences than they did during the year prior to that moment. Contacts with the police decreased as well.

Criminaliteit en traditionele Chinese medicijnen

Tijdschrift PROCES, Aflevering 2 2014
Trefwoorden traditional Chinese medicine, wildlife trade, CITES, green criminology
Auteurs Drs. Daan van Uhm
SamenvattingAuteursinformatie

Traditional Chinese medicine (TCM) is deeply rooted in the Chinese culture. Although thousands of animal and plant species are used for medicines legally, some medications contain more sinister elements; illegal animal or plant ingredients of protected species. What is the origin of this demand for rare species as medicine, who are involved in the trade and why is law enforcement complicated? This article will show that the illicit trade in TCM is a form of crime that transcends the borders of China and manifests itself in Western Europe. Various aspects of the trade are highlighted, including criminalization of the use of endangered species, western anthropocentrism and the cultural use of medicine, to understand this relatively invisible crime.

(On)gelijke behandeling in het reclasseringswerk

Tijdschrift PROCES, Aflevering 1 2014
Trefwoorden reclassering, rrisicotaxatie, overeenstemming, plan van aanpak
Auteurs Drs. Jacqueline Bosker
SamenvattingAuteursinformatie

In order to support desistance from crime and rehabilitation into society, the probation service has to adapt its service to the individual problems and strengths of offenders. As a result, offenders who have committed similar crimes but differ in the problems related to their offending behavior are approached differently. However, equal treatment of offenders by the probation service is important if their problems are comparable. In this article the results are described of a study about the level of agreement between probation officers about intervention plans. In addition, it was studied whether the use of an instrument for structured decision making improves agreement about these plans.
