    Restorative justice has developed into a recognized sanction or intervention in several countries. Literature shows that restorative justice is experienced as a procedural just approach by participants. Furthermore, a strong rejection of the behavior of the violators would reinforce reintegrative shaming in the process. Finally, stopping crime (desistance) could be achieved if the restorative justice approach would include reconstructing the self-image of the participants. This systematic literature review examines to what extent restorative justice contributes to compliant behavior by individuals and corporations. Although direct effects of restorative justice on compliance and recidivism fail to appear, procedural justice and reintegrative shame are positively affected. The results offer practical implementations and challenges for further research.

    Structured assessment of the risk of repeated offending has become common practice in the judicial system. However, much less attention has been paid to the way of communicating about the results of these risk assessments to the court or forensic settings. Research shows that the way of communicating about risks of relapse may affect decision-making by judges. In this article, these research results will be summarized and the different approaches to risk communication are discussed. Finally, recommendations are provided for clear communication about risk assessment results.

    Teen sexting is an increasingly common phenomenon. It is doubtful whether primary teen sexting – when minors take sexually pictures of themselves and share these voluntarily with peers – should fall within the scope of the Dutch offence description of child pornography. The German Penal Code contains an exception clause for primary teen sexting, whilst the Dutch Penal Code does not. In this article is argued, through comparative law research, that the Netherlands should also adopt an exception clause. This way not only the right of the child to protection against sexual abuse and exploitation, but also the right of the child to sexual development is safeguarded sufficiently.

    By the end of 2020, the European Public Prosecutor’s Office (EPPO) will be operational. The EPPO will be tasked with investigating, prosecuting and bringing to judgement criminal offences against the EU budget. The substantive competence of the EPPO could in the future be extended to terrorism and other serious cross-border crimes. This article will first describe the background, structure and competences of the future EPPO. Then the procedural guarantees will be discussed and the problem of ‘forum shopping for evidence’. This problem entails that the choice in which Member State to conduct an investigative measure could be made on the basis of the less stringent rules in that Member State regarding, for example, the right to privacy. The article will end with a proposal on how to prevent forum shopping for evidence.

    In this article, a substance use management program is presented that is applicable to clients who lack any realistic prognosis of reaching any form of sustainable abstinence. The aim of this program is to optimize the client’s quality of life and safety, and to reduce the risk of criminal behavior. The concept of directed substance use is introduced and explained. Practical guidelines as to how directed substance use should be practiced are provided.

    In 2016 an independent review into a deadly ex-partner stalking case1xEenhoorn Commission. (2016). Conclusies en aanbevelingen: Onderzoeksrapport TweeSteden. identified a number of structural problems in the police’s approach to stalking cases. Police struggle to accurately and effectively assess and respond to stalking cases because of several reasons. Police often fail to identify stalking by focusing too much on single incidents, missing the pattern of behaviours that constitute stalking. Investigations also focus on the criminal offence of stalking, with police waiting to take action until a particular threshold is reached. There is a lack of knowledge about stalking in general and risk factors associated with stalking in particular, which means the victim’s safety can be at stake if adequate security measures are not taken. These findings led to the development of a new structured response to ex-partner stalking cases, which consists of an automated query, case screening and prioritisation with the SASH2xMcEwan, T. E., Strand, S., MacKenzie, R. D., & James, D. V. (2015). Screening Assessment for Stalking and Harassment (SASH)., case management together with partner agencies and improved training for police officers who are handling stalking cases. Victim safety must always be the first priority.

    Investigative reporters show an increasing interest in criminal phenomena. Dutch journalists may be allowed access to ongoing police investigations on the condition that they comply with data protection legislation. Working in international cooperative projects, using sophisticated research tools and hot sources, journalists by themselves also manage to uncover hidden crimes that may prompt indictments. The article explores possibilities of future collaboration between criminal investigators and reporters, while acknowledging each other’s professional roles and responsibilities.

By opening a hospital or donating funds for the development of a football field they try to present themselves in a cordial way and as good citizens to the public. Using the media to present themselves as animal lovers is a very effective manner to go for public admiration and sympathy. In this contribution is investigated how this mechanism works and why it is so effective.

    #MeToo has played a significant role in the struggle to confront taboos around sexual violence, including the acknowledgment of male rape victims. In this article, the authors have examined reactions at three different moments in time (T1, T2, T3) to Dutch journalist Jelle Brandt Corstius, who shared his #MeToo experience via Twitter. The article shows that the Belief in a Just World, victim stereotypes and rape myths seem particularly useful concepts to examine different positive (supporting, compensating) and negative (blaming, distancing) observer reactions. Reactions are most negative at T2, when JBC’s case least adheres to stereotypes and rape scripts.

    Datingfraud is nothing new but it is an underexposed subject. Victims are approached on online datingsites by criminals whose goal is to gain large amounts of money. To achieve this, they start, with a false identity, an online relationship with their victims. In this article research has been done what the needs of the victims are after the offense has been committed. To this end interviews have been made with victims of datingfraud and staff members of victim support. Many victims do not end up with victim support because the police refuse to make a report. Nevertheless, the emotional and legal aid seems to functioning well. However, the practical help leaves much to be desired, especially because employees are not informed about all possibilities there are to support the victims.

    Persons who suffer from dementia could potentially commit serious crimes. By studying 22 casus of settlements in cases of serious crimes allegedly committed by a demented person, published on ‘rechtspraak.nl’, the mode of settlement in these cases was established and problems in that field were identified. The group of dementia sufferers proved to be heterogeneous which resulted in a great variety of settlements within the criminal proceedings. However, problems do occur and certain aspects of these problems are not resolvable within the current Dutch penal systems. Reflection on this issue is desirable, as the number of people who suffer from dementia will increase considerably in the near future.

    In 2017, the Research and Documentation Centre of the Ministry of Justice & Security (WODC) published the report ‘Neuroscientific application in the juvenile criminal justice system’. This report concerns an inventory of possible neuroscientific applications in the juvenile criminal justice system. The release of the report attracted attention from well-recognized national media. The positive media attention was striking for several reasons. It indicated that –in contrast to a few decades ago – it has become more accepted to study neurobiological correlates of antisocial behavior. On the other hand, the overwhelming news value indicated that the idea that antisocial behavior is also associated with neurobiological deficts has not become common knowledge yet. Based on the WODC report, in the current article the authors summarize how neuroscientific knowledge and methods could be applied in the juvenile criminal justice system.

    Circles of Support and Accountability (COSA) is a method in which volunteers support and monitor a convicted sex offender during his or her re-entry into society in order to prevent new sex offences. COSA was developed in Canada in 1994 as a grass roots approach to an acute crisis in a small town near Toronto, and since then has spread throughout Canada. In 2002, the COSA model was introduced and further developed in England, and from there the approach found its way to the Netherlands, where circle projects are provided by the Dutch Probation Organization since 2010. Until now, more than one hundred sex offenders (‘core members’ in a circle) have participated in a circle in the Netherlands. Although the COSA model predates the Good Lives Model, it’s basic principles align very well to the Good Lives Model. In COSA, a group of three to five volunteers form a surrogate social network, that offers social inclusion, practical and moral support in all kinds of daily challenges the core member faces, and that monitors risk and risk behavior. The volunteers are supervised by a professional circle-coordinator and supported by professionals who are involved in the core members’ after care arrangements. The COSA intervention model describes a number of conditions and strategies that support its effectiveness. Canadian, American and English case-control studies into the effectiveness of COSA shows a substantial reduction of offending behavior in core members compared to controls. Since the international proliferation of the COSA model is ever increasing, protecting the program integrity is a growing concern, and stresses the need for international cooperation between COSA providers.

    The Dutch Minister for Security and Justice recently announced a revision of the sexual offences in the Dutch Penal Code. Part of this revision could be the introduction of several sexual offences that are committed on the internet. The Minister mentioned sexchatting, sextortion and revenge porn. This article describes the present-day possibilities the Penal Code offers in tackling these crimes, and gives insight in the bottlenecks in current penal law. This article also provides a description of several relevant criminal investigative powers in existing and future Dutch procedural law.

    Every year there are some 130 cases of victimization dating fraud in the Netherlands. On average the victims lose more than 19.000 euros in this scam. With dating fraud a person on the internet pretends to be someone else and begins a love affair with the victim with the aim to make as much money off the victim as possible. This is a form of Nigerian fraud. In this article is described how this dating fraud is being done. Dating fraud is highly organized with highly educated offenders. Victims come from all layers of society, but according tot he Fraud Helpdesk midddle-aged women who are lonely, have a christian background and work in care, loose the largest amounts. The impact on the victims is huge: the emotional damage is even bigger than the fiancial loss. To reduce dating fraud it is necessary to pay more attention tot his form of fraud.

    In the near future, the legislator will decide on the criteria to be applied to make a choice between the administrative and the criminal justice system. It is a possibility that the legislator will depart from the so-called ‘open context’ and the ‘confined context’. In his Farewell Speech, Rogier pleaded that the severity of behavior should be the criterion to the applied. When behavior can be qualified as ‘serious’ a criminal procedure should take place and if the behavior is ‘less serious’ the administrative procedure has to be chosen.
