    This contribution provides an overview of the legal and criminological research into the decision following the determination of a supervisor that the conditions of a freedom-restricting sanction are not met. It is an important decision, on the one hand because it can result in a more severe sanction than was initially imposed, on the other hand because a decision that is perceived as unfair can influence the extent to which suspects and convicts are willing to comply with conditions, and recidivism. Yet little research has been conducted into this decision. The legal safeguards with which it is accompanied are lagging behind those of the original sentencing decision. Undeserved according to penitentiary experts. The scarce empirical research shows that decision-making involves many different layers and that the actors involved have different goals, ranging from deterrence and emphasizing the credibility of the system to the successful completion of the sanction. Even in countries where regulations have been tightened considerably, the discretionary power of direct supervisors, such as employees of the working project or therapists, is still large. This raises the question to what extent the final decision maker (usually a judge) still has sufficient room to make an independent decision.

    This study describes how penal protection orders contribute to victim perceptions of safety, drawing upon data collected via a victim survey (n=101). Perceived victim safety is explored based on the factors of personal vulnerability, procedural justice, and experiences with compliance and enforcement. Results show that more than half of the victims in this study does not feel safer because of the protection order. The effects of the orders are even weaker for feelings of relaxation and feelings of anger about the situation. An increase in perceptions of control over the situation appears to be the most important predictor of an increase in feelings of safety and a decrease in feelings of anger, but is unrelated to an increase in feelings of relaxation. The effect of procedural justice differs per outcome measure. It is associated positively with increased feelings of safety, but negatively with decreased feelings of anger because of the protection order. The positive association with feelings of safety is partly indirect via personal vulnerability. Findings result in various suggestions for future research.

    There is no clear answer to the question if corruption makes victims. Currently an (international) discussion is taking place about this matter. On the one hand it can be discussed that corruption in general does not know any direct victims and that corruption can even take place without any damage. On the other hand it is known that corruption can cause tremendous public and financial damage, with society as a whole as the victim of this crime, whether or not in primary gradation. In the underlying article these two perspectives will be discussed and applied on two cases. Special attention will also be paid to the impact and relevance of pointing out the victims.

    This article focuses on the ways the NVU, Pegida and Voorpost - three far-right groups from the Netherlands - make use of social media platforms in the year 2017. Our results show that these extreme right-wing groups use social media to spread their ideology, to construct a group identity, and to call for (democratic) forms of resistances. In addition, our findings illustrate that these far-right groups seem to adjust to their digital surroundings: they do not change or conceal their extremist ideas, but rather manage their online content to ensure that their ideologies can be disseminated through social media.

    In our 2017 report “Profielen van outlaw bikers and outlawbiker clubs” we concluded, “Dutch members of outlaw motorcycle gangs disproportionally frequently have a history criminal justice contacts”. The attorney representing the Hells Angels in the civil law suit filed by the Dutch public prosecutor requesting a civil ban of the Hells Angels, after consulting an expert methodologist, challenged this conclusion due to the possibility of type 2 and type 1 errors in constructing our sample from a police gang database. Here we calculate the proportion of convicted Hells Angels members under different levels of potential bias resulting from these errors. We find that a realistic estimate of the proportion of convicted individuals among the Dutch Hells Angels membership is between 58-96%, which, at a minimum, is roughly twice that in an age-matched population of male motorcyclists who are not members of an outlaw motorcycle club.

    Two developments are discussed that have a significant influence on the scope and content of the penology of the future, but otherwise have little to do with each other: The expansion of the sentencing field has resulted in a completely fluid research field. However, the important questions of penology can only be answered by integrally mapping and analyzing that sentencing field. For that reason, penology should radically free itself of the limitation of its field of research to the penal sanction. Ongoing insight into the functioning of the brain and the predictability of behavior on the basis of algorithms shine a different light on the portraits of mankind on which we base punishment. It also exposes a range of new possibilities to influence behavior and prevent criminal behavior. It is also part of the research field of penology to question which of those possibilities we want to use and under which conditions.

In addition, based on the observed ‘silences’ in the scholarly debates on the criminalization of migration and border mobility, three avenues for further criminological research will be identified.

This complicates the chances of a successful re-socialization. It is foreseen that the number of patients will increase significantly in the upcoming years.
    More effective treatment programs and instruments for risk assessment are needed. For this, the causal relationship between psychopathology and delinquency must be better understood. This requires more criminological research.

    Internationally, research on the experiences of white-collar offenders with the criminal justice system and the consequences of prosecution and conviction is scarce. Such research becomes more relevant, as the response to white-collar crime has become more punitive and more offenders are convicted. This paper presents the experiences of the co-author as a convicted white-collar offender as an autobiographical case-study. In this cases study, the consequences and experiences during four phases (investigation, prosecution, sentence-execution and post-sentencing) are analysed on four live-domains: health, private life, social life and professional life. Such an approach could be a blueprint for further and more systematic study of the experiences with and consequences of criminal justice for white-collar offenders. Such study can shed light on the effects and actual achievement of goals of punishment for white-collar crime.

    This article studies the development in the prison system over the period 1837-2016 in the Netherlands. It describes trends in three characteristics of the Dutch prison system: (a) the number of prisoners, (b) the number of cells, and (c) the inflow of persons from the free society. The findings are twofold. On the one hand – when examining absolute numbers – the article shows that three distinct periods can be distinguished: a period of 140 years with low stable numbers (1837-1975), four decades in which the numbers tripled (1975-2005), and a subsequent decade where the numbers halved (2005-2016). On the other hand – when examining relative numbers, i.e. per 100.000 inhabitants, and thus controlling for the growth in population – the article displays that developments in the prison system in the Netherlands between 1837-2016 can best be characterized by a long-term continuous decrease in detention.

    In the United States, the term disproportionate minority contact (DMC) is used to refer to the disproportionate number of minority youth who come into contact with the juvenile justice system. Statistics on DMC in the United States put the issue on the political agenda and measures have been taken to reduce the inequality. In the Netherlands, there are some studies on the representation of ethnic minority groups in suspect statistics, but data regarding all ethnic groups at various stages of the juvenile justice chain are lacking. Due to this lack of information, DMC is not mentioned in Dutch research literature and is not a political issue. Therefore, the purpose of this article was to explore whether DMC existed in the Netherlands and whether elements of the US policy could be applied to the Dutch situation. To investigate this, the likelihood (odds ratio (OR)) was calculated for young people with a migration background to be registered and held as a suspect, to participate in an alternative punishment program (Halt) and their likelihood of incarceration. It turned out that the OR for young people with a non-Western migration background to be registered as a suspect was more than three times as high, with an OR of 5 or higher for some ethnic groups. The chances of a Halt-settlement were much lower for young people with a non-Western background. The odds of ending up in a youth prison was over six times higher for youngsters with a non-Western background compared to their Dutch native peers. For young people of Caribbean and Moroccan origin the likelihood was more than ten times higher. These results showed that DMC is present at all examined stages in the Dutch juvenile justice chain. The large overrepresentation of young people with a migration background (especially of Moroccan and Caribbean origin) shows that further research is needed in order to develop programs to reduce DMC. To establish this, it is important to register the ethnic origin of the individuals at all stages of the juvenile justice chain.

    Early literature on female perpetrators of World War II focused on labelling the accused as deranged psychopaths, thereby distinguishing the group of perpetrators from the vast subdued and ‘normal’ population. While this perception has changed over the past decades, the perception of female perpetrators has remained limited either way, women are denied having a lot of agency when perpetrating crimes in conflict. Similar to the ‘mad Nazi’-theory these narratives imply that female perpetrators are different from ‘ordinary’ women, as their actions collide with notions of ideal femininity. This empirical research has shown that in the case of female perpetrators of World War II in the Netherlands it seems that they can be seen as ordinary women operating in extraordinary circumstances. In this study, a special group of female war criminals is described. Against the background of early post-war imaging of such women and more recent research on female perpetration during wartime, an analysis of Dutch perpetrators who received severe punishments after the War, is made. Based on unique historical data, the criminal career of these women as World War II perpetrators is analysed. The outcomes show that a notable part already had a criminal record before the war and that the perception of who they were and why they acted the way they did needs reconsideration, since they were not psychologically weak and incompetent. They were generally young, unemployed and low educated and they planned and committed their crimes of treasons in order to create better living conditions for themselves. In fact, one can claim that these women are likely to be ordinary people influenced by dispositional and situational factors.

    On 1 April 2014, the Dutch Act on Adolescent Criminal Law entered into force. With this law, the age limit in article 77c of the Criminal Code, which allows for the application of juvenile criminal law to young adults, was stretched from 21 to 23 years. In this article stock is taken of the developments that have taken place in the four years after the introduction of this law. In practice, article 77c Criminal Code is increasingly being applied in case of young adult suspects, however still to a little extent. Among others, this has to do with confusion about the target group that qualifies for the adolescent criminal law. The access to and justification for the application of the law show a very diverse picture.

    Illegal (IUU) fishing is a relatively understudied area within criminology. In this article the authors briefly describe what IUU fishing entails, what is known about the consequences of such fishing, and will list law enforcement issues. They illustrate how illegal fishing can be organized in different ways, and will give some examples of fish fraud. The authors also discuss the (massive) measurement issues. The ecological impact of IUU fishing constitutes an important reason for more research into this phenomenon.

Drie perspectieven op de illegale vogelhandel in Nederland

    The Netherlands are considered as an important hub for the illicit trade in species of endangered birds protected by the CITES convention. In this article the authors analyze five substantial criminal cases from three different perspectives. First, from a criminal business perspective, the cases illustrate that logistics vary from relatively simple to highly complex, but always require in-depth knowledge of the animals as well as regulations, to be able to keep the birds alive to make a profit, and to smuggle them to the Netherlands, respectively. Second, from a network perspective, it is clear that those who are involved in the illicit trade – suppliers, traders and customers – are part of a closed and often long-lasting group of people who know the trade. Finally, from a green criminological perspective, the authors conclude that harms of the illicit trade in protected birds are mentioned only to a limited extent in court rulings, contrary to what one might expect based on social construction theories of criminalization and sentencing.

    According to police statistics, juvenile crime in the Netherlands decreased annually since 2007. Explanations for the crime drop primarily focused on single macro explanations, such as increasing prosperity, focused policing or decreasing alcohol use. The prevalence of self-reported delinquency also dropped in the period 2005 till 2015. In three consecutive cohorts of the Youth Delinquency Survey (YDS; 2005, 2010, 2015) changes in exposure to risk and protective factors offered potential explanations for the drop in juvenile delinquency. Compared to previous cohorts, juveniles in the 2015-cohort were less exposed to risk factors like alcohol use and delinquent friends, and more exposed to protective factors like perceived emotional support, solicitation and monitoring by parents. Amongst serious delinquents, however, the exposure to individual risk behavior and delinquent friends was stable over time. Serious delinquents also showed stability over the cohorts in frequency and seriousness of offenses. The vulnerability for risk and protective factors was consistent amongst the three cohorts, regardless the seriousness of delinquency. Changing social cultural attitudes towards risk behavior, e.g. delinquency, could be an additional explanation for the juvenile crime drop. Implications for theory and policy are discussed.

    This empirical study examines how criminal investigative police officers (re)construct a criminal case and the vulnerabilities of their logic.The investigation process is analyzed through Goffman’s framing and interaction theories. While Goffman’s theories have been widely applied to other disciplines, such contributions remain rare in criminology. Here, they shed light on how detectives understand and give meaning to the situation surrounding the criminal case they encounter. The results indicate that this approach shows promise for improving our understanding of the investigative process, if complemented by other theoretical views.
