Tijdschrift Justitiële verkenningen, Aflevering 4 2020
Trefwoorden art theft, history of art theft, organized crime, motives for stealing, international networks
Auteurs Noah Charney
SamenvattingAuteursinformatie

This article seeks to provide an introduction to art theft today. It is divided into sections that look at the context in which art is stolen, definitions of key terms, an explanation as to why the field is understudied and under-reported, and a brief history of the phenomenon. It also contains sidelines on actual developments like the theft of a Van Gogh painting from the Singer Laren Museum in the Netherlands as well as on the drop of art theft since the start of the Corona pandemic.

Metaforen in de Nederlandse inlichtingengeschiedenis

Tijdschrift Justitiële verkenningen, Aflevering 1 2018
Auteurs Dr. Constant Hijzen
SamenvattingAuteursinformatie

Since intelligence and espionage are so secret by nature, discussing it proves to be rather difficult. Debates about intelligence therefore tend to be fought with metaphors. Using Johnson’s and Lakoff’s idea that metaphors provide conceptual frameworks and thus have real-world effects, as well as Butler’s idea of performative power, this article has explored the most widely used metaphors in Dutch intelligence history. The Dutch security services have been depicted, in a wide variety of images, broadly as remnants of the past (ruins or ‘anachronisms’), as spies on wooden shoes, as a stowaway of democracy, and as a state within the state. Since the civil servants and politicians almost always felt the need to respond to these metaphors, by providing explanation, nuance, and facts – or by introducing a competing metaphor – it is argued that these metaphors have real-world effects, showing how the security service was positioned in politics and society.

Begaafdheid en crimineel gedrag

Tijdschrift Justitiële verkenningen, Aflevering 6 2017
Trefwoorden IQ-crime relationship, high IQ offenders, white-collar crime, criminological research, self-reporting
Auteurs Dr. J.C. Oleson
SamenvattingAuteursinformatie

Criminologists generally regard below-average intelligence as a robust correlate of delinquency and crime. In this article the author argues that the negative association between IQ and crime could be explained at least in part by a lack of research access to gifted adults who possess wealth, power and privileges. Asking these adults about other types of offending (e.g. white-collar crimes) than usual in self-report studies might uncover a positive relationship between IQ and prevalence rates, in accordance with the results of the exploratory study underlying this article. As a consequence different conclusions about the linkages between intelligence and crime might have to be drawn.

Sharia4Belgium en de verburgerlijking van de provocatie

Tijdschrift Justitiële verkenningen, Aflevering 3 2017
Trefwoorden Sharia4Belgium, fundamentalist Muslims, political humor, Provocation, ethnic and religious minorities
Auteurs Dr. O. Verkaaik
SamenvattingAuteursinformatie

In their book on Sharia4Belgium, an organization that during its short existence from 2010 to 2012 criticized what it perceived as anti-Muslim discourse and promoted the introduction of the sharia in Belgium, the authors Pim Aarns and Ineke Roex focus on the use of political humor by the spokespersons of the organization. They offer a nuanced interpretation of the political humor in a large number of online videos, distinguishing between, among other things, the ridicule of right-wing nativist opponents, a ludic critique of sexual mores, and the mockery of other Muslims who do not accept the group’s version of Islam. The focus on humor is refreshing, because in today’s liberal, secular democracy devout believers, and fundamentalist Muslims in particular, are often believed to be lacking a sense of humor. Although failing to offer a broader analysis of political humor in current political discourse, the book successfully shows that radical religious ideology and political humor are not mutually exclusive.

Tijdschrift Justitiële verkenningen, Aflevering 3 2013
Trefwoorden prisons, prison officers, communication, collegial relations, work stress
Auteurs T. Molleman en E.F.J.C. van Ginneken
SamenvattingAuteursinformatie

The job of prison officer is recognised as highly demanding, given that prisons are dynamic environments that place a burden on the mental and physical resources of staff. The article explores what prison officers consider the most rewarding and most stressful aspects of their job, and how they cope with job stress. The authors conducted seven semi-structured interviews with prison officers in a large Dutch prison to complement and illustrate findings from the literature. Prison officers especially enjoy human interaction in their job: working with their colleagues and with the prisoners. Poor communication about management and policy decisions, too much paperwork, and (violent) incidents caused frustration and stress among employees. Talking about problems with colleagues, family and friends alleviated some of the stress.

Levenslange gevangenisstraf: uitlevering en overlevering aan Nederland

Tijdschrift Justitiële verkenningen, Aflevering 2 2013
Trefwoorden life imprisonment the Netherlands, extradition, surrender, human rights, European Court of Human Rights
Auteurs V.H. Glerum
SamenvattingAuteursinformatie

In principle a Dutch life sentence is served in full. ‘Lifers’ can benefit from executive clemency. However, over the last 26 years clemency has been applied so sparingly as to call into question whether clemency for ‘lifers’ is a real possibility at all. Recently the European Court of Human Rights has refined its case-law on the compatibility of life sentences with Art. 3 ECHR, in the national context as well as in the context of extradition. This contribution discusses whether under Article 3 ECHR the Dutch practice of executing life sentences in full acts as a bar to extradition or surrender of a person who faces the imposition and/or execution of a life sentence in the Netherlands.

Vrije wil en verantwoordelijkheid in de strafuitvoering

Tijdschrift Justitiële verkenningen, Aflevering 1 2013
Trefwoorden penal execution, rehabilitation, responsibility, life course approach, motivation
Auteurs M.M. Boone
SamenvattingAuteursinformatie

Responsibility of the prisoner for his own rehabilitation is a central element of ‘Modernising Imprisonment’, the masterplan that aims to reform the execution of the prison sentence in the Netherlands. The Secretary of Justice strives for an individual approach based on the points of departure of the Life Course Approach in criminology. This method is designed in different ways. A central element is that rehabilitation will only be offered in the near future to prisoners that show responsibility for their rehabilitation. Based on this starting point, a far-reaching system of advancing and degrading is introduced. Prisoners can deserve freedoms by showing responsible behaviour, but loose them again in case of irresponsible or unmotivated conduct. Three objections against this aspect of Modernising Imprisonment are discussed. First, the rehabilitation principle itself does not allow for such a far-reaching exclusion of categories of prisoners. Second, the high demands put on prisoners are not realistic given the characteristics of the prison population. Third, the assumption that a strict system of advancing and degrading will increase the effectiveness of sentencing is not well founded and cannot be derived from research.

De strategie van ‘removing excuses’ toegepast op financiële facilitators

Tijdschrift Justitiële verkenningen, Aflevering 2 2011
Auteurs M.R.J. Soudijn
SamenvattingAuteursinformatie

Criminals sometimes use so-called financial facilitators to invest their ill-gotten gains without drawing attention to themselves. These facilitators are experts at getting round anti-money laundering procedures. Because of their expertise and unique capabilities they play an important role in criminal networks. It therefore stands to reason that law enforcement focuses on them. That focus often translates in prosecution when laws are broken. However, what can we do to prevent financial experts in breaking the law? In this article the focus lies on the method of removing excuses. This technique is employed in every day crimes but has not been put to the test in the context of organized crime. Interviews with police officers show that the technique of removing excuses could work under certain conditions. However, it turns out that an important differentiation lies in the sort of activities financial facilitators undertake. Not all financial activities take place in the legal financial-economic system. Instead of distinguishing between the three classical phases of money laundering (placement, layering, integration), a two-pronged focus is proposed on those who are involved in cash based transactions and those who construct smokescreens on paper.
