    Academic perceptions of litigation rates are dispersed: they vary from observations of a ‘litigation explosion’ to empirical accounts of ‘vanishing trials’. In this article the authors study whether civil trials are increasing or vanishing in the Netherlands. To find out, the authors studied trends in the number of civil cases in the Dutch courts. First, they observed developments in the filings as well as the dispositions of civil cases over the past 25 years, taking into account the trial-likeness of the procedures. Second, they put the Dutch figures - including other indicators of legal activity - in a European perspective. The findings show that the number of court cases in the Netherlands is on the rise. This does not automatically imply, however, that the Netherlands are a highly litigious society. ‘Light’ versions of trials are predominant, as is efficiency in the management of cases. Moreover, the number of lawyers and judges is rather small compared to other European countries.

    There is currently no legal base for financial supervision and crisis management at the European level. Powers are nationally based. This article develops the financial trilemma, which states that a stable financial system, an integrated financial system and national financial autonomy are incompatible. Any two of the three objectives can be combined, but not all three; one has to give. Assuming that a stable financial system is desirable, this article explores the trade-off between national financial autonomy and financial integration in Europe. Policymakers face a clear choice. If they want to preserve the benefits of the single market for financial services (financial integration), financial supervision and crisis management have to be based on a European footing. This article stresses that a strong legal base is needed for such European arrangements. Voluntary cooperation does not work in a crisis, as national governments tend to follow their national interests. The alternative to European arrangements is preserving the current national powers. This article predicts that banking will then become national: each country has its own national banks.

    The world is in the throes of the deepest economic depression since the 1930s. Worst is yet to come. The financial crisis has spread to the real economy on a global scale. A global recession combined with the current credit crunch is a rare, but a deadly cocktail. This will lead to a recession of unimaginable magnitude - a deflationary depression. This doom scenario is based on the conjuncture waves of the Russian economist Nikolai Dimitrievitsj Kondratieff (1892-1938) and the strong similarities between 1920-1929 and 1980-2000, both autumn seasons in the Kondratieff cycle. Soon it will become clear that all measures taken by governments have had only a little, temporary positive effect. The stock markets, housing markets and world economy will reach new depths in the coming decade. Social chaos will be the result. The history of the 1930s could serve as our guide here.

    In this article the authors try to analyze the prerequisites and critical factors for the successful implementation of a nodal orientation in law enforcement. Their analysis is based on an exploration of the exemplary case of the Dutch national airport Schiphol, one of the most important multi nodal and infrastructural nodes in the Netherlands, where transport by air, road and rail and streams of people and goods intersect. The authors reject naive instrumentalism that sometimes comes along with the nodal orientation. They discuss the possibilities and limitations of high tech, the stipulation of nodal security governance and the dilemma's with regard to the privacy of citizens. They advocate a balance between the need for safety and personal freedom, based on a dialogue in politics and in broader society, and more accountability in the application of high tech detection equipment.

    This article discusses what is left aside in the perspective of nodal governance: namely the adaptability and dynamics of social reality itself. The challenge is to research ‘what actually happens’ without reducing it to collective structures or specific frameworks in advance. Previous to specific structures (‘teams’) and frameworks (‘meetings’, ‘contracts’) there is constant change, movement and difference. By using the work of the French sociologist Gabriel Tarde (1843-1904) the authors research how the nodes police, insurers and loss adjusters cooperate in the fight against transport criminality and how interactions between these nodes take content and shape. Consequently, their cooperation is not interpreted as a static theme, but rather as a dynamic process that requires constant interpretation in terms of relationships, unexpected events, adaptations and coincidences. On the basis of fifteen in-depth interviews the authors show in which way a ‘new language’ with ‘new mechanisms’ originates within the cooperation. As a consequence, ‘informal contacts’, ‘goals and interests’, ‘mutual confidence’ and ‘information-exchange’, which play an important role between the nodes, are constantly re-defined.

    This paper advances a ‘nodal governance’ perspective, which understands the delivery of security as being accomplished through the thinking and practices of various ‘nodes’ or entities characterized by ways of thinking about problems and influencing events. In this light, policing should be understood sociologically as involving the activities of state and non-state entities (e.g. corporations and well-resourced communities) as well as the public police. The authors argue that it is essential for police to recognize the nodal world within which they live and to locate themselves within ‘nodal assemblages’ for the delivery of security. As illustrations, the paper discusses two practical projects devoted to exploring nodal security governance arrangements in the country contexts of South Africa and Australia. The authors add that the question of what precisely nodal policing can or should look like in concrete terms is an empirical matter to be resolved within site-specific contexts.

    The primary objective of the ISD Order is to reduce public nuisance caused by extremely persistent offenders. Another objective is to reduce recidivism. Recidivism can be prevented by influencing behaviour, with due regard to any personal issues involved. In this article the author looks at the arguments the judiciary uses to impose or end an ISD Order. The author notices that the judiciary views ISD Orders as a last resort: an order is given only in the absence of alternatives, and with the requirement attached that ISD subjects are to be put on a programme. The judiciary considers rehabilitation within an ISD framework to be extremely important. The orders are almost invariably imposed for two years, with no deduction of the pretrial detention period. There is reason to terminate the order if the recidivism risk has receded, but there may be other termination grounds, outside the control of the ISD subject, such as negligence on the part of a government agency.

    The authors report on a content analysis of semi-structured interviews with twenty-two offenders who had been placed under a special measure in an Institution for Persistent Offenders (ISD). While the sample cannot be considered representative for all ISD offenders, the majority consider the ISD measure useful, mainly for utilitarian reasons. Most offenders want to break with their old life. Prominent in their reports is the relevance attached to proper housing arrangements. Those placed in wards with regular detainees where (hard) drugs are reportedly easily available, regard ISD as less useful.

    This article focuses on the growing need internationally for accountability of the administration of justice. The CEPEJ report European judicial systems compares the judiciary in the member states of the Council of Europe showing how this justification takes place. Accounting for the administration of justice still involves a lot of attention for the input and the procedures, while accountability for the results is most important. New methods for measuring the experiences of users of the administration of justice are developing. This fits a trend in which hierarchic and internal accountability, for instance through appeal procedures, are becoming less important in favour of horizontal accountability towards stakeholders, colleagues and users of state services.

    There is a growing consensus among practitioners that independent peer review is the preferred approach to furthering trust in the legal professions. The article draws on experience abroad, as reported in the professional literature, and lessons from comparable arrangements at home, in academia and the medical professions. It formulates an institutional design in which an autonomous agency, independent of the Lawyers' Association and at arms' length from the Minister of Justice, develops methodology and organizes peer reviews by fellow-practitioners. Since professionals, everywhere, like to share experience, it is argued that making site-visits, sampling case-files, and discussing a self-evaluation of the practice under review promotes open innovation and creates scope for shaping rather than controlling professional excellence. It also allows for discretion in catering to the widely diverging needs of large international law firms and small local practices that a system of command and control could not deliver.

    In this article four possible relations of the credit crunch and corporate crime are examined. A first relation is that cases of accounting fraud have contributed to the causation of the crisis. Due to these scandals the trust in large corporations and the financial sector would have been eroded. A second possible relation is the reverse: the crisis will lead to more corporate crime. Because of the crisis companies run into financial difficulties. In their despair they could try to cut costs by not complying with regulations or they could try to gain illegal profits through fraud. The third relation is the criminalization of more unethical corporate behavior. The moral outrage on the behavior of banks and insurance companies that contributed to the crisis might lead to an increased labeling of risky or greedy of corporate executives as crime. This will result in more regulation. The fourth and final relation is that these amplification effects will lead to the discovery of more corporate crime.

    The subjects fraud and corruption play an important role in the recent debate on the constitutional changes within the Netherlands Antilles and the ‘status aparte’ of Curaçao and Sint Maarten. The Netherlands and the various islands keep passing the blame on one another when it comes to fraud and corruption. It seems there is little willingness to look at the underlying causes or to express self-criticism. In this article an attempt is made to outline what is really going on in the field of fraud and corruption in the Caribbean part of the Kingdom. Several investigations on fraud and corruption committed by politicians in the past fifteen years will be addressed. Furthermore several socio-cultural, political and economic factors that play a role in causing fraud and corruption are being discussed. In this way the author hopes to contribute to a more constructive debate about the issue of fraud and corruption.

‘There is no justice, just us’

    In recent years the Dutch radical animal movement has manifested itself through arson, threats and destruction of property. This article describes the rise of the radical movement and its tendency towards violence. While the animal movement has its roots in nineteenth century romanticism, the anarchism of the sixties and the squatting movement of the eighties gave way to a more radical animal movement. The anti-establishment movement of the sixties turned against intensive farming. When the punk movement of the eighties freed itself from an overwhelming sense of doom, it gave rise to a new attitude, which rejected drugs, alcohol, and meat. The so-called Straight Edge Movement developed into one of the driving forces behind the recent animal related violence. Hiding behind the facade of the Animal Liberation Front the activists are strongly convinced that they have morality on their side while targeting farms, cattle trucks, and animal test facilities. Many animal activists feel that Dutch law as it is, does not protect animals in a sufficient way. Another problem is that animal laws are hardly being upheld. Inspections of farms, slaughterhouses and transportation vehicles are rare, prosecutors usually give no priority to animal cases, and judges and the rare judicial sentences are usually extremely mild. This leads radical activists to a conclusion that one of them wrote on a wall: ‘There is no justice, just us’.
