    The recently cancelled Quayside smart city project in Toronto by Sidewalk Labs is an example of a top-down, tech-driven, intransparant model of a smart city, where government and citizens got sidetracked in the planning process. This article analyses what went wrong and proposes an alternative approach. Experts in the field – from data scientists to philosophers, sociologists and activists – propose a different kind of smart city. The open smart city is based on principles of open data, public digital infrastructure, and civic participation. It uses technology to strengthen public values, civic participation and human rights, instead of undermining them.

    The tremendously popular television programme De Rijdende Rechter (The Itinerant Judge) has an uncomfortable relationship with official legal practice. Many people indeed think that the itinerant judge who arrives in their street to personally check neighbourly grievances has come as a representative of the Law with a capital L. It is not clear where reality TV stops and current legal practice begins. Things have become more complicated because the itinerant judge has become a symbol of the ‘close-to-the-people’ judge that is embraced by legal practice today. In this article the murky boundary between TV judges and official judiciary is investigated, taking into account the cult status of the itinerant judge, the effect of imagination on reality, similar phenomena in the United States and the current situation in the Netherlands.

    This article investigates which online undercover investigative methods are applied in practice and how they fit in the Dutch legal framework. In particular, the three special investigative powers of a pseudo purchase, systematic information gathering and infiltration are examined. Investigative powers cannot be applied unilaterally (across state borders). When law enforcement officials cannot reasonably determine the location of the suspect, the online unilateral application of undercover investigative powers is allowed. However, there is still a risk that diplomatic tensions arise with the involved state. States should agree in treaties under which circumstances cross-border online undercover operations are allowed.

    This article highlights the special position of European heads of intelligence and security services. In the search for important characteristics of intelligence leadership through time, a comparison is made between five services from five different countries (Germany, France, the Netherlands, Greece and Spain). Using Anglo-American reference information and a leadership typology developed by intelligence expert Robarge, the consecutive heads of service in these European countries are profiled and categorized. This leads to a picture that has always been dominated by males, a strong military presence and many end-of-career heads. Their influence on the internal and external service development was often substantial, with alternate appointments of inside and outside reformers. The scale of openness usually constituted a struggle with both the inside and outside world. Nowadays, the heads are being confronted with new challenges and demands, which leads to the conclusion that a new form of ‘distributed’ or ‘interdependent’ leadership is required, in which old reflexes to appoint people with an operational, military or police background as heads of these services are no longer self-evident.

    Various forms of organized crime are concentrated in the Dutch province of North Brabant, bordering Belgium. In this essay it is argued that specific historic, geographic, social economic, cultural and social psychological factors created an enduring window of opportunity in which criminality can flourish. Brabant is portrayed as a marginalized province that suffered from war, exploitation by the central government, rural gangs, a lack of law enforcement, extreme poverty as well as from discrimination because of its mainly catholic population. Against this background the population developed a mentality of solving problems on their own. Their survival strategies implied not only legal activities like agriculture and small-scale production in private houses, workplaces and factories, but also smuggling and illegal alcohol production. In more recent times the production of synthetic drugs, growing cannabis and transport criminality became widespread.

    In order to understand why people can turn to violence to achieve political or societal changes, it is important to examine factors that can trigger a process of radicalization. In this article the authors outline such a model of trigger factors. In this model they specify trigger factors at the micro level (individual level), meso level (group level), and macro level (societal level). In addition, the authors argue that it is important to take into account personal characteristics, such as age, gender, and the type of motivation, behind a radicalization process. With respect to these types of motivation, the authors distinguish between sensation seekers, justice seekers, identity seekers, and meaning seekers. This model enables to discern triggers in the radicalization process of specific people in specific contexts.

    The modern secular democratic state rests on a new portrayal of man and a new status of religions and other comprehensive doctrines compared to the period before the sixteenth and seventeenth century. In this new view of man, as incarnated in the modern rule of law, other persons and communities are no longer seen as a condition for personal aspirations and development, but rather as a limit. This is expressed in the ‘harm principle’ of the French Revolution and John Stuart Mill. Freedom is at the center of this new constellation, so the homogeneity of the state must be generated from below, by a free civil society and also by religious organizations and traditions. Three problematic developments since the nineteenth century make the Christian view of man as free, responsible and undefinable ‘image of God’ relevant: the zoological, ‘scientific’ description of man that reduces man to a risk factor and an object of security management; the disappearance of ‘innocent’ disasters and calamities that increases human responsibility and the temptation to blame ‘others’ for our faults; and the growing gap between a legal and a moral public response to criminal acts that opens the need for forgiveness.

    The upsurge in the use of economic sanctions in the post-Cold War era has prompted much scholarly and policy debate over their effectiveness and humanitarian consequences. Remarkably little attention, however, has been devoted to their criminalizing consequences and legacy for the post-sanctions period. In this article, the author develops an analytical framework identifying and categorizing the potential criminalizing effects of sanctions across place (within and around the targeted country) and time (during and after the sanctions period). This framework is applied and evaluated through an in-depth examination of the case of Yugoslavia. For comparative leverage and to assess the applicability of the argument beyond the Yugoslavia case, the analysis is briefly extended to Croatia. The article suggests that sanctions can unintentionally contribute to the criminalization of the state, economy, and civil society of both the targeted country and its immediate neighbors, fostering a symbiosis between political leaders, organized crime, and transnational smuggling networks. This symbiosis, in turn, can persist beyond the lifting of sanctions, contributing to corruption and crime and undermining the rule of law.
