    Last year, Dutch parliament approved the proposal for a new Intelligence and Security Services Act (Wiv 2017). This law will replace the current Intelligence and Security Services Act 2002 (Wiv 2002). The Wiv 2017 should be considered feasible with effect from 1 May 2018. Before that time however, an advisory referendum on the new law will be held on 21 March. This article first discusses the nature of the law and the need for innovation. Subsequently, a comparison of both laws takes place in general terms, with regard to the powers of the intelligence and security services, the safeguards, the supervision, the complaint handling and the international cooperation between intelligence and security services. It is argued that the extension of the powers of the services in the Wiv 2017 is only limited in scope, while the safeguards have been considerably strengthened. The introduction of a binding judgment in complaint handling also contributes to a better and more effective legal protection for citizens.

    In 2013, the government of the Netherlands established a national police force, replacing a system of largely autonomous regional police organizations. This led to an extensive police reform. In this article, I explore the effects of this police reform on the internal dynamics within the police organization. I describe five ‘negative’ effects: anonymization, decoupling, formalization, confusion and de-owning. These effects lead to alienation between police offers and the police organization and hinder the development of the national police force. Beside these negative effects, there are also positive forces that shape the development of the national police force. The top leadership is changing the strategic leadership style and there are many innovative initiatives on the local level contributing to the goals of the reform. However, to make the ambitions of the reform feasible there are adjustments needed in the organizational structure and change approach. The operational core of the organization needs to be the central point of reference for these adjustments.

    Recent figures indicate that certain drug markets, or at least parts of it, shift from the Netherlands to Belgium. However, it is still unclear whether it is a displacement of some parts of the illicit drug markets or whether it should be seen as a diversification of certain parts of some illicit drug markets in terms of spreading of risks and taking profit of new opportunities. In this respect, this article contributes to an ongoing research (DISMARK) by providing an overview of drug policy measures most recently taken by the Netherlands, from a Belgian point of view, and by trying to link these developments to drug-related trends in Belgium. It is clear that both countries will have to invest in a common approach of their common drug problems. However, it is not yet possible to draw any profound conclusions on the actual displacement of illicit drug markets.

    Older people can become victims of abuse by someone they know and whom they depend on, such as family, friends or professional caregivers. Elder abuse is not always intentional, sometimes it is due to care falling short. Conducting a study to explore the prevalence of elder abuse is difficult. Commissioned by the Dutch State Secretary for Health, Welfare and Sport, the Netherlands Institute for Social Research (SCP) has brought together the current knowledge on this topic using the most recent data drawn from qualitative research, surveys of older persons, professionals and volunteers, and record data. The sources together do not produce an unambiguous picture of the actual number of victims in the Netherlands. All sources produce far lower figures than the estimated 200,000 based on a study of twenty years ago. The numbers found depend strongly on the research method and definition of the phenomenon.

    The ‘Willing-Being Able-Daring’ (WBAD) framework for analysing rule compliance is introduced and explained. It models rule transgression as the result of climbing a three step staircase: people first have to form a will to not-comply, then see whether they can find an opportunity to transgress the rule without being caught for certain, and finally have to decide to take the risk, facing the consequences of being caught and issued an informal or formal reaction in terms of social disapproval or juridical prosecution. The WBAD framework proposes to identify which of these steps is (too) low, using expert meetings or surveys. It advocates to ponder on ways to increase the heights of the steps. It is claimed that the approach is simpler and hence more parsimonious than the Table-of-Eleven-approach commonly used in The Netherlands. The approach is illustrated with an example from the realm of tax compliance. The article concludes with sketching a perspective when to apply WBAD.

    The private member’s bill ‘Huis voor klokkenluiders’ is a step forward in the protection of whistleblowers in The Netherlands. However, adoption of the bill will not end the discussion about the protection of whistleblowers, because the bill has several flaws. The new ‘Huis’ has too many roles, the ‘Fonds’ provides the wrong incentives, and whistleblowers who go straight to the relevant authorities are not protected. Therefore, the next step should be a general Whistleblowing Protection Act, which provides legal protection, both to public and private employees who report serious organizational deviances to the relevant authorities and who, in doing so, have acted with due care. Enforcement of the Act, including the award of compensation, should be provided by the industrial law courts and not by a ‘Huis’ or a ‘Fonds’.

    All rights in the Convention on the Rights of the Child (CRC) apply to all children, therefore they also apply to minor foreigners in the Netherlands. Nevertheless precisely for this group a continuous fight needs to be battled to make sure they receive the protection provided by the CRC. This article provides an overview of the most important articles of the CRC where minor asylum seekers and migrants can appeal to. The article also stresses the fact that children who reside unlawfully in the country may not be discriminated against their access to socio-economic rights. Furthermore, the question whether fully integrated children should have the right to a residency permit is dealt with. Subsequently the Dutch policy with regard to family reunification is assessed alongside the CRC. At last the article elaborates on the tension between the ‘ultimum remedium’ principle (article 37 CRC) on the one hand and the policy concerning children in alien detention on the other.

    Intimate partner violence (IPV) changed from a private problem to a public concern over the last decades. It has become subject of various discourses in different domains. In the social sciences the gender-based discriminatory nature of IPV is contested by some researchers who claim a gender equality in IPV. They call for a gender-neutral approach to IPV as a family problem, de-contextualized from gender-based inequalities. In the Netherlands this degendering is reflected in current policy discourse. However, in the international legal human rights domain, IPV is unequivocally considered to be an issue that affects women disproportionately as a form of women's discrimination that is the result of unequal power relations. Both international binding human rights law and recent ruling of the ECHR impose binding duties to acknowledge this. This article addresses the paradox that is reflected in these two positions and how to get beyond it.

    This article presents a short historical introduction of the Dutch radical movement in the 1840s. What kind of people were these radical-democrats? Where did they come from? And what did they want? Moreover, this case study shows how government framed these radicals, and what actions were taken against them. It becomes clear, that from a historical perspective the continuity and similarities between the 1840s and the present are at least as remarkable as the differences.
