    The Dutch Judiciary has only a very limited role in the imposition of sanctions with traffic offenses. With other minor offenses its role is rather limited and has decreased. There has been a striking shift from the imposition of penal sanctions to sanctions based on administrative law in this area. With major offenses (crimes) the role of the judiciary is still significant and has not diminished over the last 20 years. This despite policy efforts to boost out of court sanctioning.
    The Judiciary is a fundamental pillar of the rule of law. It offers legal protection, by judging and, if necessary, penalizing violations of norms in a fair trial. In this way not only justice is done with individual cases. Case law has wider implications: confirmation and development of norms and thus general prevention. To fulfil this aim a certain volume of cases and openness of the judgment process is necessary.

    This article highlights the special position of European heads of intelligence and security services. In the search for important characteristics of intelligence leadership through time, a comparison is made between five services from five different countries (Germany, France, the Netherlands, Greece and Spain). Using Anglo-American reference information and a leadership typology developed by intelligence expert Robarge, the consecutive heads of service in these European countries are profiled and categorized. This leads to a picture that has always been dominated by males, a strong military presence and many end-of-career heads. Their influence on the internal and external service development was often substantial, with alternate appointments of inside and outside reformers. The scale of openness usually constituted a struggle with both the inside and outside world. Nowadays, the heads are being confronted with new challenges and demands, which leads to the conclusion that a new form of ‘distributed’ or ‘interdependent’ leadership is required, in which old reflexes to appoint people with an operational, military or police background as heads of these services are no longer self-evident.

    This research takes a closer look at the criminal careers of 89 offenders who are involved in offering hawala services. The main finding is that 61% has a criminal record that does not consist of hawala related offenses. This finding is important from both a policy and criminological perspective. Firstly, incorporating hawala in the legal financial sector is a difficult prospect with the current people involved. Somehow the sector needs to be cleaned up. Secondly, the findings tie in with other research about criminal careers in organized crime. About two-thirds came into contact with the authorities later in life. However, an important caveat to the authors’ findings is that the outcomes are based on a known group of offenders. The total size of the hawala population is a dark number.

    The draft of the Dutch Whistleblower Protection Act that is currently discussed in Parliament can be regarded as an essential step forward in the protection of whistleblowers. However, it can be questioned if the Act will contribute in an optimal manner to the ideal of transparency and the fight against the abuse of power, which should be the main goal of the Act. The tasks and powers of the new House for Whistleblowers are rather unclear and they do not meet legal standards. The combination of advice and support to whistleblowers and independent research into major violations of integrity should be abolished.

    As a result of the democratization of technology we now seem to live in an era of ‘Wiki-regulation’. Increasingly transparency is considered to be the universal solution to all sorts of problems. In line with this dominant viewpoint there has been a proliferation of whistleblower initiatives in recent years. A newly established Dutch initiative is Publeaks. Launched by a large number of Dutch media outlets and aimed at protecting whistleblowers, shedding light on wrongdoings and encouraging investigative journalism, Publeaks is a website ‘for people to leak documents to the media securely and anonymously’. In this opinionated article the authors propose three arguments against this particular form of whistleblowing: the protection against unfunded accusations, the negative side effects of ‘scandal overkill’, and the value of non-transparency.

    The Advice Centre for Whistleblowers in the Netherlands (het Adviespunt Klokkenluiders) opened on 1 October 2012 and offers independent and confidential advice to (potential) whistleblowers. Even though the Advice Centre opened only recently, this article gives an overview of the findings of the Advice Centre up-to-date, because of its relevance for the public debate on whistleblowers. The article inter alia mentions the number of whistleblowers that needed advice from the Advice Centre, the sectors where they work(ed), the types of wrongdoing involved in the cases and it describes the questions and dilemmas of whistleblowers who approached the Advice Centre. The article also points out how the Advice Centre could help persons with raising their concern about possible wrongdoing or malpractice in the workplace.

    The private member’s bill ‘Huis voor klokkenluiders’ is a step forward in the protection of whistleblowers in The Netherlands. However, adoption of the bill will not end the discussion about the protection of whistleblowers, because the bill has several flaws. The new ‘Huis’ has too many roles, the ‘Fonds’ provides the wrong incentives, and whistleblowers who go straight to the relevant authorities are not protected. Therefore, the next step should be a general Whistleblowing Protection Act, which provides legal protection, both to public and private employees who report serious organizational deviances to the relevant authorities and who, in doing so, have acted with due care. Enforcement of the Act, including the award of compensation, should be provided by the industrial law courts and not by a ‘Huis’ or a ‘Fonds’.

    This article seeks to aid understanding of the ways in which different policy purposes, approaches and legal options can be combined in the design of better legislation, using Australia’s recently passed Public Interest Disclosure Act 2013. It provides a guide to key elements of the new legislation, as an example of legislative development taking place over a long period, informed by different trends. In particular, it is one of the first national laws to seek to integrate divergent approaches to the ‘anti-retaliation’ model of whistleblower protection, including its place in the employment law system, it sets new standards for the role of ‘public whistleblowing’ in such a regime, and provides new responses on basic questions of coverage, including which individuals are able to gain the benefit of the legislation. This provides lessons as to how different legal approaches might be better integrated, in pursuit of a clearer understanding of the interface between whistleblowing and other integrity reforms.

    This article describes the social position of Central and Eastern European (CEE) migrants in the Netherlands, in particular their labour and housing position, using the results of recent Dutch research by three different groups of scholars. We cannot speak of a homogeneous group of migrants. The prevailing image of the hard-working labour migrant, doing low-qualified and often low-paid work (even though many of them are highly skilled) and faced with poor working and living conditions is largely confirmed by the available research. However, there are also knowledge workers (‘kennismigranten’) among the migrants from CEE-countries working in the Netherlands. In addition, the authors also found partners and children of previous migrants from CEE-countries, and students. This diversity of the new group of migrants from CEE-countries forms a challenge for local governments to find appropriate instruments to lead integration on the right track.

    Since 1995 the influx of labour migrants in the Netherlands has increased steadily from over 10.000 in 1995 to around 47.000 in 2011. As a consequence, from 2007, searching a job is the main migration motive of non-Dutch immigrants to migrate to the Netherlands. On average, one third of all labour migrants were women. Explanations for the fact that a minority of the labour migrants coming to the Netherlands are women can be derived from the literature. Possible reasons are gender patterns (in the Netherlands and/or the countries of origin) and differences in the personal networks of men and women. In addition, the Dutch labour migration policy, and in particular the conditions applying to labour migrants (in terms of education and employment sector) as well as the restriction on the right of family members of labour migrants to work in the Netherlands, may limit the influx of female labour migrants.

    The economic crisis in the Netherlands forces the Ministry of Security and Justice to cut expenses. In the forensic psychiatric sector, the main savings are expected from reducing the length of stay of forensic psychiatric patients (TBS-patients) in high security hospitals. Currently, over 70% of all TBS-patients do not reach the now set goal of successfully terminating their treatment program within eight years. The present article questions whether it is plausible that this goal will be reached. Research has shown that there are several possible measures that can be undertaken to reduce the length of stay. Examples of these are identifying subgroups of patients who take particularly long to complete their treatment and setting up interventions for those patients, reducing the focus on risks in society and in forensic practice, and the inclusion of protective factors in risk assessment. These factors may help in finding a way out of the crisis.

    Having a job is an all day reality, having a job in a prison or a forensic psychiatric hospital is not. Dealing on a daily basis with disturbed people who have committed a severe crime requires a highly professional attitude. For the professional working in this field, individual thoughts and feelings (of disgust of the criminal and his crime for example, so common amongst the public) are not an option, while at the same time the given means for doing the work are highly dependent on public opinion as expressed by the media and political spokesmen. Ed Brand, forensic psychologist for more than thirty years, describes the change in risk management which took place in those years on the social and political level in the treatment of psychiatric disturbed offenders. In his account he also refers to the changes in his personal life before he stopped his work in state prisons and forensic psychiatric hospitals.

Dr. Ed Brand (1955), psycholoog, werkte vanaf 1982 achtereenvolgens in de CAD-Alcoholkliniek in Haarlem (de huidige Brijderstichting), in het Penitentiair Selectie Centrum in Den Haag, in de FOBA (nu: PPC) in Amsterdam en als hoofd behandeling in de Oostvaarderskliniek (tbs) in Amsterdam (nu in Almere); daarnaast was hij consulent bij de Reclassering Den Haag en Leiden en lid van de Commissie van Toezicht van de justitiële jeugdinrichting Amsterbaken in Amsterdam. Hij promoveerde in 2001 op Het persoonlijkheidsonderzoek in het strafrecht (Deventer: Gouda Quint). Sinds 2009 werkt hij in Gezondheidscentrum Nieuwerkerk aan den IJssel en in een psychiatrische polikliniek bij Mentrum/Arkin, de overkoepelende GGZ-instelling in Amsterdam.     In this article former judge Jaap Tielenius Kruythoff tries to answer the question how being a judge influenced his personality and vice versa. Decision-making is both a rational and emotional process. Judges are susceptible for being manipulated by litigants and colleagues as well as acknowledgements from others. The author stresses the importance of having the possibility to express doubts in the course of the decision-making process between judges. Trying to erase doubts – for instance when one judge is dominating discussions in the judge’s chambers – interferes in finding the real truth in a case. Also, colleagues can help creating awareness of tunnel vision. According to the author there is no such a thing as a general sense of just punishment. Discussions about reasonable punishments are influenced by previous decisions. Being a judge gave the author a lot of fulfilment in his work and a higher social status.

    This article is a first report on the longitudinal study of forty Moroccan and Dutch criminal men. The research was started in 1982. The author returned to the subject in 1988. In 2008, the author started a new research project with the same men.
    The focus of this article is on the process of desistance. Ten men already ended their criminal period in the late eighties (the ‘early desisters’). In between time, two of them relapsed. Nine men can be called ‘late desisters’. They had many more obstacles to face in their re-integration, such as long-term employment and addiction to hard drugs. The combination of getting regular work, marriage and a permanent place of living is very effective in the process of desistance. But in the end, personal qualities, such as discipline, taking up responsibility and motivation, will be decisive.

    This article gives an overview of the UNMIK and especially the EULEX mission in Kosovo thereby concentrating on the judiciary. The current state of the judiciary and its organisation are analysed as well as the main starting points and goals of the mission. From her own experience the author describes the cooperation between EULEX workers and local partners and the influence of cultural differences.

    This article presents a short historical introduction of the Dutch radical movement in the 1840s. What kind of people were these radical-democrats? Where did they come from? And what did they want? Moreover, this case study shows how government framed these radicals, and what actions were taken against them. It becomes clear, that from a historical perspective the continuity and similarities between the 1840s and the present are at least as remarkable as the differences.

    This article is based on research in the archives of the Rijkswerkinrichting in Leiden, the Netherlands, which served as a penitentiary for female vagabonds and beggars between 1886 and 1907. At an average 48 years of age, women were old; about four in ten were confined more than once. Contrary to males in similar institutions, females were almost exclusively from the lower echelons of society, and very few had ever been married. While material conditions in confinement compared positively to the living conditions before confinement, mortality was high. Women, like female detainees these days, mostly performed menial work that offers little prospect for successful reintegration. Most had probably led rough lives, with alcohol abuse, poverty and familial strife. The confinement of these women probably served more as a temporary respite than as a solution for these women's problems.
