This article could thus be seen as a first step, and invitation, to discuss future interventions and policymaking on fighting the exploitation of the elderly to prevent, detect and investigate these crimes.

    Caring for someone can be very strainful. In this article the author states that stress reactions are not necessarily due to the burden of the emotional or practical care load itself. More important factors are the individual capability to regulate emotions and the way in which careseeker and caregiver interact on emotional topics such as pain, panic, sorrow, depression, and anger. The author starts from the attachment theory and describes the importance of attachment for someone who feels threatened, sick or fearful. Deep stress may hinder the caregiver to be aware of the thoughts, emotions and acts of the other person. Several effective and non-effective interaction patterns are described. The author argues that without self regulation the risk of care derailing and mistreatment will be substantial while the need for external regulation grows.

    This article describes the attitudes of Turkish and Moroccan Dutch regarding cousin marriages, using two qualitative studies. Last year the Lower House of the Dutch parliament passed a bill involving a ban of cousin marriages. The main reason for the ban is that many of these marriages are supposed to be concluded forcibly. The new law will mostly affect immigrant groups, since such marriages occur frequently in this population. This article describes the significance for the enforceability of the ban for these groups as well as the attitudes towards cousin marriage. Legitimacy problems seem to arise because a part of the Turkish and Moroccan Dutch respondents feel that the state should not interfere with the individual choice for a marriage partner. Yet there is also evidence for regulatory compliance on normative grounds, even among those who oppose the bans, due to democratic procedures and religious norms.

    This articles offers an overview of four centuries of ‘forbidden relations’ in The Netherlands. From the late sixteenth century onwards, the dominant Calvinist church tried to ‘purify’ the Dutch nation by persecuting all forms of fornication, adultery, incest, and sodomy. The French period (1795-1813) separated church and state, and removed several forms of forbidden relations from the penal code. But social control on relations remained intense. An ‘ideal’ marriage was based on equality of the spouses in terms of social background, religion and age. Parents as well as the local community made sure young people made the ‘right’ choice. Competition between religious groups intensified in the late nineteenth century and mixed marriages became even more problematic. In the 1960s and 1970s all this began to change, and many rules and norms regarding partner choice were relaxed. An example of the changes over time are unmarried cohabitations which transformed from a crime (sanctioned by banishment) to deviant behaviour (sanctions through withholding poor relief) to a more or less normative ‘trial marriage’.

    Between 2001 and 2012 there has been a sharp drop in marriage migration from Turkey and Morocco. The number of migration marriages fell particularly sharply in the years after 2004, after changes were made in the legislation concerning marriage migration: the income and age requirements were raised and passing a pre-entry test became conditional to obtaining a visum. This article aspires to explain this decline of migration marriages among co-ethnics of Turkish and Moroccan origin in the Netherlands. As the strongest decline in the number of migration marriages coincides with the introduction of stricter conditions for marriage migration, the author states that these changes in the law acted as a catalyst for a change in mentality among migrant families of Turkish and Moroccan origin.

    This article reflects on the various aspects of paedophile relationships. It is for a large part based on the author’s 30 years of clinical experience with the treatment of paedosexual men. The characteristics of paedophile relatonships are examined and how they usually develop. What does the paedophile seeks in a relationship with a child and vice versa? The prohibition of paedophilia and its consequences for the paedophile are also discussed. Paedosexuality is banned because of the supposed damage for the child involved. But what causes this damage? And what is the possible damage caused by the prohibition? Finally the author shows the interacting of elements like desire and love as well as manipulation and secrets. The friendship with an older man can be very valuable for a child, which is reflected in many books and movies on this topic. In this sense a paedophile relatonship can be appropriate. But this applies only if the adult has enough self control to refrain from giving in to sexual desires, since a paedosexual relationship can never be appropriate.

    In light of the high numbers of persons entering the EU via the southern borders and the current uneven distribution of asylum seekers (five Member States of the EU currently received in 2014 more than 70% of the total amount of refugees), there is a clear and urgent need for the EU ministers to ensure a fairer distribution of asylum seekers within the EU. The Dublin Regulation’s system of allocating the responsibility for an asylum request does not offer a solution for this challenge, also because Member States cannot have a blind faith in the standards of a number of states for processing asylum requests. There are significant differences in the application of the law and the procedures.

    The advent of the Dutch National Police in 2012 is the culmination of a much longer process of centralization and scaling up of the regular police organization. Partly as a result of this process of increased scale, municipalities have introduced their own surveillance officers to patrol the streets. Thus, the contours of a dual police system have arisen. This raises various questions, and in this article we focus on two of them. First, which background factors have contributed to the emergence of new municipal enforcement organizations and to what extent developments within the police have contributed to this development? Second, what are the consequences of this dual police system and what problems and risks are involved?

    Dutch policies concerning the illegal stay of aliens are characterized by regular tensions between central and local governments. This article describes various concrete (proposals for) policy changes in the last twenty years and examines the reasons for these tensions while using the distinction between policy strategies based on denial versus strategies based on adaptation (Garland). When it comes to refugee policies, the central government works in the denial mode while local governments adapt and try to find solutions in order to bring problems under control. This attitude can be explained by the local governments’ duty to provide for in the case of humanitarian emergency situations.

    Dutch policy makers, as elsewhere, have a strong belief in the effectiveness of asset recovery legislation. There are high expectations concerning the amounts of crime money to be collected, and the collection thereof would enable theauthorities to tackle serious, organized crime and fill the treasury. However, the results of the authors’ empirical research into the actual execution of ‘recovery orders’ show a different image. The majority of asset recovery cases concerns cases with low payment obligations (under € 5,000), indicating that mainly ‘smaller fishes’ are targeted. In general, the collection of crime money proves to be a difficult endeavour. Large amounts are not collected and there are long execution times. Policy makers who publicly announce high expectations, and who budget the expected incomes from asset recovery, do not practice evidence-based policy making and give leeway to false hopes which then require new (legislative) measures.

    Does biocriminology by definition corrode the image of human beings as ‘free’ in the sense of being autonomous and responsible? This article focuses on modern biocriminological research and discusses important aspects in which current biocriminological insights differ from historical perspectives on biology and criminal behaviour. Three aspects are discussed: plasticity, integration and conscious/unconscious processes. Illustrating their case with empirical research examples the authors argue that modern biocriminological research does not consider human beings as ‘unfree’. Instead, research shows that biological characteristics are subject to change and that biological insights are complementary to more traditional psychological and sociological perspectives. Finally, the authors argue that recognizing the biological influences on human behaviour should not be viewed as a threat to autonomy, but instead should be considered as an enrichment of our understanding of human behaviour, and may therefore even increase autonomy.

    This article gives a historical sketch of a century of juvenile justice in the Netherlands. It focuses on the development of the concept of childhood from the beginning of the twentieth century to the present. Starting from the notion of degeneration and the idea of the neglected child, in the thirties a psychologization process emerged. Crucial was the notion of the childlike nature of the behavior of minor offenders, which was clearly inspired by new insights coming from pedagogy, developmental psychology and child psychiatry. The author argues that recently, after some decades showing a trend towards more toughness on crime, there are indications of a reemergence of the notion of the childlike nature of young delinquents, again inspired by knowledge and insights from the behavioral sciences but also from neurology and brain research.
