    The smart city is the urban ideal of our time. Yet its high expectations often run counter against the performance of smart city projects in practice. The Rathenau Institute has studied a number of such projects in the municipality of Eindhoven, a leading city with respect to digital innovation in the Netherlands. To ensure that data is used in a proper manner with respect for public values Eindhoven has applied several strategies, such as privacy by design and the active involvement of its citizens. It has also set up a number of principles for the digital society which helped to negotiate contracts with private partners. Yet the authors’ analysis shows that important legal challenges remain. Some of the principles require more detailed specification. The authors also found that the law is not yet fully appropriated to the new digital context and needs to be adjusted accordingly.

    Public values and citizen participation are key terms in smart city discourse that are propagated by all its actors, from governments to corporations and civil society. Nevertheless, the design and development of smart cities are hardly ‘public’ as some publics and some forms of participation are never included. This is particularly visible in current protests against a key enabling technology for smart cities, 5G. These contestations tend to be considered ill-informed and irrational, while their methods are seen as conflictual rather than helpful. In this article the author argues that the public value approach to smart cities is rooted in a deliberative perspective of democracy, while the tensions that are produced by 5G and other forms of anti-technological protest are better understood as part of agonistic democracy. Such conflicts about the new smart technologies that are currently hidden from public sight need to be articulated and constructed as contentious issues for electoral politics, in order for the smart city to acquire its democratic legitimacy.

    This article deals with the relationship of smart security technologies to broader modes of exercising power and subjugating individuals. It claims that the notion of psychopower is precisely what is missing from post-Foucaultian accounts of the smart city. In the article psychopower is defined as the manipulation of our consciousness in order to channel our desires toward ‘normal’ social behavior, drawing a line between what is ‘acceptable’ and what is ‘unacceptable’. Psychopower raises a series of concerns related to its democratic legitimacy and accountability as behaviorally informed conditioning of the mind runs the risk of constant surveillance, where human agency is diluted in a techno-utopian vision that promises to improve city-wide efficiency, decision-making, and security.

    In this article, the authors draw on a netnographic study conducted between May and July 2019 on phishing on Telegram Messenger. The results indicate that Telegram, just like cryptomarkets and online forums, seems to function as a criminal marketplace. In the groups analyzed the authors see users who both offer and are looking for specific goods and services related to the crime script of phishing. Furthermore, the information on Telegram contains specific modi operandi that are offering comprehensive and step-by-step guides to successfully complete specific financial cybercrimes. Therefore, based on this explorative study the authors argue that Telegram can be seen as a digital offender convergence setting.

The authors revert to an analysis framework that was previously used to interpret new forms of crime during the banking crisis. It consists of four scenarios that are briefly described. The future will have to show what effects the corona pandemic has had on fraud and other financial and economic crime.

    The aim of this research was to examine how Dutch citizens behave online and to explain their online behavior. The results of an experimental survey (N=2,426) show that unsafe behavior is highly prevalent. For example, nearly 40% of the respondents use a weak password. However, it appears that there are major differences between self-reported behavior and objective behavior. The objective measurements in the survey show that people behave more unsafely than they self-report. The research further shows that there is no silver bullet for promoting more safe online behavior. Different online behaviors seem to stem from different sources. Nevertheless, the authors do see a lot of value in interventions that focus on adaptations to the technology that people use for online activities, such that the possibility of unsafe behavior is reduced and the possibility of safe behavior is increased – also known as security by design. There is a role here for policy measures encouraging technology manufacturers to make these adjustments.

    Online fraudsters seem to adapt to new digital opportunities. While the academic literature about phishing mainly focuses on phishing through emails, fraudsters also appear to use new means of communication and platforms to find and deceive their victims. Based on analysis of 728 police reports from the period from June 20th to August 20th 2019, this article provides a descriptive study on the new phenomenon of payment request fraud on the Dutch advertisement platform Marktplaats.nl (similar to eBay). The article will provide a thorough description of the crime script and its success factors. As fraudsters now use new means of communication, it will also be assessed to what extent they use new persuasion techniques, and to what extent victims may have different characteristics. The research, therefore, focuses on the modus operandi, persuasion techniques used by the fraudsters, and victim characteristics.

    This contribution treats debt recovery as an important cause for the emergence and worsening of the debt problem. It is explained that when a bailiff seizes wage, the debtor often has too little left to live on. In addition to seizure of wage, the bailiff can also seize the bank account or seize household goods in order to sell these. The author describes how this can lead to new debts and what legislation is being prepared to modernize this situation. In case of problematic debts, multiple creditors are collecting from the same debtor, which requires coordination. The recovery by creditors facilitated by the current rules focuses on the claims of individual creditors. However, as soon as problematic debts are involved, an integrated approach is necessary, in which the common interest, the interest of all creditors and that of the debtor, takes precedence over self-interest.

    Problematic debt has a large impact on people’s lives and tends to escalate quickly, making early detection and debt prevention crucial. Debt prevention is a mix of measures, activities and provisions aimed at ensuring that people acquire financial skills and that they are capable and actually behave financially sound, so that their finances are and remain in order. So people have to be financially literate and have financial skills, but they also have to be able to act at the right time in the right way. There is currently not enough attention for these three elements in legislation and regulations.

    In the Dutch debt counseling system, a close collaboration between two trajectories, being voluntary debt settlements and debt settlements imposed by a judge, is vital for the overall success of the system. This article shows that this crucial collaboration is in fact poor, and negatively impacts the success of the debt counseling system. One of the underlying factors is the poor performance of the system as a whole. Although there is a common interest in reducing debts, the involved parties also have their own conflicting interests. The current system fails however to accomplish a tighter collaboration, and even sometimes seems to do the opposite. The authors conclude that a redesign of the Dutch system is necessary to organize a better and more coherent playing field.

    In order to improve the effectiveness of offender supervision many studies have been conducted into risk factors for delinquency. Evidence was found that debts and crime are interrelated. However, understanding of potential underlying risk factors in this relationship is limited. Results of an analysis of client files (N=250) show that debts among probation clients are highly prevalent and problems with respect to education, work and mental and physical health seem to be important underlying factors in the relationship between debts and crime. In addition, interviews were conducted with both probation workers (N=33) and clients (N=16) to get insight into the possibilities to adequately support clients with regard to debts in order to stimulate successful resocialization. Results underline the importance of paying attention to possible underlying factors to effectively supervise clients.

    The structural vulnerability of the port of Rotterdam to organized crime is dealt with in this article from a broader, historical perspective. Using examples from ports in Italy and the United States, among others, the author shows how at the end of the last century local criminal groups managed to gain a dominant position in the handling of good flows. The author discusses various research reports that have been published over the years on the import of drugs into the port of Rotterdam and other European ports. Drug traffickers turn out to respond very flexible to stricter controls by simply moving to alternative ports or opting for transferring drug loads to small fast boats in open water. The author emphasizes that ports should not be studied as isolated transition points, but must be considered as nodes in networks that extend far inland and abroad. This is the only way to see the broader strategic and tactical options for stopping or reducing drug trafficking. In addition, attention must be paid to the problem of corruption among port workers, police and customs officers.

    In this article, a recently published Dutch book on corruption in the port of Rotterdam is reviewed. De Schiedamse cocaïnemaffia. Een corrupte douanier, doorgewinterde criminelen en duizenden kilo’s coke was written by journalist Jan Meeus from NRC Handelsblad. The book can be seen as a case study of a customs officer – Gerrit – who fell for the big money. It gives a good insight into the connection between the legal and the illegal world and how this is experienced by those involved. The information in the book is based on seven large criminal files and dozens of conversations with people mentioned in those files. Meeus also attended the criminal proceedings intensively. It is now known that the film rights of the book have been sold and that Meeus will be writing the screenplay for the feature film together with director Jean van der Velde.

    This article focuses on the challenges associated with public-private partnerships in tackling drug crime in the port of Rotterdam. The authors identified the actors involved in the fight against drug crime and, more generally, security in the port. The authors show how these various actors view the subject of drug crime (so-called mentalities), what they set as objectives (finalities) and how they try to achieve these objectives. Subsequently the various aspects of the interactions between these actors are being analyzed. The article is empirically based on 76 interviews with public and private actors in the port of Rotterdam, that were conducted in the period from January 2018 to February 2019, and an analysis of literature, news items, government reports and other documents.

    Dutch youth care was decentralized in 2015. Since the transfer to the municipalities, youth care is in a state of deep crisis. There are long waiting lists, even in situations of acute need; there is lack of money, of professional and experienced staff, of adequate care, and of central coordination and guidance. In contrast to Denmark, where youth care was transferred to municipalities in 2007, there was barely time to prepare the transfer in the Netherlands. Moreover, the number of municipalities was not significantly reduced and the funding was extremely cut back. In this article, a number of interventions is being proposed to save what can still be saved. First, funding will have to be substantially increased. Second, the access to youth mental health care should not be a matter of municipal authority.

    Among the asylum seekers arriving in Europe are unaccompanied minors (UMAs). As a result of the often traumatic experiences before and during their flight, many have mental health problems. The question is how they cope in the country of destination. After the flight, the plight is not over: destination countries are often not welcoming in all respects, UMAs may encounter violence in reception facilities, and experience stress related to the asylum procedure and possible family reunification, as well as worries about relatives left behind. Although UMAs are also known to be resilient, and most are supported by family members and/or significant others, there are worries about their transition to adulthood. When they turn 18, they have to deal with the developmental tasks that come with that age, as well as to come to terms with past experiences. At the same time their guardianship ends, and they are supposed to manage on their own in the relatively new country. Many UMAs seem to manage, but it would be helpful if the 18 years age limit could be used flexible when necessary.

    In view of the recent problems arising from the decentralization of the Dutch youth care system, this article examines whether the Netherlands could learn from decentralization experiences in other countries. The author focuses on Denmark, where such decentralization took place fairly recently. In addition, elements of the organization of youth care in Germany and Norway are also discussed. It becomes clear that the Netherlands has a relatively complex system with many different organizations with overlapping tasks and powers. In the Netherlands, much attention is paid to control and risk management. In Denmark, on the other hand, there is much more confidence in the capacities of parents and children to find solutions. It is noticeable that in the vast majority of cases there is consensus between parents, child/youngster and care providers about how to deal with the problems. The most important lesson that the Netherlands can learn from abroad – and especially the Danes – is: invest in underlying values and principles and give professionals and families time, support and space.
