    In this article the authors discuss the opportunities and challenges they experience from the criminal investigation of financial exploitation of the elderly. By sharing knowledge and experience, they stress that the all party approach in this distressing problem, from the viewpoint of criminal investigations, will achieve the best results. This article could thus be seen as a first step, and invitation, to discuss future interventions and policymaking on fighting the exploitation of the elderly to prevent, detect and investigate these crimes.

    Older people can become victims of abuse by someone they know and whom they depend on, such as family, friends or professional caregivers. Elder abuse is not always intentional, sometimes it is due to care falling short. Conducting a study to explore the prevalence of elder abuse is difficult. Commissioned by the Dutch State Secretary for Health, Welfare and Sport, the Netherlands Institute for Social Research (SCP) has brought together the current knowledge on this topic using the most recent data drawn from qualitative research, surveys of older persons, professionals and volunteers, and record data. The sources together do not produce an unambiguous picture of the actual number of victims in the Netherlands. All sources produce far lower figures than the estimated 200,000 based on a study of twenty years ago. The numbers found depend strongly on the research method and definition of the phenomenon.

    This article describes the attitudes of Turkish and Moroccan Dutch regarding cousin marriages, using two qualitative studies. Last year the Lower House of the Dutch parliament passed a bill involving a ban of cousin marriages. The main reason for the ban is that many of these marriages are supposed to be concluded forcibly. The new law will mostly affect immigrant groups, since such marriages occur frequently in this population. This article describes the significance for the enforceability of the ban for these groups as well as the attitudes towards cousin marriage. Legitimacy problems seem to arise because a part of the Turkish and Moroccan Dutch respondents feel that the state should not interfere with the individual choice for a marriage partner. Yet there is also evidence for regulatory compliance on normative grounds, even among those who oppose the bans, due to democratic procedures and religious norms.

    As an EU agency operating at the external borders of the EU, Frontex is actively involved in combating illegal migration. Since a rising number of migrants drown in the Mediterranean Sea or are pushed back to unsafe third countries, Frontex is being accused by human rights organizations for violating the fundamental rights of the EU. The Agency however maintains that it can’t be held accountable for human rights violations, as it is only assisting Member States, and not taking over their responsibility. This article analyses if this position is correct in the light of the growing tasks and mandate Frontex is granted by the EU.

    In Dutch criminal money laundering investigations there is no need to fully proof the predicate offence. When a criminal suspicion of money laundering exists without a direct connection to the predicate offence it’s the suspect who must prove the legal origin of his income or possessions. If the suspect doesn’t succeed in this, the judge will rule that the origin has to be criminal. This article shows in six steps how judges rule in this kind of cases and how an investigation can be done. These six steps are combined with examples from recent jurisprudence. The goal of this article is to raise awareness on this subject in order to operate more efficiently and effectively in money laundering investigations.

    Throughout history the way detainees were portrayed by society has varied. At first, until the Second World War, detainees were mainly seen as blameworthy objects. After the war they became a fellow human being with dignity in need of resocialization or psychological treatment. In the Seventies detainees became citizens with a legal status according to the rule of law. When in the Eighties criminal law became more punitive, prisoners developed into enemies of society. Since then the detainee is moreover seen as dangerous and as a risk. Consequently the desirability of resocialization is questioned. This has resulted in a more individual approach towards prisoners, who need to prove that they are motivated for resocialization programs. In the end this leaves the most vulnerable detainees to their fate and expresses a view of man which could be characterized as the lost human.
