Het gebiedsverbod als wapen tegen verspreiding van jihadistisch gedachtegoed

Tijdschrift Justitiële verkenningen, Aflevering 2 2018
Trefwoorden freedom of movement, religion and expression, counterterrorist measure, system of restrictions on fundamental rights, constitutional censorship prohibition
Auteurs Prof. mr. dr. Jan Brouwer en Prof. mr. Jon Schilder
SamenvattingAuteursinformatie

In mid-August 2017, the Minister of Justice and Security prohibited the controversial preacher Jneid from exhibiting in the vicinity of ‘his’ bookshop, annex mosque in the Schilderswijk in The Hague. By means of this ban, the minister wanted to prevent Jneid from carrying out his ‘intolerant’ message any longer in an environment where many young people are susceptible to radicalization. The Temporary Act on Counterterrorism was supposed to provide an adequate basis for such a ban. This article argues that a measure restricting the freedom of movement with the aim of preventing someone from conveying his message is against the constitutional prohibition of censorship and may therefore not be imposed.

Auteurs Dr. R.A. Roks
SamenvattingAuteursinformatie

During an ethnographic research on the Rollin 200 Crips, a Dutch ‘gang’, Sin – one of the author’s informants – was shot and killed in Amsterdam. In this article, the author focuses on the ways in which the Rollin 200 Crips interpreted and made sense of Sin’s death. Several narratives of interpretation could be discerned in the aftermath of his death. Firstly, speculations and rumors about the motives brought feelings of uncertainty and suspicion to the fore, contrasting the otherwise instrumental logic of violence the Rollin 200 Crips communicated during the author’s fieldwork and in the media. In addition, Sin’s death produced a number of narratives about the ‘realness’ of Dutch gang life. For these reasons, Sin’s death represents an impressive, important and meaningful moment during the author’s fieldwork and, more generally, in the history of the Rollin 200 Crips.

Hoe Europa zijn zigeuners uitvond

Over een schaduwzijde van de moderniteit

Tijdschrift Justitiële verkenningen, Aflevering 5 2014
Trefwoorden European culture, history of gypsies, modernity, images of gypsies, European literature
Auteurs Prof. dr. K.M. Bogdal
SamenvattingAuteursinformatie

Europe is commonly depicted as the cradle of modernity. But this image usually has a blind eye for marginal communities and cultures existing seemingly apart of the big developments. An example of this is the neglect of the Roma people who settled here early, on the threshold of the Middle Ages and the modern era. The attitude of the European people towards this mobile ethnic group can be described as moving between contempt and fascination. Referring to images of gypsies in literature and other cultural expressions the author shows how during the Romantic era the gypsies were serving as a projection object for desires and fantasies about socially deviant lifestyles. The subsequent process of ‘de-Europeanization’ together with the creation of exotic images through ethnology is described as well as the racial theories and their political consequences for the Roma people in the twentieth century. Instead of contributing to the creation of borderlines and fuelling destruction fantasies, art and sciences should give more attention to the undividedness of humankind and to human dignity.

Faillissementsfraude: een hardnekkig fenomeen

Pleidooi voor een preventieve aanpak

Tijdschrift Justitiële verkenningen, Aflevering 3 2014
Trefwoorden Bankruptcy fraud, Preventive approach, Prosecution, Trade Register, New legislation
Auteurs F. Kemp
SamenvattingAuteursinformatie

In the Netherlands new criminal law measures will be introduced to prevent and combat bankruptcy fraud. In this article the author argues that the emphasis on criminal law measures is not sufficient to effectively tackle the phenomenon of bankruptcy fraud because prosecution and punishment always occur after the damage is done. What is needed is an integrated approach realising preventive measures, such as tools to detect fraud at an early stage. Fraud is, after all, characterised by typical behaviour that throws up digital red flags. After detecting those red flags subsequent action can be taken to stop the fraud. Also modernising the Trade Register would contribute considerably to the protection of creditors.

Blik naar het Noorden?

Een kenschets van het justitiële beleid in Scandinavië

Tijdschrift Justitiële verkenningen, Aflevering 8 2013
Auteurs P. Kruize
SamenvattingAuteursinformatie

This article focuses on the question whether Dutch policy makers and researchers ought to look more often to Scandinavia for inspiration and less to the West (UK and USA). Scandinavian countries are also influenced by Anglo-American ideas about crime and justice, but at the same time the number of incarcerated persons has not changed dramatically while recidivism rates are low. Dutch policy makers and researcher do sometimes look at initiatives and practices in Scandinavian countries, most often Sweden. Dutch society shares many similarities with the Scandinavian welfare states and therefore it should be natural – according to the author – to benefit more often from Scandinavian experiences. Some suggestions are discussed in the article.

SamenvattingAuteursinformatie

This article describes the social position of Central and Eastern European (CEE) migrants in the Netherlands, in particular their labour and housing position, using the results of recent Dutch research by three different groups of scholars. We cannot speak of a homogeneous group of migrants. The prevailing image of the hard-working labour migrant, doing low-qualified and often low-paid work (even though many of them are highly skilled) and faced with poor working and living conditions is largely confirmed by the available research. However, there are also knowledge workers (‘kennismigranten’) among the migrants from CEE-countries working in the Netherlands. In addition, the authors also found partners and children of previous migrants from CEE-countries, and students. This diversity of the new group of migrants from CEE-countries forms a challenge for local governments to find appropriate instruments to lead integration on the right track.
