    Last year, Dutch parliament approved the proposal for a new Intelligence and Security Services Act (Wiv 2017). This law will replace the current Intelligence and Security Services Act 2002 (Wiv 2002). The Wiv 2017 should be considered feasible with effect from 1 May 2018. Before that time however, an advisory referendum on the new law will be held on 21 March. This article first discusses the nature of the law and the need for innovation. Subsequently, a comparison of both laws takes place in general terms, with regard to the powers of the intelligence and security services, the safeguards, the supervision, the complaint handling and the international cooperation between intelligence and security services. It is argued that the extension of the powers of the services in the Wiv 2017 is only limited in scope, while the safeguards have been considerably strengthened. The introduction of a binding judgment in complaint handling also contributes to a better and more effective legal protection for citizens.

    The future of wiretapping is threatened by encryption and developments in the telecommunications industry. Internet communications changed the wiretapping landscape fundamentally. In practice it is often impossible to wiretap all possible internet connections. Not all communication providers are obliged to execute wiretap orders. This limits the use of a wiretap in an increasingly digital world. Although the content of certain encrypted Voice-over-IP communications and private messages might not be visible to law enforcement officials, the traffic data are. These traffic data show when the suspect connects to certain communication services, which provide important clues to proceed in a criminal investigation. It is important to have a discussion whether our wiretap laws need to be amended to better fit the needs of law enforcement. However, to make such a debate possible we need transparency. A good first step is to provide details and statistics about the use of internet wiretaps.

Hoe waarschijnlijk is function creep?

    In this article it is argued that function creep is a structural phenomenon which is inherent in policy development. The author discusses several policy development theories which might be useful in trying to explain the phenomenon that policy instruments tend to be applied in reaching purposes never intended at the time these instruments were developed.
    Kingdon's streams model, the classic phase-oriented approach (e.g. Hoogerwerf), Sabatier's advocacy coalition theory as well as Walker's diffusion theory give various explanations for the phenomenon of function creep. But crucial is that policy makers are always looking for new innovating policy instruments to achieve their objects. According to the author it is almost impossible to prevent function creep. To some degree the abuse of function creep can be prevented by institutionalising these processes and to submit them to democratic control, checks and balances, procedures and other guarantees. But this will never be enough to escape from the ‘voyeurist society’.

    This article offers an analysis of the side effects caused by the increased counterterrorism measures adapted in Dutch law and public policy after 9/11. Taking clues from Foucault's thinking on securitisation and Beck's risk society, it is argued that focus, referent subject and object of security measures and deployment of counterterrorism laws have shifted from the concrete individual to society and risk prevention as a whole (1), that this shift induces function creep (2) and a much quicker deployment of measures, resulting in an increasing suspect population (3). Rather than arguing against the legality and legitimacy of these measures, the authors analyse the epistemological shift in reasoning and unpack the various probabilistic arguments (as opposed to evidence-based arguments) behind the wave of securitisation after 9/11 - resulting in a lack of knowledge about, transparency and accountability of the generated side effects.

    This article gives an overview of the UNMIK and especially the EULEX mission in Kosovo thereby concentrating on the judiciary. The current state of the judiciary and its organisation are analysed as well as the main starting points and goals of the mission. From her own experience the author describes the cooperation between EULEX workers and local partners and the influence of cultural differences.

    In this essay the author looks back at ten years of rule of law foreign assistance in Afghanistan. She first surveys the elements that make Afghanistan particularly challenging as a development. This is followed by a brief outline of foreign donor-assisted efforts at rule of law reform in the last decade. The features of law and legal systems in Afghanistan that are salient for would-be foreign reformers are analyzed. The concept of judicial independence serves as example of well-intentioned rule of law interventions that have not fared well in this complex environment. The author argues that better prepared international advisors with a better grasp of legal history and comparative law may have produced stronger outcomes. Ultimately, however, a pre-post-conflict setting constrains conventional rule of law programs in important ways and calls for more realism about what can be achieved, within what time frame and with what degree of sustainability.

    In this article the author explores - on the basis of Mitchel Lasser's book Judicial deliberations - the possibilities of enlarging the legitimacy of the Dutch Cassation Court (Hoge Raad). After a broad theoretical analysis of several concepts of legitimacy he describes the societal position of de Hoge Raad as highest court vis-à-vis rivals, such as the European Courts, the Council of State (Raad van State) and the Council of the Judiciary (Raad voor de rechtspraak). He argues that the cassation institute has to innovate itself and suggest new ways of exerting judicial leadership.
